Kenya: Uriri MP is to be sued for not paying his meat’s bill to a local trader and for bouncing cheque

The Uriri M<P Cyprian Ojwang’Omollo may soon face a legal suit in court for failing to pay a local traders at Rapogi Trading Center the sums of Kshs 220,000.

The MP had issued the trader Mr Benard Otieno Jobando with a check for Kshs 130,000 as part of the settlement of the debt, but the cheque dated 30-09-2010 which was payable at the Kenya Commercial Bank at the United Kisumu Mall branch bounced with the remarks “Insufficient fund refer to drawer”.

On November 17,2010, a firm of lawyers operating in Migori Town as S.O.Odingo and Company Lawyers wrote to the MP as follows.

Take notice that we have been instructed by our above mentioned client to address you as hereunder;

{a} That between the month of January and October 2010 or thereabouts our client supplied yourself with meat from his butchery at Rapogi Trading Center in Uriri district,Migori County, amounting to Kshs 220,000particulars whereof are well known to you.

{b} That you defaulted to make good payment of the same, to date hence occasioning this action;

{c}That after persistence demands of payment of the same by our client, you issued him with a cheque of Kshs 130,000 dated 30th September 2010 which cheque was subsequently deposi6ted by our client but failed to mature {bounced}.

“Our client gave you a report of the failure of the cheque but you advised him to rebank it, which he did but it again bounced. All this information is well known to you.”

In the premises of our instructions are that unless you make good payment of Kshs 220,000 plus another Kshs 5,000 being collection charges and the cost of this notice thereof, within the next seven days from the date thereor, we shall be constrained to institute adverse but legal action against you for the recovery of the same at your own risks as to damages that would arise there from.

The Letter is signed by S.O.Odingo for Odingo and Company Advocates, Migori and Homa-Bay towns.

Hon Ojwang Omollo could not be reached for his immediate comment. A call to his phone by this writer went unanswered.

    We thought this MP was elected on the premise that he was the “sonko” of Uriri. He even promised that he will not take his salary for the first one year. what happened?
    Let people know that “not all that glitters is gold” when shall we wake up? He has started ferryng dead bodies againg in preparation for 2012. Should handling of dead bodies form the basis of one’s election to a position? It’s unfortunate that those who worked so hard for his election have also employed the same approach. Jo Uriri, wachomo kanye?

    Does he have a hotel or was he hosting delegations at his home?The bill appears too high for the period that it is said to have been icurred!I was also almost aking about the MP’s name again as Jim above but Joshua appears to be his constituent and therefore knows that name to correct.It is time we reverted to the old times when people were elected on the basis of how well they could articulate our problems and not how deep their pockets were! Unfortunately with time voters have been made to believe that people who appear to have limitless resourses during campaign period are their answer to all the constutuenc’s problems! Did you get what Stanley Githunguri,the Kiambaa MP said recentrly about electing “poor” people?

    To Voters of Kenya when will you learn that the majority of your leaders are FRAUD!!!!!!!!!

    This is what you get when you vote for your ( MpS) based on Tribal and Party lines. Haha..Haha, how many cows were rendered lifeless by butcher to generate Sh 220,000 bill??., How long did the MP kept his tab running to generate this bill? What is the size of the MP’S family that consumed this meat bill?,What was the butcher thinking when this tab was growing..unpaid??. Has butcher ever heard ..full me ones same on you..full me twice same on me!!!. How many times can the the MP’s check bounce before the butcher realize that he was being “taken to the cleaners”????. Yes, it true that the butcher has the right to sue, unless there was ” was written contract between the two parties, the butcher may want to kiss his nyama good bye.

    Knowing what I know about relationship between MPS and “wanainchi” this nyama was sold on verbal contract. The butch and his lawyers should pursue ” Wire fraud… writing bad check to defraud” . I am not optimistic that Mr. Butcher can be able to produce item list with MP’s signature for the Sh. 220,000 nyama bill and written contract to attain the Sh. 220,000 nyama bill.

    The lesson you Kenyans should learn, vet your: leaders and all public officials holding public offices before the are: elected or appointed to any public posts. I see now commissioners are being appointed left and right without thorough public VETTING. Some of these people are “old grossly corrupt officials: ( in previous and current regimes) who have looted your country to the ground yet they are the new commissioners being appointed to head various “public bodies” stipulated by the new constitution. I bet you Kenyans knows very well what some of these new commissioners have done when they were: MPs, or head of major Public institutions in this country. You don’t care about vetting them because: .they are one of your own, they come from your region, they are followers or loyal to to your political leaders who appoint them ..damn qualifications and integrity as minimum requirement to hold public office in Kenya!!!.

    By the way or for laughs, how did Makadara MP “Sonko” got elected based on his ” Criminal rap sheet with the law” in this country???. You the voters of Kenya deserve these fraud leaders like : Nyama choma, the Sonko of of Makadara and many like them in this country. I would again, dare they Mr. Uriri MP, to go for more nyama bill and while you are at it, seek out changa supplies I bet they are dying to sell to their Mps on tab so longs you are” one of their own”!!!

    this is very sad of a whole mp.how i would have wished he be stop from operation with an immediate effect and a warrant of arrest be charged against him.what a shame? he should make an immediate payment.

    This is where we always go wrong,he is now bringing people with buses to register in Uriri to vote for him because hi has money,he doesn’t know anything and yet he will be reelected because of the party name,Uriri people should wake up,some one who can bring change should be elected.
