Kenya: Miguna’s Court Case in detail

Mohamed Isahakia has been sued because he issued the so-called suspension letter and leaked it to the press (electronic, radio and TV) more than 20 hours before it was delivered to me.

The Attorney General has been sued because he is the competent government authority that is legally liable for or on behalf of the Government of Kenya. If the head of public service, the PM or the President do anything unlawful or illegal, the person to sue is the AG.

Let me underline the following:

1. My counterpart, Prof. Kivutha Kibwana and Raphael Tuju were hired on contract as advisors at job group “V”, which is the same job group as the head of public service, Francis Muthaura.

2. My contract was to last until the end of the coalition government. In other words, I am employed on a fixed-term contract until the coalition government is dissolved. If the coalition government is dissolved in August or December 2012, my contract lapses automatically.

3. However, if – for whatever reasons – my contract is terminated (I cannot be dismissed because this is a contractual relationship; termination of a contract must be for material breach, etc), the employer is obligated to pay ALL my dues up to the end of the contract.

4. So far, the employer has breached the employment contract in two material ways: first, the employer has refused to pay me the same as Kibwana; and two, the employer has purported to suspend me without pay.

5. There is no suspension for the alleged infractions in law in Kenya. I could only be suspended if I was convicted or being tried for SERIOUS criminal offenses. Neither has happened.

6. There is no indefinite suspension in Kenyan law. The letter I was issued with does not provide the duration of the suspension. It is blanket.

7. Due process was not followed. I was not given a “show cause” letter with detailed particulars and asked to respond within a specific amount of time.

8. I was not requested to return from vacation and a proper “show cause” letter issued to me in a humane and dignified manner.

9. The withdrawal of my salary, allowances and benefits was both illegal and actuated by malice.

10. The withdrawal of my security and government issued vehicle was both illegal and actuated by malice.

11. The summary termination of employment of all my staff was both illegal and actuated by malice.

12. The leakage of the “suspension letter” to the media before it was served on me was unlawful and actuated by malice.

13. The discussion of my so-called suspension with third parties unrelated to my employment such as James Orengo, Jakoyo Midiwo, Oburu Odinga, Francis Muthaura, Francis Kimemia, Alfred Mutua, Caroli Omondi and Mohammed Isahakia was both unlawful and actuated by malice.

14. The failure by the PM to contact me for more than one week (up to now) proves malicious intent.

15. The IIEC has disclosed to the PM that I was not involved in the alleged “interference” with the commission.

16. I was not an employee of the ODM party. I was not answerable to ODM or to Jakoyo Midiwo, etc.

17. In any event, I was instructed to write my article on the IIEC chairman and the position he had taken with respect to the party’s decision to kick out rebellious MPs and Councillors.

18. It was the PM who instructed me to write a column on topical social, political, governance, legal and constitutional issues. Indeed, the PM has on a number of occasions not only given me specific assignments; he has consistently approved of and praised (many times in the presence of others) my articles and defended me when PNU have demanded that I be either stopped from writing or be fired for the same.

19. Lastly, the manner of “suspension” does not accord with the principles in the constitution, the law and good governance.

20. Under the circumstances, I am fully entitled to fight for my rights and to insist that those in positions of power abide by, uphold and respect both the constitution and the rule of law.

21. My “suspension” has absolutely nothing to do with the “reasons” that were given in Isahakia’s letter, nor those attributed to Jakoyo Midiwo. Truth, honesty and integrity must prevail.

I have reluctantly taken this action after waiting in vain for the Prime Minister to contact me and apologize for this transgression so that the artificially created dispute could be amicably resolved. Unfortunately, he has failed or refused to do so after one whole week. This is neither honourable nor humane. A man who cannot apologize and correct his mistakes has no business pretending to be the symbol of positive change for this country. I would like to underline the fact that I am NOT doing this lightly.

I have sacrificed my professional career, my life – even my family – for Raila Odinga. For him to throw me under the train in such callous, inhumane and clearly barbaric manner astounds me. I have loved Raila Odinga. I have fully trusted Raila Odinga. I have committed all my life and energy to defending and promoting the interests of Raila Odinga and that of the citizens of Kenya and the country at large. I have done so voluntarily because of my commitment to democracy, good governance, justice, equality, equity, the ruler of law and constitutionalism.

Unlike many people in and around the office of the Prime Minister, I have never been involved in corruption. I have never acted in pursuit of personal self interests. On the contrary, I have consistently and courageously opposed corruption at the OPM in particular and in Kenya, generally. I have also opposed – and will continue to fight – mediocrity, tribalism, nepotism and cronyism. My record speaks for itself on these matters.

I did all these things for higher ideals. I believed (I now realize, wrongly), that Raila Odinga was the “agent of change” for our country; the “bridge between the old and the new Kenya”.

I have worked as a slave for Raila Odinga. Raila Odinga knows that I have done nothing wrong. He has been made aware by the IIEC that I was NOT involved at all in any conspiracy to undermine the commission.

I have been advised that the IIEC has informed the PM that an internal IIEC investigation has revealed that the author of the articles published in the Star newspaper under the byline “Gikonyo Boaz” – and whose contents nobody has refuted – is one “Dr Baraza” who is well known to the commission. The PM has been advised that I have no connections, links, nor do I know who Dr Baraza is. Despite all these, the PM and others around him claimed that they were “sacrificing” me “to save Major Oswago”. I am not sure why I should be sacrificed to save anybody.

As I understand it, Mr Oswago is also innocent of the frivolous charges. Even if he was facing allegations of wrongdoing, the best thing that ought to have been done was to accord him due process. No one is or can be condemned unheard. If this were the case, the PM would have been hanged for allegations that he attempted to overthrow the Kenya Government in August 1982.

Over the years, the PM has made it a career of reminding Kenyans of the inviolability of freedom of speech, freedom of the press, freedom of expression, freedom of conscience, freedom to hold different opinions, a fair and functioning judicial system and a functioning democratic system. Indeed, he suffered greatly for championing these ideals. These are the reasons why I have supported him over the years.

Early this morning (August 12, 2011), I received information that on July 6th, 2011 when my staff went to the Prime Minister’s Building to collect my leave allowance, a junior employee at the Human Resource department at the OPM was boasting that I would not be returning to work because I had been fired. My staff did not have the courage to tell me of the rumours in case they turned out to be just rumours.

I am also aware that I was not allocated office space at the PM’s Building last year due to mortal fear by the “power men” from Nyanza that I was becoming too powerful and influential. These “power men” believed that my “power” and influence” were emanating from the proximity I had to the PM.

They thought that discarding me at the NHIF Building in Upper Hill, would dilute the perceived power. However, when they noticed that I continued to discharge my functions with complete commitment, diligence and distinction, the power men panicked and resorted to bestiality. But because they are both cowardly and dishonest, they could not face me with their fabrications. They waited until I was on leave to execute their nefarious plans.

So, quite clearly, the PM and those around him simply wanted to “sacrifice” me for parochial, mischievous and malicious political reasons. The PM has acted both dishonourably and disgracefully.

But in doing so, they acted inhumanely, did not follow due process, and grossly breached my legal and constitutional rights. Nobody can justify these acts. I am not a dog that can be brutalized without consequences.

I shall protect and uphold the rule of law and the Constitution. Those who fear democracy, the rule of law and refuse to uphold the Constitution have no business pretending to represent the ideals of the new dawn.

When it comes to issues of justice, truth, respect for human rights, the rule of law and constitutionalism, I have no other option but to be uncompromising.

I know that the people of Kenya and God are on my side on this. The inhumane and bestial way I have been shunted has touched many people. Everybody knows the positive contributions I have made and will continue to make for the well-being of this country.

To the people of Kenya, I want to say: I shall never bend and serve at the whims of parochial selfish interests.

Kenya: August 28th 2011 is The Factor to Political Fever and Frenzy in Kenya

August 28th 2011 is here. Politicians in Kenya are in the frenzy of positioning for re-organization for Status Quo. Kibaki is to step aside leaving his son to warm-up with PM Raila before election is called in august 28th 2012…….The Drama is all about the hot pursuit scramble to re-align for positioning to make a kill for Status Quo, a sad state-of-affair and a tall order in the present Kenya.

It has just down on them that time is up and the Constitution Reform Agenda cannot be evaded. It is a law and is going according to the timetable. This is the reason for the rising political temperature and the scramble to glue control of key powerful public offices to themselves before the “D” day. They have just recognized that “Ocampo” factor is REAL…….. the “Pre-Trial” cannot be manipulated or pushed to fit into their conspiracy they were trying to cook……..The skies are coming down on them like “Thunderbolt” beyond their understanding or powers. This is the reason why Miguna’s position is being manipulated to compromise the Status Quo special interest. It is rumored that names of such people like Samwel Omwenga were listed top to be considered while in the spree of beer drinking to be handed by Jakoyo Midiwo to Raila’s wife for consideration to Miguna’s position. Other people in line who were engaged in shoddy lobbyist deals, were to be considered as well within the Diaspora for rewards through Raila’s wife connections in the US, UK and Canada……..These group of people are seen busy shuttling between Canada, UK, US, Uganda and Kenya……….

They are preparing an assault on Constitutional Reform in readiness to tactfully scuttle the complete Reform implementation according to New Constitution, by delaying clear-cut ground breaking civic education to public in preparation of the formulation of Counties for implementation of the New Constitution by positioning sycophants, those of strange characters, being imported early to cause fear and intimidation as well as fracas and confusion for their win strategies, those questionable characters who will support Status Quo’s interest and altogether will block the would be genuine prospective people’s candidates, a show case of what is now happening in Siaya and Kisumu areas. People are currently being killed, ambushed and cut with pangas as they come from work, notably, four days ago, about ten people have been cut, some died and some are still nursing their wounds. This happened in Ukwala and Kodiaga. Jakoyo Midiwo should tell us what is cooking, as he is the Constituent Representative of Gem Constituency. Why does he seem to be quiet like he does not know what sufferings people of his constituent are under going, or is he detached from reality and from his Representation Responsibilities. Can he tell us why the case for the Council women was few days ago, thrown out by the court in Siaya, in favour for Mr. Aggrey who was defeated by Ms. Elizabeth?……..What about schools that were funded by Canada in Siaya, why have they been closed? Are these the political maneuvers meant to interfere with developments for ulterior political motives??? This and many other will not be tolerated and will not be acceptable as, the whole world is watching keenly activities and happenings in Kenya…….This are just tips of an iceburg…….

August 28th 2011 is another deadline for President Kibaki and Amos Wako, when they are suppose to leave Public Office according to the New Constitution. This is why President Kibaki had earlier announced two months ago, that he is remaining with two months to retire, and it is the reason why his son is to join PM Raila in the remaining 12 months of the Coalition Government starting August 28th 2011 to August 28th 2012. At this time, PM Raila will continue to hold the Office of the two positions, as Prime Minister as well as the President while grooming Kibaki’s son to prepare for taking position in the Rank and File.

To Kibaki and PM Raila, politics and leadership of Kenya is a family affair. This too must stop and stop now……!!!

It is therefore this Political fever and frenzy the reason why political temperature has been illegally and unconstitutionally raised, the reason politicians abandoned their duties to effectively implement Federalism Majimbo Governance but are busy with sideshows, the reason politicians are scampering, having thought ICC the Ocampo factor was unrealistic only to find they cannot wishy washy Hague matter as the “Pre-Trial” cannot be manipulated for extension or otherwise in the hope Hague could be bribed and pocketed in any manner…….they are realizing, they assume the impossible. They are treating human sufferings as political gamble or chess card. Everything to them is fools play……the reason there is too much hunger and sufferings in Kenya. This is just poor and bad management with corruption meant to fool the International community and the public………and it is the reason why Miguna Miguna has been sacrificed upon the alter. This must stop and must stop NOW……!!!

ICC Hague is real and it cannot be shelved……….!!!

It is just a matter of time that Reform Agenda for CHANGE, will stay and remain real and be seen to be realistic, where peoples mandate to Federalism Majimbo Governance will offer the needed change for peoples livelihood with good prospects for better future………The Destiny we all want……..

Presidential campaigns disgraceful, premature

Our political leaders need to snap out of their obsession with the post-Kibaki presidential race and confront matters that most Kenyans perceive to be of immediate and paramount importance. The issues of the moment are jobs, food, security, cheaper energy, health, land reform and school fees — of course not necessarily in that order. Meanwhile, the field of self-declared candidates to succeed President Kibaki in 2012 (or 2013, whichever year is finally chosen) is getting crowded by the day.

Unfortunately most of these “candidates”, including some very well known names, are driven not by a genuine interest in the welfare of their country, but by personal vendetta, revenge and the need to protect ill-gotten wealth.

Yet hundreds of thousands face starvation in the “triangle of death” that straddles the borders of Ethiopia, Kenya, Sudan and Somalia. Also caught up in a daily cycle of hunger are residents of informal settlements or slums in key urban areas.

Rethink agriculture

Despite the vastness of its desert landscape, Turkana has massive potential for farming by irrigation and production of electricity using the wind, yet it remains the most undeveloped and desolate places one finds in Kenya.

Due to global warming, areas of the country that were once food baskets have seen their harvests dwindle as rainfall becomes more erratic each year, and the planting seasons shorter.

The subdivision of land in these areas has also reduced the portions available for growing food crops. Rain-fed agriculture is no longer a viable option for the future.

What is needed is a Marshall Plan of sorts, a complete rethink of Kenya’s agricultural policies to reflect the changing demographics and end perennial hunger that is getting more vicious with time.

But who will kick our leaders out of their lethargy and permanent fixation with elections? In Parliament are lawyers, doctors, insurers, teachers and engineers, but rarely do they come together to push non-political agendas in the House.

MPs have been very vocal on the matter of raising their salaries and allowances, avoiding taxes and fighting to get a pension for life (whether or not they have served just one term) once they leave Parliament, yet they have been remarkably quiet when it comes to feeding the starving and saving the dying in their midst.

Kenyans care little whether elections are held in August or December next year, or March 2013.

What they want is for the Minister for Justice, Attorney General and Commission for Implementation of the Constitution to speed up the drafting and tabling of necessary legislation that will ensure fair and free elections when the time comes, and anchor the new laws.

In exactly 26 days, the new Constitution will be one year old, yet very many Bills that the current Parliament needs to debate and pass have not even reached Cabinet.

Instead, many MPs have adopted a herd mentality and spend most of their free time trailing their favourite “presidential candidates” on their premature campaigns where the latter spend more time on chest-thumping theatrics and insulting and belittling their opponents, than offering a realistic roadmap on how they will create jobs, improve security and health care and reduce Kenya’s dependence on hydro power. What are these so-called “candidates” offering that is different from the rubbish spewed out by others every five years since Independence? Haven’t we heard it all before?

By allying themselves to “presidential candidates” whose only message is hate and revenge, our MPs have become intellectually bankrupt, morally repugnant and a total disgrace to Parliament.

Kenyans need to ask themselves how, where, and when some of our leaders acquired so much wealth in such a short period of time that they even own helicopters and planes.

A day’s budget for flying around in one of those things is enough to ensure many a hungry Kenyan gets at least one balanced meal. Such reckless spending, when others are dying of hunger, is a strong enough reason to reject their candidacies.

Ill-gotten wealth

When asked how they made their money, many lie and spin “rags to riches” tales, painting themselves as ordinary Kenyans who made it through sheer hard work and willpower, when in truth they are beneficiaries of grand corruption.

Kenyans must take a long hard look at those who wish to lead us come the next elections.

If they are not forthcoming on the source of their wealth, then they probably have plenty of elephants in their closets and should be rejected forthwith.

Time runs out as Kibaki eyes good legacy

With President Kibaki preparing to leave office, his focus appears inclined to taking stock of his successes as his legacy faces the radar.

Having served the constitutionally allowed two terms as President, Kibaki is expected to retire after the General Election due next year.

While aspirants eyeing the presidency have been galvanising support, Kibaki has his eyes set elsewhere.

He has devoted time to inspect projects he had initiated over the years. The President is also hurrying up to begin new development projects he feels would help shape up his legacy, which has attracted praise and criticism in equal measure.

His new focus has been manifest in activities he has undertaken in the last two months.

Kibaki has been visiting projects while shunning political debate waged by his lieutenants and presidential aspirants in the succession race.

He has on two occasions made it clear he would not name his successor. Unlike his predecessor Daniel arap Moi, he will not be active in campaigns to pick the next president.

Even in his central Kenya backyard, and especially his native Othaya constituency, Kibaki has given indications he would not take sides in supremacy battles between Finance Minister Uhuru Kenyatta, Gatanga MP Peter Kenneth and his Gichugu counterpart Martha Karua. Hands-off nature of the President is a strong pointer he will be spending the remaining time consolidating his work on projects that could define his legacy.

Tax evaders

When Kibaki took over power in 2003, his appeared focused on improving infrastructure, hence the decision to tighten the law against tax evaders among other crosscutting reforms.

The Kibaki administration rolled out a massive road construction programme. He is now going round to commission other projects and to push for the hastening of road works to ensure they are completed in time.

Among the projects that have served as pet subjects for Kibaki is the Isiolo-Marsabit-Moyale road, which on completion, will link Kenya and Ethiopia.

After commissioning the road four years ago, the President returned to northern Kenya to open another phase of the project, a 136km stretch from Isiolo to Merille River.

The section is said to have cost Sh6.3 billion, funded by through a partnership between the Government and the African Development Bank.

Kibaki said the road would open up the northern Kenya region for development and investment. He said it would also serve as a connection to Ethiopia from the port of Mombasa.

“The upgrading of this road to bitumen standard is expected to contribute to the development of this region through increased trade and other business activities, including marketing of livestock produce,” the President said during the visit.

He also commissioned the construction of another 121km road from Marsabit to Turbi, calling on the contractors to hasten its construction.

Within the same week, the President had given the go-ahead for the construction on Lamu Port, another of his pet.

An indication that he wants to take credit for the mega- project, Kibaki said he was looking forward to commissioning it next year, the same year he is expected to leave office.

Noting that the project was mooted 36 years ago, he said: “It is my hope that with the completion of consultancy studies, the project can now be implemented without further delay. I look forward to commissioning the first ship docking at the Lamu Port next year,” said the President.

Contractors on the Nairobi-Thika superhighway – which would help define the Presidents policy on infrastructure – have been put on notice to complete work by mid next year.

As Kibaki enters the last year of his term, he is keen on turning his presidency into a success story.

MPs jittery over Political Parties Bill

What would be the future of political alliances if Parliament outlawed pre-election coalitions?

The debate on Political Parties Bill on Tuesday in Parliament saw MPs oppose pre-election mergers, which have been common.

This opposition may just be a tip of the iceberg as more intricate issues continue raising storm. Centre for Multi-Party Democracy (CMD) has planned a breakfast meeting this week to cushion the Bill against being watered-down in the House.

“I have talked to some MPs and they are willing to attend the meeting to discuss the Political Parties Bill,” CMD chairman Justin Muturi told The Standard On Sunday. Muturi said CMD is against funding of regional parties, which he feels are more likely to be tribal, and which he says would be a contrast to the Constitution’s push for parties to have national attributes.

“We are also against the push by some MPs to allow a situation where one can walk in and out of a political party without notice. We need strong parties as institutions of public governance,” said Muturi in an interview. Political scientist Frank Matanga says pre-election coalitions are not healthy, as they end up leading to instability whenever basic agreements are honoured.

He cited the broken MoU between Narc and LDP, which led to a falling out after the divisive 2005 constitutional referendum.

“Post-election coalitions are stable, focused and promising as seen in Germany and Britain. Pre-election coalitions are mainly formed with purpose of capturing power,” said Prof Matanga, who lectures at Masinde Muliro University.

Ahead of the General Election, possible alliance include the so-called G-7, which seeks to block Prime Minister Raila Odinga from succeeding President Kibaki retires.

The G-7 alliance revolves around Vice-President Kalonzo Musyoka, Deputy Prime Minister Uhuru Kenyatta, Eldoret North MP William Ruto, Saboti MP Eugene Wamalwa, and Assistant Minister Aden Dualle. Although the G-7 had indicated it was weighing between forming a pre-election alliance and fronting separate presidential candidates to force a presidential run-off, it remains to be seen how the expected law would affect the plot.

County seats

CMD has its own reservations. The Charles Nyachae-led Constitutional Implementation Commission is pushing for funding of regional parties, which may only field candidates for county seats.

“There may be parties which opt to participate in county elections alone. These are legitimate national elections occurring at a distinct level of government,” said Mr Nyachae.

According to him, restricting funding to parties that win seats in elections at the national government is a failure to recognise the legitimacy of county governments and violates the letter and spirit of the Constitution in Article 6. CIC also wants the Bill amended to provide that the distribution of funds to political parties be reviewed annually.

“Each party’s political representatives may change from year to year depending on successful election petitions, recall of MPs, and by-elections. It is necessary that these changes be reflected in the allocation of funds to reflect the constitutional principle of fairness,” the commission suggests.

Funding to parties

While opposing CIC’s push to fund parties that only win county seats, Muturi says any serious national party can win seats at national and county levels and that such a scenario should be encouraged.

“Parties should have a national outlook and be ran professionally. We do not want parties formed without ideology, and whose purpose is to win positions,” added Muturi.

Muturi also pointed out that CMD wants the office of the Registrar of Political Parties strengthened.

“The office should be powerful enough to even reject registration of a party that duplicates ideologies. There should be distinct ideological differences between major parties. Those that share ideologies should merge,” added Muturi.

When the Bill came up in Parliament on Tuesday, MPs accused the Registrar of Political Parties Lucy Ndungu of bias. MPs recommended tough action on destructive dissent in parties.

The Bill proposes deregistration of political parties if they do not conduct free and fair elections and calls for stern measure against defectors.

But Gichugu MP Martha Karua and Sirisia’s Moses Wetangula argued only the High Court and Supreme Court should exercise powers to deregister political parties. Wetangula opposed pre-election mergers and called for action against party rebellion. Kimilili MP Eseli Simiyu alleged the Bill was drafted to legitimise political alliances and “party hopping”.

Parties in mad rush to put their houses in order

ODM and ODM-Kenya have embarked on an aggressive mission to reinvent their political strategies.

The steps follow a sharp drop in opinion poll ratings, which point to falling fortunes.

ODM, rated Kenya’s the most popular political party, dropped significantly from 42 per cent to 32 per cent in the latest Synovate opinion polls.

Equally, ODM-Kenya did not impress. The parties’ bet for president Vice-President Kalonzo Musyoka’s ratings continued to sink.

ODM brigade, led by Prime Minister Raila Odinga, last week quickly convened National Executive Council meeting to discuss a raft of issues, including the way forward as the General Election nears.

Sources privy to the meeting told The Standard On Sunday that a number of grassroots mobilisation strategies were proposed.

Party offices

The party tasked MPs to troop back to their constituencies and re-activate dormant party offices.

The MPs were also asked to increase their contacts with party supporters by making sure they hold weekly party meetings with local leaders.

The plans are part of strategies adopted by the party as it seeks to endear itself to the electorate.

“We want to see everyone making effort to sell party policies,” Raila told the MPs.

South Mugirango MP Manson Nyamweya said: “We are keen to bring Nyanza together to rally behind Raila as our presidential candidate without mixing signals.”

Planned meetings

Similarly, ODM-Kenya is not taking any chances. After the party rebranded in readiness for the 2012 General Election, it has now planned meetings with various caucuses.

In an interview with The Standard On Sunday ODM-Kenya Executive Director Henry Rop and National Executive Council member Marwa Maisori said they had lined up a series of strategy meetings.

On Thursday, they hosted women leaders, and next Wednesday they will meet party youth at Bomas of Kenya.

“We have teams, which we intend to invite for a meeting and lay out strategies to strengthen our party,” Rop said. He spoke as Maisori disclosed the VP had been given green light by the top party organ to set up his 2012 presidential campaign secretariat.

They said Musyoka would still be the party candidate next year, and that he would be hitting the campaign trail soon.

“We have also asked him (Kalonzo) to address national issues so that we are seen to be fighting for the national good,” Maisori said.

Your unity will not shake me, Raila tells rivals

Prime Minister Raila Odinga has said he is ready to face presidential aspirants who have indicated they would pick one candidate to face him.

In an apparent reference to G-7 Raila said the group cannot shake his presidential ambitions.

“You can go round saying how you will unite and will pick one presidential candidate but you will still come to face me. I am waiting,” he said.

And Deputy Prime Minister Musalia Mudavadi, who spoke at the same function, said he was also in the presidential race.

“I also want to be president. Raila also wants the seat but there can be only one at a time,” he said. Raila said ODM is still the party to beat and expressed confidence that it would form the next government.

“We will make sure that we beat our opponents with a margin that would not leave any doubt that we won the elections,” he added. Raila claimed that G7 would have a problem picking a candidate who would face him.

He explained it with a parable illustrating the situation facing the G7. “Rats once had plan of putting a bell around the cat’s neck to alert them whenever danger lurked. However, no one volunteered to take up the task of tying up the bell around the cat’s neck,” he said amid laughter.

Deputy Prime Minister Uhuru Kenyatta, Saboti MP Eugene Wamalwa and Eldoret North MP William Ruto, who are G7 members, have presidential ambitions.

The three have indicated they would pick one of them to go for the top seat.

Mr Wamalwa, who spoke earlier at the same function, told politicians not to underestimate him and gave the biblical example of the battle of David and Goliath.

They spoke during the burial of Leonida Mukonyi in Chegulo village in Kakamega North District. Mukonyi was Raila’s house help in his Nairobi residence, Karen.

Kalonzo officially kicks off State House campaign

The rebranding of ODM-Kenya on Wednesday and the party’s Women’s Congress a day later marks the beginning of Vice-President Kalonzo Musyoka’s second stab at the presidency in the General Election.

It is a journey that Kalonzo has kicked off in earnest over the weekend following a three-day whirlwind campaign in Gusii-land, in Prime Minister Raila Odinga’s Nyanza backyard.

“We have picked an umbrella as a logo because people use it to shield themselves during rainy and hot seasons, while a wiper is used by those driving vehicles,” party Secretary General Mutula Kilonzo explains the changes.

Party officials also claim the changes were occasioned by the loss of votes during the last election when members confused it with ODM, whose presidential candidate was Raila.

The Standard On Sunday has further established that ODM-Kenya’s top decision making organ meeting last Wednesday also gave the VP the nod to set up a campaign secretariat, which is expected to be unveiled soon.

This development is bound to raise the interest within the so-called G7 group that includes Deputy Prime Minister Uhuru Kenyatta and Eldoret North MP William Ruto.

The three, alongside others, are in a pact to field one candidate against the Premier. The mode of doing so is yet to be agreed upon.

The estimated 600 women delegates who attended a national congress at Bomas of Kenya resolved to conduct grassroots campaign for the Vice-President.

In resolutions read by Nominated MP Shakila Abdalla, the women leaders from 47 counties said the party would support the Gender Commission Bill, which would empower women.

“We have also resolved that the party would support policies aimed at attaining food security and end starvation, which has caused deaths of thousands of people especially children, women and the elderly,” Abdalla said.

Beatrice Masis, a NEC member, said ODM-Kenya was entrenching itself at the grassroots and that it was popular among women and youth.

Mary Kithika from Central Province said Kalonzo had endeared himself to the residents of the region and expressed hope that he would succeed Kibaki in the 2012 presidential race.

“I am sure that with more visits to the region, the people of the larger Mount Kenya would vote for Kalonzo,” she said.

Afya Rama from the Coast region said women would conduct door-to-door campaigns for the Vice-President when the campaigns kick off.

Information Minister Samuel Poghisio, who is the party chairman, said he was proud that women were taking part in the rebranding and campaigns for the party.

Kalonzo, while addressing the women, said ODM-Kenya wanted women empowered to achieve 50-50 per cent gender parity, which is beyond the one third provided for in the new Constitution

Constitution committee plans Bills merger to beat deadline

The Constitutional Implementation Oversight Committee (CIOC) will merge two Bills in a bid to pass 18 pending Bills before August 27.

The committee also asked Justice minister Mutula Kilonzo to discuss with the House Business Committee (HBC) possibilities of extending parliamentary sittings, including on weekends, to speed up the passing of several Bills before the constitutional August 27 deadline.

Last week the CIOC threatened to ‘punish’ the minister if he failed to table Bills still held by the Attorney General, the Cabinet and the Commission on the Implementation of the Constitution (CIC) by yesterday.

Meanwhile, the CIOC will begin to vet nominees to the Judges and Magistrates Vetting Board on Friday as Parliament plots to take a final vote on the Political Parties Bill on Thursday.

Vice-chairperson Millie Odhiambo said yesterday that the committee had derived a formula to pass five Bills in a week and announced that MPs have just 13 days, to pass the 18 laws, including the Environment and Land Court Bill and the Power of Mercy Bill, which have not even been drafted.

Odhiambo said the committee “has no intention” of seeking Parliament’s approval to extend passage of these laws beyond August 27 as suggested by Vice-President Kalonzo Musyoka last week.

The strategy

The strategy involves the creation of three sub-committees within the 27-member CIOC to scrutinise the pending Bills.

After discussions, Odhiambo said a sub-committee, led by nominated MP Amina Abdallah, would merge the Kenya National Human Rights Commission Bill and the Commission on Administrative Justice Bill.

The merger was proposed at the MPs’ retreat in Mombasa at the weekend which also recommended the Bills’ suspension from debate.

The merger means either a new Bill will be drawn covering aspects in both or one of them will be withdrawn and the remaining one amended to include the other.

CIOC agreed to allow its vice-chair to consolidate all proposed amendments to the Political Parties Bill for a fast approval of the final vote.

She said Parliament would not be held back from vetting the Judges and Magistrates Vetting Board nominees if the President delays in naming the three foreigners to sit on the Board.

“We have confirmed that we actually have 13 days and not 17 days to ensure that all the Bills have been passed,” she said.

Assistant minister Alfred Khang’ati will chair the sub-committee that will scrutinise the private Bill, The Ratification of Treaties Bill.

The committee agreed that the merged Bills (the Treaties Bill, Political Parties Bill and the National Gender and Equality Commission Bill) are approved by Thursday.

Following concerns from many Kenyans about AKR’s future , a meeting was held on Tuesday evening between the outgoing Ex. Committee and some Kenyans elected at a social gathering at Grill and Barbecue last Saturday.

Several resolutions were passed in our meeting which will be communicated to you soon.

Key among the resolutions was that the current executive committee will create room for a team of moderators to normalize the membership list and to facilitate the election. By this email we kindly request all Kenyans to grant the team cooperation and to support them with ideas and recommendations on the way forward.

The members of the team are Joseph Manzi, James Kingori, Kepher Usenge, Julius Keter, Berry Odhiambo, Lilian Onyango and Anne Kimani

On behalf of the current executive committee I would like to thank all those who took their time to attend our monthly meetings, our sports day, our tree planting exercise and most of all our fund raising exercise.

KENYA: TEAM SPIRIT, HUMILITY AND TACT: SOLUTIONS TO THE 10 DEADLY SINS

When the RH Prime Minister talked the other day in Ndhiwa about other communities getting scared at the behaviour of the Luo in case he became the president, he brought out what has been in murmurs over time.

The conclusions of others might be based on mis-perceptions but there are incidences which are quoted namely:

1) ‘Sirkal’ fans throwing stones at all and sundry whether it wins or looses;

2) Many a luo man engaging in contests for hearts with others and openly bragging about snatching others girlfriends, daughters and at times wives;

3) Openly boasting about achievements in social gatherings making others shy away from socializing with them;

4) Openly degrading others e.g. magi to kono ji ang’o, dak ne wanene Makerere ndalo mane wasomo kuno;

5) Impunity e.g. kama itiyoe e ma ichieme, be isemuko kamoro?

6) Merry making at the discomfort of others e.g parting with loud music at the detriment of a goood nights rest by neighbours;

7) Always thinking aloud;

8) Know it all attitude; and many other behaviors that all biol down to LACK OF HUMILITY and TACT. These are not cultural traits and I know many of us are tactful and humble but a few of us engaging in the behaviors in each neighbourhood in Kenya can make generalizations which have some basis.

I personally support and I know many of us support the call by RH Raila for behaviour change. Positive change will come when we embrace Godliness and it is time we went back to GOD.

KENYA: WHEN THE VALUE OF MARRIAGE HAS BEEN REDUCED TO ‘CHAPA’

One of my Facebook friends recently posted on her News Feed page a very informative joke: “If money grew on trees women would date monkeys.” This is also true of Gwen Guthrie, an American singer-song writer, best known for her 1986 song: “You’ve got to have a j-o-b if you want to be with me/ No romance without finance”.

It explains why a common saying that a Kikuyu woman will treat you like a king as long as you have cash, but toss you like rotten mutura (traditional sausage) once you are broke is no longer confined to Kikuyu women alone-every woman needs ‘chapa’ (cash), especially now that Kenyan economy is almost becoming valueless.

The prices of essential commodities continue to shoot up due to weakening of Kenya shillings against US dollar. This week alone by the close of trading session on Tuesday, the local currency closed the day at new low of Sh95.05 against the dollar with dealers in the market quoting the shilling at an average of Sh95, for the first time in about 17 years.

Already there is fear that by next week according to the market projections an exchange rate may shoot up to Sh100 plus. The weaker the shillings the continuity of higher prices-it means that pay cheques will never keep up as media reports. This scenario makes everyone to love money.

That is also why the myth of sex that Kamba woman is known to be a force to reckon with, or coastal women are so idle that they spend the whole day applying henna all over their bodies, prepare elaborate weddings and cook biryani the whole day as they gossip, or Taita are said to make exemplary, humble wives, but when they make up their minds that a relationship is headed for doom, they are known to vanish back to their parents’ faster than you can say “mdavida” are gone myths.

Other myths that Luo women are said to stick to their men like glue as long as they suspect love is in the air and don’t look at another woman! If you do, she will have you and the other woman by the neck does not apply. Apart from being prided to have “drop dead gorgeous” bodies – with ‘Adhiambo sianda’ being their brand name, Luo women are believed to be good cooks and bewitching lovers.

Some men, especially Luo men like to marry Luhya women because of the myth that they are known to be modest and to have austerity, and that while they cannot stand extravagance, a Luhya woman would rather stay at home and drink numerous cups of tea than have you take her for an expensive dinner so long as there is in constant supply of ugali and Ingoho (chicken), she is yours for keeps.

The Luo men, mainly from Awendo, Dede, Migori, Ulanda, Ogwedhi, Makalda or surrounding areas of South Nyanza are said to like marrying Maragoli women not only because they believe they are easy to tame, but also because they are known to be in the business of making children, does not apply either.

The myth also has it that Kalenjin woman will never utter a word even if she smells strange perfume from you-she will not ask you from which woman did you get the perfume and where. And that men like them because they most beautiful, hardworking and wear big-hearts-former American ambassador to Kenya picked one.

Other myths have it that Maasai women are unquestionably obedient. They will never dream of correcting their menfolk. They still view their husbands as “lord of the house”.
People believe Masaai men are still glued to the custom of planting spears outside their age group member’s manyattas to warn the husband that serious business is taking place inside the manyatta and therefore will not ask you where you slept and with whom. Men also like them because they are generous with their husbands.

While Meru women are believed to be so faithful and agreeable that they will fight divorce to the bitter end even if they are living in hardship condition despite the fact that like men they can be hot tempered, Kisii woman has it in her mind that as long as you make her world rock she will never leave, even if you hire ten bulldozers to evict her from your house, like Meru women men are cautious because they can be hot tempered.

Today all these myths have been taken by time. In US for instance, unmarried couples account for more than 5.5 million households. This is because marriage means business. Without money it means no love. Your girl friend can just leave you because you refused to M-Pesa her or bamba twenty.

This is because the lack of money generated by one person in the eyes of the other can cause a problem because the expectations of the other person haven’t been met. Some working class would like to remain unmarried because they want to feel that they want to enjoy their funds alone because they are doing so well.

These are the type of women who would not like to get married because a man could use money as a symbol of power in the relationship. This is because in relationship money has proven to be the root of the problem. The man is usually the authority, and money has control and authority connected to it.

Another reason why most single professional women do not want get married as some of my Facebbok friends argue is because most single professionals are tied by careers, lack of appropriate partner or just lack of commitments and fear of responsibility, or because they are feared for what they have or education levels or the far they are careerwise.

Most single professionals online would however, like to combine forces to remove this fear and have single people take a step of faith to declare they are single and are ready for a commitment, which is why you can get them through date lines. Some women and men through such date lines have managed to get good partners for life.

Although some working class or professional single women as they are sometimes referred to would like to get married, according to the Daily Nation results of the poll published December 24, 2006, on which I was also interviewed, 63 percent of Kenya’s single women are frustrated marriage-wise because there is no man to marry them.

It explains why some single women and men have formed their own class where they prefer to be lesbians or homosexuals staying together even though most gay people disagree with this theory despite the fact that most scientists and biologists agree that there may be an environmental component to sexuality.

Of course, while some women would like to be lesbians because of the past molestation by men, especially through rape, the fact remains that some do so as a matter of choice between two options. This also applies to homosexual gays.

The good news is that professional women in their late 30s and 40s are happy, independent ‘living singles’. Some have made a deliberate decision to remain so while others argue they are still single by forced circumstances such as broken relationships, whereas majority of those in their 40s have established careers and acquired property so many men shy off from them because they feel threatened.

The bad news is for women in their 50s-they struggle with loneliness. They tend to hate men and cry over lost relationships, cursing those men who messed them up when they could have made better choices. Most of those women suffer from rejection, bitterness and stigma.

So the issue here is not sorely on money that is why for instance, there are around 150,000 divorces a year in the UK at the moment with the average marriage lasting 11 years. It’s often women who do the walking out of a marriage that has gone stale, or where both parties have grown apart.

KENYA: GIVING AND RECEIVING HANDOUTS (GONYO): NOT A CULTURAL PRACTICE OF THE LUO

Thathe last copy of ‘Luo Kitgi gi Timbegi’ and talks with elders both Luo and Suba reveal that there are some practices that were unknown in the Luo community. One of these strange practices has cropped up in the last 2 to 3 decades. This practice is that of giving and receiving hand outs (gonyo).

Gonyo is a deadly practice that if not checked would evolve into a culture that would kill any remaining enterprising spirit in the community. It is deadly because:

1) It does not allow the giver to offer sustainable help to the community. Instead of channelling resources to economically viable projects, much is lost through scattered drops to different people(instead of giving people hunting tools, little bits of spoils from hunting is distributed);

2) It denies the giver resources to invest in private enterprise which could in turn create employment;

3) It reduces social interactions to mere transactions where the giver thinks he/she has bought the receiver and the receiver remains feeling cheap and hopeless;

4) It makes the receivers not to think beyond the box to fend for themselves;

5) It encourages the receivers to demand from and harass those who do not have extra/are not willing to give;

6) It is an abuse of love, an abuse of charity and evil. We often see able youth and wazees chasing after gonyo bot you rarely see the very vulnerable widows, orphans and physically handicapped demanding for gonyo.

We should therefore campaign vigorously against gonyo and all its other forms.

Kenya: Sugar cane farmers wants the government to speed up privatization in the industry

The 351,000 strong members of the Kenya Sugar Cane Growers Association {KESGA} have appealed to the government to speed up the privatization process within the sugar industry.

The Association’s Chief Executive Officer Francis Waswa Mungo charged that cartels of sugar barons are known to be secretly sabotaging the planned privatization of the state-owned sugar mills.

And as the result KESGA has petitioned the two principals of the coalition government President Mwai Kibaki and the Prim Minister Raila Odinga urging them to fast track the privatization process.

Speaking in Kisumu Mungo said only privatization would led to the reduction in the cost of sugar production in the country which is the highest. There cannot be another extension,” we can no longer bend the rules and government must implement the privatization of Nzoia, Sony,Chemelil, Miwani and Muhoroni sugar companies.

The exercise he said would eventually benefit 10 million people in Nyanza, Western and in the lower parts of the Rift Valley regions.“ The people have been exploited and ignored in the past.”

He accused the Permanent Secretary Ministry of Agriculture Dr.Romano Koome and the Kenya Sugar Board for dragging their feet over the question privatization of state owned sugar companies.

“As a matter of fact and utmost urgency, the two principals in the government should fire PS Koome and put in place a substantive CEO at the KSB to have the process move forward quickly,” he suggested.

He said KESGA which a membership sugar cane growers, will strongly resist attempt by the cartel of sugar barons, certain powerful politicians and millers to derail the privatization aimed at reducing the cost of sugar production from the present Kshs 60,000 per tone down to about Kshs 30,000 per tone.

The Kesga CEO took issues with local sugar millers for underpaying farmers while spending lavishly in advertisements about their ready made sugar products.

Mungo alleged that powerful cartel with intent on sabotaging the economies of Nyanza, Western and Rift Valley regions by arms twisting the privatization and were planning a looting spree in the sugar mills to bring about the collapse to frustrate cane farmers so that the President and the Prime Minister take a painful decision of dumping them out of government now.

He said that in the present state owned sugar mills were over staffed by unqualified relatives of top managers, politicians and all the management pondered to the whims of powerful politicians. But when privatized the mill will operate with optimum staff level adopt better technology and increase efficiency.

He demanded that the farmers who have been ignored by the government and its agencies be consulted on the issue of privatization because they are the suppliers of raw material which the millers thrives on.

As the outcry persist in different parts of the country over the conduct of several provincial administration officials who are accused of committing crime ranging from theft of relief food, to corruption and impunity.The residents of South Rachuonyo District in HomaBay County are not spared, they have been left wondering in fear why their area DC John Olekepas and his political bed fellows from the area have chosen to use public political fora to vilify and threaten residents who have secretly tipped him on security matters.

Led by Young Orange Democrats luminaries Aguko Mayora and Omondi Otore, the residents claimed that the area DC’s action depicted him as part of anti-reformist civil servants who is busy serving purposes that are clearly personal and not public.” The DC is not ready to work in consonant with the new constitutional dispensation, he is busy looking for political ways to protect the status quo to propel his political interest in Kajiado in 2012 elections” said Otore.They asked the DC not to get involved in the local politics instead he should try to concentrate on his duties as a civil servant.They further requested the minister for internal security Prof.George Saitoti to intervene and appoint an independent team of detective to investigate the conduct of the DC as members of the public are now scared of passing information to the authorities for fear of being betrayed.

On 18/7/11 the Kasipul Kabondo area member of parliament had convened a political rally at Waradho in Kachien North Location to drum up support for his re-election in 2012.A business magnet from the area Ong’ondo Were got an information from some residents that some youths armed with crude weapons were planning to disrupt the rally and later blame it on him as part of hate and smear campaign against him,Were called the area DC asking him to investigate the claim.The DC who was reportedly in Kisii town a distance of 25 Kms from his area of work is said to have instantly dismissed that information as fabrication and won that the motive of that information was to undermine his authority as head of security in the area.

The Dc who is said to be vying for a political office in one of the constituencies in Kajiado county however, rushed to the rally, instead of keeping vigil or otherwise investigate the allegations,he took to the podium and addressed the crowd revealing to them that he had been called by One Ong’ondo Were to investigate some claims about insecurity at the rally adding that he knew even before he came that he was given a false information and that Were should be forced to substantiate his claim before the District panel.The DC said he was to sermon Were to appear before the District Security team for interrogation the following day.To date the DC has not formally sermon any body over the incident.

The Dc later colluded with a nominated Councilor who the residents have been accusing to have spearheaded the burning of Wire forest during the post election violence to fire residents who are complaining about the DC. addressing a funereal in North Kamagak Councilor Arthur Aoko warned that the area DC will stamp both his political and administrative authority over those who think can undermine his leadership and that of the current Kasipul Kabondo Mp.In another memorable incident last year during the campaign for the new constitution locals got the wind that there were some youths who wanted to disrupt YES rally that was to take place in Kadongo and Oyugis organized by some parliamentary aspirants without the blessings of the area member of parliament.When the DC was secretly briefed by the organizers of that rally he came to the scene closely escorted by the very youths that were being mentioned as suspects the DC instead of providing security dispersed the crowd that was being addressed by prof.Richard Muga as the said youths pounce on innocent people with crude weapon.In another dictatorial move is an incident in North Kamagak where the DC had authorized the prospecting of Iron Ore at God Nyango without consulting members of the community,he even threatened to arrest one Leo Ooro who had challenged the viability of the project.

While addressing several gatherings within the Kasipul Kabondo constituency Aguko Mayora and Otore praised the police for their ethical and professional abilities in handling issues of security.But said they are highly suspicious with the manner in which the area DC is handling his work.”We have a lot of respect to madam(OCPD) and her team ,but not this politician in the name of a DC,we wont surrender to his dictatorial political styles meant to harass and torture innocent residents of South Rachuonyo “said Aguko who was visibly agitated.

KENYA: AWENDO CANE FARMERS BLAMES SONYSUGAR COMPANY FOR DISCRIMINATION ON RAW CANE PRICES AND VOWED TO TAKE ACTION AGAINST THE COMPANY.

Farmers around awendo sugar cane growing zone are up in arms against the SONYSUGR company fr what thy termed as gross discrimination on cane prices. They have blamed the company management for being adamant to increase cane prices.SONYSUGAR is still paying the old price of Kshs 3,128/- per ton.

Other millers are now payment between Kshs 3,950 per ton or even as higher as Kshs 4,200 per ton.

According to a Nairobi based business mn wh is also a cane farmer in Uriri constituency John Bob Awiti-Otange this company is fleecing the cane farmer out of their sweats.

He said that while it is assumed, that management of the organization would be more concern about the prevailing conditions in the market in order to monitor the forces of demand and supply which dictates the commodity price per ton. It is because the company is operating under perfect market conditions where there are several participants with little or no influences on prices by one particular participant.

In this regard,Awiti-Otange stated,” continuity in business would only depend on good hospitality and healthy rates being offered to potential customers who are engaged in the supply of raw materials input to the factory for conversion to finished product.”

“Looking at the current market rates, assuming all factories operate under the same environment conversion cost per ton would be the same as sources of raw materials are same, supplied by nearby out growers next to factory location. All factories have similar fixed and incremental costs in converting raw material to finished product ready for sale.”

And in each factory, one ton of raw material yields 100 kilograms of sugar after processing it packaged in fifty (50) kilograms sold @ Kes, 5,600/-. Therefore, 100 Kilograms would fetch Kes, 11,200/- factory price. Whilst Sony Sugar Co. pays farmers only Kes, 3,128/-

Awiti-Otange said the Direct material cost per ton Kes, 3,128/-, Conversion cost per ton 50% of cost direct material Kes,1,564/-,absorption cost per unit (ABC) Kes, 1,500/- therefore total production cost per ton is roughly kES, 6,192/-Mark up is Kes, 5,008/- which is more than cost of material.

Participants in the market are Kibos Sugar, Chemelil Sugar, Miwani Sugar etc which operate under the same environment with similar market conditions and particularly Kibos Sugar pays farmers Kes, 4,200/- per ton whilst other millers have pegged their prices per ton in the region of Kes, 3,750/- and 3,800/-. But Sony Sugar Co. which is also expected to operate in the same environment and under the same market conditions only pays Kes, 3,128/-per ton. What is the rationale behind this big variation in price per ton paid by Sony Sugar.

While some farmers perceive it as punitive measure inflicted by management to get cost advantage, others perceive as inept management which do not bother to monitor the concept of market conditions to adjust prices to motivate farmers for continuity of supply of raw materials to maintain factory’s operational existence.

CID director Ndegwa Muhoro should save Kenyans the drama!

CID’s Muhoro is leading a team that is currently questioning the Ocampo Six with an aim of prosecuting them in Kenya. Reports indicate that he has questioned Mr Sang, Henry Kosgei and William Ruto. This is a very good move. However, Muhoro is a professional who knows the motive of such investigation at this time are merely meant to distract Kenyans.

I am personally wondering why he is following up on the Ocampo Six while there are others who are still in Kenya who took part in the 2007 PEV. Previously, Mr Muhoro had indicated that the Ocampo Six do not have a case after-all since no police station in Kenya recorded such statements in the police occurence book. He had also said that no one has come forward to report incidences of rape, murder and other human rights abuses witnessed.

I am writing this at the same wondering why the government is now wasting resources to protect the Ocampo Six. There are numerous cases CID and the Police have failed to investigate and prosecute. Even the recent murder of a university student, as well as the murder of the athletic Wanjiru. Robert Ouko murder has never been resolved. Activist Oula and others have not bee revealed as yet.

And now we are waiting for a miracle from the CID to bring to book those who committed 2007 murders and rape, and other crimes against humanity!

Like I had said earlier……….We were being treated to the corrupt haba haba syndrome of political conspiracies machine of boot-soldiers, meant to smear or defraud………which shows, PM Raila cannot make informed decision that which is for the good of the people, except people like Jakoyo Midiwo think and act for him……….Is this the man we intend to vote for as the President of the Republic of Kenya with Jakoyo to represent his think-tan?

This is in many ways the same problem like that which befell the Siaya Women and others in Siaya County, when they were robbed of their victories, and altogether, the hunders (underwear) in the event were ripped off and were suspected to have been taken to “Sunshine Boutique” in Pandpierri, Nyalenda or Kibuye and some may have crossed to Mogadishu. It will be fundamentally crucial and necessary to trace and find evidence of these torn masirualis from these women that were sent to “Sunshine Boutiques”, as revellers of Koinange are of International hawkers, so in addition to consolidate the case, all factors that form part of obstruction and derailment of the New Constitution from taking effect must be included as a package in addition human sufferings along with other cases that are left hugging affecting individual infringements of rights and aggravated theft, should engage the Interpol police and FBI to locate, retrieve and report these masurualis with other pending cases for ease of Ocampo’s consolidated and compressed dossier, would suffice a clean house for take off of the New Constitutional implementation………..

This kind of leadership has exposed many good people to unnecessary harassment and pain, many have been quietly wounded beyond repair and their lands and resources taken by force through Dominion Investment and in Mining and Fishing from in and around Lake Victoria, Migingo and Ugingo. We will never know the truth why some Somali and Mungiki terrorists were left loose in Kisumu and Siaya from Uganda, unless these Interpol and FBI detectives give us true records of their findings……….It is because, where there is smoke there is fire, and corruption, graft and impunity must be uprooted for National Reform Agenda to take root and be implemented in time for 2012 electioneering………

The second myth they have conjured refers to “failure to sign local agreement forms despite several appeals”. These are forms forwarded to me by Isahakia more than one whole year after I had been hired. The forms sought to fundamentally change the terms of my employment. My remuneration, allowances and benefits were arbitrarily reduced by half.

I had written to Isahakia and the Head of Public Service, Francis Muthaura, that I couldn’t sign the forms unless and until they amended to reflect what I had been offered and I had agreed to.

The terms I had agreed to were identical to those of the advisor of President Mwai Kibaki on constitutional affairs, Kivutha Kibwana. I have never received a response to my letters demanding those amendments. Indeed, I have filed a case in court seeking compliance with the contract. The trial is scheduled in a few months.

Is this claim valid? Is it supposed to be the means somebody has devised as a response or “defence” to the legal action, which incidentally, the Attorney General has not responded to? I have now seen that Hon. Midiwo is claiming that I have no legal or constitutional right to sue for my interests. I am not sure where he gets that. But one thing is clear: Jakoyo’s comment was either actuated by malice or ignorance of the law, or both. More fundamentally, I don’t see how it is Jakoyo’s mandate to determine whether I keep or lose my job. And he does so through the media.

Kenya: Acute shortage of cane has forced one of the sugar factories in Nyanza to sack 100 workers

UNCALLED for and unwarranted cut throat in competition in he price of row cane as well as undercutting and undermining of each other is likely to force several sugar factories operating in the Nyanza Sugar Belt to close down.

One of the factories, Chemelil Sugar Company, which is believed to be the best managed and the most vibrant facility has already sacked close to 100 f its workers as a result of the acute shortage of mature cane currently being experienced in the region.

In the past few months, Chemelil has reported experiencing acute shortage of cane within its cane harvesting zone, prompting to operate below its capacity.

The company’s Public Relations manager Salim Bakari said the factory had been forced to operate for only three days a week since they have to accumulate cane for two days to have the amount required for the week’s production.

He said when the situation was ideal, Chemelil factory used to run for 24 hours a day throughout the week and only close for one day maintenance a week, but the cane shortage has brought about a very grave situation,” said Bakari.

Under the normal conditiond, Chemeil factory has a production capacity of f about 3,000 tones of sugar per day, but this had now dropped to only 1,000 tons and could even be less in some instances.

The shortage has come about s the result of poor planning on he pat of the government, particularly the Ministry of Agriculture. Out of the four sugar factories situated within Nyanza sugar belt in Nyando and Kisumu districts, one of them the Kibos Sugar and Allied Industries has got no nucleus estate of its own to ensure for uninterrupted harvesting throughout the year, and depends entirely on the out growers scattered in the Kano plains and along the Nandi escarpment.

And once the mature cane in the areas mentioned is exhausted this firm resorted to hawking and poaching harvesting system, even at time poaching for cane from the zones of Chemelil and Muhoroni sugar companies.

Another problem, which need to be urgently resolved by the relevant authorities, is the question of one sugar company trespassing and poaching the mature cane from the zones of the other, particularly the cane crops which were developed with cash loan from one factory, and the money which could only be recovered if the farmer in question delver the cane to the factory that had given him money for cane development. When the cane is delivered to another factory which did not spent even a cent for its development, this hurt the company which was involved in cane development with its money. It cannot recover the money it had loaned to the farmers who deliver his cane t another factory.

Several harmonization meetings have been called and held at the various paces to sensitize the farmers over the need to respect the loan agreements they had signed with the various factories, but all in vain. Those involved in the poaching are arguing that since the industry is liberalized cane farmers were free to sell their crops to whoever is paying them well and promptly. Liberalization, however, is a not a license that one can behave like a rough bull of buffalo and be immunized from paying back cane development loans money.

Among the three factories, which are currently operational within the Nyanza sugar belt, Kibos factory pays Kshs 4200per tone of row cane, while Chemelil pay Kshs 3,750 and Muhoroni is paying Kshs 3,200 per tone. This is what has prompted the cut-throat price competition.

However, rumor is widely spread that some factories could be offering incentive prices, while fleecing cane farmers through the alleged technical adjusted weighbridge. The Ministry f Trade which is responsible for Wight and Measures department, should therefore move with the speed and ensure that all weighbridge used for transacting farmers cane are up-date and without stage managed faults.

A government auditors report about 15 years ago had revealed that SONYSUGAR Company based at Awendo in Migori County had fleeced the cane farmers close to Kshs 210 million in ten years by way of using default weighbridge. This shameless theft was discovered and the company workers who were involved in the scam fired.

This is to say when a farmer delivers 10 tones of cane to the weighbridge, it is technically adjusted to read either eight {8} tons or less. In this cane the farmer loses two ton valued at Kshs 7,600—compared to hundred f farmers who do delivers thousands of row cane to the factory in a day, it could translate into million of shillings within a month.

It is the duty and responsibility of the government to protect the small farmers from being fleeced millions of shillings due to their ignorance. Therefore there is some elements of suspicion the cane famer may be subjected to cheatings through weighbridges hence the booming prices of cane unless the government agencies involved with weight and measure print its authorities on this issue by ensuring that each and every weighbridge transacting cane to he factories are checked at regular intervals.

The government must also come up with a working plan to demarcate cane growing zones for each and every factory. In some places the investors are known to be floating the rules and regulations set by the Sugar Act that a new sugar factory must be established at a place which is more than 40 kilometers from the existing factory to avoid the cut-throat cane price wars now being experienced in the Nyanza sugar belt region of Nyando and Kisumu districts. This is the only sensible way of protecting the workers in the ever ailing sugar industry.

President Obama is an annointed man in a mission for Peace and Unity of common good for all irrespective of who is who, he listens to the cries of the poor and share the pain by sacrificing himself in LOVE to achieve Peace and Unity for all……….he has no sneaky agenda, he is transparent, he sticks and does what he promised to the people, he is a man of the people, he respects Public Mandate and lives up to value and virtue of statemanship in Leadership Responsibility, Dignity and Integrity. President Obama Cares and respects Human Rights concerns, where he strives to provide a balance for survival between the rich and the poor. He puts his life on line to save life irrespective of Nationality, class, colour or race, so to avoid unneccessary human pain and sufferings, as well as avoid acts that could pause or cause catastrophic danger to human kind. He believes in a United Global Peace and Unity for common good of all in a balanced fashion, the fair Give and Take Partnership prospects for a better future for all. He believes in Faith, trusting that, with availability of conducive environment to CHANGE under good governance of democratic rulership with Just Rule of Law, all people, poor and rich, if united for a good cause for humanity, are able to meet challenges of Global competition without conflict of interest, or over-burden the poor to ultimate Poverty Death- Bed……

You cannot equate the above with PM Raila who is sneaky, greedy, self-centred, corrupt and not transparent, does not like to work with intellectuals or professionals to achieve good results for progressive development, does not keep his political promises for public mandate in the National Reform Agenda, does not believe in New Constitution or Majimbo Federalism instead to curtail public trust, works behind the curtain with enemies of public to scuttle Reform Agenda through his boot soldiers both inside and outside to derrail Public faith, faith and confidence, maneuvering activities that are causing untold human sufferings and pain, including loss of lives, largely to the majority people of Greater Luo Nyanza through ripping off their resource and wealth for himself.

Miguna Miguna is a professional on hire who was entrusted to provide a balanced legal advice for Unity of Purpose in the Coalition Government under Prime Minister Office. Within the Legal framework, he had a duty to sieve the Grain from the Chaff, believing in Public mandate and the delivery of the National Reform Agenda in a timely basis………

Therefore to equate the two, I can probably give ratings according to service performance,

Someone who have failed in performance ratings is not competitive and cannot deliver service to public sustainably therefore, PM Raila MUST BE SENT HOME………..!

Five basic components to share about PM Raila………..this is why a smart thinker will deal with Raila on facts and Truth alone………..Raila cannot be trusted, he is not a good manager, the reason he could not face Miguna Miguna in the face and sack him, but sneakily have his pycophants deal with Miguna while he turned his back facing the otherside, pretending he does not know what is going on while he was away…………. therefore it can be summarized as:-

1) that PM Raila has failed as a statesman for the top position in the Country, to be a potential Presidential material, because he is greedy in many ways, is selfish and self-centered who from the begining loathed working close with those Luo successful entrepreneurs or Professionals as well as those who are principled with independent minds in Development. It is an open truth that can be attested by the naked eyes and does not need elaboration or debate. To remove Miguna Miguna, is another tricky way Coalition Government sheme to engage to kill the case of Ocampo six as it is gaining momentum by the ICC……..Jakoyo Midiwo is hanging on to save Uhuru’s neck with the Ocampo Six, a contract to save his face in the midst, that if the New Constitution takes root, Jakoyo will miss his chance to stay in the Status Quo as well, his illegal lobbying deals will loose out……… that if Ocampo six stays, the Old Constitution also stays and sure enough, Jakoyo is done and out………..

2) Land matters are so twisted that many will not escape……..Lake Victoria, Yala Swamp including Kano Plains, Lamu Ports with its environs, including Turkana with its environs, along with other Public, Private, Family and Community lands have been sold and targeted for unscrupulour corrupt business undertakings and business expansion……….the corrupt are not able to explain to public or defend………

3) that GMO is truely harmful to human consumption, and is a slow killer and food poisoning causing other unhealthy bodily syndroms, and as well, because of the high toxic hazardouse contents, it is capable to destroys and kill soil nuitrients also pullutes water from its natural soil purity,…….. if produced for food consumption, chances are high risk of diseases, costs of maintanance on both health and fertilizers will be too costly, end food products will equally too costly and unaffordable, since food for consumption will compete with food for Aircraft in petro-dollar market………..it is also a serious risk to the environment ……….therefore, in the “Free Market Business Entrepreneurship” the local peasant farmers stand to loose big time…..as top dollar earner in the Global market sale will be laughing all the way to the bank, as they will be supplying in potential high demand for Ethanol oil for Jets and other Aircraft…………. So the unscrupulous special business interest with their cohorts will use GMO to help with the slow puncture of elimination of greater Luos with POPULATION REDUCTION, and it is equally very sad……. Luo Nyanza has been targeted by PM Raila for his greediness and self-centeredness, so to expand his supply for Industrial raw materials and also gain free ownership of Traditional and Community lands in smart thinking, known as “Intellectual Property Thieving”

4) Now, Since Raila at the time, desparately needed someone urgently for brainpower to help him wade the PNU factor in the coalition Government, he sought for Miguna Miguna services on the Reform Agenda handy to give him clout so he can stay afloat above his political opponents, and because he so desparately wanted to be the most powerful President of Kenya and Africa. These are reasons he stub his father on the back. Raila in actual sense does not want CHANGE……Raila does not fear messing with people’s unity and peace as long as that will provide him with an opening to offer comfort to his family members and twisted psycofants, who are able to do dirty jobs for him, not for the community gain, but greed and corruption for selfish ends.

5) Both the two principles and team of pycophants do not want the New Constitution being implemented, so people can have the Majimbo, Federalism Governership, where there is devolution of power in the Counties, the reason his pycophants are messing with the women in Siaya local elections so they can have their henchment with unscrupulous business cartels to be in control of those positions so they can pursue their Status Quo agenda of corruption, graft, impunity, sell of “Top Skin” (to finish human natural fire and water) necessary to sustain Luo’s natural Industrial Area for human production………

Miguna Miguna got proof in the eating of the pudding, where he was releaved off his duties, without empathy or consultation nor notice, but along with his office staff, he was sent away packing by Miguna’s juniors, through the media, short notice from PM Raila’s Office, a public office paid by taxpayers money. How can you then convince me, Kenya will have a balance of Development in a Progressive environment with challenges in Kenya’s Market-Place and Abroad if PM Raila becomes President if, we will not see dust………..with his usual Mbwa Kali at the gate……!!!……..Do you think, in this short stint, Raila was able to demonstrate ways and means to achieve NATIONAL REFORM process or secretly destroying humanity……… which is a Violation and Crime against Human Rights ………..is this the Will and Purpose of Creation…..????…….How will he do it Better if both Him and Kibaki have failed………???……..instead of burdening public, they should have a visitation at the Hague first, why there is too much hunger and poverty when money is donated by the world including USA to safeguard poverty and hunger…..why is it just them, that have more filling and their cups are overflowing…..???

Is this not Leadership through endengerment of Slavery……..??? We have tasted what Raila will make it to be, so even if he becomes as strong as Hercules with all the money in the world, we will be satisfied with our poverty and all LUOs except his pycofant will vote for him this time round…………We have better people to Represent Gem Constituency and not Jakoyo Midiwo. If Kenya have a Responsible Government, it will regulate Religious moral activities to maintain their place in the society and separate Religion from income generating activities that are created to improve lives for the Member Society of the Church………those like any other income business activities have their apportionment policy of shared sacrifice in the community, to pay their share in Revenue Taxes ………. and no leader would just bubble out in public irresponsibly without understanding what or how they are expressing public issues without thinking…….What comprihensive package for Religious taxes is he talking about……to fill the gap of stolen money and facilities including Treasury Bonds they misused their self businesses??? who do they think are stupid to pay their debts they privately consumed not doing Government work but private…..?????……….These are the very reasons why they kicked Miguna Miguna unceremoniously………….Surprises are in the offing people……We must clean the house for a FRESH START……..!!!……..

Miguna Miguna is right in sending such text to Raila, and Raila’s quiteness proves he is guilty in sacking Miguna unproffessionally and without good cause, where Miguna and his staff rightly need their compensation settlements by all means, contract must be honored………this PM Raila cannot escape…………

Jakoyo Midiwo, Oburu Odinga, James Orengo, Mohammed Isahakia, Isaack Hassan, Alfred Mutua, Francis Kimemia and Raila Odinga himself.

Prime Minister Raila Odinga’s sacked aide Miguna Miguna has now taken on the Premier himself after he send the ODM leader a terse text message expressing his anger over the decision to terminate his employment.

The Premier received Miguna’s commanding text message last night but did not respond to it.

Miguna is said to have made frantic efforts to call the Premier who was not responding before dropping a tough worded text message on the PM’s cell phone.

In a message seen by a Kenyaradarlive Reporter Miguna is accusing the Premier of unnecessarily intimidating his staff.

“Jakom, good evening! Those who are publicly abusing and undermining you and the party like Dualle,etc are sacred,

Those looting and plundering public resources are cosy. But I who have sacrificed so much and defended you and fought for you and what I’ve believed to be higher ideals is sacrificed so inhumanely. For What?, “he writes.

And the long text continues, “I who has gallantly stood up to the merchants of impunity is cut loose! Does anybody think this is the way to win elections? Does anybody believe that I have done anything? And so my staff is fired summarily without due process”

And Miguna goes on, “I have not even received the letter or any other official communication about this. Is this Justice? Is this the change we’ve sacrificed our lives for? Awuoro Awuoro God bless you.” Raila’s office has set up a team to investigate the activities of Miguna Miguna described by the premier as very disturbing.

The team to be led by PS Mohamed Isahakia and Chief of Staff Caroli Omondi will start work in a week’s time.

But sources close to Miguna also said to be holding a Canadian passport revealed that hard talking lawyer who threw spin left and right against the PM’s opponents is contemplating flying back to Canada to continue with his legal practice.

“The attorney will not appear before any investigators on this matter of fabrication,” said a confidant.

IIEC puts multiple-party members on notice

Shock awaits voters who have registered themselves in more than one political party as the new electoral reforms take shape ahead of 2012 general election.

This is part of the radical changes to be effected by the Interim Independent Electoral Commission (IIEC), as it moves to help parties instill electoral discipline.

All parties will now be required to provide a list of its members, which will be run against each other to rid them of double registered voters.

Over the years, some voters had formed the tendency of registering in more than one party to benefit from their development programmes.

But that is now set to end as IIEC moves quick to fast-track electoral reforms in liason with the political parties, (IIEC) Commissioner Ken Nyaundi disclosed.

“We have consulted with the parties to weed out electoral mal-practices before they hold party primaries next year,” said Nyaundi.

While inducting voters on the role of elective offices in the Constitution, in Kisumu, Nyaundi put voters on notice to guard against electoral malpractices.

“The era of electoral double standard is over. We will help the parties to hold free and fair nominations and we are glad they are supporting us,” said Nyaundi.

In the past, political parties primaries were marred by acts of hooliganism and violence triggered by disorder because the parties did not have clear list of bonafide members and structured format to conduct the polls.

This paved the way for non-party members to infiltrate others’ affairs to disorganise their arrangement causing people to fight. The IIEC commissioner rooted for peaceful elections in 2012, asking voters to smart from their past misdeeds.

“Always be a peace messenger, moreso during electioneering period,” said Nyaundi.

I did not realize, until after you had received the funds, that they were in Kenya Shillings. I automatically assumed (I now realize that my assumption was mistaken) that the three Drafts were in Canadian instruments. No more DRAMA, in summary, lets hit the nail on the head and solve the puzzle……..!!!

Corruption, Impunity, Graft, Mungiki, Somali Mafia & Al-Shabaab, Kibaki & Team, Raila & Team = (equal to) Goal Keeper Hassan…….It is therefore rumoured that remnants of Al-Qaeda and Al-shabaab is receiving material support in form and kinds from Kenyan Politicians for their security over Public’s stolen Wealth and for electioneering back-up……the reason Raila cannot work with independent minded Professionals, unless “Micky Moused” like Prof. Anyang Nyongo, who is easily compromised to pooh in his professionalism…………the reason Hassan is the Goal-Keeper of the whole episode, and why he is put at the Election Commission….Like I said before, and I repeat, they are all FOOLS as the world is watching details of their scheme……..and so Raila and Hassan cannot also stand Mary Angawa as the Official Judge in authority…….

Kano Community is one such victims just like Turkana who are being robbed off their land and wealth in a political schemed attacks to get rid of them from their land for unscrupulous investors……….people in Yala Swamp are equally victims, as their land is stolen from them by Dominion Investments who are dealing in GMO, the Genetically Modified foods which are essentially for ETHANOL PRODUCTION, but are not for human consumption……..is the reason for Molasses Plant expansionism for ease of products’ Raw Material supply……….This plan does not give a balance to human survival except for self-centred selfish business Political cartels…………

Miguna Miguna out of Raila’s Team

Prime Minister Raila Odinga on Thursday suspended his advisor on coalition affairs Miguna Miguna over gross misconduct, abuse of office and harassment of junior officers.
According to the suspension letter, the outspoken advisor will not be entitled to any pay for the entire time when he will be suspended pending investigations into his conduct.

Dr Miguna, who has served as the PM’s advisor since 2008, was on Thursday suspended and has also been asked to hand over all his assignments at the PM’s office to the Secretary Administration and also surrender all government assets under his custody. He was privilaged to have to his access a government car, drivers, body guards, government house, other public wares and also a plum salary.

In a letter read by the PS from the Prime Minister’s office said in part that his advisor was suspended over gross misconduct, abuse of office and harassment of junior officers.

“I have been instructed by the Rt. Hon. Prime Minister that you be and are hereby suspended from performing your duties as the advisor, Coalitions Affairs with immediate effect,” read the letter written by the Permanent Secretary Office of the PM, Mohamed Isahakia.

Dr Miguna is known for his fiery attacks against foes, real and imaginary, in a weekly column in The Star newspaper. The last straw came in an article he wrote on one of the local dailies, last month, criticising the leadership of the Interim Independent Electoral Commission chairperson, Issack Hassan.

In the article Dr Miguna said that Mr Hassan did not deserve to be credited for the IIEC’s successes calling him a poor leader who he claims can’t manage presidential, gubernatorial, parliamentary and civic elections with a ten metre-long ballot paper, said the article.

Previous occasion especialy the past two years part of the problem within the coalition government can be attributed to the poor working relations between Mr Miguna and his counterpart in President Kibaki’s office, former cabinet minister Kivutha Kibwana.
Other long running public confrontations have been with one of Deputy Prime Minister Uhuru Kenyatta’s fixers, fellow Star columnist Moses Kuria.

Even though the attacks at times could be justified, some of the complications out of the public activities of such figures is the assumption their utterances and writings represent the views of their employer. Therefore Mr Miguna’s attacks have been presumed to carry the Prime Minster’s approval, just as Mr Kuria’s assaults from the other side have come to be associated with Mr Kenyatta.

That probably explains that when it became apparent that Mr Miguna was part of the campaign against Interim Independent Electoral Commission boss Ahmed Isaack Hassan, his position became untenable.

“As a lawyer, Isaack’s record is patchy. He isn’t a good courtroom lawyer, nor is he a good drafter or negotiator. In fact, Issac isn’t quick on his feet. He floundered badly when the ‘red brigade’ invaded the Bomas of Kenya where the IIEC was releasing results for the referendum,” read Dr Miguna’s article.

“If he couldn’t handle such a simple electoral exercise, he certainly can’t manage presidential, gubernatorial, parliamentary and civic elections with a ten metre-long ballot paper,” it added.

He further accused Mr Hassan of abusing his office when he recently declined to de-gazette 34 nominated councillors as had been requested by the Orange Democratic Movement.

In the article, Dr Miguna also said that the IIEC chairperson did not deserve to be reappointed as the head of the yet to be constituted Independent Electoral and Boundaries Commission (IEBC).

“People tend to serenade Isaack with all the successes of the interim electoral body without asking whether those praises are well deserved,” he said.

However Mr Hassan has not been the only one who has also received Dr Miguna’s backlash.

Former President Daniel arap Moi has also found himself on the receiving end with Dr Miguna criticising his leadership style.

Dr Miguna has also been at the center of a dual citizenship controversy, being a holder of a Kenyan and Canadian passport, although the law effecting this allowance has not yet been enacted.

Several political leaders had asked the Premier to suspend his advisor over the issue until his citizenship issue was resolved.

The politicians also asked the PM to open criminal investigations against Dr Miguna.
Reports indicate that he went on a self imposed exile in Canada during the former President’s reign before returning to Kenya in 2007 when he even attempted to run for the Nyando Parliamentary seat but lost.

Understanding Miguna Miguna putting Things in the Perspective

For those who don’t know, Star columnist Miguna Miguna is a civil servant, paid by the tax payer’s money, and is not an Orange Democratic Movement (ODM) official or spokesperson. He is the Kenyan Prime Minister’s adviser on constitutional issues and coalition affairs. Full stop!

Many of Miguna’s detractors always respond to his writings in a way that depicts him as speaking for the ODM. For the record, ODM has its officials and a CEO, Janet Ongera, who speaks on its behalf. As far as I understand journalism, the opinions expressed in Miguna’s columns are solely his and not those of his employer or boss’ party.

In the Star newspaper of July 25th, one Abdirizak Arale hit back at Miguna for the article he had written the previous week, saying that the Chairman of the Interim Independent Electoral Commission, Isaack Hassan should not hog all the praise for the success of the body so far in the handling of elections in the country from the time it was created to date.
Whereas he accuses Miguna of writing in bad taste, Abdirizak himself makes many sweeping statements without any substantiation. He says for instance that Miguna’s article was motivated by “ODM’s disappointment on the handling of the list of councilors that Miguna’s party wanted deregistered and the fact that Isaack could not be manipulated by ODM to bend the law in its favour.”

As I pointed out earlier, that fact is wrong. Miguna is not and has never been an official of ODM. The fact that he advises the party leader, Raila Odinga, who also happens to be the Prime Minister, does not make him a spokesperson of the party. Abdirizak needs to get his facts right.

In the same vein, Abdirizak makes some statements that if left unchallenged, will not augur well for peaceful co-existence and harmony in this country. In his defence of Isaack, he makes a general statement that has no basis. He says that Miguna’s article is “a clear manifestation of the hatred that Miguna, ODM and its leadership has for Somali professionals in particular and professionals from the pastoralist communities in general.”

This is stretching the argument too far without any solid basis. How do comments made by Miguna represent the feelings of ODM and its leadership? Surely, Abdirizak needs to get serious. He is accusing Miguna of hatred yet he himself is exhibiting signs of intolerance. What Miguna did was to question Isaack on certain aspects of his life. Is there a crime in doing that?

That is freedom of expression and no one has any right to interfere with it. Abdirizak may not be comfortable or even like what Miguna says but he should let him talk and express himself. After all, Isaack is an official serving in the public domain and the public has a right to question him in the discharge of his duty.

I agree that Miguna may have gone too far and seemed to be attacking the person of Isaack but that does not amount to an attack on the Somali or pastoral communities. Abdirizak and others should desist from dragging the names of their communities and tribes into issues whenever they are being questioned or interrogated.

In his article, Abdirizak further says that “if ODM was to have its way, no single professional from pastoralist communities would hold any constitutional office in this country.” Please! Looking at the appointments for ministerial and assistant ministerial posts that were made from ODM into government, one sees that Abdirizak’s argument holds no water at all. Members of the pastoralist communities were well represented.
In the latest appointment for candidates to spearhead the selection of new commissioners to the Independent Electoral and Boundaries Commission, the Prime Minister nominated Dr. Ekuru Aukot, a member of the pastoralist communities.

We also have other examples from other areas of great public interest in this country which exposes Abdirizak’s opinions as having no solid foundation. In the recent by-election that was to take place in Kamukunji in Nairobi, ODM’s candidate was from the Somali community. So where does Abdirizak’s opinion come from?

I wonder why Abdirizak is taking it upon himself to speak on behalf of the pastoralist communities. Are they special in any way? Does it mean that any person from a pastoralist community who applies for any office in this land should not be questioned and interrogated about their past performance in public life?

Abdirizak accuses Miguna and ODM of nepotism and cronyism while in the same breath he vouches for professionals from the pastoralist communities. Why does he only speak of the interests of the professionals, who are as elitist as he is, instead of speaking for the general good of the pastoralist communities as a whole?

In actual fact, I think that Abdirizak is not speaking for the good of the common man in the pastoralist communities, but rather, he is speaking for a few elite in that sub-group of Kenyans. Basically, they want to hog and protect what they can in the name of speaking for their communities.

By attacking Miguna using wrong facts, many people, even those endowed intellectually, end up exposing their ignorance of facts in the public domain. And I suspect Miguna enjoys seeing them making fools of themselves in the eyes of the public.

It is absolutely wrong for one person to vilify another person using wrong facts, the way Abdizirak has tried to do with Miguna. He should not drag other people and other groups into an argument that is purely between two people. Unless Abdirizak is a broker speaking for vested interests, he should try to get his facts right to support his opinions. Otherwise, let him keep the peace.

“Tact” is always thrown around when something an adversary did is described.

I did not see ‘tact’ being a adjective to describe mafiyan arrogance, with examples galore.

No where has Hon Miguna said anything without backing it up factually.
I like dealing with facts, not with some amorphous entity.

And yes as all of you can see, no one can break down Hon Miguna’s arguments, not only in this article but in the previous ones posted.

Lets face it.
His brilliance is self illuminating. He writes YOU READ!

Kenya: Postponement of AKR elections

We have noted as the outgoing committee with great sadness that some Kenyans have decided to circulate email calling for elections of AKR against the advise our high commission with false claims of refusal to be housed!

We are of the view that a leader or one aspiring to be a leader has first to respect others, We wish to request Kenyans of good will to keep off that meeting and follow the advise of postponement of AKR elections as earlier advised.

We also advise Kenyans that anyone wishing to register as a member of AKR should be patient and wait for the contentious issue of membership to be addressed

We urge all Kenyans to stick with our government representatives here in Rwanda because that is our point of unity.
