Whatever the outcome of talks, respect our Constitution

I found this commentary by Patrick Maina from Kampala lacking in intelligence and quite shallow in its attempt to compare Kenyan situation with the US elections.

The incumbent, Mwai Kibaki has abused and violated the Constitution on the extreme!

A few things that this writer ought to understand first hand:

1. President George Bush, won the the elections against Gore because he had the majority of the Electoral votes and popular votes as well. Florida helped to maintain this win for Bush after all the counting was complete. Your understanding of this outcome may be skewed.

2. The electoral process of the US is quite transparent and anyone including a common person can verify the data.
3. Police force or Military or Paramilitary are never used to cover the voting places or vote tallying centers as was done at the KICC.
4. The international community is not imposing nothing on Kenyans. They are friends of average kenyan citizenry and are determined to see that the interests for us Kenyans are upheld and not abused by those in authority.
5. Kibaki and PNU themselves do not respect the very constitution they are calling upon. First, the corruption is a relfection of that. Secondly Kibaki stole the elections which is a felony in the criminal code. Kivuitu was drugged and we need to find out who was responsible for this. Was it Muttu or one of the junior officers serving the commissioners.
6. The Judiciary is delinked from the executive in the US. You have seen Senators and Congressmen close to President Bush get indicted for the wrongs committed by them. In Kenya this is impossible!

We should be proud that the International Community has come to our aid on this political thievery!

It is amazing that Kibaki should be the one advising Kenyans and the Annan mediation team to respect the constitution when:

    1. He has violated the constitution by rigging the election.
    2. He has given orders to his police to shoot to kill innocent Kenyans who exposed his rigging crime.
    3. He has refused to protect Kenyans equally as per his oath of office.
    4. Gema has violated the constitution repeatedly by ensuring unequal distribution of the national resources and jobs.
    5. Gema has been grabbing for the last 44 years inspite of and despite the said constitution.
    6. Gema uses tribalism against innocent Kenyans despite and inspite of the said constitution.
    7. Kibaki is criminally and arrogantly clinging to power when his right place since the rigging of the election and killing of innocent people should be either prison or the Gallows.
8.Kibaki has despite and inspite of the constitution deified corruption.

To whom is he now trying to preach about the constitution? What could stop ordinary Kenyans from violating the constitution if the head of state upto and including 27th December 2007 violated the same constitution and continues to do so thereafter?

He should stop preaching to the coverted who will never again respect him or accept him as their president.

Julius, once again you fail. The 2000 elections in th eUS were stolen. Bush did not win. He claims to have won. The same way Kibaki claims to have won, but really did not. They stole and you know it. You’re just a puppet of the republicans, after all the donated over 130 Million KSHS to your guy Odinga, and so they’re rally pissed that he did not win and want to find out how he’s gonna repay them. Second point, the Judiaciary in the US is not delinked from the Executive…it is actually molded by the policies of the excutive. The President appoints the Federal Judges and the Supreme court judges, right? So these guys are there to serve the interest of the appointing authority. A good case would be Justice Antonin Scalia who will disagree with anything that does not serve the conservatives. When you say that they indict even the presidents men, you need to qualify that with the fact that the president later pardons them (case in mind is the Scooter Libby case). My friend the mist political Judiciary is found in the US. Do some home work my friend

    Joe and Joseph,

Its no doubt that you are the same person juxtaposing as different people. Anyhow, your arguments do not warrant any response. I would like to reiterate my point which I urge you to go back to and read before your make yourself sound ridiculous and shallow. Just fyi, Nader spoilt for Gore in Florida. Bush won the elections. Whatever your analysis of the outcome, you seem not to have a good comprehension of the facts.
