What if Raila & Kibaki are in Ocampo’s sealed Envelope?

Few who actually read my notes know my motto: To lay matters bare, there has to be an unusual way of looking at issues, don’t you think?

And in the same spirit I ask.
Hypothecially, what if Raila & Kibaki are among the prominent Kenyans whose names were given to the ICC Judges today?

I ask you, Ocampo indicted Slobodan Miloševi?, Radovan Karadži?, Félicien Kabuga, Omar Hassan Ahmad al-Bashir, a sitting president among others, what will he not do to our principals?

I ask you again, when the crocodile eat their own eggs, what will they not do to the flesh of a frog?

It follows therefore that we must think out of the box. That we must ask ourselves the ‘what if’ questions and come up with viable answers to our complicated hypothetical.

My hypothesis is that if the principals are in the Ocampo’s sealed envelope to the Judges, Raila would step down, but Kibaki wouldn’t. Because of this, the ICC may not reach and arrest others who also bear the greatest responsibility. How could he, when the duly sworn will claim that Kenya is a sovereign state?

On the other hand, my 10th great grandfather Ragem’s thesis is that anyone mentioned adversely should step aside, face the ICC squarely and if proven innocent, can rejoin active politics again.

However, the reality is that this situation is about Kenya. And Kenya being a land of Nguachi, whose Capital is Nairobbery, the City in the sun, and of plaster and stone. It is God’s country ‘ya kitu kidogo’ of ‘Eeee ndonege matubo bau!’

Kenya is still a country where we believe there is no way a wife can abuse a husband, or that rape cannot occur in a marriage, and when it occurs outside marriage, it was someones’ fault, or that the principals are above the law. That because whatever happened, happened, or that because the arm of the law is not long enough, Ocampo should leave us alone. After all we are in the middle of creating a new constitution and a new voters register, and his actions will interfere with our noble work.

People, I ask again, have you thought really hard about what will happen to our political landscape when Ocampo’s list is made public? The worst to imagine is that Kalonzo Musyoka could become caretaker president, considering he was # 3 in those elections and is also the VP! The best to imagine is that we could go to early elections and vote for Hebron Mosomi or Mark Mutunga, or George Luchiri Wajackoyah or Omondi Bunde, even though we still do not havew a voters register or new constitution!

Really, because we have this impunity syndrome, I do not see clearly what impact Ocampo’s action will have on our political landscape. My thinking is that it is just a front for US and other interested Nations, through UN to ensure that we complete Agenda IV to avoid the occurrence of another dark period in our Nation’s history.

However, in the very unlikely event all mentioned adversely including the principals agree step down, I, and not my 10th great grandfather Ragem, urge you to consider a vote for Omondi Bunde. He is a fisherman who has never hurt a fly or stole a pence.

    It is anybody’s guess but I do think that by arresting authorities using NATO forces to subdue the defiant Slobodan Milosevic and taking him to The Hague forcefully Kenya might not be an exception.

    But again I do not expect injustice on the part of The Hague, so arresting them might not be synonymous with both of them being guilty.

    I find it difficult to believe that the 450 plus people who died with bullet entering their bodies from behind could have died because our policemen ordered themselves to shoot and kill. Besides The Hague may not be having TKK ( towa kitu kidogo) arrangements that could be used arrogantly and with impunity in defense of the elect of God in power in disfavor of those who seek justice in our country.

    All said and done I believe God is still in charge of our country.

    The implication of this article is that there will be a leadership vacuum. You fear that since leadership vacuums foster confusion and violence the country will be plunged in a state of chaos. Those fears are unfounded. The succession hierachy is in place that will ensure that the affairs of the nation are transacted. We should desist from the the assuption that Kenya is Raila or Kibaki or Kalonzo and will cease to exist if any or all three were to exit the stage in a hurry. Kenya is greater that any one person. Now, good Sir, we must unite in the quest for justice for those injured or deprived. Kenya was greatly injured by the events that led to outbreak of violence after the last general elections. Kenya wants its day in court.

    I wont be surprised if they are mentioned because they are the leaders of the two protagonists that made our beloved country to bleed.As Odhiambo Onyango mention Kenya is bigger than the two so let us not think that there will not be a better Kenya if the two were arrested by the ICC.

    All implicated, whether Raila or Kibaki etc should face the full force of the law (at Hague). kenyans (and specifically the innocent blood lost) demand justice! I concur with Odhiambo Anyango that there will be no leadership vacuum — kenya has a constitution which stipulates succession hierarchy and the legal framework can and will expedite the process, I strongly believe.

    Odhiambo, Ajwala & Opiyo,

    What is this hierarchy? Do you agree to say that IF Raila or Kibaki step aside, Kalonzo will be the President and Mudavadi the PM? Do you actually believe Kenyans will allow this?

    Let us be honest and not make the same mistake twice, there is no plan. Confusion will reign supreme and things will fall apart when the center will not hold.

    Yes Joram,
    Kenya shall endure. There will come a time that we empasize will be on the sustainity of our institutions of governance rather than on personalities. The road to that day may just be expedited by the events taking place right now even as we speak. The hierachy I mentioned assumes that the VP will succed the President in the event the President is incapacitated or simply quits. By the same token should the same fate befall the PM the DPM with the majority in the national assembly shall suceed him or her. Tell me if you know any different.
    As to wether Kenyans will allow that to happen I believe, until such time that the law says differently, they do not have a choice.
