Immigration shuffle sparks panic

TENSION is mounting at the Immigration Department after changes were effected in which Director of Immigration Joseph Ndathi has been moved to Foreign Affairs ministry. A source at the department told Kenya Times other senior staff who could be possible targets were fearing of being transferred or sacked after Ndathi’s unexpected transfer to the Foreign Affairs ministry. “There is a general feeling that senior employees could be target of censure as well at the Department following the departure of Ndathi,” said the source.
The Director of Administration at the Foreign Affairs ministry, Mr Albert Musasia, has swapped places with Ndathi in the changes made by Head of Public Service and Secretary to the Cabinet Francis Muthaura. The source said the reshuffle could be effected at Foreign Affairs following the transfer of Musasia. There are also fears the transfer could be a blow to investigations being undertaken by the Kenya Anti-Corruption Commission (KACC), the Police and the Crimes Prevention Unit at the Immigration Department.
The move now ends the battle between Immigration minister Otieno Kajwang’ and Ndathi. Other changes effected include the moving of Joseph ole Kiserema from Foreign Affairs to the Ministry of State for Provincial Administration and Internal Security as Under Secretary, Fauziya Ahmed Mohammed from Foreign Affairs to Internal Security as Senior Assistant Secretary and Christopher Chika from Foreign Affairs to Office of the Prime Minister as Deputy Chief of Protocol. The transfer letter was fowarded to Permanent Secretaries Francis Kimemia (Internal Security), Thuita Mwangi (Foreign), Mohammed Isahakia (Office of the Prime Minister) and Emmanuel Kisombe (Immigration).
The letter was also copied to Titus Ndambuki (Public Service). “The following postings have been agreed upon with immediate effect. All affected officers are required to report to their work stations within two weeks from the date of this letter,” read part of Muthaura’s letterdated August 13. There has been bad blood between Kajwang’ and Ndathi over passport issuance at the Immigration department. Kajwang’ has ignored technical advice and opened the door for members of a controversial sect to easily gain the high security documents, an act that appears to reflect indiscriminate use of good judgment. Against the advice of PS Emmanuel Kisombe and Ndathi, the minister allegedly gave visas to seven members of the controversial Church of Jesus Christ of Latter Day Saints.
The minister ordered Andrew Barney, Jordan Casey, Canton Hutchison, Basil Khuzwayo, Michael Papworth, Solly Sibiya, Jordan Skidmore and Clayton Whiting – all members of the sect be allowed into the country. “These permits have delayed inordinately even after I directed they be issued. Can they be released today,” Kajwang’ had earlier ordered Ndathi. Kajwang’ has been cleared of corruption allegations in the issuance of work and entry permits by a Parliamentary committee.
The committee on Administration, National Security and Local Authorities said Kajwang’ acted within the law in approving the issuance of entry and work permits to foreigners. The committee, chaired by Mt Elgon MP Fred Kapondi (ODM), indicted Ndathi and recommended that he be investigated for failing to focus on the overall administration of the department. The committee recommended that the National Security Intelligence Services be also investigated for clearing foreigners on the basis of fake papers and in the process undermining State security. Faulting the Act for failing to state the number of foreigners who should be granted citizenship, the committee proposed that it should be amended to block future ministers from using those powers arbitrarily to naturalise non-Kenyans.

“Kenya is beginning to see the light??” Kudos to Kajwang??? I do not understand the source of your excitement. Transferring or shuffling corrupt government officials between ministries does not solve a damn thing! Suppose a thief robbed a bank in Nairobi and is taken to court then the judge tells the thief he is no longer allowed in Nairobi and has to move to Nakuru or Mombasa. Do you think that kind of reasoning is sound??Does it address the fact that the thief committed a criminal offense? If a government official commits a crime they should be fired and prosecuted according to the law. If their performance is below expectation then they should be fired according to their employment agreement. Otherwise they should keep their job period. Transferring such an individual to a different position does not address their lack of performance nor does it hold them accountable for any alleged crimes. I still do not understand your definition of progress. The day that we shall all be subjected to the rule of law, fairly and justly then we will herald that day as the beginning of progress. Otherwise what we are seeing here are mere shenanigans, politicians protecting their turfs and shielding their own from criticism.

Sorry I’m less enthused by these developments than you are.

Eric & Judy,

What we are seeing now in this job changing situation is just cosmetic, it is like putting people with the same chemistry together to continue stealing. If you are in a place where the boss is preventing you from stealing then comes the superman Mr. Francis Muthaura to help you , by taking you to a boss who will not disturb you when you are stealing. I think we should see things as they are. Even though other people may call a certain object a book, if it does not look like a book nor perform the functions of a book, can it really be a book ?.

Folks,

An accused person is not guilty unless proved or charged. I believe the man has to be moved from occupying office for investigation before he is charged.

The move in itself is a good sign and is therefore commendable. I am not excited but pleased that something is being done. Dont forget, we are on top of situations there, and we are not sleeping, we are not even stopping here, we are with them every step of the way. We have to give credit where credit is due buddy…..Its not an easy saddle.

Folks,

I agree with your sentiments wholly and we definately asking for total clean-up. We want to see what they are doing with dead woods. We already said earlier we want to see clean-up done. The have to do their job, we have to watch the next move. we cannot let this go on for more than a month. We definately want to see results.

Internal Security minister George Saitoti has said the Government will collaborate with the United States Government in fighting terror networks.

Speaking when he met a delegation of US congressmen, Prof Saitoti said that the Government was ready to commit resources and time to fight terror, with emphasis was on the exchange of security and intelligence data between the various anti-terror units.

He refuted claims that Kenya was acting under US command in the fight against terror, terming the remarks as “mere rumours”

“Who said Americans are leading the fight (against terror) on our soil? All we have to do with the Americans is what we call collaboration.”

The minister termed terrorism as a “big threat” to the security of the country, saying that although the country had returned to normalcy after the post-poll crisis, absolute security would mean pre-empting all terror attacks.

Prof Saitoti took the US team through the events that rocked the country following the controversial 2007 General Election to the present situation.

Mr Bennie Thompson, the head of the US delegation, floated the idea of merging all security agencies since the focus is on “fighting a common enemy.”

Borrowing from the US experience after the 9/11 bombing in New York, Mr Thompson said that such mergers have proved successful in the war against terror.

Prof Saitoti’s remarks come at a time when the police are facing accusations of leaking information to the mastermind of the August 7, 2001 Nairobi bombings, Harun Fazul to evade arrest.

Police have since denied the accusations, although the suspect has eluded police dragnets at least three times within a month.

Yes you are right, an individual is innocent until proven guilty. But if you decide that you are going to investigate a public official then it means that you have evidence of impropriety and therefore it is within the labor laws to fire them or suspend them pending prosecution. The purpose of this investigation would therefore be to establish whether the public officials actions warrant criminal prosecution or not. Otherwise if such evidence is lacking and you decided to investigate the officer then your investigation is based on hearsay.

There is nowhere in the law (labor, criminal or civil law) that stipulates that an official under investigation should be given an alternate position to facilitate investigation into his official conduct. Kangaroo justice is not justice at all!! You either prosecute someone based on available evidence against them or you dont, simple and clear. This shuffling of people around is kangaroo justice which we do not need. Just because “something is being done” it does not mean that the right thing is being done. We have laws, and we have a defined due process of the law, lets follow the law as it is written in the law books. Kajwang does not deserve any credit, all he did was get rid of subodinates who differed with him. I dont see how that benefits the 30+ million kenyans out there.

The article in the paper clearly states quote: “There are also fears the transfer could be a blow to investigations being undertaken by the Kenya Anti-Corruption Commission (KACC), the Police and the Crimes Prevention Unit at the Immigration Department.The move now ends the battle between Immigration minister Otieno Kajwang’ and Ndathi”. Therefore I dont understand what you mean when you say “we are on top of situations there, and we are not sleeping, we are not even stopping here, we are with them every step of the way”. The transfer is actually detrimental to ongoing Police investigation it is also according to the paper a personal grudge between Kajwang and Ndathi. As with everything the devil is always in the details . You clearly did not understand the details and implications of Kajwangs actions.

    TRANSFERS OF CIVIL SERVANTS-KENYA.

    Those government officials who are found to be corrupt and to be stealing from the public kitty should be sacked, sent to court, tried and punished ACCORDINGLY and not TRANSFERRED.Transferring them will never end the impunity.

    Transferring is condoning their corruption and also implicates whoever is transferring them where they can also with confidence continue with the vice.

    Corruption will never end in Kenya as long as the corrupt are transferred or promoted! And in any case the vice should be fought from from bottom-up and up-bottom position.

    It will be mere dreaming if small fish are targeted leaving the Anglo Fleasind/Leasings and Goldenburgs, whatever their names!

    It seems obvious that wheoever is transferring corrupt leaders instead of sacking them could be benefitting from either their incompetence, ineptness or corruptness.
