The trials of Uhuru Kenyatta and William Ruto have everything to do with the Kenyan state and Kenyan people only to the extent that innocent Kenyans were murdered, raped and displaced. It is because of the victims of 2008 genocide in Kenya that the ICC trials is about Kenya and Kenyans. Otherwise, Uhuru Kenyatta was clear during the presidential campaigns that his trial at the ICC is a personal challenge. He should therefore leave Kenya and Kenyans at peace not in pieces when fighting his personal challenges.

THE GOVERNMENT OF KENYA IS ACCUSED FOR BEING INSINCER WITH ITS EFFORTS TO REHABILITATE THE AILING SUGAR INDUSTRY

The government of Kenya is being accused of insincerity in its declared plans to resuscitate the ailing sugar industry. Instead the sugar sub-sector which, is so vital in the country’s economic growth, is said to have been neglected and turned to a milking cow.

A recent tour of the Nyanza sugar belt by the cabinet secretary for agriculture Felor Koskei has provoked sharp criticism of the government whose sincerity to introduce a crash programme for the rehabilitation of the sugar sub-sector is now put into a big question mark.

Koskei announced that five sugar mills which are currently in public investments and under the parastatal management would be privatized soon.

He said the move will be to comply with a resolution passed by parliament in January this year. The five sugar factories included Nzoia, Muhoroni, Sony Sugar, Chemelil and Miwani.

The five sugar companies are heavily indebted to the turned US 525 million with their annual books of account not very attractive.

Koskei issued a directive that sugar cane farmers may now be forced to sell their crops to any millers without zonal restriction. This he said will be on willing seller willing buyer basis.

The cane farmers in Western Kenya through Kenya Sugar Cane Growers Association (KESGA) have reacted angrily and vehemently opposed the new directive.

Sugar cane farmers view the new directive as aimed at protecting the errant millers at the expense of cane growers.

The farmers in the sugar cane growing regions said they have a feeling that if Koskei directive is implemented it will automatically trigger chaos worse than the current pathetic situation in which cane poaching crisis has threatened to cripple the sugar industry.

Koskei, they said has missed the point. How do the farmers who are specifically contracted to sugar companies that had advanced them with millions of shillings in land preparation and development loans deliver their harvests to other millers that did not invest a cent in the same crops development, even if they are offering better terms?

For a farmer too develop an acre of sugar cane from the land preparation to harvesting cost approximately between Ksh. 40, 000 and Ksh. 50, 000 respectively which poor farmer can not afford, hence for partnership with the millers who can only recover their money upon the farmer delivering the cane to the same miller, who had advanced the m with the land preparation and cane development loan.

The government is equally blamed for not having put in place certain binding conditions when signing contract with new investors in the sugar industry especially on issues related to the employment of top management staff in the sugar companies.

There are five privately owned sugar factories which are currently operational. In all the five with the exception of one, Miwani sugar Mills which went burst and presently under the official receivership, all top managers are foreign expatriates recruited from either India or Pakistan.

Local African staff and workers in those factories are only engaged to work as casuals without letters of appointments. Local Kenyans are employed but earning discriminative salary scales in comparison to their foreign counterparts

The expatriate are the one earning the highest salary scales, but not subjected to mandatory deductions such as NSSF and NHIF, while their counterparts (Africans} are forced to pay the mandatory deductions.

Expatriates are employed on petty and odd jobs such as time-keepers, store-keepers, junior account clerks, cane yard clerks, casuals, messengers, accountants, electricians tractor drivers, sweepers etc.

Salaries for the expatriate varied from Kshs 30, 000 up to 80,000 per month. The highest paid African worker earns between Ksh 6000 and Ksh 15, 000 per month, but without being issued with letters of appointment.

In actual sense this is purely case of new slavery when indignant Kenyan workers are being discriminated in their own country.

All the jobs specifications on which foreign workers are doing can easily be filled by local personnel.

Kenya has trained and turned out thousands of skilled workers, in excess of its industrial needs therefore does not require any foreign workers of the above mentioned categories.

The Indian sugar companies, it is being alleged, are said to be spending fortunes in the way of corruptly obtaining the work permit for the expatriate workers, which runs into millions of shillings.

The Indian owned factories incTrans-Mara lude Butali, West Kenya, Kibos Sugar and Allied Industries, Trans Nzoia, Mara Sugar Companies and Miwani Sugar Mills. All are located in Western Kenya.

Some of these rules stipulates among other things that the new mills must be established at a distant of not less than 40 km apart from the existing one, cut the invest must provide to the KSB with evidence that they had acquired enough land acreage for sourcing continued cane supplies to avoid scrambling and cut throat cane poaching.

These r KSB regulations are defiantly and flagrantly ignored by excessively arrogant Indian investors and hence the source of discontent leading to near violence cane poaching that has been witnessed in Western province and in the Nyanza sugar belt and also Awendo sugar cane growing zone which Sony Sugar is violently competing for cane harvesting with Sukari Industries and Trans Mara Sugar Companies as located less than 15 km apart.

The County Allocation of Revenue Bill specifies each county’s share of that revenue and any other allocations to the counties, from the national government’s share of that revenue, and any conditions on which those allocations shall be made.

March 16: This is the deadline for passing the Division of Revenue and County Allocation of Revenue Bills.

March 1: This is the Deadline for Budget Policy Statement to be made available to the public.

The County Fiscal Strategy Paper (CFSP) is a document prepared by the County Treasury that specifies the broad strategic priorities and policy goals that will guide the county government in preparing its budget for the coming financial year and over the medium term. The CFSP provides the financial outlook with respect to county government revenues, expenditures and borrowing for the coming financial year and over the medium term.

February 28. This is the deadline for Budget Policy Statement to be approved by Parliament. This is also the deadline for the County Fiscal Strategy Paper to be tabled in each County Assembly.

February 15. At the National level, Cabinet Secretary for Finance is expected to submit the national Budget Policy Statement to Parliament. This is also the deadline for the debt management strategy paper, and the Division of Revenue and County Allocation of Revenue Bills to go to Parliament.

KENYA: WHY UHURU WON’T BE COWED BY JOURNALISTS’ THREATS

President Uhuru Kenyatta and his Jubilee coalition government have made up their minds that his memorandum on the media Bill remains, whether journalists drawn from all media houses hit the streets to oppose it.

David Ohito, the vice-chairman Editor’s Guild and a long time friend of mine says they are going on the street because they were not satisfied by the move to place the memorandum before the Parliament for debate and adoption without involving all stakeholders, sighting mischief by the Government.

Journalists are wondering how can individual journalist pay Sh500,000 and the media houses part with Sh20 million. Threat by media to move to court to challenge the constitutionality of the Bill is not going to help much either.

Ohito says they will present their own memorandum before the Parliament during the protest. But even so, this won’t help either since the speaker of the national assembly is jubilee slot and in many occasions has been seen siding with Jubilees’ agenda, particularly removing Kenya from Rome Statute to save Uhuru and his deputy Ruto from attending the cases against them.

Ohito is also challenging Uhuru to take personal responsibility about the whole issue and allow for media freedom. No matter how much Uhuru would be willing to do so, his hands are tied since he cannot act independently from his Jubilee mandate.

Uhuru cannot take personal responsibility that is why his effort to defend Land, Urban Development and Housing Cabinet Secretary Charity Ngilu has been challenged. Jubilee coalition members are plotting to get rid of her.

Some of the things Jubilee government would not like media to report is current silent rebellion against Deputy President William Ruto, which is slowly building up in the Rift Valley with some MPs being critical of what they say is Ruto’s soft stance on matters of national importance.

TNA particularly would not like to see media reporting that URP MPs are especially irked that Ruto has remained complacent even as plum state jobs are being distributed to one half of the Jubilee government.

The disharmony is not only limited to MPs but some of Ruto’s close associates have expressed their concerns that his erstwhile political protégé, Joshua Kutuny was appointed as President Uhuru Kenyatta’s political advisor without any consultation or notice and now being used by TNA pro Uhuru instead of Nancy and Mutahi Ngunyi.

The recent statement by Kutuny and which did not please URP legislators is when he was used to issue statement that no one coached ICC witnesses to fix Ruto. This has not gone very well with URP members.

Kuttuny robustly defended uhur against these allegations and urged the leaders to desist from making statements on the ongoing ICC cases at the International Criminal Court.

Politicians don’t work like professionals. That is also why Attorney General, Githu Muigai and the Cabinet Sectary for Communication, Fred Matiangi have been left out in darkness about the clauses in the memorandum.

The same fear of media also emerged during the Kenya’s first President Jomo Kenyatta when he fell out with his political ally, Tom Mboya in 1960s. Media was seen as a threat to Kenyatta’s government when Kenyatta and Mboya rivalry led to the formation of the Central Organisation of Trade Unions (Cotu).

Cotu was mooted by the Kenyatta administration ostensibly to neutralise Mboya’s influence in the country’s trade union movement. Trouble started in 1962 when Mboya threatened to leave Kanu.

Kenyatta feared that if Mboya used the Kenya Federation of Labour as a party, an economic strategy, which favoured capital rather than labour, would give his critics further ammunition to fight his government.

The same thing happened after Jaramogi Odinga Odinga formed an opposition party, Kenya Peoples Union (KPU). Radical trade union leaders, who supported Odinga were suspended from Cotu. Media was not allowed to report this.

Moi was even particular. He banned some sections of media several times when it emerged that they reported his brutal action of detentions and political trials, torture, arbitrary arrests and police brutality.

Moi always perceived human rights generally as alien and Euro centric conceptions inconsistent with African values and culture. That is why he always tried to ban civil organizations.

Journalists who reported things against his government were taken to Nyayo torture chamber. Moi’s actions were meant to silence journalists and the intelligent, perceived to be critical of his authoritarian rule.

In 1986 alone, 100 people were arrested and detained for their alleged association with Mwakenya, the movement started by some Kenyans in Europe who had fled Moi’s oppression regime.

Politicians who were vocal were ruthlessly killed. Foreign Affairs Minister, Dr. Robert Ouko, was assassinated in February 1990. Clergymen, lawyers, and other pro-democracy and human rights advocates were persistently arrested and harassed, or even killed.

In the build-up to the 1992 to 1997 elections were met with police beatings. Any journalist who reported this incident was put into task. Opposition members who refused to vote KANU and Moi had their houses burnt, property looted or killed.

Judges who made rulings in favor of human rights victims exposed themselves to punitive transfers or sacked.

Mwaki Kibaki’s regime was not different either- He tough with media when they reported that campaigners and critics condemned the reappointment of retired Justice Aaron Ringera as anti-corruption director.

Kibaki’s regime reappointed Ringera because he was cheap to be tamed. Campaigners were against his appointment because he failed to fight corruption, not to realize that this was the type of person Kibaki government wanted.

The same Ringera has been appointed by President Uhuru to lead the team which is to probe the activities of JSC. This is despite the fact that Ringera is not fit to head the team of tribunal since at one point when he applied to be a judge of the Supreme Court he was not short listed.

Ringera was appointed chair of the tribunal whose other members are Jeniffer Shamalla, my friend Ambrose Weda and Mutua Kilaka. Apart from Weda, the LSK chairman Erick Mutua explained that Shamalla had also come out in the media directly critisising the JSC.

At one point, Jennifer Shamalla has not only come out on national TV to say that the JSC does not know what it is doing but also criticized the honorable Chief Justice Dr Willy Mutunga.

At the end of 2005 President Kibaki appointed him director when he had failed to respond to the Anglo-Leasing dossier as the public demanded. Ringera was set for cover-up. He never released the copy to John Githongo who was then the Secretary to Ethics and Corruption.

Kenya: civil society have said they will appeal the consensus decision reached by the Assembly of State Parties (ASP)

civil society have said they will appeal the consensus decision reached by the Assembly of State Parties (ASP) members, who allowed President Uhuru Kenyatta and his Deputy, William Ruto, to be excused from their trials at the International Criminal Court (ICC).

Speaking to journalists in Netherlands, United Nations Special Rapportuer, Maina Kiai, civil society representatives, Ken Wafula and Njonjo Mue, said the decision by ASP meeting entrenched inequality and they must appeal the decision.

On her part, Ms Otieno said the decision by the ASP members to excuse Mr Kenyatta and Mr Ruto from trials will pose a great danger to ICC witnesses who many will recant their testimonies.

They said they will file an appeal at the ICC Appeals Chamber to see whether the decision can be reversed so that Uhuru and Ruto can attend their trials in person without sending their lawyers.

On Thursday, ASP members made an amendment of Rule 134 on Rules of Procedure and Evidence which now exempts Uhuru and Ruto from being present at trials and allows use of video link as a substitute for attending court.

This also means that Uhuru and Ruto can be represented in court by their lawyers without necessarily being required to be there in person.

Dr. Auma Obama, the only member amongst President Obama’s Kenyan relatives, that then US President-elect Barack Obama pays a personal tribute to in his historic acceptance speech of 4th November 2008 at Grant Park, Chicago

Did you know that Dr. Auma Obama, President Barack Obama’s Kenyan half-sister, is the only member of Kenya’s “K’Obama Clan”, the only member amongst President Obama’s Kenyan relatives, that then US President-elect Barack Obama paid a personal tribute to in his historic acceptance speech as US President-elect at Grant Park, Chicago, on 4th November 2008?

In his said 17 minute acceptance speech of 4th November 2008 Barack began by paying glowing tribute to his opponent in the 2008 US Presidential election Senator John McCain, then paid glowing tribute to his 2008 running mate Vice President elect Joe Biden. Barack then went on to pay glowing tribute to his wife Michelle and their two daughters Sasha & Malia. After this Barack, paid glowing tribute to his maternal grandmother Madeleine Dunham, though he interestingly omitted paying personal tribute to either his mother Ann Dunham or his maternal grandfather Stanley Dunham. Barack paid tribute to the family on his mother’s side using the following words: “And though I know my grandmother is no longer with us, I know that she is watching along with the family that made me who I am; I miss them tonight; My debt to them is beyond measure”.

It is interesting that Barack did not pay a personal tribute to his maternal grandfather Stanley Dunham in his said 4th November 2008 acceptance speech, because Barack speaks rather highly of his maternal grandfather Stanley Dunham in his book “Dreams from my Father”, mentioning how his maternal grandfather had time for him when he was under the care of his grandparents while growing up in Hawaii.

After this Barack paid tribute to his Indonesian half-sister Maya and then his Kenyan half-sister Auma. After paying personal tribute to both Maya and Auma, Barack concluded his tributes to both sides of his family by thanking “all my other brothers & sisters for all the support you have given me.” Barack then paid glowing tributes to his campaign manager David Plouffe, his chief strategist David Axelrod, and above all, all Americans. He said he was “never the likeliest candidate for the presidency”, before paying personal tribute to 106 year old Ann Nixon Cooper, one of the voters in the 4th November 2008 US Presidential election, using Ann Nixon Cooper as a glowing example of the strides that America had made i.e. Ann Nixon Cooper was born just one generation after slavery, a time when someone like her could not vote for two reasons i.e. because she was a woman and because of the colour of her skin i.e. she was Black. Barack then concluded by making a passionate appeal for Americans to unify.

“White Mischief”, the 1987 movie on promiscuity amongst a sizable number of Whites in colonial Kenya. It focuses on the illicit happenings in the then “White Highlands”, and what was then specifically known as “Happy Valley” (mainly Naivasha & Nanyuki).

“White Mischief” in particular, focuses on the murder of Lord Errol (Josslyn Victor Hay, 22nd Earl of Errol). Lord Errol was an aristocratic philandering playboy in colonial Kenya, who met his death on 24th January 1941, as a result of a steamy affair he was having with Diana Lady Broughton. Lord Errol’s body was found the following morning i.e. 25th January 1941, in Karen, Nairobi, near where St. Francis Church now stands.

The prime suspect in the murder was Lady Diana’s then husband, Sir Henry “Jock” Broughton. Sir Henry was acquitted of the murder, but later revealed (while drunk at either Karen Country Club or Muthaiga Country Club), that he had “fixed” Lord Errol for having an affair with his wife.

The good looking Lord Errol made many enemies with his extensive womanising in the then Kenya colony, and there was therefore little love lost following his murder. Diana Broughton became Lady Delamere when she got married to her fourth husband, Thomas Pitt Hamilton Cholmondeley, 4th Baron Delamere, on 26th March 1955.

Thomas Pitt Hamilton Cholmondeley is the grandfather of Thomas Patrick Gilbert Cholmondeley i.e. the Delamere who shot dead Kenya Wildlife Service game ranger Samson ole Sisina on 19th April 2005 and also later shot dead stonemason, Robert Njoya Mbugua on 10 May 2006. Lady Delamere is therefore Thomas Patrick Gilbert Cholmondeley’s step-grandmother. Lady Diana promised to make startling revelations on the 1941 Lord Errol murder, but she passed away before do so.

The movie has interesting scenes e.g. at Nairobi’s then mortuary, after Lord Errol’s murder, where Alice de Janze (Sarah Miles), rubs her vagina with her right hand, and then proceeds to rub her said right hand on the face of the deceased Lord Errol (Charles Dance), with the accompanying words “Forever Josh.” This particular scene is between the 58th & 60th minutes of the movie, approximately. “White Mischief” showed to packed movie theatres in Kenya in the early 1990s.

“Sanders of the River”, the 1935 movie in which independent Kenya’s founding Premier & President, Jomo Kenyatta, makes a cameo appearance

“Sanders of the River”, the 1935 movie in which independent Kenya’s founding Premier & President, Jomo Kenyatta, makes a cameo appearance. “Sanders of the River” stars the legendary Paul Robeson. Jomo Kenyatta, father of independent Kenya’s 4th President, Uhuru Muigai Kenyatta, landed the role of a “Tribal Chief” in “Sanders of the River”, during his long 15 year sojourn in Europe of 1931 – 1946. Jomo Kenyatta, and other “Tribal Chiefs”, appear alongside Paul Robeson (“Bosambo”) in a scene that lasts from about the 31st minute to the 34th minute, a scene where Leslie Banks (Commissioner Lord R.G. Sanders), is bidding farewell to “Tribal Chiefs” who have served him loyally during his tour of duty. After a brief thank-you address by Commissioner Lord R.G. Sanders, the “Tribal Chiefs” disperse, and one notes Jomo Kenyatta disperse alongside his fellow “Tribal Chiefs”, with his distinct trademark swagger. Many who were alive during Jomo Kenyatta’s 15 year rule of 1963 – 1978, or who may not have been alive but have nevertheless watched video clips of the Jomo Kenyatta years, distinctly remember Jomo’s trademark flamboyant swagger like e.g. during the State Opening of Parliament in 1974, where Jomo majestically swaggers along the corridors of Parliament on his way to the chambers. “Sanders of the River” wasn’t that great a movie, but what has helped keep the legend of the movie alive to this day, is the fact that it’s star, Paul Robeson, was a pioneer African-American top-notch actor who trail-blazed the path for numerous African-American actors & actresses who came after him. Clare is a second year medical student from Kenya and she writes: “Beste tomorrow is World Aids Day and I just read a shocking report by World Health Organization (WHO) that more than 2 million adolescents between the ages of 10 and 19 years are living with HIV, and many do not receive the care and support that they need to stay in good health and prevent transmission.

In addition, millions more adolescents are at risk of infection. The failure to support effective and acceptable HIV services for adolescents has resulted in a 50 percent increase in reported AIDS-related deaths in this group compared with the 30 percent decline seen in the general population from 2005 to 2012.

Here in Kenya religious leaders have opposed a proposal by Family Health Options Kenya that primary school pupils be issued with contraceptives for protection against sexually transmitted diseases and pregnancies. The group, which deals with reproductive health, wants contraceptives such as condoms to be introduced in schools to promote safe sex.

Because of its seriousness can religious leaders allow the popular saying in ethics that the end justifies the means to be applied to save the lives of our young generations from dying of Aids?”

No Clare, I don’t think so because the “ends justifying the means” usually involving doing something wrong to achieve a positive end and justifying the wrongdoing by pointing to a good outcome is not the end in itself.

Another might be justifying the abortion to save the student from being discontinued from school. Taking an innocent life is morally wrong even if that was done good intention to help the student pursue her career.

The national chairman of the Inter-Religious Peace Foundation of Kenya, Bishop Joseph Maisha, argued that the introduction of contraceptives to school-going children would fuel teenage sex in the country.

Bishop Maisha argues that the Ten Commandments make it clear that murder, adultery, stealing, lying and greed are unacceptable in God’s eyes and He makes no “escape clause” for motivation or rationalization.

In other words, Bishop Maisha is trying to pass a clear message that only those who do not know God may be forced to justify their means to an end, but those who claim to be children of God have no reason whatsoever to break one of God’s commandments.

This proposal by Family Health Options Kenya comes after the recent Government report which revealed that girls as early as eight years were engaging in active sex and they risk getting infected and becoming pregnant.

Those who lobby for this means to be applied argue that the use of condoms is justified in order to stem the spread of disease and save the lives of young generation.

According to the report, HIV rates in Kenya are much higher for women than for men. This gender differential is particularly pronounced for young women aged 15 to 24 years, who are four times more likely to contract HIV than young men in the same age group.

The HIV prevalence rate for adult women is almost double that for men. This represents a female-to-male ratio of 1.9 to 1.0, the highest in Africa.

Despite the significantly higher prevalence rate among women in Kenya, however, the data also show that more men are sexually active than women. This trend is particularly pronounced for 15 to 19 year girls, 37 percent of which have had sex and carry an HIV prevalence of 2.7 percent, compared with 44 percent of boys who have had sex with a rate of less than one percent.Fr Joachim Omolo Ouko, AJ

When we launched The Monthly Nationwide Clean-up Campaign in September 2010 in Nairobi, we went against all the grain and we are happy with the success story we recorded for the 1st Circle of The Clean Kenya Campaign- TCKC.

We chose not to respond to any call for proposals and instead, opted to invite support and partnership from those who believed we were doing the right thing. And we got this beyond our imagination. Men, Women and Institutions came forward and we are happy we all jointly made The 1st Circle of The Clean Kenya Campaign a success.

We were also far more impressed by the voluntary response and participation from many Kenyans in the Towns that we visited- Nairobi, Mombasa, Eldoret, Kisii, Kisumu, Kakamega, Nyeri, Naivasha and Kiambu.

It was the same story everywhere we went; many people enthusiastically joining with us to help make some change. And the response from the Government and the Municipal Councils was equally great. They came with working tools and equipment besides their staff members also joining with us. The Corporates were not left behind- some donated working tools which we promptly gave to the Councils.

We must also appreciate the many political leaders who joined with us. We have noted that the Governors have energized the process and now, it is time to join up with them.

Even though The 1st Circle of The Clean Kenya Campaign was by and large a success story, we had our low moments when mercenaries on hire berated us. But we took those in our strides and soldiered on. We also had severe financial challenges to effectively run the Campaign the best way we wanted. But still, we must appreciate our Partners who ensured the work was done. We want to make special mention of The Public Service Transformation Department, Akiba Uhaki Foundation, A Better World/SOFDI, Phoenix Aviation and the many more who joined with us. You are our heroes.

In a move that surprised many, Kisumu County’s Assembly Members passed a list of the early proposed Public Service Board members after they were treated in the house of one of the nominees where they were given plate of beans and chapatis and given two thousand shillings as transport to take them back home.

The hungry and broke County Reps had thought that one of the leading Kisumu businessmen Dr.Hezron Mcobewa would get involved and bankroll them as he did the other time only for them to turn around and vote a list he was favoring.

The County Reps who are an eye sore within the city of Kisumu due to their begging habits are said to be so broke and are always desperately seen converging every morning at the County Assembly hall where they have no major things to do except to way lay business men who goes about their bi\business normally in town and begs from them ceaselessly

Many were surprised further when they cleared a former Magistrate for the seat in the board yet Justice Aaron Ringera had her sacked during the 2003 “radical surgery within the judiciary”

During the vetting the Ringera Committee vetting came to haunt Betty Asuna as she was asked why she applied for the position yet she was declared unfit to hold any public office.

Asuna accused Justice Ringera of bias and never given her a chance to be heard therefore leading to her being sacked as a Magistrate.

She worked in Kisumu and Thika where she was sacked.

The board members comprised of retirees who are said to be close relatives of Kisumu Governor Jack Ranguma in one way or the other.

Lawyers have urged President Uhuru Kenyatta to append his signature on the Matrimonial Property Bill 2013.

They also have called on the Judiciary to establish a division of the High Court that exclusively deals with matrimonial property.

The lawyers also proposed that Judges in the Family Division of the High Court at Milimani Law Courts be increased from two to 10 to deal with backlogs and increasing family disputes.

LSK Vice Chairperson Ms. Lilian Renee Omondi said that time had come for the country to do away ancient and unconstitutional matrimonial laws.

Family lawyer Ms. Judy Thongori said that the controversial amendments introduced by Parliament on November 12 can be addressed after President Kenyatta assents the Bill into law.

“We (Kenya) have made gains on the Bill that sending back the Bill to Parliament for debate may kill the dream,” Ms. Thongori said.

The lawyers were speaking during a joint Law Society of Kenya (LSK) and United Nations Development Fund for Women (UNIFEM) breakfast meeting at The Hilton Hotel in Nairobi.

UN Women Country Director Zebib Kavuma said that the Constitution has transformative provisions on equality and non-discrimination that should be upheld.

The Matrimonial Property Bill 2013 elicited public debate after Parliament amended a provision that spouses share matrimonial property 50-50 upon divorce.

According to the amendment by the National Assembly, spouses must prove financial contribution to acquiring matrimonial property before claiming a stake

Ms. Thongori said that the country has no law on matrimonial property arguing that the Bill has progressive sections that should not be embraced.

“There is a lot of public mis-information on the Bill. It has provisions that cater for both professional and stay at home mums on ownership of matrimonial property,” Thongori said.

Lawyer Ochieng Oduol said that the Bill should be passed into law and the Judiciary urged to establish a division that deals with matrimonial property.

“The Family Division at the Milimani Law Courts currently has only two sitting Judges to hear increasing cases on divorce and division of matrimonial property,” Mr. Oduol said.

Mr. Oduol said that the Judiciary should increase the number of Judges at the Family Division from the current two to at least 10 Judges.

Nominated Senator Ms. Judith Sijeny and Runyenjes MP Ms. Cecily Mbarire said that the Bill will be a pillar to both men and women when signed into law.

“We want President Kenyatta to sign the Bill into law then we shall deal with the few controversial clauses later,” Ms. Mbarire said.

BISHOP WASHINGTON OGONYO NGEDE IS AN UPRIGHT PERSON WHO DON’T DESERVE THE NEAR INSULT COMMENTS

I personally knew Bishop Dr Washington Ogonyo Ngede, the head of the organization, ‘Power of Jesus around the …’ from about 40 years ago.

The Bishop is an upright and honest person who got into priesthood from an humble background. He worked hard founded the church which he is heading.

I was disappointed and dismayed when I read two comments written in jaluo.com website. The two comments, one in Dho-Luo vernacular and the other one in English appeared to have come from an insane persons suffering from petty jealousy. All the heads of Christian churches are known to be using motor vehicles bought with money raised by their flocks. Therefore there is nothing wrong for the folliowers of Bishop Ogonyo Ngede have decided to do fundraising for the purpose of purchase a bran new car for their leader to easy his travellings while on the mission of spreading the gospel of Jesus around.

Of the authors of the two comments, one calling himself Jamach Piere Yindo and the other Onyango Otare. I am sure they are not members of the Bishop’s church. All the churches including tho old ones and well long established churches including the Roman Catholic and the Anglican Bishop are usuing the church facilities like vehicles etc. But we have heard or read no other comentators jealous because of the state of the art black Toyota Prado car Bishop Ogonyo Ngede is uysing. For close to more than two decades Bishop Ogonyo Ngede has been keeping a fleet of sleek cars, all well maintained at the expense of, church members.

It is also wrong and amounting to the campaign of hate for the two authors to drag in the names of highloy respected persons like Raila Odinga and another humble man of God, Bishop Silas Owiti, into their dispute with the Bishop.

Bishop Ogonyo Ngede has served the Kenyan community in general and the Luos in particular diligently with dedication. This is why we can now be proud about the magnificent church building standing by the roadside near Kachok/Nyalenda in Kisumu City. His tireless efforts also the church spreading iuts wing into many rural locations inside Luo-Nyanza and beyond.

Since its inception and when the God called him to the Ministry in 1977, the church has since established close to 200 churches affiliated to it, all built on permanent materials. This is no mean achievement.

Personally I am not trying to gag those who want to criticize the Bishop, but I believe in constructive and not destructive and subversive criticisms. Such criticism must be genuine and based on truth. The two critics of Bishp Ngede, judging from their names must be the servants of satanic idols.

I AM TOLD THAT Jamach PiereTindo is a sexist and is a sexist maniac, if so then my passionate message to him is that he should seek the salvation from Jesus Christ . But they should leave the hard working Bishop alone.

KENYA: A MAASAI WOMAN AND HER CHILDREN HOLD HOSTAGE BY LIONS

A Kenyan Maasai living close to the famous and popular tourist destinarion in Kenya, the Maasai Mara is counting its losses after a pride of six adult lions and their cubs invaded their homestead and killed one fat bull.

The beasts made a break into highly fortified Manyatta home and jumped into the cattle pen,. A young housewife and her young children were asleep when the incident occurred. Her husband was away at the time of the incident leaving the family behind at home, which is located close to the Mara Game Reserve,

The lions imposed a dawn to dusk curfew and held the family hostage for close to ten hours. After accessing the cattle pen. The woman said she was terrified when she opened her door during the day break only to find the six lions and their cubs feasting on the carcase of the family bull they had killed. She quickly locked the door and could not raise the alarm fearing the beasts on hearing any commotion w could be provoked to attack her and her children, The children were still sleeping and It didn’t alert them.

The woman and her children fearing they would be terrified on seeing the lions wondering in the homesteads next to their doorstep. She stay put inside the Manyatta until the neighbors, who sensed that something was wrong in the home, came. The neighbors wondered why the family cattle were still locked inside the pen whle the herds of cattle from the neighboring home were grazing outside They came with crude weapons such as arrows and speakers and chased the lions away . The beasts escaped into the nearby thicket and disappeared in the forest and game reserve. The woman and her family were late rescued by the neighbors. Mrs Christine Nakola 43 year old mother of six children.

The neighbors might have wonders that something is a miss, because there were no human movements in the usually crowded Manyatta, while the family herds of cattle were still locked in their pen.

KENYA’S NEWEST WHITE SUGAR MILLING FACTORY EXPECTED TO START WORK NEXT JULY

Kenya is expected to commission its tenth white sugar processing factory next July. This will place the country to a near self-sufficiency in sugar products. Already the country has nine sugar mills most of them are located in the sugar growing region in Western part of the country.

Once fully operational, the new sugar mill, which is currently under construction in the Coastal district of Kwale will help the country cut-down its perennial deficit in sugar preproduction for its domestic requirement and needs.

Available statistics shows that Kenya is currently producing close to 500,000 of made sugar, while domestic needs stands at about 700,000 tons annually. This leaves about 200,000 tons, which the country is sourcing from foreign countries. At the present the bulk of these imports come from Egypt, a country which is outside the Preferential Trade ArEA for East and Southern African countries [COMESA}. However it has since been discovered that Egypt is a country which is producing less sugar for its domestic supplies, but only imports the commodity from Brazil, which in turn is re-exporting to Kenya.

Sugar products sale into the domestic and international market would boost the economy. The firm which is constructing the new factor is called Kwale International Sugar Company Limited [KISCO} The firm is expected to invest about USD 200 million which is equivalent to KJSHS 17 .1 billion. The project is also expected to generate 80 megawatt of electricity with 25 per cent being used to the plant and 75 per cent to be used for water supplies to the mill, and the rest would be connected to the national grid.

The new factory is expected to go into production on or about July 24, 2014 when its products would be introduced into the regional and local market. The project director Mr Harsil Kotwxha was recently quoted by the media as saying that that because sugar cane takes a year to mature in the coastal region due to unfavorable weather, compared to between 18 and 24 months in other sugar cane growing zones in Western KENYA.

The firm is currently embarked in constructing green field system of sugar cane growing. It started land preparation and cultivation in 2010 through the cultivation and plugging of a 5000 hectares nucleus estate farm.

The entire project is expected to cost Kshs 17.1 billion. It was launched by the retired President MWAI kibaki in 2007. It is owned by members of a family of business men through their family business flagship IPabari investment.

Endshich undertook the initiative following the collapse of Ramisi Sugar factory in 1980,which later sold 25 per cent share equity to Omni Sugar.

The project was partly financed by CPC/Stanbic and the PTA bank. At the same time about 1,200 local farmers were registered as the cane out growers. They have so far put about 4000 hectares of land read for sugar cane plantation2. The government of Kenya had leased 15,000 hectare of land for the same purpose..

NAIROBI, Kenya, November 25, 2013/ — Schneider Electric (http://www.schneider-electric.com), the market leader in energy management with operations in more than 100 countries, inaugurated the MiCROSOL project aims to develop a single, modular standard technology for producing electricity, drinking water and heat simultaneously, primarily to benefit micro-industries located in rural areas of countries with high levels of sunshine, especially in Africa.

MiCROSOL is based on the principle of cogeneration of electricity and heat, applying a new approach to a technology that is already widespread – solar thermodynamics. The solution focuses its constraints on the design of thermal storage that only uses environmentally-friendly products.

Its purpose is to simultaneously meet three basic needs regularly expressed by these people: Access to electricity that is reliable, efficient and inexpensive; Clean drinking water that is produced economically and consistently; and Heat generation that is continuous and environmentally sound.

Microsol can help micro-producers in the food, textile and paper industries with processing their raw materials by automating some of their processes (e.g. drying, washing, pasteurization, etc.). In the tertiary sector, Microsol can help the tourist industry by providing the energy needed for many premium services: electricity for HVAC, refrigeration or security; heat for hot water, laundry or heating; water for drinking or cooking.

Located in a rural village, Microsol can also meet some or all of the production needs of local residents: water supply, electrification of communal areas, and so forth.

A Microsol solution produces 50 MWh/year of electricit, 1,000 m3/year of drinking water, and around 800 MWh/year of thermal energy. The solution has an expected life of at least 20 years.

“That technology can help Africa’s poorest countries”, said Pradeep Monga, Director of the Energy & Climate Change Branch of the United Nations Industrial Development Organization (UNIDO), while attending the inauguration of Microsol solution.

For the environment, Microsol is a green solution that guarantees zero greenhouse gas emissions, reduced deforestation and health problems owing to the clean production of heat and electricity. Also, Microsol use easily recyclable steel and aluminum components.

Gilles Vermot Desroches, Senior Vice-President, Sustainability, Schneider Electric, announced: “All countries with high levels of sunshine are potential targets for marketing Microsol. However, because of its infrastructure needs, geographical location and economic models, Schneider Electric and its partners decided to focus their efforts on Africa”.

After market research, the consortium led by Schneider Electric chose Kenya as pilot country for the industrialization and commercialization of Microsol. Kenya meets a set of favorable conditions for the establishment and development of this solution.

The consortium plans to start the commercialisation phase in 2015.

Uganda-Kenya Relationship

Kenya and Uganda governments have agreed to a mutual deal that when fully implemented will make it much easier to the citizens of the two countries have an easy access to border crossings, instead of the cumbersome going through tough immigration scrutinizes.

The agreement came at the conclusion of a week long consultative meeting held in Kisumu City. The meeting held at the posh Sun-Set Hotel on the eastern shore of Lake Victoria.

It will facilitate free movement of labor between the two countries. IN the new deal those nationals of the two neighboring nations moving to either for a period of six months will only be required to produce their national identity cards. This will apply to Kenyans crossing into Uganda while Ugandans travelling to Kenya will use heir voting cards as the official documents.

The Ugandan delegation headed by a r Mohamed Sadique arrived here last Monday during which time the two delegations deliberated on various contentious issues affecting the two countries. The two teams revived reviewed issues such as reviving the question of Migingo island in Lake Victoria, which has been the sources of endless political wrangling between the two nations for the last eight years.

The Kenya delegation was headed by James Ole SeriAN who is the Regional Co-coordinator Commissioner for Western Province. It asked the joint border survey committee which was established Five years ago to urgently embark on the review process to end the stalement. It became clear at the end of the discussions that the two countries wants Migingio ISLAND border survey reviewed quickly and the dispute between the two countries sorted out amicably and diplomatically. The same dispute has remained a thorny issue for the last eight years at times threatening he peaceful co-existence of the two countries.

Mr Ole Serian the head of the Kenya delegation had told the gathering that the long territorial spat over the disputed Migingo Island in Lake Victoria will soon be resolved in a peaceful manner. His counter part Mr Sadique said that the to countries have enjoyed cordial and warm relationship anf therefore needed to resolved all the outstanding issues harmoniously.

The joint survey team was established by the two nations in 2009 and undertook the joint inspection of the international boundaries in the region, But its work had stalled despite the two countries having made available the sums of Kshs 240 million in which each contributed half of the amount of. During another KENYA-Uganda Ministerial COUNCIL held in the Kenyan capital, Nairobi in 2011 it was agreed that the joint survey team would complete its work and come up with practical modalities to conclude the survey and demarcation of the common boundaries in Lake Victoria.

The initiatives, however, stalled due to what Mr Ole termed as failure to bring on board the stakeholders. NINTH KENYA-UGANDA JOINT BORDER TECHNICAL COMMISSION does bring on board all the stakeholders, and, that exercise among the many issues surrounding the true ownership of Migingo Island. Which were supposed to have been addressed adequately and sufficiently.
