NAIROBI, Kenya, May 12 – The process of enacting a new Constitution has been rocked by a new controversy following claims that there are two different drafts in circulation.
The contentious document said to be in circulation concurrently with the authentic one has amended section 21 (1) (d) to limit the Bill of Rights in cases the government deems “prejudice to National Security.”
The Committee of Experts was quick to state that the anomaly had been noted and that the Office of the Attorney General had demanded that it vets all drafts to be distributed.
“The draft now being printed and distributed to the public is authentic as certified by the Parliamentary Select Committee on the Constitution Review and the AG,” said CoE Director Ekuru Aukot.
However, chief political No campaigner William Ruto led nine MPs in demanding for the suspension of the August referendum, to rectify the anomaly saying the inclusion of the words “national security” in one of the clauses negated all the gains in the Bill of Rights.
“These same words (national security) have been the excuse used all the years to deny the people of this country their rights,” said Mr Ruto adding that the No team saw this as “an orchestrated move by the powers that be to endorse a fundamentally wrong document to Kenyans.”
“Under the pretence of National Security we have seen people sent to detention without trial, media house raided and even rallies of anti government people cancelled.”
Mr Ruto claimed that he had information that there were one million copies of the controversial draft already in circulation. The AG’s Office has admitted the circulation of the illegal draft but said it had ordered the suspension of printing the wrong document.
“I talked to the AG who acknowledged the error which he suspects occurred at the government printer and he intimated that some people in government had been pushing for the changes,” said Lugari MP Cyrus Jirongo who joined Mr Ruto.
Attorney General Amos Wako directed that investigations take place to determine who sneaked the illegal clause and action be taken against them.
“The AG should have recorded a statement with the police by now,” said Igembe South MP Mithika Linturi.
The AG published the draft on Thursday last week.
The Committee of Experts in turn launched a nationwide civic education campaign in readiness for the referendum o be held in less than three months.
Mr Wako was expected to address a news conference on the controversy on Wednesday afternoon.
“Sneaked Ilegal Clause”.
There is nothing like sneaked illegal clause. This is a deliberate attempt by those opposed to the New Constitution. The so called “NO” campaigners have realized that the draft constitution has no room for “Parties for Sale”. There is no room passing in between (Kupita Kati Kati). The draft constitution does not give room for bogus coalition where people use their parties to bargain for power after they are defeated. The draft is also very clear on the fact that once you vie for Presidency, you cannot vie for MP at the same time. This means that those who feel that they can’t make it in Presidency see themselves locked out of Parliament all together. Land grabbers are also running scared. Als scared are those who have been using Government resources to enrich themselves then later they claim that they are more hardworking than others.
The Proposed Constitution is for serious Men and Women, NOT middlemen who use their tribe for power bagain. It is high time Kenyans show middlemen the door to their rural areas.
“American Leadership and Kenyans”
American leadership must now lead by example. If indeed the administration is serious about Kenyan issues, then it has to act and act very fast because time is running out. After Kenyans lost their lives after the last election, we cannot afford another chaos. All in all, if the forces that be stop kenyans from getting a New Constitution, the past may repeat itself because the same people who caused chaos are still there and greedy for Power. They go at any length to make sure that we don’t move an inch in getting a new constitution. THE FIRST ACTION BY USA ADMINISTRATION IS TO RECALL THEIR AMBASSADOR in Nairobi. I am not an expert but the regime in America should have come with New Faces in USA Embassy in Nairobi too. When Kenya was burning, I saw USA Assistant Secretary of State for African Affairs walking side by side in Nairobi with private businessmen who had nothing to do with Government Protocol. After that, she had nothing to say conclusive about her fact finding mission. I therefore maintain that Nairobi Embassy has to change for Kenyans to have confidence in the USA Administration. The time for a New Constitution is now or else, we shall do it after we have fought amongst ourselves to ground zero. I am saying this because we shall never accept another rigging and continuous looting of state coffers by a few disgruntled elements. Only checks and balances as contained in the draft can save us from this. Forget about those who want bring confusion using Kadhi Courts and Abortion. If there is something wrong with these Clauses, we shall amend them later, though I am 100% sure that there is nothing wrong here. The so called “Christians” pretended to be neutral at the hour of need after the chaotic election. They should continue with their neutrality for ever. They should channel the tithe and offering to worthy causes before we start to investigate their activities. I am understand that an Organization based in America is supporting them on abortion. Let the Organization be informed that America need their support on abortion than Kenya. Innocent babies are murdered daily in America in the name of Pro-choice and they are doing nothing about it. I will take them serious if they stop abortion in America.
