Your email to Jane Hayes/Gavin Darby has been passed to me for a response.

Vodafone is aware of the concerns you have expressed in your email and indeed similar concerns have been aired in the media over recent weeks and months. There are essentially three misconceptions that lead to these concerns.

The first is that Mobitelea is a shareholder in Safaricom and that they will benefit from the current IPO. This is not true. The shareholders of Safaricom are the Government of Kenya and Vodafone Kenya Ltd. Mobitelea does not own shares to sell in Safaricom.

The second is that shares were given to Mobitelea. This is also not true. Mobitelea have paid for their shareholding in Vodafone Kenya.

The third is that Vodafone is being deliberately opaque about the details of Mobitelea. Vodafone is legally bound by a confidentiality agreement which forbids this kind of disclosure without being subjected to legal action.

Vodafone has been a committed investor in Safaricom and Kenya since 2000 and are please that our confidence has been endorsed by the substantial growth and success of the company.

I refer to our brief telephone conversation this morning and the need to talk to Gavin Darby-CEO of vodafone responsible for Africa operations. As Kenyan residents and business people living in the UK, we have grave concerns regarding the your chosen partner in respect to shareholding in Kenyan Safaricom and the lack of transparency on behalf of vodafone to come forth with detailed information about the owners of this shadowy partner. To contextualise the issue, Kenya have had serious problems in the past where shadowy companies were involved in fleeing funds to foreign countries. We have the example, of Angelo Leasing where billions of public money was stolen by using fake companies. As the CEO of the leading mobile operator with strategic investment opportunities in Africa and Kenya in particular, your have both moral and social responsibility to be transparent and not be party to a company whose intentions and ownership is to steal public resources from a third World country like Kenya. We have established that MOBITELEA was registered in Guernsey on the 18 June 1999. I wait in anticipation Kind regards Joram OdusChairman-Kenya Forum for Peace & DemocracyLONDON “This e-mail is sent on the Terms and Conditions that can be accessed by Clicking on this link http://www.vodacom.co.za/legal/email.jsp ”

I am not aware of such activities. BUT I would encourage everyone to the BUY shares. We need economic empowerment and this is certainly one of the ways to do that. I trust we do not want fall prey once again to the pre-independent talk that ‘we should not buy property in Nairobi because we will lose them to people from Central’. The consequences of the talk partly explains why Luos were very reluctant to invest in Nairobi in particular until recently whereby we largely remain TENANTS rather than LANDLORDS unlike our counter parts from central Province.

Buy these shares wananchi watukufu, from North America, Europe, Asia, South America, Africa and Australia/New Zealand!

Let us then endeavour to put this “mystery partner” on their toes…

With Safaricom Limited open not only to the Kenyan public but to the ENTIRE globe, Mobitelea (whoever that is), Vodafone Kenya Limited, Vodafone UK et al will shy to have any “hanky panky” flying around!

Herewith attached is the Safaricom Limited prospectus.

Whoever this joker from South Africa is responding on behalf of Vodafone, Their CEO or director for Africa and other areas said that they always go into partnership with local advisors to advise them on market dynamics. Last time I checked, Carribean Islands are not located anywhere in East Africa and South Africa is certainly not located there either. If this joker is going to come out and claim Mobitelea ( read (MOi BIwott TELecommunications East Africa) then his or her interest is the swame as the english mouthpiece that is covering them up. Wake up brothers and sisters, you are educated and have a bunch of degrees from some of the most prestigious universities around the world. Put this theory to the test and make the MF respond to your querries instead of try to brush you off as some other bushman african w/out common sense or an education.

Further, why do you let somebody in the ministry of finance sell you an IPO for shares that you already own as the taxpayer that got the company started to begin with and walk away with billions of shillings in commisions that go into their bank accounts? That is akin to the Enron Scandal that bought electricity and utility type commodities and sold them to the very same principles they bought them from to make a profit off the commodity they already owned. Do not get fleeced, Afrikaaner or not. You have the PHD’s use them to your country’s and peoples advantage. That Emilio does not have a PHD in Economics or Finance. You can probably run circles around him. Keep up the vigilance and watchfull eye over your less educationally endowed brethren. IT IS YOUR DUTY.

I’m also doing anything within my capability to make sure the truth is known.

Guys, good work on applying pressure on Vodafone. They need to be put on notice that although Safaricom is a sound company with a sound business model, ujanja will not be allowed with the peoples’ money.

The misconceptions mentioned in the correspondence by the alleged CEO are not the borne of contention in demanding that the the veil of incorporation of Vodafone be ripped off.

Rather Kenyans are concerned about the mystery surrounding the formation and very existence of Vodafone.Infact as a public servant the Finance Minister will not be doing Kenyans a favour by instituting legal proceedings so that the human faces behind this facade are known.Mr Kimunya is simply not performing his work and one will not be wrong to suggest that he is infact working in cahoots with the beneficiaries of this scandal to defraud Kenyans.
