PRESIDENT UHURU HAS POWER TO DICTATE WHAT HE WISHES

Joshua from Nairobi writes: “Fr Beste you said categorically in one of your recent articles that President Uhuru will have to pay Anglo Leasing whether Kenyans like it or not, and it has just come true. Kenyans cry is just like the cry of frogs which cannot prevent cows from drinking water in a river.

Now he is saying that he is taking the issue back to anti-corruption team to start a fresh investigation and people responsible will be charged. Do you think Uhuru does not know people responsible of the scam surely?”

Absolutely, President Uhuru knows people responsible Joshua. You have rightly put it, telling him not to pay is just like telling cows not to drink water from the river because of the noise of frogs. Joshua, president is a president and can dictate anything. Furthermore, which court will you take him?

On 20 September 2006, the former Minister for Justice and Constitutional Affairs Ms Martha Karua released what she termed as the Anglo Leasing list of shame. President Kibaki could not act on the list because it included names of two ministers and close ally in his Narc government.

President Kiaki could also not act on the list because they included eight former ministers both in former President Moi’s government (Kanu) and his government. Prominent and untouchable people mentioned in the list included Vice-President and Minister for Home Affairs Moddy Awori and Minister for Roads Simeon Nyachae.

The former ministers in the Kanu government mentioned were Musila Mudavadi, William Ruto, who is currently the Deputy President, Chris Okem, Julius Sunkuli, Chris Obure and William ole Ntimama. Those in the Narc government were David Mwiraria and Dr. Chris Murungaru.

The permanent secretaries mentioned in the list included Sylvester Mwaliko, Sammy Kyungu, David Mwangi, Joseph Magari, Ali Korane, Margaret Chmengich, Zakayo Cheruiyot, Mwaghazi Mwachofi, Simeon Lesirma, Moses Obudo and S. K. Bondotich (financial secretary).

Anglo Leasing corruption scandal involves a total of 20 shady government contracts. Anglo leasing scam began during Moi’s era and continued during Kibaki’s rule. Ministers named in the scandal exonerate themselves claiming that they were not guilty because they did not sign the contracts.

Even though under the legal perspective, the issue of guilt is a matter of interpretation by the court, Kibaki could not order the arrest of the ministers named to be proven guilty or not guilty as required by law.

That is why the threats by opposition coalition Cord that they plan to name the Kenyans behind the Anglo Leasing companies and who stand to benefit from the Sh1.4 billion that Uhuru has paid out is absolutely a waste of time.

According to Cord, four powerful businessmen are among the key figures involved. Some were major donors to the Jubilee campaign. Businessman Deepak Kamani, who still lives in Nairobi, was one architect of Anglo Leasing but has publicly boasted that he is untouchable because of his high level contacts. President Kibaki could not touch him either.

Although Aruna Pereira, a Sri Lankan businessman, is mentioned to be behind First Mercantile, he cannot be touched because he is working closely with another Kenyan businessman linked to Ruto’s party, URP. Cord had planned to table the list of names in the National Assembly on Wednesday afternoon until government withdrew its motion asking MPs to approve the controversial payments.

On Wednesday many Jubilee MPs walked out on Treasury Secretary Henry Rotich after he failed to name the beneficiaries of the payments. Jubilee MPs, mainly from the Mount Kenya wing rather than the Rift Valley wing, were in open rebellion because they feared that they could become unelectable if they approve payments to Anglo-Leasing.

Uhuru Kenyatta himself is fully aware of the deal since he chaired the Public Accounts Committee in 2005 that recommended that all payments to Anglo-Leasing should be cancelled or suspended. This could be one of the reasons why the MPs feared that Cord could exploit this apparent hypocrisy to destroy Jubilee and TNA.

Cord claimed they had obtained the names of the Kenyans behind Anglo Leasing and I would name and shame them when the report was tabled again. To avoid this happen Jubilee MPs were to discard debate in parliament.

According to Cord, the beneficiaries of these millions are here in Kenya but they are using foreign figureheads to push for these payments. It means that it is another way of corruption and not what Rotich told the National Assembly that British and Swiss courts have ordered the government to pay Sh1.6 billion to First Mercantile Securities which agreed to forego Sh204m, in interest, making a final amount payable of Sh1.4 billion.

Although Cord MPs have vowed to shoot down any attempts to pay the Swiss company, as I have said present is above the law and can dictate what he wishes is right according to him. That is why, whether to pay Anglo-Leasing is to reward impunity it did not matter to him.

KENYA: WHY PRESIDENT UHURU WON’T ALLOW KARANGI JAILED

Robert from Nairobi writes: “Fr Beste, what is your opinion, do you think President Uhuru can allow Chief of Defence Forces Julius Karangi be committed to civil jail after reportedly ignoring a court order directing release of 27 former soldiers on bond?

I am asking this because Karangi was due to retire after serving a one-year extension to his contract given by then President Mwai Kibaki so that the transition in the military would not coincide with the General Election. President Uhuru Kenyatta also chose to keep him for 12 more months – perhaps to buy time as he assessed who among the ranking generals to promote.

After buying time elapsed, President Kenyatta quietly extended the contract by a year, due to end next year. My worry Fr Beste is who will succeed Karangi when he retires next year? Who is legible to succeed him? Could it be another Karangi in making? Thank you”.

Thank you for seeking my opinion Robert. With impunity in Kenya, I don’t see President Uhuru allowing Karangi jailed. Remember Robert, the Chief of Defence Forces (CDF) is the highest-ranking military officer in the Kenya Defence forces and the principal military adviser to the President of the Republic of Kenya and the National Security Council.

As such, Uhuru like any other president must retain chief of defence forces, not only because he comes from his ethnic community, but also because he close to him, and indeed a friend. In Kenya you are forced to go tribal. I am sure even if Raila were to be the president he would be forced to assign this duty to the man from his ethnic community and close ally.

The rank of CDF is very important because it outranks all respective heads of each service branch and has operational command authority over the service branches. He leads the meetings and coordinates the efforts of the Service Commander, comprising the CDF, the Commander of the Kenya Army, Kenya Air Force, Kenya Nevy and the Commandant of Military Intelligence.

That is explains why President Kibaki forced to extend Kianga’s term for two-and-a-half years despite the fact that the terms of service for the CGS provide for only four years. Karangi heads the board that sit to appoint, promote, and post senior officers from the rank of major to lieutenant-general.

Your second question as to who can succeed Karangi is a bit tricky. Those who could succeed Karangi include Lt-Gen Samson Mwathethe, the Army Commander, Lt-Gen Joseph Kasaon and Lt-Gen Jackson Waweru who heads the National Defence College, Kenya Air Force Commander, Maj-Gen Joff Otieno and Kenya Navy Commander Maj-Gen Ngewa Mukala. They cannot succeed Karangi because they are two ranks below the top position to succeed him.

Succeeding Karangi can only be possible if President Uhuru can do reshuffle in the military as soon as possible. Uhuru is probably following the footsteps of his predecessors, Mr Kibaki and Mr Daniel arap Moi, who did not always make changes when time was due.

The appointment of key military officers is an elaborate process which begins from the lower ranks all the way to the National Defence Council, which advises the President on the top appointments. The National Defence Council is normally chaired by the Cabinet Secretary for Defence, Ms Raychelle Omamo.

FIRING CHIEFS WON’T END ILLICIT BREWS IN KENYA

Maurine from Sagana, Kenya writes: “Fr Beste thank you for your moving article on illicit brews that continue to kill many Kenyans. Now I am just wondering, do you think the move by Embu County Commissioner Amos Gathecha to fire Embu Municipality Chief Titus Mugambi and his assistant Catherine Wanja during a visit to Shauri Yako slums where the illicit brew was being sold is going to solve the problem of illicit brews in Kenya?”

Thank you for this important question Maurine. The problem with illicit brews is not with the chiefs, so firing them won’t help anything. Early this Kirinyaga county government set aside Sh1.5 million to combat the consumption of illicit brews in the area, since then nothing has improved.

County Commissioner Joseph Keter said the security team would spend the money to map out illicit brew dens and crackdown on brewers and consumers. He declared a major operation to weed out illicit brewing and consumption dens which he said had retarded development in the county.

He said the operation would be intensive and thorough. The operation was to target more than 300 brewers who he described as “notorious” in brewing and selling illicit alcohol in the area. He said illicit brews are selling like hot cake in the area because sellers collude with chiefs and their assistants.

There are several reasons why Kenyans drink illicit and deadly brews. The major one is to do with grave dangers of unemployment in the country, leading to higher poverty levels. Some Kenyans desperately look for cheap source of livelihood including brewing and consumption of the deadly liquor.

Economic conditions and the increasing sense of hopelessness is making people take recourse to cheap brews. Sellers of brews take opportunity of this condition to make money and they can do whatever they can to make their business go on. That is why they are able to bribe government agency that looks after the food and drink beverages.

The story by Meja Mwangi, Kill Me Quick gives an overview how unemployment in Kenya is a crisis. The story depicts two young boys who move to the city after obtaining their secondary school diplomas. They hope to find jobs in order to support their families back home.

Initially unsuccessful, the pair live in dumpsters, eating rotten fruit and stale cakes, unable to return home as failures. Eventually, they obtain jobs at a farm working for a very rich family. Mania causes problems in the house while blaming Meja, who suffers the consequences.

Meja is put on half rations, moved from job to job, and then has his rations almost completely revoked. After Mania’s biggest episode, the pair loses their jobs. Mania and Meja split after Mania steals from a store and gets Meja in trouble.

Meja flees home only to return to the city and work in a coal mine. Mania joins a gang in “shanty land,” lead by a boy named Razor who claims they went to school together. Here, Mania attempts to run a scheme selling milk to clients in the area, which he has stolen from the rich neighborhood. Eventually, he is caught. The pair meets up again in prison, but soon go their separate ways. Meja continues to go in and out of prison, and Mania ends up on trial for murder.

Women are depicted as objects for sexual pleasure, or as Nici Nelson puts it, only there as “screws for the main characters. This is because of unemployment and poverty. Sara, Razor’s girlfriend, is there for the sole purpose of allowing him to obtain pleasure in front of his gang. Mania’s girlfriend Dehliah is mentioned briefly, and she works as a “barmaid,” also known as a prostitute.

Against the background that Kitengela town is reeling from the shock of a man alleged to have been teaching children to perform various sexual acts for pornography industries. He teaches children sexual acts, including oral and anal sex for little pay, which I believe they take home to their parents for their survivals.

That is also why, even after the Teachers’ Service Commission dismissed 600 teachers over allegations of sexual abuse in our primary and secondary schools, pupils still engage in sex, getting pregnant every term.

In Nyanza where poverty is said to be a major problem, cases of sexual abuse have been on the rise, with 15 cases been reported in Migori, Rongo, Rachuonyo, Kuria and Nyatike districts. These areas due to poverty men target pupils for sex, luring them with as little as Ksh 20 to buy mandazi (pan cake). These children are hungry.

The D.C. Circuit’s decision in the Verizon vs. FCC case dealt a huge blow to the open Internet.
Right now there is no one protecting Internet users from ISPs that block or discriminate against websites, applications, or services. Companies like Verizon will now be able to block or slow down any website, application, or service they like. And they’ll be able to create tiered pricing structures with fast lanes for those who can afford the tolls and slow lanes for everyone else.

It’s time for the new FCC leadership to correct the agency’s past mistakes and to reassert the agency’s clear authority over our nation’s communications infrastructure. To preserve the open Internet, the FCC must reclassify broadband Internet access as a telecommunications service.

Use your authority to establish a solid legal footing for the vital policies and protections this court decision threatens.

The D.C. Circuit court dealt the latest blow to the open Internet by striking down the Federal Communications Commission’s Open Internet Order, because of the questionable legal framework the agency used when it adopted its net neutrality rules in 2010.

This ruling means there is no one who can protect us from Internet service providers that could block, speed up or slow down web content based on its source—or charge you more depending on what website you are looking at.

But there’s hope: FCC Chairman Tom Wheeler can correct the agency’s past mistakes and truly protect our nation’s communications infrastructure.

We only have until the May 15 FCC meeting to pressure Wheeler to ensure the FCC maintains an open Internet

Tell the FCC to restore net neutrality rules.

African Centre for Human Advocacy’s Report on Prevailing Situation in South Sudan

1. Political Situation:

April 30, 2014 (SSNA) — Following the last reshuffle of the government of South Sudan on 23 July 2013, which resulted to the removal of the entire cabinet members including the Vice President Dr. Riek Machar Teny by President Salva Kiir Mayardit, tensions had abruptly flared up within the SPLM ruling party. Before his dismissal from the position of Vice President, Dr. Riek Machar and other senior SPLM members within the SPLM ruling party voiced concerns about the President Salva Kiir’s dictatorial way of handling the affairs of the state, where he absolutely used to take most important decisions singlehandedly without consulting the SPLM Political Bureau which is the highest political organ in the ruling party or the executive wing of the government where the Vice President was deputising him in the party. President Salva Kiir’s apparently manipulated the Interim National Constitution in his favour where he appoints or dismisses any member of the cabinets without consulting the Vice President as it was already stipulated in the constitution that the President would act in consultation with his Vice President.

However, President Salva Kiir has been promoting tribalism, nepotism, chauvinism, corruption, human rights violation etc., which are considered as parts of bad governance at any level of government all over the world during his eight years reign in South Sudan. In his turn, the former Vice President decided to challenge the President openly in the next general elections, which is supposed to commence in 2015, whereas President Kiir adamantly rejected such decision from his former Vice President Dr. Riek Machar and other SPLM senior members who were challenging him within the SPLM leadership. He did not want to be challenged by any member from the SPLM ruling party. When he saw a looming threat from the party colleagues, President organised his supporters to sabotage any move from the supporters of the former Vice President to challenge him in the upcoming elections. This becomes a wrangling within the SPLM leadership on who to run for elections. The former Vice President’s position was vigorously supported by majority of the SPLM political Bureau members and the masses all over the country that got tired of President Salva Kiir’s style of leadership, which favoured only few members from his own ethnic group, the Dinka who he placed in most of the key strategic positions in the government. They are the ones controlling the finance, security, foreign affairs etc., just to mention a few.

In addition to that, President Salva Kiir secretly recruited and trained an army numbering 15,000 soldiers that were drawn up inclusively from his own Dinka tribe, from two states of Warrap and Northern Bahr El Gazal as personal protection guards. He never trusted the SPLA regular soldiers to be guarded by him because majority of them are from Nuer tribe, which constituted 60% of the fighting force. During the first and second weeks of December 2013, SPLM supporters of the former Vice President Dr. Riek Machar which included 14 senior SPLM Political Bureau members staged two consecutive rallies in Juba where they demanded for democratic transformation within the SPLM ruling party to be urgently realized and translated into reality. This idea brought several thousands all over the capital Juba to Freedom Square to attend the two rallies in which subsequent press releases were issued afterwards to highlight their six points that include; 1. SPLM reform, 2. Economic reform, 3. Corruption eradication, 4. Strengthening relations with foreign countries, 5. Human Rights violations, 6. Tribalism, nepotism and chauvinism etc.,

During the last SPLM rally of 15 December, which was overwhelmingly attended by all SPLM government and opposing political leaders who rejected President Kiir re-elections as Chairman of SPLM, and vied for Dr. Machar to take over the chairmanship of the party instead of the incumbent SPLM Chairman and President. The tension became high in which the President Salva Kiir hastily ordered his close associate and trustful General Marial Cenouer who was in charge of 15,000 (soldiers) so-called Presidential Guards based at Luri garrisons in southeast of Juba to immediately disarm the SPLA Nuer soldiers within the Presidential Guards in the evening hours. At around 10.00 PM, on 15 December 2013, the fighting ensued within the Presidential Guards of Dinka and Nuer members from SPLA in which several soldiers were reported to have been killed on both sides. SPLA mutinous soldiers briefly captured the Tiger Headquarters, which hosted the Presidential Guards. Dr. Riek Machar and other associate members escaped along with him to the bushes of South Sudan and the direction to Bor.

The 11 SPLM political leaders who were associated with Dr. Riek Machar were detained on the following day of 16 December, in Juba prison where they remained there for some months. Towards the end of January, 7 of them were released through SPLM – In Opposition, IGAD and Troika’s interventions and were flown to Kenya to participate in the ongoing peace talks in Addis Ababa. But they chose to remain as separate block negotiating on their own as a faction instead of siding with the SPLM/A – In Opposition that advocated for their unconditional release from jail. The other 4 political detainees including the SPLM Secretary General Pagan Amoum remained in jail and have recently been released in this April, by the government in Juba and are still confined inside the country. The government in Juba is denying them opportunity to participate in the peace talks in Addis Ababa while their presence in the talks is very instrumental indeed. The IGAD and Troika peace mediators in Addis Ababa should exert more pressures on the government in Juba to fully release them and allow them participations in the peace talks.

2. Human Rights Violation:

As mentioned above that on the 15 December 2013, a group of SPLA soldiers from Presidential Guard mainly from Dinka attempted to disarm their colleagues from the Nuer tribe who were in the same Presidential Guards. Unfortunately, the SPLA soldiers from Nuer refused the disarmaments and instead their rivals from SPLA Dinka started the shooting which result to the captured of Tiger Presidential Guards Headquarters by the SPLA Nuer soldiers. They occupied the said military garrison until the following day when SPLA combined forces from different units came and recaptured the Tiger Headquarters from the mutinous soldiers of Nuer elements. Dr. Riek Machar and his wife Mrs Angelina Teny who were prime targets of being implicated by President Salva of being behind the rebellion escaped the government planned onslaughts for hiding along with former Minister of Environment General Alfred Ladu Gore and former Governor of Unity State General Taban Deng Gai.

The three SPLM leaders and Madam Angelina Teny apparently escaped to the bushes for their own lives and made their way to Greater Upper Nile where the Nuer civilians known as “White Army” and some SPLA defectors from other garrisons mostly from Nuer when they heard that wanton massacres was being carried out by some SPLA of Dinka soldiers in Juba against the innocent Nuer civilians in Juba came to their rescues. In fact, Dr. Riek and his wife left behind most of their personal bodyguards. They were left behind in their official government residential quarter in Juba on the night of 15 December 2013, when the fighting erupted in Juba. On 16 December, the infamous Nuer massacre took place in Juba and lasted for three days up to 19 December 2013, by their Dinka attackers who masqueraded as Presidential Guards inside Juba town. They summarily executed over 10,000 civilians including 35 personal bodyguards of Dr. Riek Machar who were first disarmed by the government soldiers and later killed in cold blood when the government soldiers (SPLA) smashed a two storey government building used by the former Vice President with military tanks. Inside the same house it was sheltering over hundred civilians most of whom were closed or distant relatives of former Vice President and his dear wife who an emergency sought refuge there. Unfortunately, military tanks crashed all of them and this was the most gruesome massacre ever conducted in the history of South Sudan in one town since South Sudanese fought successive wars with Khartoum regimes in the past. The UNMISS and did not revealed the exact figures of those Nuer killed in Juba for fears of reprisals from that notorious government in Juba.

The UNMISS put the figures of the dead to 500 hundred persons only while the government soldiers conducted house-to – house searches for three days from 16 – 19 December, where they collected several thousands unarmed Nuer civilians in the neighbourhoods of Gudelle, Mia Saba, Thongpiny, Jabal Kujur, Manga teen, Souk Jabal, Khor William, Gumbo, New Site, Jabal Dinka, Guray etc., Hundreds of them were summarily executed at Gudelle Police Station and thousands others were killed in different locations where their bodies dumped on the River Nile or burnt to ashes beyond recognitions. This is very painful story but the UN and other human rights groups did not revealed the exact numbers of the Nuer civilians killed during the aftermath of the massacre in Juba and its surrounding areas. The real figures were later revealed by the victims themselves who fled to UNMISS camps at Jebel Kujur and Thongpiny or hidden by their Equatorian’s friends in Juba town.

When the news of the massacres of Nuer in Juba spread throughout the Nuerlands in Upper Nile, Unity and Jongeli States, ten of thousands of well armed Nuer youth and SPLA deserted soldiers flocked into government garrisons in Greater Upper Nile States where they attacked government loyalists which resulted to the capturing of the three state’s capitals of Upper Nile, Unity and Jonglei. In the process of these fighting many lives were lost on both sides. Since December 2013, the towns of Bor, Malakal and Bentiu were repeatedly captured or recaptured by SPLA – In Opposition or government soldiers and their Uganda (UPDF), JEM and SPLA-N allies more than four times, in which thousands of innocent civilians were sadly killed there and destructions of properties were enormous indeed. Government infrastructures and religious worshiping centres as well as hospitals were therefore demolished in all the three state capitals of Bentiu, Bor and Malakal as well as at counties level during the course of fighting between the two parties.

Following the recaptured of Bentiu by SPLA – In Opposition on the 16 April 2014, from the government forces in which the UN and other international NGOs expressed propound disappointments with alleged killing of over 200 Darfuri and Dinka civilians and 400 others wounded. This damning report was circulated all over media houses all over the world and several countries expressed strong condemnations against the rebel movement who were accused of perpetrating a deliberate massacre against the unarmed civilians caught in cross-fire in the town of Bentiu. The SPLM/A – In Opposition on their part, strongly repudiated the allegation made by UNMISS boss Mr. Toby Lanzer and journalists from several news media who visited the town of Bentiu following the capture of the town by rebels who said that those Darfuri killed or other South Sudanese men (Dinka) who died along with them were not civilians but government sponsored militias and mercenaries. The SPLA – In Opposition Spokesman and other sources from the ground indicated that there were no Darfuri traders existing in Bentiu since January 2014, when the government forces and their allies recaptured it from them.

All the Sudanese traders evacuated all along the town because it becomes a war zone, and virtually deserted by its entire population to UNMISS camp, where over 8000 IDPs resides there. There was no reason at all for 800 traders from Darfur to continue in Bentiu town where there was no market or buyers to buy their goods. It is true; while in combats they usually dressed with civilian clothes and used the Mosque during that attack by SPLM/A – In Opposition forces as human shields. They had indeed guns and fought vigorously against the rebel forces when they were denied access to UNMISS compound by rebel forces following the capture of Rup Kona’s Bridge. Those civilians who felt threats because of fighting they definitely ran to UNMISS compound in Bentiu before the fighting reached the town. The fight took nearly three days before the capture of Bentiu occurred. If the Darfuri traders were actually civilians who felt threatens they would have gone to UNMISS camp before the fighting escalated into town.

The same thing with the alleged Dinka civilians who were said by UN and other aid agencies that they were deliberately massacred by SPLA- In Opposition forces. Those Dinka men who got killed were also recruited government sponsored militias who were fighting actively on the side of the government against the rebel forces. The rebels denied killing of any unarmed civilians being elderly, women or children intentionally during the fight in Bentiu. If the rebels were intended to massacre the Darfuri and Dinka civilians as it was alleged, what would have prevented the 400 wounded not to be killed in the Mosque while the rebels were the ones in control of the town and not UNMISS? Definitely, the rebels would have killed them all if they really wished to do so. The UN and other NGOs had indeed given misleading information to the outside world, which was not the true picture in the ground. They are indeed inciting more massacres in South Sudan by issuing false allegations on the side of the rebels. The Radio of Bentiu was used only by SPLM/A – In Opposition commanders who captured the town to inform those still in hiding to avail themselves that the town was free and not used for projecting hate messages as it was later alleged by UNMISS representatives from Juba and their accompanied journalists. All the images shown on the news media had no any child or woman seen in it. They were all men wearing civilian clothes where the rebels collected their guns after they got killed in action. This is a propaganda that will not serve the purpose and instead it will certainly create more harm then good between the two rival communities of Dinka and Nuer respectively. This will also make peace in South Sudan difficult to be realised within a short time if the UNMISS and other international NGOs continuous to wage such negative propaganda campaigns against one group of the fighting parties or most importantly against the SPLM/A – In Opposition and their Nuer sympathizers.

What UNMISS has been preaching following the fall of Bentiu to the rebel forces on 16 April, through the international news outlets, the resultant of it was the worst gruesome and awful attacks on Nuer civilians at UNMISS camp in Bor on the 21 April, when some SPLA soldiers and other organised forces from the government along with Bor youth went on rampage and attacked 6000 IDPs from Nuer as retaliations by Dinka to what happened to their people in Bentiu. The attack on UNMISS camp in Bor was a government initiative which was directly spearheaded by some well-known senior government officials from Jonglei and Bahr El Gazal States to massacre Nuer. The UNMISS did not give adequate protection to the IDPs inside their centre in Bor and that was the reason why 145 persons mostly women and children were deliberately killed by their Dinka attackers. Another 273 persons sustained injuries and unknown numbers of Nuer youth fled to bushes in panics and never reported back to the camp. They are presumed dead because the same attackers pursued them. The UNMISS continuously kept the numbers of those IDPs killed or wounded down simply because they did not want an embarrassment from international community or get into loggerheads with the government in Juba. The survivors themselves were the ones who revealed the accurate figures because UNMISS always played down the numbers of those killed and wound. In the first place they gave conservative estimates of 20 persons killed and 48 wounded. This is a complete lie and at the same time a great insult to the Nuer victims and their loved ones. UNMISS should not act biasedly for fears from the government to terminate their activities in South Sudan. The UNMISS mandates in South Sudan is to protect human lives and their properties against any human rights violators no matter war. They have the full mandate from the United Nations in New York to use all the necessary means if human rights of any community is seriously violated by any warring party in the conflict.

On 23 April, the town of Renk was briefly captured by the SPLM/A – In Opposition forces in which they dislodged government forces and their ally’s forces from town. After the rebels withdrew from the town which bordering the White Nile State, Republic of Sudan, the Nuer officials in the government and other organised forces were deliberately killed by their Dinka colleagues and militia soldiers who were armed by the government to intentionally fight the rebels. According to various reports from different sources said that about 300 Nuer civilians have been killed in Renk alone. UNMISS has no present in Renk and no NGOs agency can easily verify this report because few of the NGOs who used to operate in Renk had evacuated the town before it was briefly occupied by the rebels.

On 27 April, Mapel SPLA Training Centre was attacked by a group of Dinka soldiers in which they killed about 192 unarmed SPLA Nuer trainees and several hundreds others fled to forests for their own safety. Their whereabouts are not known and the government still playing it down as if nothing had actually happened. According to the statement from the State Government of Western Bahr El Gazal State Hon. Razik Zachariah Hassan, he said that some widows whose husbands got killed by the rebels in Unity State carried out the attacks on Nuer SPLA trainees in Mapel. He also played down the death rates to be three persons killed and four other wounded. If this statement over Radio Tamazaj is true, could several hundreds of Nuer men who left behind their dear wives and children ran to the bushes to escape widow’s onslaughts? Could this episode provoke the defections of seven Brigadier Generals and their forces of not less than a complete brigade to forests? Would the widows managed to kill 192 persons as reported by the survivors in the bushes and defector generals from Wau area? And yet the attackers are still hunting after those who escaped such ordeals. This appalling situation aggravated the defections of 7 SPLA Brigadier Generals and their forces that are from Nuer simply because they did not want their own fellows Nuer to be humiliated in such a manner in their watch. The 7 brave Brig. Generals have decided to rescue their fellows Nuer instead of continued supporting this notorious government in Juba under dictator Salva Kiir Mayardit. The UNMISS did not report this incident to the outside world yet they are more concerned with the fates of Darfuri rebels from JEM and SPLA – N who were killed in action by SPLM/A – In Opposition in Bentiu. The government forces and their Uganda (UPDF) allies have recently captured the town of Ayod from the SPLA In Opposition forces in which they are now conducting gruesome killings against the civilians in the area and yet UNMISS and other international NGOs are keeping quiet and not reporting such wanton killing of Nuer in all these places.

3. Humanitarian Situation:

The humanitarian situation in Greater Upper Nile States of Unity, Upper Nile and Jonglei is pathetic indeed. Most of its population have migrated to neighbouring countries or UNMISS camps or to saver areas within the country. Over one million people are already registered by UN and NGOs agencies operating in South Sudan as IDPs within the country in which most of them are from Greater Upper Nile States. Juba alone has not less than 50,000 Nuer IDPs in the UNMISS compounds whereas Bentiu with 22,000 IDPs, Malakal has the same number of 22,000; Malut has over 30,000 and Bor with 6,000 IDPs. Wau has got over 1000 Nuer IDPs whereas some of them are being rejected entrance to UNMISS compound in Wau by the government of Western Bahr El Gazal State. Nuer students at Bahr El Gazal University are greatly affected by the recent skirmishes in the area. It is reported that a number of university students have been arrested of are presumed missing by their colleagues who fled to UNMISS compound in Wau. The families of Nuer unarmed soldiers in Mapel needs to be traced because some conflicting reports indicated that some Dinka soldiers had killed them all or some fled to forests for safety. This needs UNMISS and other Human Rights organisations to pay an urgent field assessment to see if the families of the murdered and fleeing Nuer soldiers are still alive so that they can be relocated to UNMISS camp in Wau town. The IDPs at UNMISS camps in all the states Greater Upper Nile and Central Equatoria need to be relocated to secure countries like Kenya, Sudan and Ethiopia instead of remaining in that sad conditions for too long. They are more less prisoners in their own country. They lack most of basic human necessities. Their children are at high risk of contracting water bone diseases and malnutrition and at the same time not attending schools. The elders are very much depressed and are facing state of hopelessness and uncertainties. The UN and other NGOs agencies can transport them to where their children can go to schools or move freely than being confined inside UNMISS compounds throughout the country like prisoners of war.

In the SPLM/A – In Opposition controlled areas, education is completely none existent where most of the teachers have abandoned their teaching jobs and joined either the government or the rebels rank. Several hundred thousands children of school aged are staying without attending classes. Food situation is also very sacred indeed and this will force millions of people to abandon their homesteads in search of food and protections in secured places. Health situation is also very demanding whereby majority of the victims have gunshot wounds and others are suffering with different ailments mostly children with severe malnutrition cases. Cross-border operations through, Sudan, Uganda, Kenya and Ethiopia would serve more lives if negotiated in good face with the host countries and implemented by UN and NGOs agencies which is similar to that of OLS in 1990s, where both government of Sudan and (SPLM/A) controlled areas were served equally.

4. Peace in South Sudan:

If this war in South Sudan is not handled carefully, regional conflict may flare up very soon because the continuous supports of UPDF, JEM, and SPLA – N and other invisible actors like Egypt and Zimbabwe to the government of Salva Kiir in Juba would definitely attract other regional countries to join the ongoing war. Therefore, the international community has a task to pressurise the government in Juba to delink itself from his allies otherwise South Sudan will soon be a theatre of war between competing regional leaders over control of its vast oil and mineral resources. The most of its population will migrate into more secured areas in the neighbouring countries. This is because Juba is intensifying war vigorously with full supports from his allies, which are also enemies of other regional leaders. Uganda has been actively engaged in combat operations in Greater Upper Nile where they used cluster bombs against civilian’s targets in Jonglei State and jets in Unity and Upper Nile States. With the latest development where some communities are being targeted indiscriminately, the situation is already out of control and will be difficult to bring this war to an end very soon as long as some foreign mercenary allies of the government are still active in war in South Sudan. Norway must double its efforts to pressurise both Juba and Kampala to immediately withdraw the UPDF forces in South Sudan in order to give peace a chance. The same thing with Darfuri (JEM) and SPLM-N (Nuba & Ingessnia of Blue Nile) rebels who are siding with the government in Juba against the SPLA – In Opposition. The present of Sudanese rebels in South Sudan to protect the oil fields installations which are under threats from the SPLM/A – In Opposition forces and in turn they also receive their shares from oil revenues and in addition to supply lines through Upper Nile and Unity State to continue with their war against Khartoum. The JEM and SPLA – N have abandoned their cause for material gains in South Sudan. Therefore, UN should advise their leaders not to involve their fighters in conflict in South Sudan while at the same time disusing as Sudanese traders.

Generally, genuine Sudanese traders are free to operate anywhere in South Sudan without any intimidations. But the present of JEM and SPLA – N in war against the SPLM/A – In Opposition is highly posing serious threats to Sudanese traders operating in South Sudan. This is a very serious game in which people of South Sudan at the end of the days will be the losers from this war. The international community most save South Sudan from imminent collapse from Salva Kiir. The people of South Sudan are tired of war and are longing for a lasting peace where democracy, development, rule of law, accountability and human rights shall be the basis of principles of good governance in the country.

UNDERSTANDING CODE OF CONDUCT AND PRACTICE OF JOURNALISM

While World Press Freedom Day is celebrated tomorrow, May 3, 2014, Catholics will celebrate theirs on May 25, 2014. The Pope’s general Prayer intention for the month of May is “that the media may be instruments in the service of truth and peace”.

World Press Freedom Day was proclaimed by the UN General Assembly in December 1993, following the recommendation of UNESCO’s General Conference. Since then, 3 May, the anniversary of the Declaration of Windhoek is celebrated worldwide as World Press Freedom Day.

It is an opportunity to celebrate the fundamental principles of press freedom; assess the state of press freedom throughout the world; defend the media from attacks on their independence; pay tribute to journalists who have lost their lives in the line of duty.

In his message for the 48th annual World Communications Day, Pope Francis challenges us to consider how the media can either create understanding and unity or divide people. He asks, “How can we be ‘neighbourly’ in our use of the communications media?”

His answer is: “We need to recover a certain sense of deliberateness and calm. And this calls for time and the ability to be silent and to listen.” Communication is not simply about talking but also listening and recognizing that, even if we disagree with the person speaking, he or she is our neighbour.

Pope Francis writes: “There is a danger that certain media condition our responses so much that we fail to see our real neighbour.” As an example of good communication, Pope Francis proposes the story of the disciples on the road to Emmaus.

The disciples are closed in on themselves and their own ideas but Jesus listens and gently shares with them the truth about the messiah. Their hearts are set on fire by the truth and burn with love. Their dialogue with Jesus leads to a deeper encounter with him, when they recognize him in the breaking of the bread.

During the month of May, let us pray that the media may serve the truth and not manipulate people and promote half-truths or lies. May it help people to enter into dialogue with one another, so that the foundations for peace may be laid.

What Pope is expressing, that is, respect for truth and for the right of the public to truth should be the first duty of a journalist. As journalists we need to protect the privacy of individuals in a manner that secures the public interest.

This is all about what the code of conduct and practice of journalism should be. We need to write a fair, accurate and an unbiased story on matters of public interest. The code of conduct is helping us journalists to avoid misleading or distorted story.

When stories fall short on accuracy and fairness, they should not be published. Sometimes this happens because of bribe which has become a big problem of journalists not only in developing countries but also in developed nations.

This should not happen given that journalism is the fourth estate which protects and safeguards the democratic values in the society.

You find in many countries, Kenya included that after every press conference, the media will give the organizers of the meetings rough time until they part with the money. In other words, your story will not be reported unless you pay journalists money.

Journalists, while free to be partisan, should distinguish clearly in their reports between comment, conjecture and fact. In general, provocative and alarming headlines should be avoided, especially those containing allegations.

Even though letters to editor are expressing the opinions of the writers, an editor is not obliged to publish all the letters received in regard to that subject. Only some of them either in their entirety or the gist thereof should be published.

The editor has the discretion to decide at which point to end the debate in the event of a rejoinder upon rejoinder being sent by two or more parties on a controversial subject. Unnamed sources should not be used unless the pursuit of the truth will best be served by not naming the source who must known by the editor and reporter.

This is very important because in general, journalists have a professional obligation to protect confidential sources of information. That is why journalists should generally identify themselves and not obtain or seek to obtain information or pictures through misrepresentation or subterfuge.

In general, the media should avoid publishing obscene, vulgar, or offensive material unless such material contains a news value which is necessary in the public interest. In the same vein, publication of photographs showing mutilated bodies, bloody incidents, and abhorrent scenes should be avoided unless the publication of such photographs will serve the public interest.

This is specifically toTelevision stations which must exercise great care and responsibility when presenting programmes where children are likely to be part of the audience. Bringing pictures where men and women deeply kiss each other on the lips can be an embarrassment to parents who watch TV with their children.

Although most of these programmes are aired because they have been paid for, some of them are not morally upright. Think of an advertisement where, for example where condoms have been demonstrated how to use them, or sex positions, like what had been going on in one of Kenyan television stations.

This is a programme where a sex educator and therapists demonstrates several styles of having good sex. While such programmes can be extremely very important for couples, especially those who have difficulties in making love, they can be embarrassment to parents with their children.

Meanwhile, using someone else’s work without attribution – whether deliberately or thoughtlessly – is a serious ethical breach. However, borrowing ideas from elsewhere is considered fair journalistic practice.

Media should also avoid prejudicial or pejorative reference to a person’s race, tribe, clan, religion, sex or sexual orientation or to any physical or mental illness or handicap. These details should be avoided unless they are crucial to the story.

Things concerning a person’s home, family, religion, tribe, health, sexuality, personal life and private affairs are covered by the concept of privacy except where these impinge upon the public.

The media should generally avoid identifying relatives or friends of persons convicted or accused of crime unless the reference to them is necessary for the full, fair and accurate reporting of the crime or legal proceedings.

Finally, media should also avoid presenting acts of violence, armed robberies, banditry and terrorist activity in a manner that glorifies such anti-social conduct. Also, newspapers should not allow their columns to be used for writings which tend to encourage or glorify social evils, warlike activities, ethnic, racial and religious hostilities.

The New Chapter on the Journey to Peace

Our nation has been put to test by the devastating conflict that is ripping the country apart. To go direct to the point, I want to begin by thanking President Kiir Mayardit for releasing the four political detainees today. Deep in my heart, I knew that President Kiir was not the cause of their detention and throwing of our country into the mess we are in today.

However, because he is the leader and had his best chance of rejecting the bad deeds that were planned and executed against our people, he fully bears the yoke of who to blame. His great courage (which was way overdue) to releasing the G4 has a saving factor for our nation.

The crowd that stormed the court room and its compound earlier today comes from all works of life in South Sudan. The people who cheerfully lifted up on their shoulders some members of the G4 did not just hail from their respective communities but from all walks of life in South Sudan.

If there was a doubt in any South Sudan government official’s mind that the citizens were losing it day by day, then it must have been cleared today. South Sudanese people know that the government was deadly wrong to put these people in prison. The people of South Sudan know that there was no coup.

Dear fellow citizens, we cannot change the past but we can surely shape our present and future. The war in South Sudan must end. To end it, all South Sudanese must learn the following songs and they must be the only ones that we all sing.

Ending of the crisis

It is imperative that the crisis be ended immediately. The words of Pagan Amum today sent a very moving spirits across all sorts of waves in the conflict. It was a message of peace and it was indicative of what him and his colleagues could have done if they were released during the early days of the conflict. President has set his foot on the right path and he must continue to push for ways to resolve the conflict. Dr. Machar, on the other, must also mimic what Juba did today. He must put down his guns. The sounds of guns must be silenced. We want to hear only war of words and eventually, soothing words.

The political detainees, the G4 and G7, will have very critical roles to play in this process. They are the bridge or liaison between the government and rebels. The government, rebels and all people of the world must use them wisely to help successfully bridge the two warring parties.

Last but not least, South Sudanese people must be awaken and actively involved in the process of ending this crisis by holding people accountable who make the process of successful cessation of hostilities impossible.

Military families (any family with a son or sons fighting in the frontline of this senseless war) must organize and start taking charge of their own children’s lives by holding accountable leaders who are sending them to harm ways on both sides.

All other South Sudanese civil society organizations must start to organize rallies for peace and sensitize our people around peace, unity and truth and reconciliation. I don’t mean that they rally and sing President Kiir’s name like the previous, irresponsible, rallies but to call on both Kiir and Riek to stop the war and sit down and talk.

Truth, peace and reconciliation among our people

The process of truth and reconciliation must begin now. It starts with recognizing what was done wrong by both sides and focusing on what can be done right moving forward from this point now. Therefore, both sides must send people to the peace talks, who are willing to say to each other, yes, that was done wrong by my party and we are willing to change things for the better and vice versa.

The manhood or bravery that is being portrayed by people on both sides of the conflict is primitive and cannot help the nation of South Sudan to recover. The momentum that the release of the G4 set in today must not be misused. The language of peace must be what is sung by all people and institutions. The rhetoric of beating up more war or intensification of war is uncalled for.

Therefore, both President Kiir and Dr. Machar must instruct their military leaders to slow down military operations and give dialogues in Addis Ababa a chance. The two leaders must know that there is no military solution to this conflict. They must know that when they send their forces to fight each other in the name of defeating each other, they are not fighting each other, individually, but rather, making those armies fight each other! More military operations are just simply meant to destroy our resources and loss our precious lives of the armies on both sides and civilians.

Unity of our people

The need to unite our people is urgent. The nation is polarized communally and regionally. This is a very dangerous situation that must be corrected very soon. There should be no marginalization of any people or region in this country. Doing that defeats the very purpose of fighting the Arabs in the first wars. Pumping chests up and calling or boosting about how one group of people is historic, brave, own the government, peace-loving and etc is an act of primitiveness and backwardness. We must be all proud of our country and be united by our citizenship.

If the president feels that no one else can protect him better or fight the war better other than having to put in place of power his Dinka tribe men, then that is a very bad sign. The latest appointment of Malong Awan and Marial Nuor are welcomed with mix feelings and the South Sudanese people must monitor the behaviors of these individuals and the institutions they will lead. It is my hope that they will work hard to prove that they were not appointed to protect a man and a leadership but to work for the nation and its people.

WORLD MALARIA DAY MARKED AT OBAMBO

Today was World Malaria Day, a day that recognises the global efforts to control one of the world’s most deadly diseases. I led the opening prayer at St Mark’s Obambo Primary School, Kismu County where the Government of Kenya chose to celebrate it.

According to Principal Secretary Ministry of Health, Prof. Fred Segor, who represented the Health Cabinet Secretary, Mr James Macharia, Nyanza was chosen because, even though malaria deaths have reduced by 50 per cent across the country Nyanza and Western regions still lead in high prevalence.

He said the prevalence rate in Nyanza is still high because of the unique environment which favors breeding of mosquitoes. As a government, he said they want to put all mechanisms in place in Nyanza and Western to ensure that the prevalence rate comes down.

Currently the prevalence stands at 38 per cent which he described as alarming and must be tackled. He said the government’s initiatives such as distribution of nets and purchasing of malaria drugs, the mortality rate of children under the age of five has decreased by 44 per cent. The theme for this years’ malaria day is: Invest in the future: Defeat malaria.

A drama staged by Kanya Wegi drama group from Osiri and Obambo, many people are ignorant of malaria awareness, that is why instead of taking children to be checked of malaria they attribute disease to ‘juok’ ( witchcraft).

They usually consult witchcrafts who try to convince them that the disease has been caused by either one of the relatives or family members. In this case if malaria persists they take the child, or even grown up to churches that claim that they can heal all types of diseases through prayers. Like witchcrafts they will also tell you that the disease has been caused by a relative or family member.

There are also some families that believe that the disease has been caused by ‘juok wang’ (eye evil). They will try all means to make sure the sick is treated despite the fact that eventually the sick will up to die.

The integrated Kisumu campaign comes against a background of the resurgence of measles, another deadly disease in Kenya. In the last eight months, 42 children have died of measles. In addition, polio has made a re-appearance for the first time in 22 years.

Children and pregnant women are the worst affected by malaria, and over 80 percent of deaths occur in sub-Saharan Africa among children under five. Around 40 percent of global malaria deaths occur in just two countries: Nigeria and the Democratic Republic of the Congo, according to the World Health Organization (WHO).

Other countries that are badly affected include Zambia, Burkina Faso, and Sierra Leone where the government has identified malaria as an illness of high priority, and various organs of the government, including the Ministry of Health, are undertaking all efforts possible to reduce the incidence of malaria.

The good news is that the global efforts to control and eliminate malaria have saved an estimated 3.3 million lives since 2000, reducing malaria mortality rates by 42 percent globally and 49 percent in Africa.

This is due to increased political good will and commitment to expand funding to help reduce malaria incidences. Yet still, malaria still kills an estimated 627 000 people every year, mainly children under 5 years of age in sub-Saharan Africa.

World Malaria Day was instituted by WHO Member States during the World Health Assembly of 2007. It is an occasion to highlight the need for continued investment and sustained political commitment for malaria prevention and control.

Malaria causes symptoms that typically include fever and headache, in which severe cases can progress to coma or death. The signs of the disease begin eight to 25 days after infection, although symptoms can occur later in those who have taken preventative antimalarial medication. Symptoms can be flu-like, and include joint pain, vomiting, jaundice, convulsions and retinal damage.

The disease is normally diagnosed by the examination of blood using blood films or with antigen-based diagnostic tests. Transmission of malaria can be prevented with the use of mosquito nets and insect repellents. Although no vaccine exists yet, severe malaria is treated with quinine or artesunate and mefloquine.

Demand for Democracy Is Rising in Africa, But Most Political Leaders Fail to Deliver

Africans’ support for democracy is robust and rising (seven in 10 Africans prefer democracy to other political regimes) but the supply of democracy has not kept pace with demand, according to this report. Its findings reveal people’s dissatisfaction with political leaders on the workings of democracy in the 34 countries surveyed.

NAIROBI, Kenya, April 23, 2014/ — Following the tragic death of a 13-year old Kenyan girl who underwent female genital mutilation (FGM) last Monday, an organization that helps FGM victims obtain restorative surgery to reverse FGM effects, is urging Kenyan Health Secretary James Macharia to open Kenya’s first clitoral repair hospital.

Clitoraid, which is in the final stages of opening a state-of-the-art clitoral repair clinic in Burkina Faso, also organized a humanitarian mission in Bobo Dioulasso last month in which 38 FGM patients recovered clitoral function.

“Four American volunteer doctors traveled to Burkina Faso to do those surgeries, and thanks to them, those 38 patients will now enjoy their lives as complete women,” Gary said. “The same humanitarian mission must be organized in Kenya without delay. Countless FGM victims have written to us from Kenya, and they’re begging us to provide the service in Kenya. They need our help to regain their sense of dignity and their capacity for physical pleasure.”

Gary said her organization has written to James Macharia offering to come and train a Kenyan surgeon to do the clitoral repair procedure free of charge if he or she is willing to learn the technique.

Noting that a pan-African FGM conference organized by Burkina Faso’s First Lady, Chantal Compaore, will be held April 24-26 in Ouagadougou, Burkina Faso, Gary said Clitoraid is looking forward to the event.

“We’re looking forward to presenting our humanitarian project for Kenya at that gathering,” she said. “No time should be wasted, since we must act at once to save lives!”

WHY WE SHOULDN’T WORRY ABOUT DIGITAL GENERATION

Responding to my article where Wilfred from Mujwa, Meru, Kenya wanted to know whether Mary Magdalene was a prostitute, and whether Jesus had sexual relationship with her, John Robert writes via Facebook:

“In one of the recent sermons in church, the pastor talked of Post Modernity, that is, the tendency of the modern generation to think beyond the limits as provided in the Holy Bible and effort to try and provide certain answers to unclear and controversial circumstances.

I always think religion is all about unquestionable belief whose practicability can never be found in the modern world. It therefore my opinion that as Christians, we take everything as it is in the Bible lest the religion loses its meaning to us and we get lost into this world. Thank you Father”.

John Robert has raised a very important issue. This is the worry of some preachers today. Rev Fr Gabriel Atieno Okinyo from Homa Bay Catholic Diocese raised the concern recently during the home coming mass of Rev Fr Collins Omondi Odiero at Ng’owu sub parish, Ojolla parish.

In his homily based on holiness and holy things, Fr Okinyo said that digital era is almost over powering religious faith. He argued that in digital era people are slowly losing the meaning of Holy Mass and church in general, saying that instead of participating in mass some people are busy twiting and charting on Facebook.

What must not be denied however, is that social media is now part and parcel of everyone’s life. Social media has made people come together. Today, most young age people right form the age 12 are socializing getting away from there studies. Young generation prefer to socializing than going out to have some physical exercises.

Pollster and researcher George Barna writes that those born between 1984 and 2002 constitute the millennial generation. They are called millennials because they came of age at the beginning of the new millennium. They are “digital natives” who have always had access to cable or satellite TV and cellphones.

They have no memory of life without the Internet. A recent publication notes that “‘for Millennials, everything begins and ends with social connections’” and that “80-90 percent . . . uses social media.”

Millennials enjoy working collaboratively and 75 percent say they would like to have a mentor! They are open to new experiences and have transcended some of the barriers of previous generations. They have a great appreciation for diversity, and among them, interracial friendships, dating, and marriage are unexceptional.

The good news is that most young people still maintain their faith and like going to church. A Gallup poll in 2000 found that about one-quarter of people ages 18 through 29 read the Bible weekly — about half the rate of those 65 or older.

Over the past three years, the percentage of those who are skeptics or agnostics toward the Bible has almost doubled, up from 10 percent in 2011 to 19 percent in 2014. Skeptics are defined as those believing that the Bible is just another book of stories and teachings written by men.

From the adults who say they increased their Bible reading, 26 percent said it was because they downloaded the Bible onto their smartphone or tablet. Another 10 percent said that watching The Bible TV miniseries spurred them to read their Bibles.

Although for some the use of social media in every waking hour is considered a time waster or an ‘on the side’ business tool, for the younger generations social media has been easily adopted as a multi tasking communication time saver.

We must also accept that in history methods of communication have shifted from the quill to the biro pen, from telegram to phone calls, from letter to email. Now social media is the foundation of communication for the next generation. In order to do business with them you will need to join them.

Alliance for South Sudanese in Diaspora (ASSD) condemns in the strongest term possible the deliberate and targeted killing of innocent Nuer Civilians housed in the UNMISS Compound in Bor Town and urge UNMISS to immediately relocate all Nuer ethnic IDPS from Government controlled areas since the UNMISS protection force cannot adequately protect them. ASSD urge the International Community to do more in speeding up the relocation process of those IDPs before it is too late.

ASSD specifically urge elements of the Dinka Bor youths not to drag this war to their own community since the genesis of this conflict was a political one. ASSD strongly condemns and urge Dinka Bor politicians in the Kiir led government not to localize national issues where innocent youths of Bor Dinka ethnic background are being deliberately misled to attack their long time neighbors, the Nuer. The consequences of targeted killing of innocent Nuer civilians or any ethnically related killings does not and will not serve anyone’s interest but widen this conflict where all will be fair game.

ASSD leadership would like to request the UN, United States of America, African Union, Canada, United Kingdom, and Norway to immediately intervene and ensure that the signed cessation of hostility agreement is implemented by the South Sudanese warring parties.

ASSD urge Ugandan President Yoweri Musseveni and foreign forces in South Sudan to with draw immediately and stop meddling in South Sudan’s internal affairs.

KENYA: OTIENO KAJWANG’ FACES DEMONSTRATION BY YOUTH IN HIS HOMA-BAY BACKYARD HIS REMARKS ON GOVERNOR KIDERO OVER HIS REMARKS AGAINST GOVERNOR KIDERO

The small, but busy Rodi-Kopany town, which is located at the junction of Ndhiwa-Rongo and Homay road on Tuesday morning witnessed a peaceful demonstration staged by the ODM youth against the area Senate representative Gerald Otieno Kajwang’ over his remarks against the Nairobi governor Dr Evans Odhiambo Kidero.

The placard waving youth numbering about 500 told the senator to leave Dr kideroalone and concentrating his mandate of serving the people ofHoma-Bay County. Kajwang’ had warnedthe governor that he would be impeached for expressing his opion that the party shod support Okello in hid bid for the party nominatin inNyando and also the embattled migori governor Okoth Obado if the Supreme Court order for the by-elections to be held in the two places after the hearing and judgement of appeal cases currently lodged before the court.

The you demanded that Otieno Kajwang’ should account for development projects he had initiated for the mutual benefits of the electorate in Mbita constituency, which he had represented for close to 19years ever since 1992 when he first won the elections on a Ford-Kenya ticket.

The youth claimed in one of the placards Kajwang’ had left the Mbita people unceremoniously after failing to deliver the goods in two decades. He had actually absconded and took refugee in the Homa-Bay county senate seat knowingly that the had let down the Mbita people would not get any votes there.

The youth sung and an danced on the road and briefly blocked the road stopping motorists before giving way.about Kidero’s attractive record of helping the poor by way of donating his hard earned money to wards the socio-economic projects in various locations in Luo-Nyanza and elsewhere.

If there is anyone who should be impeached that man should be Otieno Kajwang’ who is only credited for his lyric of “Bado Kuna Mapambano” which has no valued added in as far as the war r against abject poverty in the region is concern. “This time around this kind of political deceits in Luo-Nyanza must come to an end if the community is to realize its ambition of voting Raila Odinga as the next President of Kenya in 2017.

One of the youths who requested not to be named alleged that it was the likes of Otieno Kajwang who caused the mass exodus of most of the former Pentagon members of ODM. They forced the likes of William Ruto, Musalia Muadavadi, Charity Ngilu and others out of ODM.

The party lost the March 4, 2013 election to the jubilee due to the laxity and poor performance by those who surrounded Raila Odinga as his close kitchen cabinet and advisers.

The demonstrating youth alleged that the Senator is known for bad-mouthing other politicians, especially those politicians from out side the Luo community. He should double check his loose tank.

Instead of trying to gaggle Dr Kidero,Kajwang and his friends should put their act together and work out the election winning strategies for 2017, which should be different from his usual singing lyrics.

NIGERIA: REPORTED PLOT TO WEAKEN EFCC MISCHIEVOUS- MIIVOC

A Non-Governmental Organization (NGO), Media Initiative against Injustice, Violence and Corruption (MIIVOC) has described as mischievous, reports in the media alleging plots to weaken the Economic and Financial Crimes Commission (EFCC) via the Nigeria Financial Intelligence Center (NFIC) Bill currently before the National Assembly.

Executive Director of the Group, Mr. Walter Duru, who stated this while addressing newsmen in Abuja yesterday further described the report as sponsored and targeted at misinforming members of the public.

“The claim that creating the NFIC takes away the EFCC’s job simply shows that they do not even understand the core function of the Commission. It is a clear indication that they do not understand the mandate of the Commission and the difference between a financial intelligence center and a law enforcement agency. NFIC is a necessary body that must be in place in order for the country to effectively check financial crimes, money laundering, terrorism financing and other dangerous practices. The argument that the Bill will open the Center to litigations is unfounded and baseless. The proposed NFIC Bill is designed to provide a sustainable and credible legal framework for the NFIC in Nigeria. It seeks to provide the NFIC with operational independence, autonomy and greater ability to provide financial intelligence to all the relevant competent authorities (in Nigeria and abroad) in order to strengthen anti-money laundering and combating the financing of terrorism (AML/CFT) measures. It is an international requirement for Nigeria to be seen as a safe country. The NFIU (as it is in Nigeria now) has severally been observed to be deficient by Inter-Governmental Action Group against Money Laundering in West Africa (GIABA) and Financial Action Task Force (FATF) on many occasions. All the relevant stakeholders in Nigeria know the latter fact. Nigeria stands the chance of being blacklisted by GIABA during its forthcoming Plenary coming up in Niamey, Niger Republic between 5th and 9th of May 2014 because of this anomaly, which has been going on for years. All the Bill seeks to do is to provide for those things that give the NFIU’s its operational autonomy and strengthen its legal framework in compliance with international standard and best practice.”

“To assure you that they are simply out for mischief and to misinform, the EFCC had long recognized the fact that the NFIU should be operationally autonomous because its board passed a resolution in 2004 to that effect. However, the GIABA and FATF keep on reminding Nigeria that a mere resolution cannot cure the defect but a legal framework.”

Continuing, Mr. Duru explains that “This Bill is aimed at establishing a national agency that will be responsible for the receipt of information from financial institutions, designated non-financial institutions, law enforcement agencies and other relevant persons, analyse the information for the purpose of turning them into financial intelligence and disseminate the latter to all law enforcement agencies and regulatory authorities without discrimination. The Bill will ensure that the NFIU is not tied to any agency (to avoid abuse and information hoarding). Rather, it has adequate measures to build an independent financial intelligence system.”

“Financial intelligence can also be used to assist the monitoring of balance of payments, use of foreign currency and prevent the abuse of the financial system by criminals. It should be noted that over 139 countries across all continents have established such independent FIUs. Nigeria as a member of the international community needs to establish one in order to be able to exchange information with other FIUs.”

On the report of an alleged US Intelligence Agency faulting the NFIC Bill, the Media and Civil Society expert described such as phantom and misleading, adding that the body’s (FinCEN) submission suggested further strengthening of some provisions of the Bill.

Duru further stated that “The report alleging that a US Intelligence Agency faulted the NFIC Bill is yet another phantom one. It is not only misleading, but also lacking in substance. The reporter made a deliberate attempt to distort facts. FinCEN’s comments on the letter by the Chairman, Presidential Committee on FATF, which we have seen is geared towards ensuring that the proposed NFIC is truly independent and autonomous in conformity with international guidelines and regulations. It never expressed any reservations about the Bill, but only advised that it be watertight in order to meet international standards. Twisting it to suggest otherwise is simply mischievous.”

On the position canvassed by the EFCC during the Public Hearing on the Bill by the both chambers of the National Assembly, Mr. Duru described it as insignificant, arguing that the interest and future of Nigeria is far above one individual or organization’s interests.

He stated that Out of about twenty stakeholder institutions, only the EFCC opposed the Bill. “The FIU is meant to serve all law enforcement and other relevant agencies in the country, the EFCC inclusive. No single agency must hijack it at the expense of the majority.”

Continuing, the MIIVOC CEO stated, “As we talk, Nigeria remains disconnected from the Secured Web of the Egmont Group of Financial Intelligence Units due to the concerns expressed over the autonomy of the NFIU. What this means is that Nigeria can neither receive nor share financial intelligence with other 138 member countries of the Egmont Group on money laundering, terrorism financing and proliferation of weapons of mass destruction, as well as other related matters. More worrisome is the fact that it is happening at a time when Nigeria needs the information most, considering the challenge of terrorism confronting the country presently.”

“The only way out is to have a truly independent and autonomous FIU, as it is in other countries of the world,” he concluded.

KENYA: EAACC AND CHIEF JUSTICE URGED TO INVESTIGATE THE CONTROVERSIAL CONSTRUCTION OF ROAD LEADING TO THE HOME OF SUPREME COURT JUDGE.

The Ethics and Anti Corruption Commissions {EAACC} and the Chief Justice Dr Willy Mutunga have been urged to probe the hasty and suspicious decision by the Migori County government to construct the road leading to the home of a Supreme court judge.

Migori residents are suspicious that the work which started last weekend is coming immediately after the embattled Migori governor Zachary Okoth Obado had lodge an earlier judgment by the Appeal Court had nullified his election on march 4,2013 as the governor and recommended that a by-election be held.

Obado has since lodged an appeal with the Supreme Court of Kenya seeking to overturn the Appeal court ruling and the case is scheduled to be mention on April 23.

The road construction is viewed by Migori resident as aimed at circumvent justice.The work not only ill-timed, but is also in bad taste giving bad innuendo to justice system

The work sparked off street demonstration by the ODM youth in Migori town last Saturday. The youth demanded that the work is ill-timed and therefore should be cancelled until after the hearing and determination of the court case.

The work began within three days only after the Supreme Court had suspended the dismissal of governor Obado and allowed him to resume his work as the Migori governor pending the hearing and determination of his appeal case.

The work sparked off a street demonstration by a group of rowdy DM youth in Migori town last Saturday.

The road which is branching off the Awendo-migori main road and leading to ogwedhi Is leading to the rural home of the Supreme Court judge Jacton Ojuwang’ Boma.The youth said the construction of this road by thr county government when the area governor is embroiled in protracted legal tusle before the same court where justice Ojwang’ is a member of the bench would portray the court in bad picture. and should be cancelled in the interest of justice.

Justice Ojuwang’ Boma is the husband of the PSS for Science and Technology Prof. Corette Suda. However, a top county executive official ln-charge of Roads Erustus Nyamori dismissed the complaints by the youth as unwarranted, arguing hat the PSS Prof Suda had applied to the County to repair the road last August “At that time the work was approved we didn’t know she was married to the judge. The repair work is normal”

The construction work began last weekend only a few days after governor Obado returned from Nairobi and resumed his duties. The County truck were seen busy delivering murrams while the workers were digging drainage on the site

Other unconfirmed sources said the County was also laying water pipe to connect the home with water supplies and that the whole exercise would cost the County government close to Kshs 30 million.

WHY OLE LENKU WON’T END AL SHABAAB OPERATIONS IN KENYA

Chris from Nairobi writes: “Father Beste you are the one who can make me understand this operation better. Kenyan interior minister Joseph ole Lenku has banned all Somalia refugees residing in Kenyan towns to go back to their refugees’ camps. In your opinion do you think this can end al Shabaab operations in the country?”

Thank you for this important question Chris. This verdict came days after worshippers in church in the coastal town of Kenya Mombasa were attacked leaving at least six dead and many others injured. In my own opinion I don’t think this can end al Shabaab operations in the country.

Somali refugees have been living in Kenyan main towns over two decades since the fall of the central Somali government in early 1990. You will agree with me that since then the Somalis refugees have been living peacefully.

For ole Lenku to end al Shabaab operations in the country he is first of all to know the reason why they target Kenya. The attack began in October 2011-June 2012 when Kenya and Ethiopia helped the Somali government fight and reduce al-Shabaab’s control over Somalia via Operation Linda Nchi.

This attack will only end when Kenyan troops stop withdraw from Somalia. Since al-Shabaab saw itself as fighting for the spread of Islam — the Islamist jihadi version — Kenya was guilty of assaulting God and the Prophet Mohammed. Islamist jihadi law asserts the punishment for such an offense is death.

Understood this way, even if you send all the refugees back to Somalia al Shabaab operations in Kenya will continue. They need a soft, high-profile target that would result in numerous dead civilians in the most horrific manner. It explains why Westgate attack was perfect for this.

It explains further why in July 2010, al-Shabaab suicide bombers attacked two sports clubs in Kampala, Uganda, packed with civilians watching the FIFA World Cup final. The explosions killed 74 and wounded 70 — revenge and Islamist jihadi “defense” for Uganda’s participation in the United Nation’s African Union Mission in Somalia.

The reason why al Shabaab will continue its operations in Kenya and its neighboring countries even if all Somalis refugees are sent back is that al Shabaab has strengthened its movements in Kenya. They have even trained Kenyans in their camps.

It also means that Islamist jihadism has expanded in Africa. That is why aside from Somalia and Kenya, al-Qaida-related groups are increasingly active in Egypt, Libya, Tunisia, Algeria, Mali, Nigeria and Tanzania. That is why al-Shabaab has not only become a more serious threat to Kenya but also Africa and the international community.

The top tier of al-Shabab’s leadership is composed of committed international jihadis, many of whom have fought in Afghanistan and other battlefields of the war on terrorism, which derive a good deal of their political and financial backing from the Somali diaspora, and especially from the thriving Nairobi community of Eastleigh (which is often called “Little Mogadishu”).
