Storm as Muthaura defines PM’s powers

A fresh round of push and pull looms over the interpretation of the National Accord and Reconciliation agreement signed by President Kibaki and ODM leader Raila Odinga arose yesterday, in a new development that threatens the formation of a coalition government.

Secretary to the Cabinet and Head of the Civil Service Francis Muthaura yesterday differed with ODM officials when he issued a press statement clarifying and interpreting the correct structure and power-sharing in the Kibaki-Raila coalition government to be formed after constitutional changes.

However, moments after Muthaura had released clarification of the new government structure, ODM issued its own interpretation of the Accord that underlined a 50 – 50 division of power in cabinet portfolios and Government appointments.

“The Accord expressly provides for a 50 – 50 power sharing formula which in other words means power sharing at the two levels of Government, that is, the cabinet and government. The Government comprises of the civil service and parastatals,” a statement read out by Amukowa Anangwe stated.

“Any statement clarifying, interpreting or explaining the content of the National Accord must be jointly released by the two principals (Kibaki and Raila) and no other person. The structure of the new Government is being worked on by the two principals.”

According to Muthaura, the Accord did not take away from President Kibaki executive powers that he is perceived to cede to Prime Minister-Designate Raila Odinga.

    Breaking News: Kenya Government ‘Clarifies’ Peace Accord

    The following is a statement read by Francis Muthaura (Head of Civil Service and Secretary to the Cabinet) a few moments ago. ODM are said to be in a crisis meeting and are expect to respond shortly.

    “There have been various media reports that have created concern as to the roles of the position of the Prime Minister, Government appointments and structure of the Government following the national Accord. In that regard the Government wishes to clarify as follows:

    • The President remains the Head of State and Head of Government.

    • The Vice-President is the Principal Assistant or the President and the Leader of Government Business in Parliament.

    • The Prime Minister will coordinate and supervise the Government functions under the authority of the President.

    • The Prime Minister and the Deputy Prime Ministers will also have ministerial portfolios.

    • The President will appoint the Vice-President, Prime Minister, Deputy Prime Ministers and all Ministers subject to the terms of the Accord. The Vice-President, Prime Minister, Deputy Prime Ministers and all Ministers are directly responsible to the President. The President will continue to Chair the Cabinet.

    • The Accord does not include sharing of jobs in the Public Service.

    • Therefore, it should be clear that appointments in the Public Service are governed by the Constitution or Acts of Parliament.

    To this end:

    • Holders of Constitutional offices, Permanent Secretaries, Ambassadors, Judges of the High Court, Chairpersons of boards and a few chief Executives of Parastatals are appointed by the President.

    • All other civil servants in Central Government and Local Authorities are appointed by the Public Service Commission or through its delegated authority.

    • Judicial Officers including Magistrates, etc are appointed by the Judicial Service Commission.

    • Teachers are appointed by the Teachers Service Commission.

    • Almost all Members of the Boards of Parastatals, Except the Chairmen, are appointed by their respective Ministers.

    • Chief Executives of Parastatals are appointed by the ministers on recommendation of the respective Boards.

    • Other staff or Parastatals are appointed by their respective boards.

    I wish to assure public servants that there is nothing to worry about the safety of their jobs or the politicization of the Public Service. I urge public servants to embrace the implementation of the Accord. It is extremely important that professionalism in the Public Service is maintained and free from partisan politics.”

    As we congratulate His Excellency President Mwai Kibaki and Prime Minister-designate Hon Raila Odinga for signing the Comprehensive Peace Agreement that brought Kenyans back from the brink of collapse, Kenyans and our International friends must watch these agents of doom who are only interested in throwing spanners in the works.

    It is a known fact that President Kibaki and Raila agreed to share power on a 50-50 basis in a win win situation that was meant to pacify the whole country and bring Kenyans back to normalcy.

    But people like Muthaura, Karua and Mutua and others seem to be interested in safe guarding their own selfish interests at the expense of National Healing. Kenyans have gone through a rough patch that if it needs the efforts being put into place by both Kibaki and Raila to share power for Kenyans to live in peace, then so be it.

    It must take on some sadist to bring us back to that bad past. People like Muthaura, and Karua, without any provocation, seem to revel on our misfortunes as a country. They must be exiled to Siberia, or better still, airlifted to Guantanamo Bay immediately, so that the Kenyans can enjoy their new found happiness in peace.

    If we lose track now, it will be a very sorry mess we will be inviting on ourselves.

    We must hence dehorn those in the ilk of the Muthaura’s of this world, people who have lived past the recommended Biblical age. To him and his team, they thrive in the misfortune of Kenyans butchering themselves.

    All peace loving Kenyans must ensure that Muthaura does not derail our collective quest for peace and a stable Kenya.

    That stable Kenya will only be when the Government is shared 50-50 by ODM and PNU in a win win situation that creates peace and stability as we share in the National Resources.

    “Mr Muthaura said he had come out to spell the structure of the new government and the powers of the President, VP and PM to clear the doubts and different versions that had come up in the public following the signing of the deal.

    He also spoke of the concern on the fate of jobs held by people appointed by the Government in line with the Constitution or statutes.

    PNU AGAIN IS TRYING TO COME THROUGH THE BACK DOORS TO DERAIL THE REFORMS KENYANS BADLY NEED. MUTHAURA CANNOT DEFINE THE TERMS AND CONDITIONS FOR MATTERS TO BE LAGISLATED. HE KNOWS VERY WELL THAT THE PROBLEMS AFFLICTING KENYANS RANGE FROM UNFAIR DISTRIBUTION OF RESOURCES TO MANPOWER DISTRIBUTION IN BOTH GOVERNMENT AND PARASTETALS. WE CANNOT HAVE OVER FITY PERCENT OF BOTH CIVIL SERVICE AND PARASTETALS SENIOR OR EXECUTIVE POSITIONS OCCUPIED BY KIKUYUS AND MERUS ONLY. MUTHAURA HIMSELF IS ABOUT SEVENTY YEARS OLD AND SHOULD HAVE BEEN LONG RETIRED. MEMBERS FROM CERTAIN COMMUNITIES OUTSIDE MT. KENYA REGION ARE OFTEN RETIRED UPON REACHING AGE 55 YEARS OLD OR EVEN THEY REACH THE RETIREMENT AGE. WHY CANNOT WAKO, MUTHAURA, RINGERE AND MANY OTHERS WHO ARE ALREADY 56 YEARS AND ABOVE ALSO RETIRE?     EVERY KENYAN OF AVERAGE INTELLIGENCE KNOWS KALOSO THE JUDAS OF KENYA HAD SECURED LESS THAN ONE MILLION VOTES IN THE LAST ELECTION AND ANY RIGHTFULL THINKING KENYAN WOULD KNOW THAT THERE IS NO WAY KALONSO THE JUDAS CAN BE THE SUPERVISOR OF RAILA OR ODM STAFF IN THE GOVERNMENT.     Are we back to the ‘vintage’ Kibaki? Preaching water and drinking Wambui! Or are Karua,Muthaura etc having their own treasonable agenda? And where is the Catholic Church are they with us or with the devils?? The answers have to come fast before the hidden devils get up to their old tricks AGAIN!

    What Muthaura and Martha Karua said yesterday on the Annan Peace accord is a clear manifestation of that bunch of high handed individuals around President Kibaki that are squirming in their chairs when they imagine what this power sharing deal portends for them. These are selfish people who relish in the majority of kenyans forever remaining poor as a few looters enjoy the fruits of our labour.

    That brings me to my long held fear that Annan may have left a little bit too soon. The real problem in Kenya is and has always been the unequal distribution of resources and opportunities. When Kenyans joined hands to fight the 21st century Ali Baba and his bunch of forty thieves it was not just for the recognition of Raila Odinga as the Prime Minister. It was never for the mere provision of a motorcade complete with security detail. It was not to just end at forming a 6 man team to work out on the allocation and furnishing of an office for the Prime Minister and his two deputies. That alone wont put ugali, githeri, or biriani to Kenyans’ plates!!!

    Kenyans were sending a clear message that, like the French middle class in the 17th century, they were tired of the present day Maria Antoinettes who have lost touch with the reality about the despicable living conditions of the citizens. They were stating loud and clear that ‘WE ALSO WANT A FAIR SHARE IN THE MUCH RESOURCES AND MANY OPPORTUNITES THAT ABOUND OUR BELOVED KENYA!’

    It is far much beyond the reach of argument that the public appointments in Kenya are skewed. It is as clear as a cloudless sky that starting from ministerial Permanent Secretaries, to parastatal heads, to the provincial administration to the police and military force, there is so much tribal inequality that ought to have made Agenda number one in the Koffi Annan led peace talks. Because that is what directly affects Kenyans. These are the people who decide which of us from institutions of learning get employed. Go to Kenya Institute of Administration right now and find out the tribal ratio of those undergoing a 2 month training before being absorbed into the provincial administration? The ministry of Agriculture and the parastatals that fall under this ministry are the ones that shall decide who gets financial and material aid that has been promised to farmers in growing of crops this season. Woe unto the rest of kenyans if those institutions shall remain under the same patronage as it stands now!!!!

    Going by what Muthaura and Karua said is tanturmount to a father who accepts a young married man with kids as his son but refuses to allocate him a plot on his land on which to build a house and grow crops for his young family!!!! Kenyans should not sit back and watch as people of Muthaura’s ilk who have reached their political, economic and social menopause threaten to destroy what our fallen brothers and sisters have lost their lives for. We should all shout in one voice and tell Muthaura, ‘KENYANS ARE TIRED BEING TREATED LIKE SECOND RATE CITIZENS!!!!’

    I opposed this power sharing agreement from the start and I still oppose it now. Kibaki lost the election period. There is no need for him to hijack the process and hang on to power by force. Once Agenda 4 has been completed and it becomes apparent on how Kibaki, Kivuitu and the rest of the ECK commissioners who were accomplices in this felonious crime, participated in the election stealing, we demand a nullification of the declaration of victory by Kivuitu immediately and a transition government put in place to oversee a new general election. Kibaki and Kalonzo must be barred from being active participants. Their right to vote must be stripped as well because they are criminals belonging to the same gang group.

    Raila, should retain the very people who have provided his security all along and avoid mixing with the spies that this Kibaki group are planting on him to study his security arrangement and his home layout. It is important that we stay the course. Raila and Ida, please reject the security details you are being accorded. You have right poeple behind you and you do not need this compromised police force providng your security detail.
