Folks,

A new Bill proposes that the Institution of KACC, where the Ethics and Anti-Corruption Commission is created in the New Constitution and is granted prosecutorial powers.

This is automatic immediately after the Referendum success. The reason Civil Society Activists are up and about to protect public interests. The same each and everyone must participate in a joint force to pressure and eradicate the cancer of corruption, graft and impunity……..it will not go away smoothly without a fight…..

But what we see here with PLO and Team, is a concoctment of mystified make-believe story.

This is what you call malingering for conspiracy…….PLO and Team is able to use the New Bill for prosecution as Court of Justice, but alas, he and team seems as they are on the Twist Again MeloDrama in Delaying Tactics for Reform Agenda to take roots.

PLO Lumumba and Team, take heart not to escape this opportunity, the best you can do for the People Public, is to act and save people from perishing……ask to beef your security and get moving……..get the ball rolling in the right direction…….

Take a risk and lets have a flavoured New Begining of life…….We are sick and tired of these old out-of-tune dancers. They are crude old fashioned without feelers, they are stale, flavourless and ragged.

It is true, you cannot teach an old dog New Tricks, unless it is fashionable and up-to-date with reality for New Found Generation Seeking for Lasting Solution for Love and Happiness.

People are fatigued and are thursty for fast-track realistic justice, if you take a step of faith and just do the right thing, God will Bless you immensely and your cup will overflow.

This is what is refered to as CHANGE………Changing from the old ways to conform to the New, which is full of captivating challenges to gain progress and success. Where we are, we are stuck in the mad of failure, a mad which is on surface of a sinking sand, and we are sinking into oblivion, a direct ticket to our death and decay……..How can you progress in a decay………and, This is not what we want……

God’s promise to humanity is, “Do Not Fear, He will protect you and see you through”, this is real with no otherwise……….Believe and you will be rewarded by God himself, who is the AUTHOR of our livelihood and survival, the beginning and the end………

New Bill Gives Prosecution Powers to Lumumba Team

A new Bill proposes that the Ethics and Anti-Corruption Commission created under the new constitution be granted prosecutorial powers. The Ethics and Anti-Corruption Bill, 2011 prepared by the Constitution Implementation Commission also proposes that the new body have a chairman and six commissioners. The new commission will replace the Kenya Anti-Corruption Commission.

The new chairman and the six commissioners will be recruited by a special panel that will be required to publicly advertise the jobs Presently, KACC does not have a chairman and it is steered by a director and his deputies. The Bill proposes that PLO Lumumba, who is currently the KACC director, retains his job as the commission’s secretary and chief executive officer.

Also to be retained are all staff of the current KACC as well as members of the commission’s board. Ten professional bodies will each be required to nominate a person to serve in the selection panel. The panel will also comprise one representative each from offices of the President and the Prime Minister as well Justice ministry.

The panel will select three persons suitable to serve as chairman and 13 as commissioners and hand the names to the President to zero in on one and six persons respectively. The names will then be handed to Parliament for further vetting and approval before the final appointment by the President.

As a way of strengthening the commission, the bill proposes that the new commission be granted powers to prosecute. Former KACC director Aaron Ringera constantly complained that one of the major weaknesses of the commission was lack of prosecutorial powers. Presently, the commission can only recommend to the Attorney General’s office that certain cases be prosecuted.

KACC has been at loggerheads with the AG’s office accusing Amos Wako of failing to institute prosecutions on many cases handed to him by the anti-graft body. But to cure this anomaly, the Bill has proposed that the new anti corruption commission has powers to prosecute but it should consult with the director of public prosecution’s office. Article 8 (1) provides that “The Commission may in consultation with the office of the Secretary of Public

Prosecutions institute criminal proceedings against any person or body, subject to this section and all other law relevant to the prosecution of criminal offences, in respect of any matter which the Commission may investigate.”

The bill seeks to give the commission powers to employ its own prosecutor who will have powers similar to those of the DPP. “A person appointed as a prosecutor under this Act shall have all the powers, rights and privileges of a public prosecutor,” stipulates Article 8 (2).

    Okay. I see a clique trying to create more jobs for Kenyans in the name of “commissioners”. While this is good, I see no role for those commissioners (& chairman) to play. It only serves to add more burden to the tax payer, to pay this chairman and commissioners for sitting and doing nothing. Simply give KACC prosecutorial powers and let it haul culprits to court. Period. KACC can investigate and take their case to the courts.

    Can someone tell me where, in this process, we need a chairman and commissioners? It’s all bullshit.
