It’s high time that Kenyans of Goodwill should take to the streets to demonstrate over what I would call impunity “fighting back” in Kenya .The reason why taxpayers money should be used to defend any individual named in the Ocampo list is a big joke, no one give a single satisfactory reason as to why this criminals deserves this instead I propose that if found guilty by the ICC, their wealth should be used to compensate those who suffered in PEV, I do respect Kalonzo for being a politician who se record have not been tainted during his time in the office but I was dumbstruck by his latest stance over this issue, no wonder his haters dubbed him watermelon during the referendum campaign, his best position could have been his usual no/yes phenomenon for that matter, to play it safe.

I watched the Vp, a lawyer, argue that by virtue of their employments Muthaura and Ali qualified for the taxpayers payments of their legal expenses. I disagree. Muthaura allegedly gave order to Ali NOT to prevent violent attacks by mungiiki gangsters on non kikuyu Kenyans. If that is true then it was an illegal order. Taxpayers cannot pay for his defence. Ali, on his part, by heeding that order abetted violence against innocent Kenyans instead of quelling it. That constituted an abdication of his position so central to maintainance of law and order and preservation of statehood. The taypayer cannot pay for his expenses. Can the competent legal authorities clarify this position to the country.
Yes impunity is raising its apparently undying urgly head again.
Mr. Anyango..this is my understanding of charges against these Six by ICC. The charges a and Muthaura were government employees at the time the alleged crime were committed but they are being charged under the aforementioned article clause. For this reason, they cannot “invoke” their official duty with the government as legal source of defense. The ICC is charging them with “individual responsibility”…the Six: cannot use:” we were carrying/following the orders of the State, Superior, others did it too …Kibaki and Oginga should be charged because they were the major principal in the election dispute…..etc.
If Kenya government ever dare to pay legal fees for these six or some of them, this government will be charged with “crime against humanity” because these Six were then carrying out government duties to commit the alleged crimes. I don’t know what type of law your VP maintain but international law may be not one of them!!!!. The noise and daily pronouncements you hear f nothing but colonial entity against African countries/leaders is only political but political statements for local consumption in Kenya.
The Six are headed to Hague no matter what these politicians say/do, or whatever the Six says out side the ICC court. The only hope for the Six and the politicians who support them hinges on the decision by pre-trial judges in March ( whether they will throw the case out or let the case move forward). In this case Ruto should fire his legal team!. If he thinks the ICC has weak case on him or against the entire group, he should not show his hands by petitioning ICC to throw out the case now. I forgot at he is a politician!!!!!
Though the issue raised is good about saying no to paying fees for the Ocampo six,Francis mixed and watered his very important contribution by praising the VP as untainted in his political career.
Francis, Kalonzo might on a big scale appear to you as untainted simply because he has tended to play watermelon all the time hence hinding his filthy under the quise of MR CLEAN.He has skeletons here and there and if worse was to be said about him,he kept Kambas backwards for long and even today his area is underdeveloped even with those big ministries he ran even during Nyayo days.Remember he even kicked out the owner of ODM-KENYA,poor lady,God will reward her.
You also mention that his-HATERS-branded him watermelon,are they his haters or truthfull fellows concerned about his wishwashy behaviour.His so called haters were people who were willing to tell him the truth and by extension he appears to have gone back to the watermelon group were he surely belonged-RUTO,UHURU,MOI.KIBAKI group.
