KENYA: NEW CONSTITUTION – – Does YES or NO VOTE MATTER ANYMORE?

Kenyans,

Perfection is not always possible, but it is the goal which everyone or every nation should try to reach or achieve. This applies also to the new constitution, because it is by this document we Kenyans will be ruled. May be the next time Kenyans will be allowed to take a vote on another constitution will be about 50 years from today, that is a very long time to come. That is a time when almost all who are in this forum might have been dead, who knows?.

SO WHAT IS THE NEW CONSTITUTION`S FAMOUS TREASURE?:

Kenyans have been cheated about Majimboism: Useless and ego maniac politicians in fact even highly idiotic educated Kenyans have joined politicians by simply saying that Majimboism will bring tribalism or will increase tribalism. This is total rubbish, the way these people argue is not wiser than a simple toddler`s brain. How will Majimbosim bring tribalism?.

Countries like USA, Federal republic of Germany, communal systems of government in Finland, Sweden, Norway, Denmark, Singapore etc have thrived much better than any other nations on earth today. The community or local governments with their own budget provides health care, education, childcare, provides jobs, plan for infrastructure with in their societies. And in case the money is not enough, they get loans for themselves to cater for the society and also get help from central government in terms of agreed percentages. Kenyans claim that majimboism will bring tribalism, a thing already existing. These school of thoughts think that Kenyans are people who can not be taught or convinced that majimboism will bring them more help than the present already existing tribalism brought by an imperial president. How will a local government bring tribalism?. Even in the most fragile rift Valley I do not think that a properly planed local government elected by the local people will bring tribalism. In fact it will bring intergration. The community will debate on what they need most and things to pay attention to first. This new constitution will not finish tribalism either. It might even trigger more tribalism, given the power invested in the presidential institution.

So Kenyans think of majimboism if we really want progress. This thing of planting cut bananas along the roads every time a president is visiting an area to show that there is progress while there is not is worse than tribalism.

The presidential powers in Kenya have been a debate since Kenya got independence from Britain in 1963 up to tomorrow. But does the new constitution addresses it?. NO, NO, NO. This constitution is still just telling the 42 tribes that a tribe whose son or daughter gets this top position will still be at the top of others and will still have advantages over the tribe which is not producing the presidency. The new constitution has made it even harder for people from smaller tribes to dream of being a president. What are we Kenyans voting for YES or NO and if Yes is it that in the new constitution the president is going to be better than in the old constitution, behave better or NOT. Somebody called politicians imbecile etc in this forum I think he was right. Are politicians right this time with this presidential system and powers given to him?. Removing the prime ministers post was an emotional thing and based on hatred among two individuals or two parties. Using the present coalition system of government where Kibaki and Raila were forced to have a joint power as the argument that it does not work is worse than a toddler`s mind. This coalition system is not the correct system to use to make judgement whether a presidential and prime minister system does or does not function. Countries like Germany, Finland have a president and prime minister and I can assure you that Kenya will not catch up with these countries in terms of development any time soon with this new constitution. Those who want to bet please go a head and do so, I am ready to take your money for free.

The Kadhi courts: Oh GOD help us, what a joke of a reason given for these courts to be included again in the new constitution despite the fact that majority of Kenyans do not want them in the document. The reason is that they have been there in the old constitution and nobody had problems with them so let them be in the new constitution also. Nobody is even interested to know how and why those kadhi courts crept into the old constitution we have today. Do these people really know that we are making a constitution of a nation to govern 38 million people, NOT a religious ceremony. This is not a voodoo thing any more. We want state things to be free from any religion, we want our Kenyan sovereign state back to belong to all Kenyans not to any particular religion or any particular tribe or group of people.

The new constitution has a prominent role to Kenyans it is like a covenant binding all Kenyans together. This paper will remind us Kenyans of laws we are to follow, it is a symbol under which we will be judged if you do wrong or accused of wrong doing. It is a paper to make Kenya thrive and catch up with developed nations. So I still ask this question: What is the point of paying a price of everything at a value of nothing?. Why not mend the fragile parts of the document first before you vote YES or NO?. Or you are already beaten up and just simply do not care whether a yes vote or a No vote, it does not mater anymore?.
