    A REJOINDER TO PROFESSOR MAKAU MJUTUA

    Makau Mutua, Interim Dean and SUNNY Distinguished Professor at the State University of New York and Buffalo Law School and Chair of the Kenya Human Rights Commission is indeed a learned man to whom most people would like to pay attention wherever his article appears in the popular press.

    Whether or not this professor is distinguished is not going to be the subject of my article. I shall choose to treat the professor’s article that appeared in the Daily Nation on the 3rd March 2008 as an intellectual dishonesty by this man of learning.

    He says the following:

    ‘’Rather, Mr. Odinga must see it as an opportunity to democratize the state, not a vehicle to aggrandize his power. I say this because there are many supplicants around him who have no other interest except a job with access to resources.’’

    I must remind the so-called distinguished professor that the constitutional changes that are now expected to be implemented in Kenya are embodied in the Bomas of Kenya Draft which is a product of contributions of Kenyans of all walks of life, Raila included. This Draft was opposed by only one community in Kenya, GEMA.

    Had the MOU that resulted from the Bomas of Kenya Draft not been shunned by Mwai Kibaki may be the more than 1,500 innocent people could not have been killed following the 27th December 2007 presidential elections theft. Raila was for the Bomas of Kenya Draft and the MOU while Kibaki was secretly not. History has confirmed this fact.

    If Mr. Raila Amolo Odinga was driven by power aggrandizement as you would like the world to believe he could not have chanted Kibaki Tosha and campaigned for him at his own expense to have him assume the presidency. Without this open and non-ambitious support by Raila the latter could never have got that job. Was that self aggrandizement on the part of Raila Amolo Odinga?

    The distinguished professor is trying to do the impossible, that is, to convince the world that Raila is ambitious for power and full of self aggrandizement.

    Who are these people surrounding Raila Amolo Odinga that are whetting their appetite aiming at accessing the resources? Is it not a historical fact Professor Makau Mutua that only Mr. Odinga and his team fought tooth and nail for justice, equitable distribution of resources, jobs, corruption free nation, to mention but a few, at a time that GEMA had not only gone slow but also grounded to a halt on such matters? Who is fooling who, Professor?

    ‘’Mr. Odinga must forcefully reject such base proclivities and listen to the nobility of his better self. Kenyans and the international community expect him to exhibit statesmanship.’’

    Professor! You are not being honest by asking Raila Amolo Odinga to do what is irrelevant since you know where to aim your missiles, not at the innocent locally and internationally recognized statesman, Raila Odinga and ODM members, if you want to save Kenya.

    ‘’It is some of these malignant voices that are likely to work to wreck the agreement. Mr. Kibaki must not allow them. Since he cannot run for a third term, President Kibaki must now focus on his own legacy and emulate the saintly Nelson Mandela.’’

    Professor Makau Mutua, unless you want us to believe that you have lost your sense of reasoning and intellectual capacity you should not tell us that you honestly do not know that the likes of Wetangula and Martha Karua were indeed acting as was ordered by Mwai Kibaki. Do not try to stretch our intelligence too far.

    Professor Makau Mutua can you academically and honestly tell Kenyans and the world what is indeed saintly in Mwai Kibaki that would make him compare favorably with Nelson Mandela? Can you tell Kenyans and the world how a person who loses an election in six and a half provinces out of eight declares himself the winner and swears himself into office secretly surrounded by his tribesmen can be qualified to be called saintly? Can you tell Kenyans and the world how an impostor to the presidency who orders policemen and his Mungiki tribesmen militia to shoot and kill Luos and other innocent Kenyans can be called saintly?

    Your own definition of a saintly person escapes common sense and hence automatically disqualifies you from that post at the State University of New York and Buffalo Law School, let alone being the chair of the Kenya Human Rights Commission. Your determination to create a saint out of a person whose theft of the electoral votes led to the death of more than 1,500 souls, throwing Kenya into darkness is amazing, Professor Makau Mutua.

    ‘’When his epitaph is written, let it say that President Kibaki rose above all mortals in Kenya’s most precarious moment to lead from the valley of death.’’

    Dear Professor Makau Mutua, the whole wide world knows that Mwai Kibaki never accepted what all mediating teams were offering Kenya and that none of them, including Kofi Annan was spared disgrace by PNU hard cores singing Kibaki tune. May be Condolesa Rice made Kibaki realize that his fate was not any different from that of Saddam Hussein in order for him to see a Kenya inclusive of all of us. Without Condolesa Rice may be the votes-thief could be still mistaking Kenya for GEMA. You cannot fool us Professor. Do not be shocked if one day Mwai Kibaki’s epitaph is written at The Hague since the death of innocent young democratic Kenyans, most of them Luos, cannot be taken lightly by mankind, except by the likes of you!

    ‘’The two must then find a meaningful role for Mr. Kalonzo Musyoka, the Vice-President. The three must whip their key aides and supporters towards a common national purpose. The three must act like self-less choirmasters taking turns to conduct an inchoate symphony. Soon-very soon-Kenya’s disparate voices, injured identities, and lost hopes might just start to cohere again. In short, it is all going to be about leadership going forward.’’

    Much as the way forward is a necessity for our country it must not include dishonesty by our learned friends from whom we deserve much more, Professor Kamau Mutua. It is a shame that you strongly suggest that traitor Kalonzo Musyoka whose action led to the death of more thaan 1.500 people should be given a meaningful post. Shame on you Professor Makau Mutua.

    I am giving you a timely advice never to rub salt on the festering wounds Kenyans are now bearing because of Kibaki and Kalonzo Musyoka. I expect that you must have realized that the mediation talks never included the post of the Kenya’s Vice-President. Even when the full weight of President George Bush was brought down on Mwai Kibaki and PNU after he had frustrated Kofi Annan only power-sharing between PNU and ODM was arranged. May be the learned professor could tell us where ODM-K surfaced in the mediation talks accord. The accord reached reflected only PNU and ODM which were the disputing parties. It is a miracle that the great professor, for tribal reasons, now wants to wriggle in the anointed Judas Iscariot Kalonzo Musyoka. Those who have been anointed need not professorial assistance.

    The UNO, AU, EU, EAC, and the USA, the eminent persons, not to mention Kofi Annan did not include Kalonzo and ODM-K in the Grand Coalition, Professor Makau Mutua. His anti-Kenya act that led to his appointment to the post of Vice-President cannot be washed to be as white as the snow by your ignoble appeal. Do you think professor Mutua that Kalonzo Musyoka, a lawyer by profession, did not realize that Mwai Kibaki rigged the elections and worse ordered police to shoot to kill innocent democrats who were honestly contesting the theft of their votes?

    ‘’What President Kibaki and Mr. Odinga must now do is to seize this historic opening to forge a national identity. Out of the ashes of these abominations may lie the destiny of Kenya as a great country. These two leaders can confirm that they saw the precipice and decided to turn away. They can preach to Kenyans that down the path of ethnic division, intolerance, and despotism awaits the termination of Kenya as a state.’’

    Kibaki did not turn away from the precipice, Professor Makau Mutua. He only gave in when he and his PNU members were apparently threatened with a fate similar to that of Saddam Hussein and his cabinet, let alone his Ba’ath Party. At least you owe Kenyans some degree of honesty Professor Makau Mutua.

    ‘’…….That is why those who have been displaced must be resettled on their properties and made whole as a testament to this truth.’’

    Well, all Kenyans yearn for justice, particularly where just property allocation is concerned. The same problem is faced by those who have been unfairly displaced. But to suggest that they have to be returned to their property in whole is to say the least dishonest. Would you like your ancestors’ land (which had been dishonestly and without your people’s consent, awarded to some favored tribe because the centre of gravity of power was, without your active participation deflected away from your province by those who wielded power and who for the last 44 years considered your people and province to be politically incorrect or to be more exact inferior) to be permanently returned to the IDPs before Truth and Reconciliation decides what is just?

    What you have strongly suggested here is but the worst type of time bomb that Kenya could least afford. It should be a shame for you professor to call it the truth. It is because of the theft of this land that more than 1.500 people have laid down their lives, Professor Makau Mutua.

    Conclusion: Professor Makau Mutua, I must honestly say that what motivated your article is the fact that you are regretting the possible loss of the VP post in the soon-to-be-made-law under the new political dispensation in Kenya.

    Your esteemed VP is a criminal who knowingly took part in the rigging that led to the deaths of more than 1,500 innocent democrats and therefore your greatest worry now should be how to save him from the potential trial at The Hague just in case the Truth and Reconciliation so decides that such action could be expedient.

    KIKUYU PETITION TO GORDON BROWN

    Petition: Mrs. Mabel Muruli Mark has written a petition to the British Prime Minister Gordon Brown in order that Great Britain should recognize the Kibaki government. She strained to convince Gordon Brown that Mwai Kibaki won the 27th December 2007 presidential elections and that the losers should effectively direct their complaints to the competent courts as by law established.

    Mrs. Mabel Muruli Mark seems to be living on another planet otherwise she is selfish and outright dishonest. To categorically tell the British Prime Minister that Kibaki won the election is to say the least an insult to a country whose elections observers stated clearly that the 27th December 2007 presidential elections in Kenya were flawed. Besides, Great Britain is a party to the power-sharing deal which is meant to restore peace to Kenya, the peace which was killed by Kibaki’s criminal stealing of the elections.

    Mrs. Mabel Muruli Mark does not seem to realize the fact that under normal circumstances Mwai Kibaki and his PNU members should be languishing in prison for the election crimes they committed against innocent Kenyan democrats.

    Does she not know that Kenyans will one day demand that the PNU leaders be charged with the injuries and deaths of innocent Kenyan democrats in the hands of the police and the government sponsored Mungiki militia following the theft of the 7th Presidential elections by Mwai Kabaki?

    This lady is claiming that they are petitioning the British Prime Minister on behalf of Kenyan Community Abroad, KCA. Which Kenyans are these who are taking part in a partisan petition that favors only one tribe of the 42 in Kenya?

    Competent courts: Her talk about the competent court system in Kenya smells of the fact that as long as the said institutions are packed with GEMA judges delivering GEMA justice then non-Kikuyu Kenyans should lie low like envelops receiving Kikuyu justice. It could have been the height of folly for Raila Amolo Odinga to go to Kibaki controlled GEMA courts to seek justice following the latter’s theft of the presidential elections.

    Opposition sponsoring violence: It is shamelessly arrogant of her to insinuate that the opposition sponsored violence, rape and murder while she is studiously silent over the fact that Njenga Karume has not denied he is the main sponsor of Mungiki militia. Besides she is studiously silent over the fact that George Saitoti, Uhuru Kenyatta, John Chris Kirubi, John Michuki, Mwai Kibaki (all Kikuyus) to mention but a few, own Mungiki and are actively not only financing but also arming the killer militia.

    What is Mrs. Mabel Mark Muruli saying about the Assistant Minister Wanjala in whose car police found weapons and who following this incidence defied police summons to register a statement with them at the Central Police Station? Does she know that no action was taken against this Assistant Minister by the Mwai Kibaki government?

    Does she not know that apart from the Nyanza PPO who openly admitted shooting to kill the Luos police too have said they were given orders from above to shoot to kill the demonstrators? What power has Raila Amolo Odinga and ODM have over police and Mungiki killers? The policeman shot and killed Member of Parliament Kimutai. How did he come into contact when every Kenyan knows that the Kenyan Traffic Police do not carry fire arms?

    Land: It is dishonest of her to say that Kikuyus bought land in the Rift Valley since Kenya achieved Independence at a time when most Kikuyus were not only jobless but also without money due to Mau Mau uprising. The fact is, their kinsman Jomo Kenyatta selectively dished out land to them notwithstanding the fact that the land belonged to the Maasai and Kalenjin, and in so doing passed the bill to the landless Kenyan tax payers to foot.

    Majimbo: This is not only an ODM idea but also it was entrenched in Kenya’s constitution at Independence 12.12.1963. The first people to apply Majimbo are the Kikuyu since they do not allow other Kenyans to own property in Central Province. Those who have tried failed to get clients as their kiosks are either boycotted or razed to the ground by hostile tribal fire.

    Rigging of the 27th December 2007 Elections: It is a shameless lie by this lady to even imply that ODM rigged the elections since the elections polling stations were manned by not only 66.000 Kibaki APs but also the infamous returning officers were recruited by Mwai Kibaki for the sole purpose of rigging the elections.

    Two days to the presidential elections tallying the Police Commissioner Ali warned the public to keep off Kenyatta International Conference Centre in an apparent preparation for the rigging. On the election tallying day it is not a secret that the GSU cleared local and international observers from the KICC in order for them not to witness the official rigging taking place at the time.

    If Kibaki won the elections why was there any need for secret swearing in just hours after the elections? Why were the diplomatic corps not invited for the occasion as usual? Why was the national anthem not played on the occasion? Why was Kibaki surrounded with his close tribesmen on such an important national occasion?

    Closely ran elections: It is a lie to suggest that the elections were closely ran. Raila Amolo Odinga beat Mwai Kibaki in six and one half provinces to Mwai Kibaki’s one and one half provinces only. Does Lady Mabel Mark Muruli have any respect for simple Arithmetic?

    Police partiality: The Nyanza PPO, Kaindi admitted that she was given orders to shoot and kill those who were looting and demonstrating against the theft of their democratic rights by Mwai Kibaki. Mungiki killers in Naivasha and Nakuru were seen live on TV being supervised by Kibaki police as they torched houses deemed to belong to the Luos. In a friendly mood police were seen escorting them to safety after committing gruesome murders against innocent people.

    Mrs. Mabel Muruli Mark says that every Kenyan has a right to life. If that is true why is she stone silent over Mungiki killing and skinning two-year old children? Would she deny the fact that Mungiki is the main force that led to Mwai Kibaki rubbishing the MOU, the government supports the Mungiki militia and vice versa Mungiki Militia protects the Kibaki government, key Kikuyu businessmen politicians, academics bankroll and arm the Mungiki militia?

    Endorsing Kibaki by UK: The causes of the post elections violence injustices, crimes, corruption, inequitable land and job distribution and many more are now under the microscope by an independent commission set up by AU, EU, USA in order to return normalcy to Kenya. With this setup in place why should Great Britain favor Mwai Kibaki? Mwai Kibaki was rejected at the polls by six and one half provinces leaving him with only one and one half provinces. What role would Great Britain play in the cause of democracy by endorsing Mwai Kibaki to illegally rule over Kenyans? On what ground should Great Britain force Mwai Kibaki on Kenyans after they have rejected him at the polls?

    A reminder Lady Mabel Mark Muruli: By government design Kikuyus are granted soft loans, licenses and protection by provincial administration over and above other tribes since Independence. This fact is known by all the remaining 41 tribes that form more than 80% of the population. It would be wiser for you Mrs. Mabel Mark Muruli to be less arrogant and selfish and to approach other communities who are disadvantaged by the government in your favor for a dialogue for the sake of peaceful national coexistence. Asking Britain to give Kikuyus a favor is naïve and to say the least an avoidance of the honest solutions to the problems you Kikuyus have created for other Kenyans.

    Conclusion: Mrs. Mabel Mark Muruli, if I were you I could start thinking outside the Kikuyu cosmology. Remaining enclosed inside the GEMA cocoon is hardly helpful. Thinking that you will always be favored is foolhardy, to say the least. You have recently seen how the wealth that you have accumulated unfairly and with which you are arrogant toward other tribes can go up in smoke within minutes, Mrs. Mabel Mark Muruli.

    To think that other Kenyans will always be ruled by Kikuyu is remote from the truth. It should frighten you that all other Kenyans have resolved to commit suicide instead of being lorded over by Kikuyus again.

    Learning from the arrogant way Mwai Kibaki rigged the elections and soon later shot and killed innocent Kenyans you should humble yourselves for you to be given another chance to rule Kenya. Neither Museveni soldiers, the Mungiki militia he is understandably training against Kenyans nor Great Britain will help you to regain the trust ordinary Kenyans have lost in you.

    Great Britain cannot impose Mwai Kibaki on Kenyans, knowing that the majority of Kenyans rejected him on the 27th December 2007 general elections.

    The Iraqi Sunnis behaved the way you have behaved since Independence 12th December 1963 and they are now on the receiving end. Arrogance, assassinations, corruption, ethnic exclusion, favoritism have not helped them with Saddam Hussein gone forever.

    What should be worrying you is the fact that no sane country supported Mwai Kibaki apart from Yoweri Museveni who has personal reasons to hate Raila Amolo Odinga and ODM, knowing what he has been historically doing in Uganda against the Nilotes.

    Having respect for the other Kenyans, equitable distribution of resources and jobs, true Majimbo and not banning other tribes from your province while your people strangle them economically in their own provinces, and equitable distribution of land will bring peace to Kenyans and not otherwise.

    The findings of the recently established Truth and reconciliation might come up with the simple truth and that is, Kenya will neither be GEMA nor GEMA be Kenya.

    Truth will always come out,it almost 45 years since Kenya got its independence from Britian.This period is long enough for kenyans to start enjoying the fruit of independence equally. But
    the obstacle of enjoying the fruits is very Gema leaders who are
    out to make other kenyans slaves. To them, slaves are not suppose to enjoy any slight freedom.Fruits of independence is
    for the few who were former homeguards. These former homeguards enjoyed during colonial government after betraying
    Mau Mau fighters. By helping colonial government,they were rewarded by large acres of land which were owned by freedom
    fighters.

    Immediately,after independence, the same shift to Kenyatta ‘s
    administration where they were to be awarded heavily. When Kenyatta died ,Moi went a head to work with them . Here, again,
    they were the beneficiary.In fact ,Kibaki has left his leadership to be run by these greedy people as kitchen cabinet. These are
    people who are ruining kenya’s democratic gain. They do not want change at all. Let us isolate these people first inorder to
    be built united kenya for everybody.

    These people have never fought for common men share because
    they want everything for themselves. At the moment,they are killing Mungiki after using to protect and kill imeginary enimies
    at Naivasha,Nakuru,Molo,Kisumu. We should stand firm and say
    enough is enough about these people who are,though few, enjoying 80%of kenya wealth. In any case,these particular people were enemy of leaders who were fighting for independence. They should not be allowed to harvest where they never planted.

    The fruit of our unity cant fade as the exact time looms we wont be buogored with a dead snake in the room of politics. JAKOM need to worry less as he is the man to sail comes 2012.His allies are making a gravy move to their political career.
