Village Elders to be on Salary

Moving the motion, Saboti MP Eugene Wamalwa said though the elders play a crucial role in assisting the Provincial Administration to deliver services, there is no legal or remunerative recognition for them. Seconding the motion, Kinangop MP David Ngugi said the elders should be formally incorporated in the Provincial Administration.

Libya is advancing a Religious Course in Kenya

The recent revelations by the press of ramifications of the Libyan business community interests in East Africa speak volumes. While many would want to see this as mere capitalist investment, it turns out that it is not. The truth is as old as the fight over Jerusalem between two sons of the Biblical Abraham. The idea is to have influence over the people as far south as South Africa . Kenya is the gateway for the moment.

Influence is created with money. That money as it has always been is in the hands of people whose agenda is to rule the whole world. It can also be seen throughout man¢s history that the only practical influence one can have on people of all walks of life is religious. There are many religions in the world. That notwithstanding, it can be argued that effectively two religions are more prominent and are dictating much of today¢s flow of money and wealth. These religions are Christianity and Islam. A closer study of world events shows ostensibly that all the bloody conflicts in the world today are an offshoot of the struggle between these two religions. Each wants to control world¢s wealth and power. And this will go on for a long time to come.

Back to East Africa, I recently met a Sudanese who once ranked highly in Garang¢s bush army and is now taking refuge in Finland . I asked him why they were fighting and what ideological basis did they have to support their rebellion. He told me a very interesting story which was an eye opener to me. He told me that they were fighting Islam. He said that Muslim world has always desired to control Africa . They argued that Southern Sudan stood between them and expansion of Islam down to South Africa . He told me that much of Arabian Peninsula wealth went into funding the Khartoum regime. They would speak in parables like what was Khartoum lacking to enable it burn its charcoal. The charcoal of course was the black Africans who needed to be converted to Islam sooner than later.

That desire to control Africa has not died. Now that the war in Sudan is officially over and Garang out of the way, there is need to do this job speedily. Gaddafi, for those who know history well, embodies the truth of the yearning desire Muslims have for their own form of Imperialism. He is very ambitious and once became a great headache to the US for a long time. He has seen some weakness in the world geopolitics because of the entry of China . He has seized the opportunity and is now moving stealthily but fast. The whole idea is to take over lucrative businesses in the countries of interest and then start dictating terms. It is not difficult to see why Gaddafi wants to buy Grand Regency in Kenya . It is because tourism and tourist form a big chunk of Kenya ¢s foreign exchange earnings. Very soon if not checked, he will have a strangle hold in almost every important sector in Kenya . What more, the Prime Minister and the President are both in his pocket. Gaddaffi bankrolled their campaign that removed Moi from power. Everybody knows how strong a Christian Moi is. It is therefore understandable why Gaddaffi would do everything to defeat Moi¢s course. So Kenyan¢s should be wary of these things that are unfolding. Sooner or later they will be slaves of Islam.

Today, Wednesday, July 30th, 2008, I woke up and told my heavenly father that I was going to go back to my regular exercise of morning walk. In this way, I will tell the enemy and his agents that I will not die but live to do the Lord’s work! Hallelujah!

Although at a slow base which took me longer that usual, I was extremely happy to be out there with nature. At this one area, I stood there for
a while, just to enjoy the singing of birds. Some of them must have been excited to see me,wondering loud and clear where I had been in the last six weeks. If only they knew that things have been tough for me!

During my morning walk, I found myself thinking of 2 very strange e-mails that have come my way in the last one month. I saw them as the Lord trying to test me! Why do I say that? You see I have promised the Lord over and over again that I will always be there for His needy children!

And so not long ago,I came across an e-mail that was copied to pastors in Minnesota conference asking for some help. It was from a young family from Cameron, who won a green card to come to this great Nation but knew no one. They were therefore looking for someone to host them for at leat 3 or so months. After speaking with my dear wife and another family friends of ours, we decided to host them.We look forward to welcoming them on August 17th, 2008.

Again, yesterday morning, I came a cross another e-mail that was copied to some pastors in the Minnesota conference. It was a letter from a student at the University of Baraton, Kenya.The student wrote to say this:

1.She comes from a family of 10 children
2.Her parents are poor and un-employed.
3.Her father is sick with throat cancer
4.She joined the University in 2003 but has only managed to do 2 academic years due to financial challenges
5.As a day student,many are the days she go without food.
6. She requested for prayers and if possible financial assistance towards her fees
7.She signed the letter as “Yours desperately in need.”

On reading her letter, I wrote back saying that I will pray for her. I also told her that I was willing to send her copies of my autobiography-Except for the Lord- that she can sell and pay fees.

In her response this morning, she expressed her willingness to do whatever it takes her to raise tuition.

As my morning walk was coming to an end, I told the Lord that if He helps me sell my book, I will pay all the tuition for this my sister in the Lord.

Oh! How I cry to the Lord day and night to send money on my way; not for my comfort, but to help His many suffering children world wide!

If you can, pray that I sell my book so as to assist this student realize her goal in life! Will you pray for me!

Why MPs won’t enact new constitution within a year

Constitutional experts have warned Parliament is unlikely to endorse a new constitution within a year for fear of fresh elections.

The Law Society of Kenya (LSK) constitutional committee says a new constitution would also mean the end of the Grand Coalition Government.

Consequently, it has presented incremental amendments in two crucial Bills to the Parliamentary Committee on the Administration of Justice and Legal Affairs.

LSK Chairman Okong’o Omogeni said the National Accord and Reconciliation Act says the coalition would not hold once the new constitution is in place.

“MPs are unlikely to pass the new constitution because it means they would go home and face fresh elections, and the coalition government would equally not be in place,” he said.

Committee member Apollo Mboya said the coalition government a temporary measure and would be insolvent should the new constitution prefer a parliamentary or presidential system of governance.

LSK now wants Parliament to withdraw the Constitution of Kenya Review Bill, 2008, and the Constitution of Kenya (Ammendment) Bill, 2008, for re-drafting.

The two Bills lay the roadmap of achieving a new constitution.

The Constitution of Kenya Review Bill is a continuation of the National Accord and Reconciliation process and is aimed at solving underlying problems.

The Constitution of Kenya (Ammendment) Bill on the other hand, aims to entrench a referendum in the Constitution.

This was based on Justice Aaron Ringera’s judgement in the Timothy Njoya case, which stated that a new constitution could only be enacted either through a referendum or a constituent assembly.

But LSK wants this amended, arguing it is borrowed from India.

Folks,
LSK was LSK when the late Oki Ombaka headed it and gave it direction.
Since then I have not seen any credibility come out of that institution other
than a bunch of hungry stomach first fellows. People who think with their
stomachs.

It is sad they have lost direction. The Kenyan Public dont need their advice
right now, whatever they say is trash that goes down the stream as waste
disposals.

The LSK needs to know that what is at stake now is the Driving Force of what
KENYANS DEMANDS from the LEGISLATORS, not What the Legislators or
the Executives want. The Legislators or Executives business is to deliver what
the Public Demands. The Referrundum spoke volumes and nothing short will
divert attention from the bigger picture of Delivering the CONSTITUTION.

This means all big mouths of Corruption Cartels will be shut by all means, and
those found guilty will be thrown to jail. Whoever he is, be it the President or the
Son of the President, he will stand charged, if found guilty will serve his days in prison.

Let them know, this is going to be a landmark, a history in the making, no short cuts.

am not a lawyer but am very aware that the constitution can be made if they want to enjoy marriage what they will need to do is to delay the implementation date of the new law.

The problem we have is that lawyers like readings the books upside down.

Could this be the reason why Moi nominated and brought Uhuru Kenyatta to politics to protect his interest? I see why Anglo Leasing and Goldenburg scandal is giving Uhuru ghostly shocks.

Can someone dig some more so we can have their heads out of the sand.

When they get stuck and over protective to leadership like porcupines with invisible inscriptions of “The Touch Me Not” syndrome, there is something cooking. They mastered the art of fear to scare public so to keep Public at bay as if they are lions – but even the lions are hunted and tamed. People, you need to dig more, even those Ministries they wont let go, there are lots of smoke a sign that fire is burning underneath.

You’re right. The Prime Minister has a huge task ahead – since he has started a battle that’s extremely difficult.

The Mau Forest saga epitomizes everything wrong about Kenya. Political patronage, forest & land expropriation, illegal logging, forced evictions of peasants, inter-tribal conflicts, losing government battles with corporate hegemonies, international pressure from Nile dependent states etc etc

For your information, the Prime Minister has a close insider account to the Mau debacle from none other than his current PS, Dr Mohamed Isahakia, who was former president Moi’s Permanent Secretary in the Ministry of Environment and Natural Resources during the height of the Mau deforestation policies around the sunset years of the Nyayo rule.

Dr. Isahakhia himself had run-in battles with Moi‘s loyal Minister in the same Environment & Natural Resources docket, Noah Katana Ngala. The latter was blindly implementing policies that were decimating Kenya’s forests purely for business interests and political patronage.

The biggest bribe to convince Kipsigis electorate into voting for Moi’s project Uhuru Kenyatta in 2002, was more than 147,000 acres of forest land excised from the gazetted and state owned Mau Forest. This was forest land that the Moi and Kenyatta logging and timber interests, RaiPly and Timsales had previously shaved off hardwood trees in unfettered fashion.

Moi had previously directed Ngala and Isahakhia to excempt his RaiPly (K) Ltd and Kenyatta family’s Timsales (K) Ltd from the ban on hardwood logging within gazetted state forests at Bararget, Nesiut and Mauche areas of the Mau Forest. The shaved lands were then allocated via political patronage, through pointmen like Isaac Ruto, Franklin Bett and others.

The ambivalence in Dr Isahakia was exposed when, on October 24, 2001, he told the Daily Nation that if he would have had his way, he would have thrown the entire lot of forest officers responsible for the plunder of forests into Kamiti Maximum Prison.

Dr. Isahakia was shortly fired thereafter.

Let Isahakia now help the PM pull the strings together. I’m only worried that the Moi-Kenyatta angle (through illegal logging activities of RaiPly (K) and Timsales (K) ) are not featuring prominently in detangling the mess at Mau.

It is public knowledge Uhuru represents the substantial Kenyatta Family stake at Timsales -go through the public media archives or just google it up, don‘t be lazy my friend. Many such articles as these (below) pop up.

Timsales was originally (founded in the late 30s) a Colonial/British company engaging in the timber business,. It specialized in harvesting cheaply, from Kenya’s vast natural forests, exotic hardwood trees being cleared for colonial settlement.

After independence, the clever British owners foresaw the significant role that local politics would impact in their business. Thus they invited President Jomo Kenyatta into partnership – for strategic reasons- to enable the continued plunder of Kenya’s trees.

True, Timsales have their own tree farms – but they mainly plant fast-growing softwoods like eucalyptus and not the expensive hardwoods which take decades to grow.

To sustain their current business, a lot of stealing of hardwoods from gazzeted state forests is part of their game. The Kenyatta, Moi and current Kibaki governments have all facilitated that robbery. The government has proved unable to protect our forests from the decimation by these political corporations like Timsales – with a heavy arm in government since independence.

Compare Timsales (K) to Raiply (K)’s brief history hereby.

RaiPly started off as Rai Timber, formed by two Indian brothers who were previously thriving businessmen in Uganda, until dictator Idi Amin kicked them out of the country (with other Asians).

Rai Timber, started off its wood processing interests in Mt Elgon then began expanding. It later moved to Eldoret where the Rai brothers partnered with the late Shabir.

At this time, Rai Timber never had the audacity to venture into gazetted state forests for ‘free’ hardwood harvests…..not even applying for the government granted forestry management concessions (given to select companies).

In 1993, Shabir & his wife were mysteriously murdered.

Immediately after the partners murder in 1993, Rai Timber got TWO NEW POWERFUL PARTNERS, a Mr Nicholas Kipyator Kiprono Arap Biwott and Mr Daniel Kipkorios Toroitich Arap Moi.

The new business changed its name to RaiPly (K) and immediately jumped into Kenya’s state forests.

The company also forcefully evicted squatters in a 20 acre plot they sought to set up a tree nursery near Eldoret.

RaiPly immediately became a tough competitor to Timsales (K) whom they learnt a lot from. The businesses collaborated in the joint decimation of Kenya’s state forests, with the old hand Timsales (K) leading, and the new player RaiPly (K) following.

From our exotic hardwoods, for no charge, Timsales and Raiply trucks and loggers blaze through in their harvests that eventually yield; veneer, chipboards, plywood, ceiling boards, blockboards, parquet, wooden tiles, doors, mattresses, gunia sacks, and even polythene bags for special orders to sugar parastatals (Mumias, Sony etc).

As you can see, the money is good and any environmental concerns raised by concerned Kenyans and activists becomes just some bothersome noise trying to prevent the big fellas from eating peacefully.

They will eat until we become a desert, then they can move on to other safe habitations.

Talking of other habitations. RaiPly (K) has eyed a quiet habitat full of hardwoods outside Kenya’s borders.

RaiPly (M), a subsidiary of RaiPly (K), is now the biggest wood processor in Malawi. To the good people of Malawi and their poor trees, here comes Moi and Biwott into your state forests!!!!!!!! Another desert is in the making right in South/Central Africa.

There is trouble here.  Libyans behaves like they own Kenya now. Seems like Kenyans have no say here. They are up for trouble.  This type of authoratative attitude sound transfixed hard stanced. Kenya and the Republic are owned by Libyans. Is that what I am reading?  Look deeper people and tighten your belts. I can smell a rat.
 
Muammar Gadaffi must not stomp on poor Kenyans because he is rich and powerful.
 
He must watch and see the course of legal finale and observe the scenario of the wishes of Kenyans because their Deal Turn Sour here needing a fix.  The Kenyan Public were unaware their Property Assets were secretly being sold – they were not aware also that their Leaders were involved in sneaky deals with Libyan Government.  Kenyan Republic interests must be protected here.  So the Libyans must tread carefully and excercise coution as well considering this situation is sensitive – they should stop their sneakyness and wait for the decision of the law.

Libyan investors officially took possession of the Grand Regency Hotel Tuesday and declared they acquired the prime property legally and would not surrender it.

The deal was negotiated above board with the Kenyan Government, said President Muammar Gaddafi’s special envoy Bashir Saleh Bashir.

“This is a government-to-government arrangement and our businessmen are here to do clean business. We will not give up the hotel because the deal is clean and the President of Kenya invited us to invest in this country,” Mr Bashir said.

The speedy transfer of the hotel was part of the sale agreement between the Central Bank of Kenya (CBK) and the Libyan firm which bought the property.

Secret sale

Mr Bashir arrived in Kenya Tuesday morning and went into meetings with government officials.

Mr Bashir met President Kibaki at State House in the morning before addressing a news conference organised by the Ministry of Foreign Affairs, at the Grand Regency Hotel.

His visit to Kenya was to state the Libyan position after the secret sale of the five-star hotel to Libyan Arab African Investment Kenya Company, which sparked a storm that led to the “stepping aside” of Finance minister Amos Kimunya.

A Cabinet committee chaired by Prime Minister Raila Odinga indicted CBK governor Njuguna Ndung’u and CBK secretary to the board Kennedy Abuga, recommending that they step aside to allow for investigations.

A commission of inquiry headed by former Chief Justice Majid Cockar has already been set up and is due to start an investigation into the affair on Monday. It will receive the views of people with information regarding the controversial sale.

Another House committee headed by Nambale MP Chris Okemo is already investigating the controversial sale.

When asked how much was paid for the hotel, Mr Bashir consulted delegation members before saying it was bought for US$ 45 million (Sh 2.9 billion) – Sh1.8 billion was spent on land while Sh1.1 billion covered the value of the hotel.

He said the full amount was paid in May to the CBK.

“We are law-abiding and cannot behave as if we are above the law. Let those investigations about the sale continue and we shall be guided by the laws of this land,” said Mr Bashir who was accompanied by 10 chief executives of various Libyan businesses in Kenya and southern Africa.

He said he met President Kibaki to discuss issues affecting the African continent and conveyed special messages of goodwill from the Libyan Head of State.
He told the news conference: “We are investing in over 35 African countries and Kenya is not an exception.”

Mr Bashir said Kenyan investors were free to do business in Libya, just as it was doing in South Africa, Uganda, Rwanda, Burundi, Morocco and many others.

Foreign Affairs permanent secretary Thuita Mwangi inspected the venue of the conference in advance and the protocol officer, a Mr Pariner, hastily interrupted the media briefing when journalist asked questions to establish more facts about the sale.

Mr Bashir said he was chief-of-staff in Libya, an equivalent rank to the Head of Public Service in Kenya. He enumerated various projects his country was undertaking in Kenya and Africa.

The Gaddafi envoy spent about 45 minutes in the hotel and met former Foreign Affairs minister Raphael Tuju. The lawyer who represented them in the sale, Mr Adan Mohammed, arrived moments before Mr Bashir left.

The Libya Africa Investment Portfolio, which Mr Bashir heads, is the government investment authority, funding all companies carrying out Libyan financial activities outside the North African country.

Junior officers

The sale of the hotel has been controversial since Lands minister James Orengo revealed that title deeds and other instruments of transfer were secured secretly in his ministry and disclosed how his junior officers were threatened and ordered to release the documents.

Attorney-General Amos Wako disowned the sale, saying he was not consulted, while the director of the Kenya Anti-Corruption Commission (KACC), Mr Justice Aaron Ringera also rejected Mr Kimunya’s claims that he was aware of the deal.

Prime Minister Raila Odinga, who Mr Kimunya claimed also knew about the sale, said he only inquired from KACC and the Central Bank of Kenya what was going on since the matter had been raised in Parliament.

Oil pipeline

Mr Odinga formed a taskforce led by Mr Wako, whose report called for the resignation of Mr Kimunya, Prof Ndung’u and the director general of the National Security Intelligence Service, Maj-Gen Michael Gichangi. Mr Bashir described the Kenya Oil Refineries and the oil pipeline supposed to connect Kenya and Uganda as a major investment but the shareholding was still being worked out.

At the Press conference, he was accompanied by the chairman of the Libyan African Investment Company Kenya Ltd, Mr Amear Ahmed, and the president of Oilibya, Mr Ali Shamak.

Re: Is Kenya Hurtling Toward A Revolution?

The rolling strikes in Kenyan secondary schools have caught most of us by surprise. We are stunned that the kids we sent to school to learn have turned into stone-throwing, book-hating thugs with the capacity to wreck untold havoc on property and their own future. We’ve watched with dismay as boys and girls have gone on the rampage ostensibly to avoid doing some exams called MOCK. And since the start of this shameful orgy, we’ve all watched as politicians, from the president down, have peddled prescriptions that serve no useful purpose except to remind us of their infuriating lack of depth.

At this point it has become clear that the strikes rolling through the undulating landscape of the Kenyan secondary school has absolutely nothing to do with MOCKs. The only mock-thing about them is that they are mocking us for having such a limited understanding of what goes on in the mind of our youths. Lest we forget the example we have set to them, I want us to look ourselves in the mirror and see what those boys and girls have seen in us. Are you ready?

The Mirror:

1. Lack of Opportunity. These kids have grown up in a nation where they’ve been repeatedly told that opportunity comes to those who stick it out in school, work hard and play by the rules. These are lofty ideals that sound noble even to the youth. Except that when they look around them, what they see is their brothers and sisters who’ve worked had, graduated from universities across Kenya, but are now reduced to roasting corn/maize at the bus stops and marketplaces in the nation. Some have even seen their parents fired and out of work for months. In the face of such reality, do we expect the kids not to despair?

2. Tribalism. Since the sixties, our nation has struggled to eradicate this very negative vice. We have failed. And now, just when things started looking up, Kenya has regressed into one of the worst periods as far as tribal relations in the country go. As the boys and girls in our schools look at the picture we’ve presented to them, what they see is a father in Kisumu cursing that Jarabuon father in Kiambu. They see the mother in Nyeri calling the mother in Tinderet something ugly. They see their brothers and sisters bite their lip in anger every time some one from a different tribe is on TV saying something. Hate, hate, hate. That’s what we’ve given them. These are the kids we’ve sent to school to study next to that boy or girl they heard being cursed and called ugly words at home. And we wonder why they mock us?

3. Corruption. Most of these kids came of age in the days of John Githongo. When they read the newspapers, what they see is stories about massive corruption in the country, and the vice is perpetrated by men who should be the example. When they read about Anglo-Leasing, Goldenberg, Turkwell, Ken-Ren and now the Grand Regency, what these kids see is a society where the rules don’t matter. What seems to matter is how high up you can go by literally looting from Kenyans…and this only when you are well connected. Now, how many of these kids are well connected? Do we put ourselves in their shoes and wonder how they see Kenya? Do we?

4. A Culture of Impunity. Mta Do? Folks, whether we like it or not, the kids have only us to learn from. It would be nice if they followed the example of the penguins, which form binding communities where the young are cared for and trained to be effective adults. Unfortunately for our youth, what they have as an example is a president who blatantly steals an election and asks Mta Do? They have a police commissioner who sits at the Waki Commission and proclaims that he’d do everything exactly the way he did it if what happened in January happened today. Does he remember that people were killed by his forces? Does he recall the shoot-to-kill order by Grace kahindi? What should the kids learn from a man like that? And how about the fact that Kiraitu Muriungi is a minister after the Githongo tapes? Look, what the kids learn from this is simple. Impunity pays. Can we blame them when they get discouraged? Or when they think they can get away with burning dorms and classes?

5. Violence. Unfortunately, when confronted with a deaf and blind leadership, most societies resort to violence. That’s what we did after the elections were stolen. But have we stopped to wonder what the kids saw when Kenya went through that meltdown? In those classrooms where we sent those kids, there were some of them who saw a friend killed, a father hacked to death, a sister burnt alive, a brother kill someone, a child left hungry, a home burnt. The list is endless. Yes, those kids saw a lot. But again, have they been given any counselling about the trauma they faced? At what point are we going to realize that our continued inability to do things right is creating a society of future delinquents and felons? Through our violent ways, we’ve legitimized violence as a means of resolving issues. So why are we stunned when the kids do what they’ve learnt from us? They are looking at our condemnation of them now and saying…what a bunch of hypocrites!

Fellow Countrymen, that’s what the kids see when they look at us. We stink, don’t we? But what makes it worse is that we now sit in judgement of them. We must take away their cell phones, we say. We must cane them. We must charge them in a court of law. Their parents must pay. We must expel the ringleaders. This is all bullshit. What must be done is for us adults to start acting our age, and be a good example to these kids. But that is a long-term solution. Here is what can be done to have an immediate impact in schools.

Prescription:

I. Let’s avail books in schools in equal measure throughout the country. When I went to Kanga High School in the late eighties, the late Hezekiah Oyugi made sure our school was well stocked with books, excellent teachers and even good food. I turned around and looked at neighbouring schools like Rakwaro and Iterio and wondered how the kids in those other schools were expected to compete with us. It seemed unfair. If the government implemented a blind policy that treated all schools equally, in terms of resource allocation, the kids might actually fall in love with the MOCKs. What’s keeping us from doing this?

II. Parents must start being there for their children. Admittedly, it’s hard to be an effective parent when you must struggle to even put food on the table. Still, parents must be proactive in their children’s lives. A father must teach his son how to be a God-fearing, law-abiding citizen. A mother must teach her daughter how to take good care of herself and handle herself with dignity. We must all remember that what society teaches our children is in addition to a foundation of learning started at home.

III. Family Planning must be brought back as a means of managing our resources and enhancing effective parenting. Whatever it takes, we need to work toward a society where we bring into this world only that number of children we can take good care of. It doesn’t make much sense to have a third child when one can’t take care of the first one, does it?

IV. We can make the MOCKs a school-specific issue. Let Kanga High School carry on its MOCKs. Let Lenana carry on its. And let Chebwai carry on its. That way the pressure to compete bigger schools right now, at a time when those bigger schools are more well endowed and resourced, is eliminated.

V. Finally, let me suggest that a society where God is not worshipped with the humility and reverence He deserves is hurtling toward self-destruction. There was once a time when the name of God, uttered in our presence, made each of us sit and take notice. Today God is just another name. I pray that we can focus the attention of our youths on God once again. We must do all we can to make God relevant. The best thing that can and will ever be said about the youth in Kenya is…They know Jesus christ as their personal saviour. That’s when Kenya will have arrived.

This is not a conclusive or exhaustive prescription by any means, it’s just my way of weeping for a nation that must turn a corner right now, or watch as we all hurtle toward a revolution!

Uhuru seems to be busy diverting Kenyans attention, when Kenyans have a serious crucial business of life and death before them – that of tackling corruption and the delivery of the Constitution.  People, The Buck Must Stop and be seen to stop with the Leaders.
 
Many are questioning Uhuru’s struggle for Kenyan leadership with all the buggage on his back of corruption, infighting, bickering,  indiscipline, bad temper, division and dishonesty, insincere, tribal based and simply not able to deliver to Kenyans people DEMANDS for New Constitution and bring to book culprits of corruption including Anglo Leasing and Goldenburg scandal, when he denies the Goldenburg saga and Anglo Leasing are not subject to Grand Coalition Government mandate. Kenyans are so synical about the whole issue of his denial and obstruction of justice in  some in some quarters.
 
Many Kenyans believes he is representing a chain network of rock-bottom cartel who have dug their heads into deep sand clad in their looting spree, like ostrich, forgot to take care of the exposed bottom.  They are unaware of spectators all around them including all the shouting and noises people make, simply because they dont care. Like in old days, a lash on the bottom will give them a rude wake up into reality of humanity and leadership call Kenyans do DEMANDS.
 
What they need to know is, the 40 years of misrule, misdeeds, slackness including Anglo Leasing and Goldenburg scandals and all other corrupt practices and indiscipline must be brought to and end by the signing Agreement of the Grand Coalition Government stroke of pen. The Grand Coalition Government have a mandate to provide to Kenyans Both Constitutional Reform Order Policy Paper as well as bring to book culprits of corruption to including Anglo Leasing and Goldenburg Scandals.
 
I am surprised how the Libyans were given access, sneeked in to operate business as usual and to run the Grand Regency Hotel when a stop was put to it awaiting finalization of enquiry and especially so when Kimunya is still being questined pending trial.  Who could have authorized the Libyans to pursue business on a Public quastionable unfinished matter of National Importance and Concern?
 
Raila Promised the Law will take its full course, shall we continue to wait to see when orders are being executed behind doors breaching the agreement and derailing the trust of majority Kenyans?  Is there something Kenyans do not know?  Will Justice be seen to be justly done?  Will Uhuru and Kimunya and Michuki and Saitoti and Kalonzo and the Police Bosses and them all be justly tried?  The buck stops with the leaders ……. they say ……………… The international community do not trust them as well as Majority Kenyans.

Take over: Libyan owners seek to change hotel name to LAAICO
THE new Libyan owners of the controversy-ridden Grand Regency Hotel took over the facility yesterday even as the Commission of Inquiry to investigate its contentious sale finalised preparations for public hearings.

Eight Libyan directors jetted into the country to take charge of the hotel after a meeting with President Mwai Kibaki at State House, Nairobi. They later met Prime Minister Raila Odinga at his Treasury office in the afternoon.

 A regional environmental group wants local fishermen to ensure clean beaches in order to reduce waterborne diseases. The East African Communities Organisation for the Management of Lake Victoria Resources (ECOVIC) whose mission is to conserve Lake Victoria, says its cleanliness should be maintained at all times.

 The group’s Kenya Chapter chairman Lawrence Odira and coordinator James Olonde said keeping the lake clean would help protect it and its resources. The two were addressing the public during a clean-up exercise organised by ECOVIC at Sori trading centre in Migori district. The event was attended by Karungu DO Reuben Kandie. Odira asked fishermen to make use of the many commercial banks that had set up branches along the beach, to ensure they saved their earnings.

 Olonde appealed the fishermen to practise responsible sexual behaviour to guard against HIV/Aids scourge. They also appealed to the fishermen to be vigilant against pirates in the lake who were known to strike and disappear with their fishing gear.

Odira said many Kenyan fishermen had complained of theft of their gear by the pirates, and condemned those among them who were suspected to be colluding with the thieves. The administrator said the fishing ban on daggers (omena) should be observed strictly.

He said fisheries officers should venture into the lake and arrest boat owners who engaged in the illegal exercise. He said the only way for Kenyan fish to attract the international market was by ensuring all fish landing beaches were clean, so as to attain internationally accepted standards. “Your fish landing beaches must conform to international standards to avoid situations where international markets like European Union (EU) are forced to reject your fish,” the DO said.

We are contemplating what is up with those who have not started with the exercises of cleaning and renovating including the reshuffles in their Ministries.
 
Wanguhu Nganga must understand its about time to remove dead woods in Government Offices which stopped functioning way back in the 90’s.  The corrupt must be replaced.  Services must trickled down to be felt by Mwanainchi. Even if it is a drop in the ocean.  The cartel’s connections must be broken.
 
We already told Kibaki, “hands off” from Ministers who are doing their work.  We want result and Mr. Wanguhu Nganga, stop dreaming.  We are not going back to those dark days.  Wake up……….

Nyong’o, Ngilu defend appointments

Two Cabinet ministers last night dug in for a fight as the storm over jobs swirled, sucking the eighth ministry — Agriculture. Prof Anyang’ Nyong’o, the Medical Services minister, and Mrs Charity Ngilu, his counterpart at the Water ministry, defended their actions and dared critics to drop the gauntlet at their feet.

PHOTO: Maarufu MohamedOn Monday, a defiant Nyong’o fired back at critics opposing his recent appointments at his ministry saying: “We must dismantle the cartels that are causing rot in the provision of essential medical services.

“Those with misgivings can visit my office or the Permanent Secretary. I will ensure the right people are in the right places.”

Nyong’o said he would not retract on the changes and challenged the organisations fighting the reforms to account for their achievements in the sector.

“They claim I recycled retirees, but Dr Kipkerich Koskei (Chief Pharmacist and Registrar Pharmacy and Poisons Board) is an appointee of the Public Service Commission,” said Nyong’o.

“I know many retirees in their 60s and 70s who are still in public service. Why should they selectively criticise my appointments? I have no apologies,” Nyong’o said.

In another statement last night, Nyong’o further defended the appointment of Koskei and Dr Richard Muga to head crucial boards in his ministry, describing the two as professionals worthy of the positions.

He also sought to clarify that while he appointed Muga, a former Director of Medical Services, to chair the Kenya Medical Services Agency (Kemsa) probe taskforce over claims of mismanagement, Koskei’s appointment was done by the Public Service Commission.

Nyong’o was reacting to criticism by professional organisations over the appointment of former chief executives to head boards they formerly served.

Members of the Pharmaceutical Society of Kenya, Kenya Pharmaceutical Distributors Association and Kenya Pharmaceutical Association have accused Nyong’o of “recycling retirees”.

Nyong’o said Koskei was appointed to the post by the Public Service Commission in 1996, but irregularly removed in 2002. He described the removal as “regrettable” and accused the Narc Government of breaking the law.

He said Koskei remained Chief Pharmacist and Registrar to the Poisons Board with no responsibilities until his reinstatement this month and noted that the officer had never been a subject of any disciplinary action in his career.

He, therefore, said it was only the PSC that could revoke the appointment.

Performance

On her part, Ngilu warned that performance would be the key indicator in the water sector even as she pointed out that many well-funded projects had stalled under senior engineers.

“I stand by my decisions. They are in best interest of Kenyans and in tandem with Vision 2030,” Ngilu said.

An engineer at the Water ministry claimed that a junior official in Job Group P was promoted to Job Group S to enable him occupy a senior position. His promotion was effected in 2005.

“This demoralised many of us who inducted him in the ministry,” the engineer, who requested anonymity, told The Standard.

Mr Wanguhu Ng’ang’a, the Water Services Regulatory Board chairman, took his war with Ngilu a notch higher with the demand that the minister and the Ps, Mr David Stower, be sacked.

Addressing a press conference in Nairobi, Ng’ang’a urged President Kibaki and Prime Minister Raila Odinga to “tame the behaviour of the minister and her PS”, saying they were making decisions which undermined State procedures and protocol.

“Ngilu has no power to dissolve any board or to sack anyone sitting in any board. She is being misadvised by the PS and it is for that am appealing to Kibaki and Raila to kick them out,” Ng’ang’a, who criticised the creation of Tana-Athi Water Services by the minister, said.

He dismissed the new entity as illegal.

At the weekend, Ng’ang’a had accused Ngilu and Stower of subverting regulations in discharging their responsibilities.

But as the ministers spoilt for a fight, the epicentre of the storm appeared to shift from Afya House and Maji House to Kilimo House where a controversy over appointments burst into the open.

At Kenya Sugar Board, which is under the Agriculture ministry, a new board is set to be inaugurated today without a substantive chief executive.

An acting official has held fort since November last year. Yesterday, there was no word it would be filled, even as behind-the-scenes lobbying intensified.

The vacuum has been blamed for the chaos gripping the sugar import sector, with analysts suggesting that Agriculture minister William Ruto has not benefited from expert guidance on policy issues in the industry.

It is their view that the minister has operated from the deep end where he found himself cast as he took up the docket.

Ms Rosemary Mkok has been acting in place of Mr Andrew Oloo Otieno, who was suspended over allegations of abuse of office in the Muhoroni and Miwani sugar companies receivership and disposal saga.

Yesterday, the Sugar Campaign Foundation Chairman, Mr Peter Kegode, appeared to open a new war front with a call on the minister to set a timetable for privatisation of mills.

He argued that 70 per cent of the industry was in the hands of Government.

Kegode urged the minister to appoint qualified and focused individuals, who could guide him reshape the industry.

At Sony Sugar — one of the country’s leading millers — several managerial appointments were still pending.

Some of those invited for interviews last week as liaison and legal officers were sent away without sufficient explanation.

At Kenya Trypanosomiasis Research Institute (Ketri) — another parastatal under the Agriculture ministry — the board was disbanded in 2003 and has never been reconstituted.

Its services have been transferred to the Kenya Agricultural Research Institute.

At Ardhi House, Lands Minister James Orengo has reshuffled up to 300 clerks within the department, throwing the ministry into panic.

The changes started last week. The clerks are reportedly being moved to other ministries.

At the Prisons Department, warders continued to ponder the fate of promotions after they sat interviews, warning that it continued to cause anxiety and transparency would be compromised.

PER CURIAM:

Hannibal Nganga Wanguhu, a native and citizen of Kenya, seeks review of an order of the Board of Immigration Appeals (Board) denying his motion to reopen and reconsider removal proceedings. We have reviewed the administrative record and conclude that the Board did not abuse its discretion in denying Wanguhu’s motion. See 8 C.F.R. § 1003.2(a), (b) (2006).

Accordingly, we deny the petition for review for the reasons stated by the Board. See In Re: Wanguhu, No. A79-513-031 (B.I.A. Jul. 26, 2005). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.

Re: As we were growing up!

Whether our parents had an opportunity to go to school like some of us or not,is besides the point! What I do know is that as each child was growing up, there were certain subjects of importance that our parents passed on to us. Included in the list were the following:

1. Never despise or laugh at those who don’t have!
2. Never mock, talk ill of, or laugh at a disabled/crippled person!
3. If someones child elopes,talk less or nothing about it
4.Never beat your chest with the feeling that you have arrived!
5.Don’t make fun of how people talk, or pretend walking as a crippled person just for the fun of it, or even being sarcastic on how a sick person talks or expresses himself/herself!
6.If you happened to go to a neighbors house and they did their best to welcome you, don’t come out saying all kinds of stuff

As we became of age and some of us Christians, we were further reminded of the following:

1.The first will be the last and the last the first!
2.God punished children who laughed at his man servant-Elisha
3.The fact that you were the first one to earn a certain degree, made it to a foreign land, buy a car/house and many others don’t mean a thing.
4.The under-dogs have always come back and surprised the world by beating the champions
5.The little boy named David,conquered a giant known as Goliath with just 5 little stones!

But, did we learn anything! Well, I will let you be the judge! But I have a feeling that some of us need to turn the clock backwards to the age when these vital lessons were passed on.

Although in many ways, we tend to entertain the thought that we are wiser than our parents, I bet those parents knew what they were teaching us. You and I better recall what they taught us!

I am willing to re-learn again so as to avoid hurting others! How about you!

Folks,

This is a testing water for Saitoti. Yes, he needs to act. I am concerned about some Ministers earn Tax Payers money yet they dont seem to do their work?

We also want to know sequences of what these Ministers do from Monday to Friday, every week and every single month. Do they perform equivalent to their earnings? Their activities will demonstrate improved performance in retrospect.

We now expect him to overhaul Police Leadership with immediate effect. This is survival and security for Kenyans that has gone to the dogs.

This is what it spells. Every Minister must embark on Cleaning and Remodelling, especially where there is rot in their portfolio like this one.

Kudos to Orengo, Ngilu and Anyang Nyongo for cleaning their Ministeries for improved service.

People, we are with you every minute every hour and we will not rest till the dust settles.

People seeking treatment for gunshot wounds at the Kenyatta National Hospital (KNH) are usually aged between 18 and 24, indicating an increase in gang violence and a population that is engaging in criminal activities at a very young age, a new study by four researchers at the university says.

“Barely 10 years ago, victims of gunshots were two decades older and most were shot by criminals interested only in dispossessing them,” says lead author W.A. Odhiambo.

But in this study, done at KNH, almost one third of the victims were found to be targets of police shootings or “official stray bullets”.

This is the first time a structured scientific study indicts the police as being responsible for a significant number of gunshot victims.

Although the study does not dwell on circumstances leading to the police shootings, calling them “stray bullets”, this could be interpreted to mean a poorly trained force or what activists call trigger-happy policemen.

“The perpetrators of firearm violence were often identified by victims as a thug or robber (66.4 per cent), followed by police officers, who were responsible for 23 per cent of the injuries out of which nine per cent were ‘stray bullets’,” says the study.

Published in the March issue of the East African Medical Journal, the study looks at more than 700 firearm injuries at the hospital in 2004 to 2005 and within the same period, records a significant increase in the use of guns in committing a crime.

The study, however, does not include those who had died of gunshots before reaching the hospital.

Young males comprise the highest number of victims reporting to the hospital with gunshot wounds, outstripping females by a ratio of almost eight to one. However, when women are involved they are much younger than their male counterparts — by almost seven years.

The study says gunshots are now the third most common cause of spinal injury after road accidents and falls from heights. It warns Kenyans to be more vigilant between 9pm and 10pm because this is when assaults peak.

“Members of the public could be advised to avoid dangerous areas around these hours, while police patrols are increased.”

Another senior lecturer at the university’s School of Medicine, Dr H. Saidi, draws a chilling parallel between the unfolding situation in Kenya and South Africa, whose gun-related crime rate is very high. He says a South African study found that 86 per cent of victims of gun-related incidents were between 13 and 18 years, the majority of whom were intoxicated.

Young victims

“The local study also depicts very young victims. Under what circumstances would this post-school population become victims of firearm assault? Could the current and younger group, as in South Africa, possibly be involved in crime and gang violence?” the study queries. It concludes that in the absence of any structured crime prevention programmes, increasing poverty and a growing drug culture, firearm-related crimes can only get worse.

This is rediculous, a show of incompetence personnel in PM’s Office.  “The deputy USA ambassador to Kenya had an appointment to see PM Raila at 11am on Friday. But at 10am, the official from PM Office called the deputy ambassador and rescheduled the meeting for noon. He arrived Five minutes to the appointed time, waited for 30 minutes without word of where their host was. The PM was away as the US team visited. They finally gave up and left”.
 
The PM’s Personal Assistant Mr. Mohamed Idris should not have confirmed the appointment in the first place, or better still could have called the visiting team 30 min. before appointment time to cancel the meeting if he realized there were technicalities the PM Raila was not going to be available.
 
How important is an important meeting?
 
The Standard on Sunday established that the US team has been working on putting together a programme for a trade delegation the PM is to lead to the US in September. The team is also planning investment in social projects for Kibera in the PM’s Lang’ata constituency and was probably there for the two issues. Mr. Mohamed Idris should be fired with immediate effect. He is unfit for this position. Without wasting time, he must be given leave of office because he will blunder more. He will cause this PM’s office to be disfunctional. This is just the begining of an iceburg.
 
The Prime Minister needs a Multi-Task staff Assistant who is capable to work under extreme pressure with a knack of tact and speed. He should stop making flimsy lousy excuses of Prime Minister being busy and is on tight schedule. His number one priority is to brief the PM on all contacts of people trying to reach him. He should be in cordial communication and be able to provide ease of free flow information conduit from all Political, Administrative, Executives, Judicial, Family and Guests.
 
An example when we went out to Demonstrate on Washington Streets at the State Department and the White House, our issues were received with professionalism and handled with speed and the concern it deserved. This is the Super Power Office in the world attending to ordinary folks like us. What will become of ordinary wanainchi with no portfolios but have burning issues that befit Prime Ministers attention? 
 
Personnel in PM’s Office must be put to work in an organized independent fashion. They too will help in sieving need assessment of information inflow and outflow to avoid bottleneck of activity flow in Prime Minister’s Office. Someone needs to put skilled personnel in this office with endorsement of Prime Minister himself. The Prime Minister must be satisfied these people can execute his work professionally.
 
Many Offices in the past failed because Domestic Affairs took control of the management of office matters. They usually mess up and cause conflicting issues. We want to see Prime Minister execute his duties and perform at his best, because he is smart and intelligent. He has come a long way in which case, he should have his program drafted so he could find quality time within his schedule, to attend to  his family in a balanced manner.

Exactly!!! PM office needs to have effecient and effective officers to assist him in speeding up the economical recovery of our country.

The Chief Secretary should help Raila to develop our country by posting effecient officers to PM’s Office. There is no reason at all to post officers who are inefficient in that office unless you want continue with frustrating Raila’s work for the nation.

Kenyans are expecting Raila to delivery services quickly in order for us to recovery from economic ruin which PANU brought.

In any case,kenyans are not expecting Chief Secretary to be partial when dealing with efficient delivery of services. If, as the chief secretary,you still behave as a PANU appointee then it high time you retire.

We want a clear minded civil servant to replace you for the sake of general development and security of the country. Trying to play politics in this important office will not help the conutry at all. Forget about GEMA domination which you are pursueing at the expense of kenya unity.
