Kenya: How Can the Kenyan six Avoid ICC trial?.

Kenyans,

Proverb 24: 3- 7 says: By wisdom a house is built, and by understanding it is established; by knowledge the rooms are filled with all precious and pleasant riches. A wise man is mightier than a strong man, and a man of knowledge than he who has strength; for by wise guidance you can wage your war, and in abundance of counsellors there is victory. BUT guys unfortunately WISDOM IS TOO HIGH FOR A FOOL.

If Kenya really wanted that the six suspects are not taken to Hague (ICC); Kenyan leaders would have already by now formed a local tribunal backed by international support. President Kibaki would have not appointed the 4 to jobs without following the constitution. They should have advertised the jobs openly first to gain confidence from Kenyans and the international community. That alone would have boosted the confidence. The so called KKK or PNU would not be now backing for the 4 names to be taken to parliament for voting, just because they know that they have the number. These lots should have done the alternative and, that is the right channel. In 2007/2008 Kenyan constitution was not followed, in fact it was abused and turned into a laughable garbage. The government in power then turned into a machine for killing people instead of protecting people. In fact the government was on the revenge mission not on governance. Kibaki`s government by then controlled the police, GSU, Ugandan army, Mungiki and even the Kenyan army. Despite all these they failed to bring peace, neither did they follow the constitution on how a newly elected president should take power.. The international community intervened.

Today the same PNU lead by KKK are still not following the constitution they messed with in 2007/2008, at the same time they want that the international community should not allow the six to go to the Hague. Some want to be the prime minister through back doors, no regard to the constitution, at the same time they want their names to be taken out of the ICC: Come on Guys even a fool will know that KibakiĀ“s diplomacy is coming from an imbecile brain thinking. Kibaki is dealing with a group whose majority are whites, so does Kibaki still think that whites are stupid to be cheated or what?. If Kenyans are intelligent enough it is high time to think hard and start do things much more wisely than we do them today. By wise thinking Kenya can avoid the Hague trial, but tribalism & greed, corruption, still avoiding the to follow the constitution we are going no where. Infact to an observer sitting far away in Hague or Washington sees us as just a trapped rat in a labyrinth with a door out, but due to imbecile brain we can not see the dwindling to the door: So we behave as if we are in a cage with no door and we turn into crude means to come out. Brain if not thinking will not help the owner if trapped.

Kenyans: In life, there are sequential stages of growth and development. a baby learns to turn over, to sit up, to crawl, and then to walk and run, Each step is important. That is true in all phases of life, in governance or ruling a community there are also process to follow, and steps to make us move forward. But there are sometimes also short cuts that if followed correctly can lead you to a better life: how ever the shortest way home is not always the quickest. So if I were Kibaki, the present Kenyan president I would go back to the bed room alone without advisers and think again.

Trying Ocampo Six in Kenya local tribunal is April fool day joke. Remember how Mr. Kibakis appointments have been handled politically. Which judges in Kenya will be willing to go against Uhuru Kenyaatta the son of the founder of this country??..which judge will want to go against Ruto with RV and Kalrnjins crying for political prosecution. I don’t see any witness walking in local tribunal to testify against these Six without being marked for death!!!

The best place neutral place to handle this case is the ICC at Hague. In fact the verdict from ICC will much stronger for this Six when they are acquited than any acquital by local tribunal in Kenya.

Paul you’re wrong? If you wanted to avoid ICC trial, you would pack the important positions in government with selected, profiled and handpicked stooges who can follow instructions. You would put a friendly guy at CJ, the same at AG’s chambers to include the director of prosecutions. This you would do so that the pawns would perfect the art of Amos Wako terminating cases, thwarting justice, taking police on a wild goose chase as has happened with the war on drugs. Nolle prosequis would be the order of the day, and if you had a flawed election hell you could have the CJ rule in court that it was fair and proper and voila you have president ruto and PM Uhuru from whence you could confidently tell the ICC and the international community to go fly a kite where the sun dont shine.

UNFORTUNATELY, Kibaki and central Kenya chauvinist kikuyu supremacy party Limited’s bluff has been called.

The Speaker ruled in law and on the side of Kenyans. His courage under unimaginable pressure must be commended and celebrated.

PNU brinkmanship has exposed itself for all to see. Kiraitu murungi, jamleck kamau, jeremiah kioni, uhuru kenyatta, simon mbugua (defunct), ephraim Maina and Co. the most unashamed of tribalists!! Along with their trophy flower girls william and isaac ruto, joshua kuttuny and all other rowdy good- for -nothing- noise makers to include the likes of philip kaloki at the behest of kalonzo the kamba chief and all the cast in this movie MEN BEHAVING BADLY starring Beth Mugo. The king is naked, be advised. And where is Kimunya??

    Benji,

The King is trully naked and it is time he shed of his tribal regalia and put on “national leadership clothes” and begun behaving like a President of a Nation, not a colonial tribal Chief!!

All these institutions; the Law Society of Kenya ( LSK), International Commission of Jurists(ICJ), Federation of Women Lawyers (FIDA), Judicial Service Commission(JSC), Commission on Implementation of the Constitution (CIC), the Judiciary, Parliament, The Minister for Justice and Constitutional Affairs, even The Attorney General and Chief Justice( for once!!!) got it right.

Surely, it cannot be Kiraitu Murungi, Jamleck Kamau, Jeremiah Kioni, Uhuru Kenyatta,Simon Mbugua (defunct), Ephraim Maina and the flower girl MPs from the Rift Valley not seeing what every sensible Kenyan sees.

This impunity of numbers in Parliament to validate illegalities and disregard the rule of law must be rejected and opposed by all means.

    Otieno Sungu.
