Kenya: Atwoli’s views on the laxity and complacency of MPs from Kenya regions is right

Commentary By Leo Odera Omolo In Kisumu City

The sentiments expressed earlier this week by the Central Organization of Trade Unions of Kenya {COTUK} Secretary General Francis Atwoli against the MPs from Western Kenya were not in vain nor destructive, but an awaking calls for our legislators to pull up their sacks and work.

The stinging and scathing criticisms of our MPs accusing them of laxity and complacency when it comes to the question of development were genuine and very constructive. The two regions of former Nyanza and Western Provinces are yawning for development, job creation and poverty eradication efforts,

The COTU[K} chief delivered his hard-hitting criticism of the MPs from Western Kenya last Monday during the National Women’s Committee Leadership Workshop at the Tom Mboya Labor College, Kisumu.

H blamed the MPs from Western Kenya regions for engaging themselves in endless empty political slogans at the expense of development. His views represent the true picture of what is going on the ground. It is also a clear testimony that our legislators are not genuinely serving the interests’ of the electorate, but their own selfish interests which are outside their mandates.

I am in total agreement that our MPs must wake up, initiate the genuine efforts on poverty eradication, building rural economic infrastructure, which have the direct economic bearing, which could be of great beneficial to the electorate instead of useless political gimmicks. The residents of the regions have heard enough these empty political slogans and sycophancy.

Truly to Atwoli sentiments, we have not heard from the Luo-Nyanza region talks about the possibility of reviving the collapsed industries in Kisumu City such as Kicomi [1985] Ltd, Kenya Breweries Plant in Kisumu City, Kibos Industries and many other medium and small scale manufacturing industries. Nearly all closed down ten years ago.

In fact, Kisumu City is the only town in the Republic of Kenya where there is not even one single functioning industry. The closure of the town’s large and medium size industries had spilled out thousands of jobless youths to the town’s streets and has since become life threatening phenomenon.

The Kenya Breweries plant and Kicomi {1985} Limited had a combine labor force of more than 5,000 workers. All these people were sent home permanently on redundancy’ and there is not the lightest hope of their reinstatement in the near future.

Another important facility which closed down about the same time as Kicomi and the Kenya Breweries plants was Miwani Sugar Company, which left and abandoned its workers as destitute in an overgrown and living camps and estates full of venomous snakes and other dangerous varmints. It went under while owing the workers millions of shillings in unpaid wages, and most of them could not move out of the company living camps due to lack of money for bus and Matatus transport fares back to their rural homes.

A series of meetings called by the MPs and leaders in Luo-Nyanza mainly to strategize on these contentious issues have all ended up with deliberations on matters of national politics and next presidential elections, but nothing tangible touching on economic empowerment of the residents of the region.

We have not heard our MPs putting up argument demanding better return for the hard working fishermen in Lake Victoria. And yet the fishing and fish trade in this region has of late become one of the greatest national assets minting billion of shilling in the much required foreign exchange.

Nobody in this region is talking about the revival of cotton one of the most lucrative cash crops with ready market out there. The last time Nyanza produced many bails of cotton made were in the years 1937, 1952 and 1957. The existing AGOA agreement between the giant US and the African nations has availed ready market for cotton, but its production has dwindled to the near extinct point.

Many parts of Luo-Nyanza are endowed with good annual rainfalls and distribution, but due to lack of incentive and encouragement from political leadership the region’s agriculture is being given only lip-service. This confirms that development agenda is not within the vocabularies of Luo MPs.

When the immediate former Rarieda MP Raphael Tuju struggled hard and initiated tangible development efforts in his constituency with far reaching effect on the population, he was simply dismissed by his FELLOW Luo parliamentary colleagues who branded him as someone who is serving the interest of the Mt. Kenya politicians.

The same group have now focused their attention on remarkable achievement of the abreast talking Ndhiwa MP Joshua Orwa Ojode whose sixteen representation in Parliament of an area previously regarded as one of the most backward parliamentary constituencies in Nyanza has turned around the area to be the bastion of massive development and food production.

In every election time, the anti Ojode elements within the ODM caucus have lost no chance of sponsoring candidates to derail his chances of recapturing his Ndhiwa parliamentary seat. But the only mistakes of Ojode’s enemies is always backing the wrong aspirants with no credibility. This has given the hard working MP who is also an Assistant Minister for Internal Security leeway of winning back his seat.

Whenever the opportunity availed itself for possible brain storming on contentious issues such as how to eliminate the abject poverty among the people, the economic empowerment of the residents of the region, the kind of talks that rent the air are quite irrelevant to the need f the population.

As a matter of fact, the residents of the lakeside region now viewed their MPs as serving them as a bunch of agents of poverty and visionless lots.

The ailing sugar industry has hit the Luos the hardest. All the five white sugar manufacturing plants are located within the region, four of them being established in Nyando and Kisumu districts where the indexes on poverty are said to be the highest

We have not hear even one single voice of an MP from this regions articulating and championing for the woes affecting sugar cane farmers in Nyanza.And where the cane famers are wronged and aggrieved due to the deployment by the government of non-performing managers or those involved in massive lootings.

But what we do hear is that some of the very our leaders who suppose to defend the farmers turns against the in support of such inefficient and incompetent managers that the farmers wanted kicked out. The farmers ends up being the losers at the hands of moneyed managers.

Iin most cases such inefficient managers only serves the interest of politicians and MPs who are allegedly shielding them from being fired, It is the politicians who some time acts as the power brokers and godfather of the inefficient managers in the sugar industry especially those serving their selfish interests . We do hear dreadful rumors of some individuals conducting clandestine operations of power brokerage between the inefficient managers and the parent ministry to ensure the retention of unproductive and non-performing managers. And these are some of the reasons the sugar industry has been baptized as the ‘Milking Cow”.

Francis Atwoli as the Secretary of the Union of the Plantation and Agricultural Workers knows better where the problem lies. He has consistently fought hard for the workers welfare and good wages, but at time finding himself being stabbed at the back by the seemingly compromised MPs.

His criticism of the MPs from Western Kenya is not misplaced, but genuinely timed and as such need to be supported by all level mind and sane people with the interest of the public at heart.

Kenya: Why lynch Mbuvi Kioko? He’s my MP and im OK!!!

I hate mass hysteria. I hate the media, I hate hecklers! I hate all of them with blind passion. How many Simon Wachira's are alive today? Stand up Simon Wachira, KCDF, KWS, National Museums etc. Which Simon Wachira is my friend, you ask me? I'm using him as an example because there are so many people by that name, but only one of them is my FRIEND. Some of you even share names with common thugs and criminals!

I know some people are bitter that they lost. Right, let them go on and threaten Mike Sonko. We the people of Makadara will not just sit by as our MP is being lynched by people that don't have respect or values. They can buy the media, but we people of Makadara know why we elected Mbuvi Kioko, its because he's one of us - and he's one in a million.

If I was Sonko, ningevuruta sehemu nyeti za huyu jangili "DJ" hadi Buru Buru Police Station, myself! Na nimuweke ndani. We seem to forget fast that one day a matatu driver blocked Prof. Obel (the famous herbalist curing HIV/AIDS) and the guy didn't even negotiate, he just whipped a gun and shot the driver! In Nairobi, everyone shudders when someone pulls by your window or stops in front of you, especially when they number more than one (in the case of DJ). I could have killed them if they did it to me that night. People don't do that.

We all know Mugabe Were was killed by thugs through such tactics. We lost a very promising leader of the people.I personally know how he was a people's leader. We mourned Were, because he helped so many people, just like what Sonko is doing in Makadara. In one stupid bullet, we lost a very hands on MP for Embakasi. As a Makadara voter, I would never want this replicated with my MP.

I know Kenyans (and the world) hate anyone that looks different than what we perceive to be normal, but its the people of Makadara that know what they want from their MP, and we proudly endorsed a young man with vision and direction, a young man with empathy, someone that walks and talks our language. If we really were looking for an angel, none is on earth. We settled on a man that was close to the angels.

We love you "Sonko", let the haters mew, show them what leadership is all about, 2012 you will be the governor of Nairobi while they still stay in bed sweating over spilled milk.

Uganda: Police in man-hunt for a catholic priest who disappeared with a vehicle he had hired

THE Police in Tororo are hunting for a Catholic priest in connection with theft of a car worth sh13m, NEWVISION has reported..
Father Gerald Mangada attached to Kwapa Catholic parish of Tororo diocese allegedly hired a saloon car registration UAL 395T, Toyota Premo in Tororo on September 4, only to sell it in Kampala at sh6.1m before he disappeared.

According to the Police, the vehicle was recovered from the buyer after a two-week search by the Police Rapid Response Unit.

The Tororo district officer in charge of crime, Isabella Amejja, said on Monday that a criminal file No.CRB18/95 had been opened against the priest.

Police records indicate that Mangada hired the saloon car from David Wakela, a special-hire driver in Tororo town.

“The priest hired the vehicle on self-drive terms, only to disappear with it for two weeks,” Wakela said.

Godfrey Okurwon, the owner of the car, said Wakela used to make his remittances on a weekly basis.

“When my driver could neither make his remittances nor trace my vehicle, I reported the matter to Tororo Central Police Station.”

The officer in charge of the Police station, Aggrey Isabirye, said detectives visited the Catholic diocese in Kwapa to establish whether fellow priests there knew the whereabouts of Mangada, but did not receive a good reception.

“The residence was almost empty as the priest had already taken away nearly all his valuables,” said Isabirye.

He said the priest is believed to have left the country.

David Ogwang, a longtime friend of the priest, said he unknowingly negotiated the sale of the car.

“The priest called me to look out for a potential buyer of a saloon car, saying he had an urgent problem,” Ogwang said in a statement to the Police.

Ogwang, who had no reason to doubt his friend, sourced for the buyer who agreed to pay sh6.1m.

In the sale agreement, the buyer agreed to pay sh5m in cash and the rest in three days.

“The buyer agreed to obtain the logbook of the car upon clearance of the sh1.1m balance,” Ogwang stated.

He said he only discovered that the sale was fraudulent after the buyer paid the balance. For days, he tried to trace the priest, both physically and on phone, but failed to get him, he narrated.

“The car buyer gave me a lot of headache yet I could not trace the priest.”

He said one of the priests informed him in confidence that the priest had disappeared.

Ogwang said he later learnt that the vehicle did not belong to the priest. “I could not believe that Fr. Mangada could engage in such an illegal transaction,” he said.

Ogwang said he immediately reported to the Police.

“I was compelled to sell my new RAV4 car at sh12m to pay the buyer,” he lamented.

Okurwon said he recovered his car at Old Kampala Police Station but added that he was unhappy because it was damaged.

Okurwon has demanded over sh4m from the Catholic diocese of Tororo as compensation for the damage.

“I’ve had audience with the authorities of the Tororo Catholic diocese but they insisted that they had to consult their lawyer,” said Okurwon.

Efforts to get a comment from the Catholic church in Tororo were fruitless. Archbishop Dennis Lote Kiwanuka declined to talk to the New Vision reporter who visited the diocesan office at St. Peter’s College, Tororo.

KENYA: PEOPLE WILL NOT BELIEVE ANY CENSUS RESULTS

The Kenyan population census results released at the end of August 2010 leaves a lot to be desired, especially, that of northern Kenya districts. With the passage of the new constitution and the expected incoming of the county administrations at local level, one would expect the Kenya National Bureau of Statistics to be robust in their work, in particular, that of the census.

According to the government experts the population of the 8 affected northern Kenya districts was projected at about 1.4 million but the actual census results had put it at 2.3 million, with a variance of 0.9 million. Due to the huge discrepancy between the estimated and actual, Hon. Wycliffe Oparanya, minister for Planning and National Development cancelled the results.

The Kenya National Bureau of Statistics should be honest enough to share with Kenyans what happened in other districts. After a closer analysis of the census report, one would conclude that, the government policy makers are only interested in justifying the population increase in terms of births. The government experts should discuss in public the effects of immigration and its wider impact on the national demographic patterns. The variance between projected and actual population in northern Kenya could have been as a result of legal or illegal immigration from the neighbouring countries. Everyone knows that immigration is the issue in northern Kenya but the government is unwilling even to acknowledge that it exists. One would be interested to know how many foreign citizens are living in Kenya. Immigration is of such importance to the national and local county planning and resource allocation that the local administration in future ought to know the true population of their areas. Until that time that the government becomes transparent enough to give us all figures, people will not believe any census results.

INTRODUCTION: THE NEW AMERICAN –KISUMU DREAM

John F Kennedy the 34th American president;

Stated this in Ottawa Canada in 1962:

The future of all mankind.”

The American corner has made us neighbours.

And American corner has made us friends.

Through American corner,

We have shared common values

And common aspirations

“Writing like all representation is never innocent To write about anything is explicitly or implicitly, to delimit, uphold, expand or challenge how it is perceived and constituted. Never is writing ever natural. We write from a particular position, inhabit particular discourse, which the very act of writing itself seeks to validate.”

The Lake Victoria Basin Film Makers Guild (Kenya) was founded to facilitate the training

of stakeholders in the film industry and equip them with professional skills in scripting and production film in a channel for the promotion marketing and distribution of films from the region. Lastly to identify, preserve and promote filming sites within the region

Our vision is to make Lake Region a centre of excellence in film making. Our mission is to produce competent professionals capable of producing films that match International standards.

I here quote the 6th American President John Quincy Adams. He stated that “If your actions inspire others to dream more, learn more, do more and become more, you are a leader”

The creation of American Corner has inspired our children. It has prompted us to dream more, to learn more. The American Corner has made reading exciting, enjoyable and pleasurable for the children, learning through audio-visuals has promoted active reading for the children. “What an investment for the children?”

The Lake Victoria Basin Film Makers Guild(Kenya) and the Kisumu Area Library signed a memorandum of understanding to manage resources at the American Corner related to artistic cultural and film making. As a result of the M.O.U the American Corner Management Board was established. The Board seeks to create a forum where noble ideas and talents are recognised and be rewarded The 1st Regional Film /Theatre Awards is planned for the December, 2010.

The Film Guild came into being during the 1st International film workshop in September, 2009 coordinated and sponsored by the US. Embassy and the Kenya Film Commission. We are also today celebrating the birth of the Film Guild and the American Corner Management Board. It has been a long journey. Thanks to the American Embassy.

ARTS AND THE AMERICAN CORNER

Art will play a critical role and generate community participation in the Library’s affairs bringing people to the library for serious public discourse through the medium of public talks, story telling, poetry, workshop ,festivals and exhibitions.

Arts are integral to life of the traditional African society, giving worth to individual and community and therefore reinforcing their identity within their communities. Arts as opposed to the other medium have profound bearing on all aspects of our lives, from spiritual to mundane.

Arts, have since time immemorial have been related to the sustainability of society in its various manifestations. Education, access to it and its practice are vital components of any working society. Education is a vehicle that allows for the development of society and it’s enhancement in various ways.

The Film Guild and the Board seek to promote good writing criteria known as the four C’s- CLEAR, CONCISE, COMPLETE and COURTEOUS. EDUCATION plays an important role in the transfer and transformation of cultural values and practices and Paulo Freire stated Literacy therefore........ is to understand what one reads and to write what one understand”

The film form will be utilised in the transfer and transformation of education and cultures in our countries.

Then what is film?

A film is a story that comprises of two critical issues that is the DESIRE and the DANGER, what then is desire? Desire is human kind’s yearning for happiness, while the danger is something that threatens life. And emotion is actually the inner driving force that powers action. Thus, the drive of desire is life’s blood of every film and the danger the heartbeat.

THE BOARD strives to promote film industry as new form of employment creation for the youth. This industry needs support of the well wishers. For the films to have effectiveness, they must have freshness, dramatic implications and emotions. We would want to tell our stories candidly and authoritatively of the stories not told before. Films enabling us to learn more and we will do more.

We are happy today as we are celebrate the 1st Anniversary of the American Corner, the American Embassy has inspired us and have made us to dream more. The former president John Adams Quincy stated before. The regional film industry no longer is a daunting task, now that American Embassy has come to our aid. We need to harness the local talents. The new industry is now going to be realisable.

The region is endowed with unique and spectacular filming sites. The Board needs documentation facilities to realise its vision and mission. Film and theatre have become major forces in the education and development. The industry will go along way in empowering the people with critical information, opportunities and chance to examine attitudes through active learning methods. “The art provide a whole range of feelings and its knowledge is as a culture bound as language.”

CHILDREN AND STORYTELLING CULTURE

American corner has created a forum where children could tell stories more often than not. Stories have an amazing ability to stimulate our imagination. Through stories we travel to distant places and see strange and wonderful sites.

“We take part in adventures and feel the joys and sorrows that are a part of them.”

Story telling includes fables, fairy tales, folk tales, myths and legends.

The story is one of the oldest human inventions.

EFFICIENT AND EFFECTIVE READING SKILLS

The American Corner Management Board seeks to improve reading skills among children through criteria known as reading efficiency index (R.E.I) we intend to work on the rate and comprehension

INTERNATIONAL FILM WORKSHOP

The FILM GUILD and the Management Board express their sincere appreciation to the American Embassy for having coordinated and facilitated the two international film workshops last year the local film makers in the region. Maseno University was also a beneficiary of the workshop. We yearn for more stimulating workshops. The workshops will enhance our skills in film making points with pictures instead of struggling vainly to translate images into verbiage.

Our American film facilitator’s last year were Prof. M.K. Asante, Mr. Scott Galloway, Madam Erin Persley and lastly, Mr. Giancalos Esposito.

Drama, like all other arts forms is ideological, conveys values which either questions or support those prevailing in the society, more than that, drama is not only a product of society but created to influence that very society “asserted Prof. C.J. Odhiambo.”

The FILM GUILD and the Board will utilise effectively the four powers of human communication namely, reading, listening, writing and speaking. The film industry will thrive through quality scripting and new film productions.

PROPOSED PROGRAMMES

The Board and the GUILD have lined up programmes for the American corner. These activities are planned for both children and adults as from October to December 2010

Their is need to establish a new magazine to promote creative expressions. It will act as a vehicle for written exchange between counties and international artistes, film makers, children demonstrating and encouraging regional tourism.

THE CONCLUSION

In conclusion I here quote a famous Japanese philosopher who stated that “The creative mind will do wonderful thing but unless the public attaches value to what has been created, they will always be reduced to toys and jokes. It’s important for those who create ideas, products and unique services, to ensure that the people see value in their creation .This calls marketing and publicity to be realised so that what we do are not reduced to toys and jokes

We are also confident that through the American Embassy our creation will not be reduced to toys and jokes. The film Guild and the Board would like to utilise the power of persuasion and words to promote book culture in Kisumu city and beyond by making the library not only as place of borrowing and reading but also a place for cultural and artistic expressions - A place where discussion, discourse and exchange of views thrives.

The Board will host bi-monthly meetings to review and assess creativity and cultural development. We hope our partnership will flourish and yield sweet fruits for the counties.

Lastly, I would also like to quote the 44th American president Barrack Obama in is speech he presented to the Chicago Council of Global Affairs on the 23rd April, 2007 and he stated that “This was the time when we brought opportunity to those forgotten corners of the world. And this was the time when we renewed the America that has led generations of weary travellers from all over the world to find opportunity and liberty and hope and hope on our doorstep “We the Guild and the Board states here that the American Embassy has bought opportunity and hope on our door step through the creation of the American Corner.

Mahtma Gandhi is a great philosopher once said “You must be the change you wish to see in the world. “ The American corner is the new change from illiteracy to literacy makes the library a living museum a new city where residents value books and cultural expressions. This is the Kisumu we yearned for - the Kisumu we want. We are a new family. As a family we must stand firmly. Let us light up the new American – Kisumu dream.

AMERICA (U.S.A) WAS NOT BUILT BY PROFESSORS

Kenyans,

I have to write this, just because of the mentality we Kenyans do posses. Viewing professorship as and end of education or rather as the best way of attaining leadership in our society rather than as a means undermines a person`s wisdom and sense of balance in the society. Although professorship is a position where somebody reaches after many years of learning, it does not not teach how to handle power or bring development to a low underdeveloped societies we have today in Africa. There is little guidance, wisdom or power in the limited center of professorship To some this professorship is like a dead river, it accepts but never gives. Then after gaining power or leadership it becomes stagnant in a lot of individuals.. But if you look at any society, including our Kenyan one, you will find that the common centers from which people approach life is very different from what professorship institution is all about. Each and every one of human being has a behavior into his brain that creates him or her. So where do I go from here. Guys: here are just a few U.S.A. citizens who have built America but do not have the professorship now our Kenya is demanding in a lot of post and jobs.

1. ) COLONEL HARLAND SANDERS

Creator of Kentucky Fried Chickens (KFC), food chain restaurants now giving a lot of jobs to USA citizens was not a professor.
Born and raised in Indiana Sanders passed through several professions in his lifetime. Sanders first served his fried chicken in 1930 in the midst of the great depression at a gas station he owned in North Corbin, Kentucky . The dining area was named "Sanders Court & Café" and was so successful that in 1936 Kentucky Governor granted Sanders the title of honorary Kentucky Colonel in recognition of his contribution to the state's cuisine. The following year Sanders expanded his restaurant to 142 seats. Now you know what KFC is made of, I need not to elaborate.

2. ) William Henry "Bill" Gates III (born October 28, 1955) is an American business magnate, philanthropist, author and Charmian of Microsoft the software company he founded with Paul Allen . He is consistently ranked among the world`s wealthiest people and was the wealthiest overall from 1995 to 2009, excluding 2008, when he was ranked third. During his career at Microsoft, Gates held the positions of CEO and chief software architect and remains the largest individual shareholder with more than 8 percent of the common stock He has also authored or co-authored several books. WAS NOT A PROFESSOR.

Gates is one of the best-known entrepreneurs of the personal computer revolution. .

Bill Gates stepped down as chief executive officer of Microsoft in January 2000. He remained as chairman and created the position of chief software architect. In June 2006, Gates announced that he would be transitioning from full-time work at Microsoft to part-time work and full-time work at the Bill & Melinda Gates Foundation. He gradually transferred his duties to Ray Ozzie, chief software architect and Craig Mundie chief research and strategy officer. Gates' last full-time day at Microsoft was June 27, 2008. He remains at Microsoft as non-executive chairman. Guys no Kenyan born professor will surrender power like that, he will tell you that he is the one who knows everything, even when his thesis he wrote to get professorship is such a micro (small or thin) that can not be identified by a magnifying lense.

3.) SAM WALTON, from where the Wal-Mart shopping shops springs from was not a professor. Now the it is buying south African`s largest shopping centers.

In 1945, after leaving the military, Walton took over management of his first variety store at the age of 26. With the help of a $20,000 loan from his father-in-law, plus $5,000 he had saved from his time in the Army, Walton purchased a Beb Franklin variety store in Newport, Arkansas The store was a franchise of the Butler Brothers chain.

Walton made sure the shelves were consistently stocked with a wide range of goods at low prices. His store also stayed open later than most other stores, especially during the Christmas season. He also pioneered the practice of discount merchandising by buying wholesale goods from the lowest priced supplier. This allowed him to pass on savings to his customers, which drove up his sales volume. Higher volumes allowed him to negotiate even lower purchase prices with the wholesaler on subsequent purchases. Walton's store led in sales and profits in the Butler Brothers' six-state region. One factor that made this store successful was its central location, making it accessible to a wide range of customers.When Walton bought the franchise from the previous owner in 1945, the store was doing $72,000 in sales annually. By 1950, the store was doing $250,000 in sales annually, due to Walton's ideas and practices.

In 2009, it generated 51% of its US$258 billion sales in the U.S. from grocery business It also owns and operates the Sam`s club retail warehouses in North America.

4.) Thomas Alva Edison not a professor (February 11, 1847 – October 18, 1931) was an American inventor, scientist and businessman who developed many devices that greatly influenced life around the world, including the ,phonograph the motion picture camera , and a long-lasting, practical electric light bulb.

Edison developed hearing problems at an early age. The cause of his deafness has been attributed to a bout of scarlet fever during childhood and recurring untreated middle ear infections .

To build our country we need each and every individual in our society, no matter how low educated you are, talents and wisdom are really learnt in schools, or universities. In fact what makes us human beings is never learnt in schools, it is already inside us.

What a difference real understanding can make? . All the well meaning advice in this world will not spring to a mountain if we are not even addressing the problem we face in Kenya today. We will never get to the real problem if we are so caught up in our own autobiography, our own paradigms, that we do not take off our blinding glasses long enough to see Kenya from another point of view. To make Kenya catch up with USA we need people like; Thomas Edison, Bill Gates, Sam Walton, colonel Sanders and a lot more etc.

Uganda tables a new Bill in Parliament to protect the endangerd Albino people

ALBINISM has been included in the new disability coding by the gender, labour and social development ministry, state minister Emmanuel Otaala said. The minister tabled the National Council for Disability Amendment Bill, 2010, which contained the new list, before Parliament yesterday.

They argue that the exclusion deters them from benefiting from development programmes as they suffer stigma and discrimination.

Albinism is a condition where a person is born without enough skin pigment called melanin. Melanin is a chemical that colours the skin, eyes, and hair. Without it, people look pale and their hair may appear yellow.

In the Bill, the disabled are categorised as sensory disabilities, physical disabilities, including those whose limbs have been amputated. Deformities, including lower limbs, spinal cord injuries, rheumatism, club feet and albinism are also included.

The Bill also seeks to streamline the election of persons with disabilities to Parliament and local government councils. Representatives will now be chosen basing on their political party affiliations in accordance with the multi-party system through the formation of electoral colleges.

“In forming electoral colleges, gender should be taken into consideration,” Otaala said. The Electoral Commission will be required to facilitate the formation of electoral colleges at different levels of government.

In addition, the EC shall appoint returning officers and presiding officers for the purpose of conducting elections of representatives of persons with disabilities.

“Any person with disabilities who meets national standards for elections has a right to contest for any elective office to represent persons with disabilities,” reads the Bill.

At every level of representation, a committee of five members shall have a representative of the blind, deaf, physically disabled, women with disabilities and youth with disabilities.

The district executive committee members shall form four regional electoral colleges to elect four representatives to Parliament and a woman representative, according to the Bill

Kenya: KACC has charged seven including a director of sugar company with fraud in Kisumu

FOR the first time since its inception a couple of years ago, the Kenya Anti Corruption Commission {KACC} on Monday this week charged eight people and a private firm with six counts of fraud, abuse of public office and forgery.

The land mark case involved a former resident magistrate and deputy registrar of Kisumu High Court, a senior government land valuer, two senior revenue officers with the Nyando County Council and a director of Kibos Sugar and Allied industries ltd.

Seven of the accused person appeared before the Anti-Corruption Magistrate Court presided over by the Principal Magistrate Kimemia Muneeni at the Kisumu law court.

The accused persons were two auctioneers Ian Gakoi Maina, John Gitau Maina,a land valuer Phillip Odongo Kabita,two revenue officers with the Nyando County Council,Moses Nyabura Osewe and Kefa Lumumba Atunga, Epainto Okoyo,an employee of Kibos Sugar and Allied Industries Ltd, Sukwindr Sigh Chatte a director of Kibos Sugar and Allied Industries Ltd and a firm called Crossly Holding Ltd

The magistrate made an order that each one of the accused person may be released on personal, but court approved bail of Kshs 5 million or alternatively each be released on cash bail of Kshs 2.5 million.

The seven were charged jointly with conspiracy to defraud. The charge sheet presented to court stated that on diverse dates between May 21,2007 and January 30, 2008 with conspired together with intent to defraud Miwani Sugar Company [In official receivership], of its property comprised in all that parcel of land known as Land Register No 7545/3 situated at Miwani by fraudulently causing the same property to be transferred to m/s Crossly Holdings Ltd.

The seven accused persons were also jointly charged with an alternative charge of fraudulent acquisition of public property.It was stated that between January 2007 and January 2008,they fraudulent acquired public property, to wit all the parcels contained inland Register No 7545/3 measuring approximately 9,394 acres belonging to Miwani Sugar Coimpany [1989]Limited [currently under official receivership] The land is valued at Kshs 2.32 billion.

They also faced a charge the third count of an offence of fraudulent acquisition of public property, a charge which is contrary to Section 45[1][a] 128 as read with Section 36 of the under the Anti-Corruption and Economic Crime Act No.3 of 2003.

Moses Nyabura Osewe a senior revenue officer with the Nyando County Council faced a separate charge that of willful neglect of official duty.

The charge sheet presented to court against the accused states that on January 3,2008 at Nyando County Council office at Awasi Town, Nyando district, within Kisumu County the revenue officer with the Nyando County Council while being the person concerned with the administration, custody and management of public revenue, he willfully failed to collect the outstanding land rent and rates while issuing a Certificate of Clearance of Payment of Rates and other charges in respect of all that property comprised L.R.No 7545/3 measuring approximately 9.394 acres of land situated in Kibos Miwani and belonging to the Miwani Sugar Company [1989] [in official receivership].

Sukwinder Singh Chatte, alias Raju Singh a director of Kibos Sugar and Allied Industries and a firm called Crossly Holdings Ltd, were separately charged with fraudulent acquisition of public property.

The charge resented to court by KACC alleged between May 21 2007 and January 30,2008, they jointly and fraudulently acquired public property, to wit ,all the parcel of land contained therein L.R.No 7545/3 measuring approximately 9,394 acres valued at Kshs 2.32 billion belonging to Miwani Sugar Company [1989][In official receivership] situated at Kibos Miwani area.

Epainto Apono Akoyo an employee of Kibos Sugar and Allied Industry was also separately charged in court that between May 21,2007 and January 30,2008,he forged a letter of consent dated 24,December 2007 purporting to be a genuine one issued by the Nyando District Land Control Board consenting to the transfer of all the parcel of land contained there in L.R.7545/3 situated at Kibos/Miwani areas belonging to Miwani Sugar Company [1989] Limited [n official receivership].

The former resident magistrate Abdulkadir Athman Salim Elkindy faced two counts of forgery and that one abuse of public office..

The first count alleged that on or about the day of 19, October 2007, being a public offcer as a Deputy Registrar of High Court at Kisumu Law Court, in abuse of the authority of his office arbitrary executed a notification of sale purporting that an order had been issued by the High Court for the sale of Miani Sugar Company Limited property involved in High Court covo; case number 225 of 1993, an act which was prejudicial to the Rights of Miwani Sugar Company Limited [In official receivership].

The former magistrate was further charged with the offence of an abuse of office. It was stated that on or about the day of 24th December 2007, being the Deputy Registrar of the High Court at Kisumuy Law Court, the accused used his office top improperly confer a benefit to M/s Cross;y Holdings Ltd by irregularly issuing orders in Kisumu HighCouyrt Civil Case Number 225 of 1993 vesting all properties belonging to Miwani Sugar Company Limited[In official receivership] to the said M/s Crossly Holdings Limited.

All the accused paid cash bail and were released. They were represented by a prominent Kisumu based criminal lawyer Mr Ridhard Onsongo of Onsongo and Company Advocates. The case will come up for mention within the next two weeks time.

The KACC sleuths carried out a thorough investigation of this case following recommendation contained in a milestone judgment made two years ago by the former Kisumu Resident Judge Mr Justice John Mwera., who had recommended that several people involved in the fraudulent transfer of the nucleus estates belonging to Miwani Sugar Company Limited be investigated.

Kenya & Uganda: Kibaki censured over Uganda extraditions

NAIROBI, Kenya, Sep 28 – President Mwai Kibaki on Monday came under a scathing attack from a High Court judge over the rendition of Kenyans to other countries on suspicion of terrorism.

Justice Mohammed Warsame questioned why President Kibaki - who recently swore oath of allegiance to the new Constitution - allowed State agents to infringe on the rights of Kenyans contrary to the new Bill of Rights.

“That kind of behaviour, act or omission is likely to have far and serious ramifications on the citizens of this country and the rulers. It also raises basic issue of whether a President who has just sworn and agreed to be guided by the provisions of the Constitution can allow his agents to breach with a remarkable arrogance or ignorance,” ruled Justice Warsame in a case in which Mohammed Aktar Kana, moved to court to block his arrest and transfer to Uganda over suspicion of involvement in the July 11 Kampala terror attacks where 70 people were killed.

“Prima facie the allegation contained in this application is a serious indictment on the institution of the President and whether he is protecting, preserving and safeguarding the interests, rights and obligations of all citizens as contained in the new Constitution.”

Already thirteen Kenyans are facing terror related charges before a Ugandan Court. Mr Kana says in his affidavit that six of those Kenyans are personally known to him as they worship with him at Jamia Mosque and elsewhere in Nairobi where they socialise in coffee houses.

“Invariably I have interacted with some of the victims in the course of my business as aforesaid. An affinity has therefore evolved in the course of time particularly through religious worship. This interaction is therefore a fertile ground by the said officers for inference of ‘guilty by association’,” he said in his affidavit.

Mr Kana through his lawyer Muturi Kigano has told the court that Ugandan authorities have variously sought to ‘abduct’ him and at one time had even arrested his cousin in a case of mistaken identity.

In blocking Mr Kana’s extradition from the country, Justice Warsame said the action by the Kenyan authorities showed “yesteryears’ impunity is still thriving in our Executive arm of the government.”

He then ordered: “I direct the Attorney General, Police Commissioner and Internal Security Minister to ensure that the applicant is not surrendered, handed over, transported and or transferred to Uganda or any other country without further orders from this court.”

“If the applicant is arrested, he shall be brought to this court without fail or subjected to the due process as enshrined in our Constitution.”

Mr Kana says that lawyer Mbugua Mureithi who was arrested and later released as he went to represent the Kenyans in Ugandan custody had told him that he and Muslim human right activists Al Amin Kimathi who is also in custody were interrogated about him generally.

In his affidavit Mr Kana also claims that he is a frequent visitor to Yemen.

“I occasionally travel to Yemen where my first wife Salima Antonio Fernandes and five of my children reside, work and study respectively. Yemen is categorised by American Government as a terrorist/ Al-Qaeda main cell.”

The court has directed that its orders be also served on the office of the President through Francis Muthaura who is the Permanent Secretary in the Office of the President and Secretary to the Cabinet.

The matter is due in court on Thursday for a hearing of all parties.

Kenya: Prof PLO Lumumba pays a courtesy call on PC Nairobi

Prof PLO Lumumba- Director KACC, Prof Jane Onsongo- Deputy Director Preventive Services KACC, Dr John Mutonyi- Deputy Director KACC, Dr Kemoli Akidiva- Principal Officer Education KACC and the CCNSET Team members led by Odhiambo T Oketch today paid a courtesy call on the PC Nairobi Province Mr. Njoroge Ndirangu at his officers.

The PC was accompanied by his Deputies and all the 9 DCs in Nairobi.

Amongst other things that were discussed are the forthcoming Anti Corruption Walk that will be held in Nairobi on the 22nd October 2010.

The PC said that the Provincial Administration are well placed to join in the war against corruption and that they are inviting the KACC team to come up with a workshop that will re orient the Provincial Administration to play a better role in the fight. He confirmed that they will support the walk and all the activities preceding the walk as a team. He then nominated Ms Mercy Gatobu- Deputy PC in charge of Anti Corruption at his office to join the Organizing Team.

Odhiambo T Oketch assured the Director KACC, the PC and all the officers present that at CCNSET, we are staying with the issues and that we will play our part in the mobilization of this process. He assured the team that all is running well towards the big day and all the necessary players are being reached and mobilized. Odhiambo is the Co-Chair to the Organizing Team for the event. The Chair is Prof Jane Onsongo.

Already, approaches have been made to willing partners who have accepted to be part of this process and we will be giving details of the same soon.

Prof Lumumba once again called on all Kenyans to join in the war on graft. He gave us a brief history of how things used to be when he was in school; how essential services were readily available and compared that time to now. He said the time to reclaim Kenya was now. Let us not let corruption eat into our body fabric and become cancerous.

He invited us to all join in the campaign and was full of praise to the CCNSET Team involvement.

Similar sentiments were expressed from Dr Mutunyi, Dr Akidiva, Mr Kinuthia Wamwangi, Mr. Chris Kinyua, Mr. Mark Korir and DC Starehe who talked on behalf of his colleagues.

We at CCNSET are proud of our association with the City Council of Nairobi, Kenya Anti Corruption Commission, The Provincial Administration Nairobi, the Kenya Police Force and all the Strategic Partners that we are working with to promote positive engagement. Besides evaluation processes, there is a lot that the Stakeholders can work in partnership with the government bodies and this is the proactive approach we have taken at CCNSET.

We want to be part of the solution to our problems of 47 years. We do not want to be part of the problem into the 48th year of our independence.

It is our belief that we can achieve a lot as a country if we chose to positively engage with the government institutions. Instead of making noise about the 5% poor score, we applaud the 95% score and then reason out the 5%.

As CCNSET, we have already put in place a monthly clean-up campaign in Nairobi dubbed Clean Up Nairobi Initiative- CUNI and this will be held every 3rd Saturday of the month all across Nairobi. I am happy to report that the Provincial Administration have given there assurance of support and partnership.

We are inviting all Kenyans to join us on this day as we shall be making a big case against corruption as we appreciate and demand service delivery from all government agencies.

We will be posting more on this initiative in due course.

SYNOPSIS

CHANGE of attitude is a major challenge in a major communities faced with the idea of change outside the general cultural mainstream. The Luo nation is not left out, especially when it comes to male circumcision which is currently in vogue. Diehard traditionalists still find it hard to com to terms with a practice that has, belatedly been proven to be insulation against the pandemic HIV and AIDS as well as sexually transmitted infections.

The understanding is still is still wavering, caught between tradition and the remedy to a palpable healthcare, whereby families, couples and communities at large find themselves caught on the horn of a dilemma. Medical science in its unyielding efforts to salvage mankind from the jaws of disaster and catastrophe has come up with research findings that offer practical solutions to health and sex issues that continuously battle many in the cities and villages – human beings at risk.

This is where science and arts meet at a tangent, mingling and jostling each other to creatively emerge with a solution that would in the short – term as well as in the long – term address an issue that continues to boggle the mind. Gender in general comes into sharp focus in the promotion of male circumcision as an important measure in the reduction of STI , HIV and AIDS in society, the vulnerable, especially the youth in society, couples, family and the broader society, can therefore be sensitized on this single most important medical research to alleviate problem.

To project this in the public domain, the employment of drama as an aspect of mobilization, sensitization to create awareness and attitudinal change on MALE CIRCUMSICION in the general wider context.

In this context here with, is the “EPITOME OF LOVE” of a screen play focusing on the important of embracing this scientifically and medically tested and proven antidote. How do the vulnerable float with flux –

BERTHA: Is a developmental coordinator, youthful and energetic, dealing with issues of HIV and AIDS.

But will BERTHA succeed in convincing BENJA on the importance of the male cut?.

Kenya: Eight people including directors of Kibos Sugar Company faces fraud chags in Kisumu

EIGHT more people were arraigned today before the Kenya Anti Corruption Court in Kisumu and charged with fraudulently trying to acquire the collapsed Miwani Company and its land worth over 2 billion shillings.

They appeared before the Principal Magistrate Kimemia Muneeni and denied the charges.

Ian Gitau, John Kimani, Moses Oseko Joseph Lumumba, Sign Sate, Ephraim Apundo and Abdikadir Salim were all ordered released on bonds of 5 million shillings each or cash bail of 2.5 million each.

One of the suspects is a former resident magistrate in Kisumu law court who is said to have presided in civil case which resulted in the complaint filed by the Kenya Anti-Corruption Commission [KACC}

They were represented by lawyer Richard Onsongo who argued that bail is a constitutional right.

The offences were allegedly committed between dates varying in 2007 and 2008.

The case will be mentioned in two weeks time. Also listed in the charge sheet was Crowley Company limited.

Last week the Management of Kibos Sugar Factory Limited (KSAIL) alongside five other suspects were arraigned in a Kisumu court, charged with fraudulently trying to acquire the collapsed Company and its land worth 2.32 billion shillings.

The charge stated that between May 21, 2007 and January 30, 2008 they conspired with intent to defraud Miwani Sugar Company of its property comprising the entire parcel of land, LR. NO. 7545/3 measuring 9,394 acres.

All the six accused persons appeared before the Senior Principal Magistrate, Ezra Awino. and denied the charges through their Lawyer Richard Onsongo and were released on a bond of 3million shillings or cash bail of Ksh. 1 million each.

Also charged were two civic leaders from Nyando County Council, a Kisumu based Auctioneer, an advocate of the same Court and KSAIL Managing Director, Sukwinder Singh alias “Raju Sign Patel” who owns the Kibos Sugar Factory.

The case is set for mentioning on October 27th, 2010.

Albino people in Uganda want to be treated in the same category with the disabled

ALBINOS have petitioned the Government to include them in the category of people with disability to enable them benefit from development programmes.

Joseph Katete, the chairman of the Elgon Foundation for Persons with Albinism (EFPA), said there was need for the Government to build schools for children with albinism.

The albinos attending a meeting at Dreamland Inn in Mbale town on Saturday. They want to be included in the category of persons with disabilities

“Albinos have sight problems and, therefore, cannot study well in class with other children and this situation is sometimes compounded by stigma and discrimination,” he noted.

Katete also called for the need to help albinos get specialised doctors and access items like sunscreen, caps and sunglasses to protect them from the sun.

He was speaking at one-day meeting at Dreamland Inn in Mbale town on Saturday.

The participants observed that the Persons With Disability Act of 2006 defined disability narrowly, thereby excluding albinos.

Musa Kimaswa, who studied business studies at the Mbale based Islamic University, said this may explain why they are never considered for affirmative action.

The meeting came up with a one-year budget proposal of about sh40m.

The participants expect to solicit the money from members, government agencies, NGOs and the community.

It is hoped that when the funds are secured, the albinos will be able get an office, carry out advocacy programmes in the communities and train members in entrepreneurship skills.

The participants resolved to continue demanding for their rights and equalisation of opportunities using national and international legislation.

EFPA, which brings together albinos from Mbale, Kapchorwa, Manafwa, Bududa and Sironko districts, was founded two years ago with 15 members. It now has 64 members.

Kenya: The government must stop extra-judicial killing in Gusii region ad ban SunguSungu

The re-emergence of the extra-judicial executions and killings of innocent in Kisii region must be put to an immediate end by the government.

It is disturbing and portrays our beloved Kenyan national as a failing state in the same category with some of ungovernable neighboring states. Our country has only one government of responsible men and women, and can ill-afford to see its citizens being recklessly slaughtered like wild animal almost on daily basis by a gang of criminals

Residents of Gussii region need the maximum security protection as the laws of the laws of the land stipulates that no one has the rights of taking away the precious life from another person except under the judicial process. But what is happening in the Kisii region cannot be ignored. The governments therefore need to act with speed to arrest the situation before it goes out of hand.

We do not have two governments in this country comprising of the ones who s summarily executing the suspected criminal s and the other one which prosecutes the suspect before the established courts of law. And from the looks of things that is what is happening in Gusii region.

The residents of the region are quick in attributing these killing as the work of an outlawed group calling themselves ‘SunguSungu vigilantes’..The group sprung up a decade ago and was hailed by the Provincial Administration was immediately recognized the Provincial Administration in the region. It was mandated to supplement the work of the regular policemen deployed in the crime prone region in suppressing criminal activities. But not to apprehend the suspect and execute them summarily before they were proved guilty of the offences with which they are charged with.

He strange thing is that while sanctioning the operations of the SunguSungu group to police the villagers and get rid of criminal elements within the society, the Provincial Administration erred for not having vetted the individual characters involved in this kind of risky operations. And no sooner did the complaints from the general public filtered in f the groups committing atrocities against the law a biding citizens.

The SunguSungu vigilantes youths exceeded their mandate of policing the villages, and turned out to be taking bribes under the pretext of settling family disputes, particularly on land, debts collection and being hired to settle outstanding contentious land dispute between the families, Such disputes always ends in the macabre killing of innocent people. Some of which have ended up in the summary execution of the suspect offenders, and even being bribed to kill unwanted neighbors and relatives by the economically powerful neighbors. The exercise painted the Gusii region in the wrong way as a place where one can easily find a group of hired mercenaries to eliminate his or her business rivalries.

A month ago residents if Kanyango village in Central Kasipul in a place located between Ruga and Rodi Kakuom markets, which are close to the border of Marani and Rachuonyo districts got a rude shock when they discovered the headless bodies of two well dressed young men laying before the roadside on the main Kisii-Oyugis road. The victim heads were also laying next to their bodies. It appeared as if the two men were killed elsewhere but transported and dumped to the place.

A week ago, the Kegogi village, which is located to the east of Marani district headquarters to the east and placed below the Manga Escarpment, was engulfed in a state of shock and mourning.

About 50 people armed with axes, machetes, rungus, swords, and guns stormed a funeral home where a committee charged with the responsibility of organizing the funeral plan for the burial of an elderly villages who was reported to have died a couple of weeks ago after being shot seven times by unknown assailants. The group dragged two selected people out of the meeting. And the next day their headless bodies were discovered by roadside the road near Miruka [Riochanda]market several kilometers away along Nyamira-Rachuonyo South districts borders.

According to the testimony of the eye witnesses a total of four young men were abducted on the same night and killed at different places. The victims were dragged to a deserted remote part of the villages where the summary execution took place. The killing was under the guise that the victim were the prime suspect in connection with the killing of the village elders..

One villager whose only crime is having come out of his house on hearing the commotion outside to investigate what was going on outside. His wife told this writer that about ten men accosted Mr Jeremiah Bogonko outside his hut and forced him back to the house. They asked why he went out and where he was going. The men using machetes smashed the family television set, and a radio. They pierced his clothes using machetes and asked fore mobile phones, which they took away and left with her husband whose headless body was discovered near Miruka on the main Nyamira- Kisumu highway.

The fact that these criminal gangs took away with them mobile phone handset and perhaps have put them to use makes it much easier for the police to trace these thugs and bring them to book. But so far no arrest has been made. The victim’s wife Mrs Eunice Nyaboke Bogonko narrated how she informed her father in-law about the abduction of her husband, and how the family had the sleepless night pondering about what would be the fate her husband night only to be told the next morning that his headless body had been discove5red far away from home. All these happened when the gangsters came and claimed they were searching for illegal guns which were used in killing the church elder of the Kenya Assembly of God Church Mzee Michael Onchong’a Nyakundi.

A Mr Pascal Gichana Onyiengo also of Kegogi village was killed in the same style, but in all these cases, the villagers says the police did not appear anywhere for the next twenty four hours, though these places are so close to Kisii Town and Marani, which is the ne district headquarters for Kitutu Chache.

Has the government abdicated from its responsibility of protecting its citizens? If not so then why has it placed its citizen under the extreme danger of being killed by night gangsters with impunity?. It is moderately being estimated that close to 200 people have lost their precious lives in Gusii region in the last three years in similar circumstances. Some of them victims died on suspicion they were witches or practicing witchcrafts’ other died on mere allegations that they were involved in unproven criminal activities.

The signs that business rivalries is also playing part in these killing is the destruction of business premises in Suneka market in Bonchari whose owners were suspected of criminal activities. Some double storey building were vandalized beyond repair by the enrage youths

It is time the government restore sanity and security of its citizens in Gusii region by banning the illegal activities of SunguSungu vigilante groups which have made the life difficult for the residents.

Maureen was married to Kevin Kimani formerly of (World Bank DC) presently in Nairobi and mother to baby Neema. Maureen was 2nd Daughter of the late David Obong and now retired teacher Mrs.Margaret Obong. She was a niece to Dr George Okello and Molly Obong. Maureen was a sister to Judy and Edwin (edu) of maryland Jacky,Elisha,Molly and Bilha in Kenya. She was niece & Cousin to Kennedy Amollo"Ken Odhis", Gladis Obong,Theresa Amollo,Malabi Chasia and Theresa Abwao and Theresa, Jorim and Micheal Obong of north Carolina.

Kenya: Rongo D.C. in a crisis security meeting in Awendom with the striking farmers and can cutters

RONGO District Commissioner Arthur Osiya yesterday spent the best part of the afternoon in a crisis talks with the contracted and non-contracted sugar cane farmers within the Awendo sugar growing zones.

The meeting, which was held in Awendo town was part of the concerted effort by the Provincial Administration to resolve dispute between the farmers, cane cutters and other local stake holders, which has paralyzed the operations of SONYSUGAR company.

It was held on the fourth days of a stand off between the cane farmers, cutters and civic leaders in the region, which has paralyzed the operations of the Awendo based facility for the last four days.

Si fat the striking cane cutters are suspected to have been responsible for the destruction of the company property, which has seen close to 20 hectares of mature and immature cane torched by unknown arsonists . The strike by cane cutters has also drastically hampered the operations at the facility and grossly interfered with the normal cane delivery at the factory.

THE D.C’s meeting with farmers and cane cutter came in the wake of an impromptu meeting of the boards of directors of SONYSUGAR board of directors, which was called specifically to deliberate on various issues affecting the operations of the SONYSUGAR company, which is a wholly government owned facility.

The D.C. made passionate appeal to the resident of Awendo cane farming zone to protect the property of the SONYSUGAR Company saying that the firm was playing pivotal role in the economy of the Southern Nyanza region being the only single largest manufacturing industry.

The D.C reminded the residents of the area of the importance of keeping peace, law and order while the government is looking into their grievances. He promised that an important announcement would be made soon in connection to the farmers demand for high prices for their row cane.

But the seemingly enraged farmers told the D.C on his face that they were not comfortable with the SONYSUGAR Managing Director Paul O Odolla and wanted him fired.

While the meeting was going on some voice from the crowd were heard shouting that the recent renewal of the MD’s contract was done in a questionable manner. This confirms the rumors making the round within Awendo and its environs that it was done through the back door and that a discredited former civic leaders was used as conduit and hirelings brokering the deal through an influential political family which prevailed upon the Ministry to have the non-performing manager’s working contract renewed to the chagrins of the cane farmers and workers alike.

The lasted development came about following the sugar cane farmers pressing demand that the row cane price be increased from the current price of Kshs 2885 to Kshs 3185 per ton of row cane delivered to the facility. The farmers want the payment in arrears back-dated to July 2009 when the National Pricing Committee of the Kenya Sugar Board approved the increment. Other Millers had already adjusted to the new prices and paid out money in arrears to the cane growers except SONYDSUGAR.

During the impromptu security Baraza by the D.C there were no senior managers from the SONYSUGAR in attendance, through there were eight civic leaders from the Councils within the Awendo environs.

A prominent farmer from Rapogi zone Mr John Boby Awiti Otange who is also a prominent businessman in Nairobi commented that the time of employing top managers in public companies through godfathers are long gone with the arrival of the new constitution dispensation.

He said the SONYSUGAR company managers must be prepared to serve the interest of the sugar cane farmers above all because the farmers are their employers. Those who could not cooperate with the farmers must pack and go because there is no more room for employment through godfathers.

Some of the farmers interviewed said they would not hesitate to go public and expose the names of people involved in underhanded and corrupt deals, which are likely to cause sufferings to the poor cane farmers

SONYSUGAR has contracted close to 27,000 within the six administrative districts of Rongo, Homa-Bay,Uriri, Gucha, Trans-Mara, Migori and Kuria. There are also equal number of non-contracted farmers within the region who are also benefiting from the company.

Only the Powerful & Rich Nations will survive

Kenyans,

Whether a dream is fulfilled is good or bad depends on the nature of the desire. It is good to the dreamer to achieve worth while goals, but not all goals are worth pursuing. When you set your heart on something, you may lose your ability to assess it objectivity. With your desire blinding your judgment, you may proceed with an unwise relationship, a wasteful purchase, or a poorly conceived plan. Faithfulness of our leaders and us is a virtue, but stubbornness is not. The old say found in almost all African dialect goes like this: `a rotten apple( in luo kudni) spoils the barrel`is often applied to poor relationship or judgments. So be very careful on whom you choose as your closest friends.

Powerful and rich nations are buying land from poor nations for food for their own nations. African nations are selling or lending most of their rich lands to those nations. Creating at the moment a food circle, food grown in Africa taken abroad and returned to sold to them. What African do not know is that the rich lands do not grow, but our populations grow very fast. African nations sell rich lands at the same time depending on international aid to feed its own population. Some countries have forsaken the population growth and have made plans for survival others are still sleeping plus their leaders.

Mathematics data are good evidence on whether we shall survive or not. Longtime ago before 1800, diseases were uncontrollable, people used to die very young. But after 1800 the world population have dramatically increased, because disease can be controlled and people live longer. We have seen a world population increasing from 2.5 billion to 6.9 billion just in the last 50-60 years. But do you know that the water we need and use for consumption is only 2.5% of all the water in the environment. On land, things are worse. An average African uses 1.37 acres of land, U.K 5.3 acres, USA 9.42 acres, Indian 0.5acres. So if everybody on earth here uses 0.5 acres of land like the Indians then the whole world can only be inhabited by only 15 billion people. The problem is that in China alone now there are children more than the whole population of USA today.

Since land does not grow but population grows, land should be considered as a resource and security for our future generation and our future survival. Good leaders with focus minds and good thinking will guarantee our future, but those who sell Kenyan land and resources to their friends should be done away with completely. It will not help that Kenyans migrate to rift valley as they did in the 1960s or 1970s. Drought is outside and most rivers and lakes will dry up leaving few land to be used for consumption. Rich powerful nations who will not find land for their people will take Africa just as they did long time ago if Africans are not waking up. The rich land Africans have sold to the rich nations will not be returned and Africans will see food growing on their soils but will have no access to that food hence dying because of lack of food.

Kenya: The election battle for the Migori County Senate seat is expected to attract more aspirants

Migori is the mineral rich region of Western Kenya

The forthcoming battles for the newly created Migori County Senate seat is likely to attract the largest number of contestants come the year 2012.

Migori County is so important to Kenya because it is laying along the Kenya-Tanzania border on both land and in the Lake Victoria

Already several names of prominent politicians are being mention at the various public gatherings and funeral places. They include the former MPs and individual personalities.

One of the prospective candidates had already I the grounds as if the elections is schedule to take place within the next two or three months..

A two time former MP in the defunct Homa-Bay constituency Pharez Oluoch Kanindo is already on the campaign trail, though his is viewed by the electorate as “Big Jokes” but it sends the message across the vast region. Kanindo hails from Central Sakwa Location in Awendo Division, Awendio district in Migori County.

Other individual said to be interested in the Migori Senate seat which the new constitution has provided include the once two term MP for Ndhiwa constituency Zablon Owigo Olang’, who hails from Sori Division in Nyatike constituency.

Another aspirant is the immediate former Migori MP Charles Oyugi Owino {Jalikowa} who hails from Wasio in East Suna location, Suba East Division, Migori County.

A retired former secondary schoolteacher Mr Jack Baraza who has twice contested the Migori parliamentary seat is also reported to be gearing to go for the Senate race. He is the sons of an Ex-Senior Chief Baraza of Wasweta West and hails from Bondo Nyironge area, Suna Central Migori Constituency.

In the last general election Baraza contested the election on PNU ticket and lost to the incumbent John Pesa

Other reports emerging from Nyatike says that the immediate former area MP Ocholla Ogur is also keen on contesting the Senate seat for Migori County. He hails from the dominant Kakoth sub-clan in Kadem Central Location, Macalder Division in Nyatike district, Migori County. Ogur, however, has yet to confirm his candidature.

From the same Nyatike, the name of Polycarp Ochillo, a lecturer at the University of Nairobi’s School of Journalism is frequently being mentioned in the public domain as one of the possible contestant for the Migori Senate seat.Ochillo hails from Kolal sub-clan in Kadem North, Macalder Division, Nyatike district.

Another prospective aspirant for the same Senate seat is Eng. Phillip Makabong’o who hails from Kitere area of South Kamagambo Location in Rongo constituency.He is a retired former employee of the postal services and an ODM operative in the area.

Nobody has come forward from two constituencies, namely Uriri and Kuria and declare his or her interest in her battle for Senate seat, It is hoped that more aspirants for this particular seat will emerge making it the most crowded race in the region.

however one Ezra Osondi who works with the Kenya Power and Lighting Company in Nairobi is said to be keen in contesting the position of Migori County governor. And so is the former Provincial Director of Education in Nairobi Christopher Chacha Ogwe. Odondi hails from Sakwa West Location, Awendo district in Migori County, while Chacha Ogwe is from Wasio sub-clan of the larger Suna clan in East Suna Location, Migori district in Migori County.

The two political giants of Rongo Dalmas Otieno, the incumbent and the Minister for Public Work and his arch-rival former cabinet Minister George Ochillo Ayacko have kept their supporter guessing as to which seat they will run for. For security reason and in the interest of ODM party unity, the electorate would wish to se them contesting different seats defuse tension usually characterized their battle for the Rongo parliamentary seat. There is, however, a strong rumors making the round within the locality to the effect that Rongo being one of the densely populated constituencies inside Luo Nyanza could be splinted into two, namely Rongo and Awendo constituencies, If this happens it will be a sign of relief to the residents considering acts of violence that has in the past characterized the electioneering campaign in the area in the past.

Otieno hails from Kangeso sub-Location in Kamagambo West Location in Rongo constituency, Migori County, while Ayacko is the resident of Waware sub-location in East Sakwa Location, Awendo Division, Rongo in Migori County.

Migori County, which could prove to be one of the richest counties in the defunct Nyanza Province, covered the largest administrative areas which include five parliamentary constituencies of Nyatike, Uriri, Kuria,Migori and Rongo. Its areas of jurisdiction include several town councils of Kehancha, Sori, Rongo and Awendo towns and Migori Municipality.

There are several important trading centers such as Isebenia, Sirare,Muhuru-Bay. Macalder, Uriri and Rapogi.

Migori is endowed with good rainfall, fertile and arable land which is capable of producing all sorts of cash crops such as sugar cane, tobacco, horticulture, finger millet, sorghum millets, vegetable, bananas and if the County resources if put to a proper use, could turn to be the hubs of massive food production in the region.

Fishing and fish trade is the main occupation in the lowland region of Migori County, covering the locations which are lying along the shoreline of Lake Victoria such as Karungu, Kadem and Muhuru. Even the controversial Migingo Island is part of Migori County.

The vast region has only one manufacturing industry, which is the Awendo based SONYSUGAR Company with one fish processing plant, which is located right in Migori town. But owing to the fact that the region is rich in minerals, several local and foreign gold prospecting companies are currently in the process of establishing full scale gold mining plants in Kamwango area of North Kamagambo Location, where the new discovery showing there is enough gold deposit, which if prospected could earn Kenya close to Kshs 400 million in 15 years.

Macalder gold and copper mines were only closed by the CDC, which was prospecting for both minerals in collaboration with some British firms in 1962,not because of the fact that the minerals were exhausted, but due to fears of chaos which were then expected to erupt soon after the country attained its political independence in 1963.. There are plenty of minerals in the region which include copper nickel and uranium The two major rivers, namely Kuja and Migori are also having abundance deposits of alluvial gold.

Other areas where gold was mined in plenty from the 1930 by foreign companies include Kehancha, Masara and Kitere. Kehancha is in Kuria West district, while Masara,Macalder are in Nyatike constituency.

Kamwango and Kitere areas are is located in Rongo and so is Kitere. Small scale mining by individuals is still going on in the places mentioned above, but to make the undertakings become more economically important to the Migori County and the nation at large, a full scale mining by reputable local and multinational firms are necessary.

Kuja River in Kabuoch Central where the river terminates its flows and a wind up in Kuja River is said t be full of the gold deposits underneath.

However, there is a political problem, which must to be resolved before the Migori County is established. Of late the relationship between the majority Luos and their minority neighbors, the Kuria is not all that cordial following the recent sycophantic outbursts of the Kuria MP Dr Wilfred Machage. Whose hostility attitudes towards the Luo political king ping Raila Amolo Odinga has of late become the talk of the region.The Kuriam MP’s anti -Luo sentiments has driven the two communities apart, and yet the two theresidents must work together in the yet to be established Migori County.

Furthermore, the Luos and the Kuria belonged to two different sets of political parties, namely the ODM and PNU, an issue which could make the distribution of top County jobs not attractive enough to facilitate the equal sharing ad running of the Migori County to be harmonious.

Dr Machage started flirtation with the Prime Minister’s political enemy’s way back at the beginning of 2008 following the formation of the grand coalition government of the PNU/ODM oasis.

Dr Machage blamed Raila Odinga for his demotion and relegation to less lucrative position of an Assistant Minister after he had served briefly under President Mwai Kibaki’s PNU administration in early 2008 as Kenya’s Minister for East African Community Affairs. But following the protracted negotiations conducted under the armpit of the former UN Chief Dr.Kofi Annan which later ushered in the grand coalition government of PNU/ODM. This fircd the re-organization of the cabinet and in the process of the realignment, several former cabinet ministers lost their jobs or were relegated to Assistant Ministers clots top facilitate the appointment of ODM Ministers to the cabinet.

This was a decision of the entire system and collective responsibility of the two principals in the coalition and not Raila Odinga’s personal decision, though the Kuria MP has of late personalized the affairs as if it was Odinga versus Machage, which is not the case.

Machage has even laid some unrealistic claims of large chunks of land inside Migori,Uriri and Rongo districts as being the land stolen by the Luos from the Kuria original owners. These kind of claims apparently prompted the police to charge h in court for haste speeches causing his current suspension from the government pending his trial for the alleged offence.

But a survey conducted b this writer has revealed that the ordinary Luos and their Kuria’s counter gets along very well and continuing doing business as usual despite of the existing hostilities between Dr. Machage and the PM. But this has also brought the bad spirit of mistrust among the two communities and could have negative effect the distributions of the Migori County top job slots between members of the two communities, given that fact of the Luos numerical strength and influence within the new county.

The Luos would form part of the majority in the County governance. But the situation could change drastically for better only if Dr.Machage loses his seat in the 2012 general election and a new MP is voted in by Kuria electorate on an ODM ticket

Kuria and the Luos have lived and worked together in one administrative district ever since 1908 when the old South Nyanza district was established and Luos, Kisii and Kurias were grouped together in one administrative district called South Nyanza.. The district was later in 1961 splinted into two namely Kisii and South Nyanza districts. The Kisii district reained in the old district headquarters in Kisii Town, while the Homa-Bay town was chosen as the new South Nyanza district. In the new district and under the County Council of South Nyanza the Kuria and Luos worked together in harmony.

When the first Clerk to the County Council of South Nyanza, the late Mzee Paul Mboya retired in 1962 he was promptly succeeded by his deputy Mr Chacha Marama from the Kuria community, a clear evidence that the two communities can still work together and developed the agriculturally rich region to the highest height of the economic growth and development.

It is also worth to mention in this article that ever since independence in 1963 the successive MPs from Kuria constituency had worked hand in hand with their Luo counterparts in South Nyanza. The first Kuria elected MP the late Benjamin Maisori Itumbo served in the post cabinet as an Assistant Minister for Social Services. His successor Samson Mwita also worked with his Luo counterparts and the same with the late Walter Mwita. All the previous MPs from Kuria community were voted into Parliament on KANU tickets

Despite of petty and normal crimes such as cattle rustling the two communities have lived together in peace for many years and are known to be engaged in cross border trades of all sorts
