I find challenges and missing links in regards to the wake up summon calls for Ocampo six. Kibaki on the other end is sending a very wrong signal to the international community reading the content of his letter to the Security Council. Looking a back, Uhuru’s comment about declining to surrender his ministerial flag is a gesture that can only be defined by Dr. Mutua who has mentioned that the calls for Ocampo six is just like reporting to a police station…..Folks, why would we as Kenyans accept this total neglect and arrogance in our government? Lets look at the enormous tax payers money that Kalonzo has used in his shuttle diplomacy. How many of the IDPs could that money help resettle? . As they put it that Kenya has a slim chance in arguing the level of inadmissibility to the ICC case, are we being fooled that our government through many professional lawyers could not read these lines of inadmissibility two years ago? Something is not clear from both corners. I feel so much being a victim of the circumstance that Kenya is doing all she want is to protect the mentioned six individuals. What a mess in a rotten society such Kenya. To begin with, how dare would Kenya argue their case that they be given a one year deferral to set up a local tribunal? Ask yourself this logic, the election fiasco is two years gone, what did or has the government done to convince the world that they did some sort of investigation on the aftermath and concluded that the six mentioned by Ocampo should be held to account for the said allegations? Why is Kenya asking for deferral and in the first place they never take investigation matters at heart? Should we hence assume that our government is convinced that “yes” the six are the ones they would also want a trail on……? Out of the 1300 innocent citizens who were “murdered” following the 2007/08 elections, Mzee Orinda had suffered the most….11 people from one family! what a joke. Did Kalonzo and co even bother to help an individual like Mzee Orinda set up a new home? No! they were nowhere to be reached and now they are just crying foul for the six who happen to represent single family-wood. Kibaki must be playing a game that he does not fully understand the consequences to the effect. Why would Kibaki goes by a second thought of nonentity that because of Ruto and Uhuru’s name’s on the list, then there is a likelihood of chaos towards 2012 elections?. If seeking a deferral for the Ocampo six holding some water according to Kibaki’s government, then why did they take that long to arraign them in Courts of Law?

But more fundamentally, the reader needs to ask what exactly is President Kibaki trying to say in that letter to the United Nations Security Council and the Assembly of State Parties to the Rome Statute. Decoded, what exactly does the president’s letter mean? What does it imply? What, really, is President Kibaki trying to tell us and the whole world in that letter?

Simple!

President Kibaki is telling the United Nations Security Council and the Assembly of State Parties to the Rome Statute that if they do not let Kenya be led by suspects accused of masterminding violence during the General Election of December 2007/January 2008, Kenyans — the same Kenyans who were subjected to violence during the previous election — will most likely be subjected once again to violence during the next General Election.

He is saying that Kenyans have only two choices in this world if they want to enjoy what he believes is “peace:” be led by violent thuggish politicians who are alleged to have masterminded violence against them during the previous election, or be exposed to violence organized, orchestrated, and engineered by the same criminals seeking to lead them by force.

He is telling Kenyans that they either accept to be led to by thugs, or be subjected to suffering by thugs whose leadership they have rejected. He is saying thyat Kenyans are between a rock and a hard place. They are damed if they do; they are damned if they don’t.

The president is saying that peace in Kenya means accepting to be led by violent criminals; war is refusing to be led by the same gang of violent criminals. You accept peace by agreeing to be led by the violent criminals; you invite violence by rejecting leadership of the violent gang of thugs who have no qualms masterminding murder, slaughter, death against fellow citizens.

The president is saying that he has looked around at his presidency, at all his powers, at all the intelligence forces, the police force, and the paramilitary and military forces under his control, and his conclusion is that the United Nations Security Council and the Assembly of State Parties to the Rome Statute must either ask the ICC to defer the criminal cases against the six alleged masterminds of the violence during the previous election in Kenya, or else Kenya will be damned.

In other words, President Mwai Kibaki and the six alleged masterminds of the election violence are holding Kenya and its 38 million inhabitants hostages. It is either them ruling Kenya by force or the 38 million Kenyan people getting sucked into violence. It is either the criminals and the alleged criminals ruling Kenya whether the international community and Kenyans as a whole like it or not, or Kenyans and their country going to the dogs.

Decoded and deconstructed, that, in short, was the loaded message in President Kibaki’s so long a letter to the United Nations Security Council and the Assembly of State Parties to the Rome Statute.

    IT IS AMAZING BUT NOT SURPRISING

    Mwai Kibaki is hell bent to have Uhuru Kenyatta lead Kenya contrary to the wishes of sincere Kenyans. He knows none referral blocks this. By his action or inaction he has proved his culpability for the post election violence.

    What is the ICC waiting for? Let him too answer for gravier charges than his kinsmen, Uhuru Kenyatta and Muthaura. Period!
