Justice GBM Kariuki was arrested last year on allegations that he had stabbed a motorist, Mr. Robert Karori Kamau on 18th October 2008.

He was arraigned in court, given bail, and by yesterday, his case had been dealt with; by the Judiciary!

He was acquited for lack of compelling evidence. This was indeed very commendable. The Judiciary handled his case with such efficiencey that they had to release him with speed. How many Kenyans whose cases were taken to court at the same time have been given such efficient Justice?

This is the irony of the Judiciary and again, Kenyans must stand up and be counted on Judicial Reforms. We all need such efficient dispensation of Justice, not just because you are Justice GBM Kariuki, but because Justice delayed is Justice denied.

In the meantime, who stabbed Mr. Robert Karori Kamau?

Odiambo,
This shoild not surprise you since they were dealing with one of their own, cant you remember the Judge whose Credit card backfired vs Kenya Commercial Bank? now my suggestion would be that as we review the constitution and as we clammier for judges and magistrates to sign those contracts, we need to have time lines included in the constitution so that its well in black and white how long one should take to dispose of a case and should it go beyond then it will be declared time barred hence dismissed. that way they will all be racing against time, we can then use that to evaluate who is sleeping on the job.

    KENYA’S JUSTICE SYSTEM IS STINKING

    That Justice Kariuki is acquitted in a matter of just a few months is evidence of the miscarriage of justice. Kenya’s judicial system favors the rich and mighty hence the deeply rooted impunity.

    What could have happened to Justice Kariuki had he been a street boy or a Jaruo?

    The Judge was not only treated differentially by his colleagues in the Judiciary but remember the Government Chemist ‘failed’ to match the victim’s blood to the sword in the boot.

    Do you also recall the maize saga and KEBS etc. When will our people learn to speak nothing but the truth and stop twisting facts to suit situations?

    We are in a rotten nation and we better wake up. In doing so we should be prepared that some will be casualties so that the rest can recover.

    So our daily newspapers who have been sued for libel must take this note seriously. They should always strive to be so investigative and analytical so that full disclosure of accurate facts will not allow them to be accused of peddling rumours and propaganda. Had they pursued the ethics and professionalism of the Govt. Chemist and the Police, they would be able to show that their publications were not designed to disparage his character but was in the public interest to know the truth. Even now, the public only knows that the Magistrate claimed the prosecution witnesses gave contradictory testimonies but what was the nature of the contraindication?

    An examination of most of our Court judgements, especially in the lower courts, leave a lot to be desired. But our Bar is also conspiratory and accomplices, because they desire to win cases, not by merit but by deceit and technical knockouts, they abhor doing thorough research and analysis or even to consult. If they did, they would put the Bench on notice to take their work more seriously. And the Public has forgotten about the victim.

    How come there’s now outer-space silence on this matter??? Like usual, Kenyans too afraid to comment or equally of having done something shady in the past? If you can’t take action where you can, who will do it for you?? Your Judiciary, Police, Educational Establishment, Legislature, Executive and the Private Sector inluding the Church and NGOs are all corrupt and perpetuate mediocrity. What will you do to get out of this messs?????
