Re: The Waki List and the Formation of Local Tribunal

What happened before 2007 election in Kenya was a well calculated scheme by some, pre-planned and engineered act of genocide and what transpired after 2007 election by others, could be termed as action in defense from total wipe out from the opponents.

It is the Tribunal Court which when locally set up comprising of independent personalities could hold hearings and provide authentics of the actuals, so culprits be punished according to the law of the land such that, in the event, no future blood bath of careless killings and adamant revamp killings of innocent will be experienced at the expense of their rightful demands for change. It is ill gotten to BLANKET AMNESTY. Let us seive the Chaff from the Grains. That the perpetrators who used Administration and Police to their advantage should be taken to task. So that elections are seen as transparent and a mark to fulfil Democratic intervention for Citizenry’s NEEDS and DEMANDS. in which case, Kenyans experience in the 2007 was met with excessive force from the Administration control that did not want to leave office, which as a result caused the loss of many innocent lives. This is not a WISHY WASHY situation. Kenyans should not allow impunity by protecting the perpetrators of violence, irrespective of their social status. We saw how Mt. Kenya Mafia do not understand dialogue. We saw how it is hard to get blood from stone. We saw how they cannot share 50/50 government, how they hold government and public property as their personal belongings, how they are ready to kill mercilessly just to stay in power. How until presently, the PNU offices don’t function and are selective of their owns for their gains. We saw how State House was used as personal private property instead of for Public Affairs. We saw how Power was used to silence and oppress Justice and deny Democratic Governance. We saw how Democratization Principles are being evaded with most eyeing 2012 individualistic selfish gains.

These lives that were terminated and lost are very precious and valuable to many. Before a repeat of the same, it is under the Human Rights Law that Kenya Ratified through the International Amnesty that takes this matter to the hilt so the powerless and the underprivilleged are protected under the International Treaty. First things First, the Law must take effects first, no room for falter. The likes of Otieno Mbai’s blood, Ouko, Tom Mboya’s are still fresh and are crying out aloud for JUSTICE. Who will provide for their children, who cares, did they fight for Kenya, did they want a REFORM for Kenyans, were they TRIBALISTS?

The Grand Coalition Government was therefore set up and the two leaders, Raila and Kibaki signed a peace accord agreement of extraordinary circumstances, a requirment that was to provide a shared Government into half/half between ODM and PNU and that an Investigative Team Commissions be instituted to report findings of genocide and that the findings be set for hearing before a Tribunal. That the CONSTITUTION be provided within one year. The results of which we have seen various report findings to include Kriegler and Waki report being completed and submitted. It is just rightfully to IMPLEMENT THE REPORT AS WAS STIPULATED IN THE AGREEMENT. If this report is not implemented as required within the 70 days provision, then it goes to the ICC the International HAGUE. So, evading Tribunal to be set up in Kenya, does not mean there is no other Tribunal or Hague. Another Tribunal may still be set in Arusha instead of being set up in Kenya. It is Naive and Absurd to refuse the setting up of Tribunal just because of the listed names. People, do not allow yourselves to be hoodwinked.

For this reason, I applause PM Hon. Raila and others for the Set Up of Tribunal and for standing his ground for the sake of Kenyans. The same way, he let go his VICTORY as the WINNER of 2007 election for the sake of Kenyans to broker peace with Kibaki who stole the election. Raila gave more than could have expected of him. People who rush to condemning Raila and calling him names may not have succeed even half way to where Raila have walked us through. Every human has their side of weakness, but this is not the time to call Raila names. I support him in this and will stand with him throughout this case. Where he slips like any other human being, we correct him and move on. I see some people taking advantage of this scene and blowing issues out of proportion for their gainful advantage – LET ME WARN THEM, WE ARE ON THIS TO THE END! We will not allow any changing tactics, we are focused on to the BIGGER PICTURE.

The act of THIEVING coupled with PRIOR PRESSURE TO RIG ELECTION is what blew reactions out of proportion and together caused mass killings of innocent Kenyas and must be condemned by all in the strongest terms possible. Culprits must face the Law.

We have seen a lot of reactions from different quarters, BUT, It will be very unfortunate and command a different outfit for the names that were provided in the list, if they do not allow or comply for the setting up of the Local Tribunal to take effect. The International Diasporans together with the International Communities as well as Friends and Sympathizers, who may not want a repeat of the same are holding this matter dear to their hearts that the 2007 Election genocide, the Economic Crime in Kenya and Human Rights Abuse see the light of Day to the end of HAGUE. This means that, the names or suspicious characters as depicts in the reports will not be free to travel outside Kenya. They will be hunted down one way or the other and will be handed to the ICC, the Hague Court. This matter will not rest or end until the legal framework is completed as is deem fit.

It is better they exhonerate themselves in safe haven (the Local Tribunal) than what will depict them at ICC the Hague.
