Kenya: Anti-graft body may probe Ruto case afresh

The Kenya Anti-Corruption Commission (KACC) is considering launching fresh investigations into the fraud case involving Eldoret North MP William Ruto.

Sources at the commission Thursday revealed detectives at the anti-graft body intend to write to the director of CID seeking to have files of investigations into the case before they start their probe.

“It is clear that public money was lost in the deal and that is why as a commission we want to take up the case and launch fresh investigation. You will be informed when we start,” said a senior officer, who asked not to be named because of the sensitivity of the case.

The source revealed detectives had been detailed to monitor the case at the High Court before it was dismissed by a magistrate.

Questions Raised

“From the beginning, there were questions on how the prosecution presented the case and why some witnesses went against their statements and others failed to show up. There is a case of perjury that has not been raised by the same CID,” added the source.

Ruto, Mr Joshua Kulei and Mr Sammy Mwaita, were charged with fraudulently obtaining Sh272 million from the Kenya Pipeline Corporation (KPC) by selling it plots in the Ngong Forest.

Nairobi Chief Magistrate Gilbert Mutembei said the prosecution had failed to prove its case. Of the witnesses the prosecution had lined up, 13 could not be found and five died while the case was going on. Those who made it to the court became hostile to the prosecution.

Commissioner of Police Mathew Iteere has since blamed the State Law Office for the acquittal of Ruto and two others over the multi-million land fraud charges.

“We played our role in this case. In the criminal justice system, there is the police, courts and prisons. It was upon the prosecutors to prove the case before the court,” he said.

But the Director of Public Prosecution Keriako Tobiko says they relied on evidence produced by police and they cannot be blamed.

    Do you recall last week when Ruto’s case was thrown out his supporters celebrated that “justice has prevailed on their leader”..and Hague case will soon follow and Ruto will be vindicated again”. Let me caution this school of thought before making my point and why I think ‘ Ruto will not be’ re- tried for graft’ as you think. Also anybody who think that the ICC will eventually turn the O’campo Six case to Local tribunal in Kenya is “smoking home grown Bangi or home made Changa in this country.

    Kenyans who are concern with justice for all..should read Nation paper titled .. Ruto had hired potential witness Ms. Junje” This is the same lady who wrote the check for Sh. 396 million to Ruto in the Pipe line case according to daily nation report..look it up yourself!!!!!. Yes, Ms. Njuje’s appointment as a member of Board of Trustees for the coffee development Fund was legal . Howvwer, Ruto was facing corruption charges when he appointed Ms. Junje.. to this post. The same Ms. Junje was involved with land tranacation ( 1.75) hectares for Sh.396 million. Furthermore, Ms. June had checkered records in graft schemes. According to the nation, in Feb. 2003 Ms. Njuje was arrested for defrauding KPC Sh. 339 Million on computer deal. As yourself did Ruto Know this when appointed her????. To me answer is Yes, because MS. Njuje had done this before and Ruto wanted to deal with some one who knows what they were doing.

    Anybody with half brain can now see Ruto’s scheme of bribing potential witness of his graft case.

    Again, Kenyans should ask themselves how come Ms. Junje was left out of KACC witness stand by Prosecutors, AG office and CID who investigated this case??????????????????????????. By design, Prosecutors produced more dead witness to the court than live ones. The few witness who showed up at the court turned against the prosecutor…why?????.why????. Let me ask you,IS THERE PERJURY LAW IN KENYA?????????????,. Where come from the one of the worst thing you can do is to commit perjury in court of law. It seems in kenya there is zero price to be paid for perjury.

    It is downing on me now..in early day of Ocampo six Ruto when around this country parading witnesses who had one testified in his ICC case that they were bribed by the ICC and looking at his graft case, it is Ruto who has been going around bribing these witness to purger themselves!!!!!!!

    So Bwana Bonny, KACC may’..consider -retrying this case but corruption in AG, Police, CID and prosecution office will still do the same thing to get the same results!!!!!!!. Again, Kenya government can appoint new judges, police…new judiciary as now required by the new constitution but none of these efforts will produced the desired justice in this country. Corruption/ graft is apart your DNA!!!!!

    I acnowledge with appreciation the efforts by KACC to dig deeper into this Ruto land saga. However, surely as night follows day, nothing new will come out of the investigations. The KACC personnel as dreaded as they are will also be manipulated, simply by upping the level of oiling their hands. Who doesn’t feel the effect of increased cost of living? It would be better other touching issues of national importance are dealt with now. Leave Ruto alone. Kenya courts only try the poor not the cast of Ruto’s.
