Semenya Wears Raila & Kibaki’s Viatu!

If your monther and father who raised you up, told you all along that you were a woman, you probably are a woman. If they also told you all along and rasied you like a man, you most certainly are. But what if, contrary to all you’ve been told and raised as, gender test show different?

Personally, I watched Semenya run in Berlin yesteday and I was not able to tell one way or another. However, I believe she is a woman, though I empathize with her for a very different reason. I am Kenyan.

We told Jomo Kenyatta he was the Father of The Nation, he believed it. The test are now showing he was not. He was a land grabber instead.

Moi told us KANU was Baba na Mama and we believed it, yet it was a dictatorship with its introduction of section 2a, and kura ya mlolongo.

Moi, it was said was ‘The Professor of politics’, and we believed it, especially seeing how Kibaki could not even give leadership in his own house. He also wanted us to believe he was the greatest envenronmetalist with his ‘Ukikata mti mmoja, pand miwili’ philosophy. In reality he was the greatest destroyer of the Mau forest.

Kibaki was told by the Mount Kenya Mafia that he won, Kivuitu gave him the certificate and he believed it. He even swore himself in at night. All indicatios however, point to the contrary. His legacy will no doubt be the biggest election thief in the era of the second liberation

So what about Raila? Moi said he was full of treacherous, yet many viewed him as a second liberator. He won the election, but he is not the president. Now he is championing Mau, but the Rift Valleyians are viewing his as a traitor. Should Raila take a credibility test, like a lie detector?

I ask you my friends, Is Semenya really woman or man. The good news is that either way you answer, African country gets gold. If, however the gender tests indicate she is man, Jepkosgei digs gold for Kenya.

Have you realized that sometimes you just do not know the answer to what seem obvious? Such are times when I wish my 10th great grandfather Ragem would shed some light.

12 Signs & Symptoms Of A Failed State.

Statesmen,

We’ve seen and said it all along. Signs and symptoms of a failed state are:

1. When the winner of elections is not the head of state.

2. When the National Accord, embedded in the Constitution, approved by parliament is only but a document. In practice, the previous GNU is still in power. The government spokesman, the head of the civil service, the first lady, are all more powerful than the PM.

3. When the head of state is unable to get concensus in his own constituted cabinet.

4. When laws and positions adopted by the National Assembly, are but only resolutions on paper. In reality, the country is governed by side road decrees, a crazy first lady, and positions taken by the ever too obvious kitchen Cabinet.
5. When agreements made on behalf of the government by her envoys, between government and international institutions are just like the lies a teenager tells to woo his young girlfriend.

6. When commissions of inquiry constituted by the head of state do not finish their mandate, and when they do, their recommendations are not made public, and when they are, not followed.

7. When all religious institutions, civil society, and human rights groups have no faith in Government and asks it’s leaders to resign.

8. When the government is unable to steal from her people in secret, and instead results in uncouth liquidation of assets to foreigners, and looting her central bank openly in broad daylight with fuzzy math.

9. When there is no electoral register, or any safe measures in the National Accord for the next in line to assume leadership should the current president drop dead.

10. When the government in power, fails to make new or follow her own laws. The president issues title deeds and then evict citizens without compensating them.

11. When the government fails to protect her territory and her people in NE and Migingo Island.

12. When a government is incapable of arresting, prosecuting, convicting and jailing perpetrator of crimes against humanity. When a government cannot investigate itself.

The best option is for such a government to resign and let the politicians seek a new mandate. Unfortunately, the government cannot resign due to the impending power vacuum. Kenya is a failed state.

There has to be an unusual way of looking at issues.

Politics is a dirty game. It is getting dirty by the hour and will get dirtier by the minute. Sample these:

1. Raila initially wanted the release of those arrested for violence after the stolen election. He in fact called them heroes. At this time they were on the same page with Ruto. They wanted these election theft bounties released. They reasoned, like they did regarding taking the election theft to the Kenyan courts, that the case would never be judged fairly, independently. The protests (and mostly violence) caused the National Accord Deal to be struck.

2. After the Waki envelope, Ruto feared that his name might be in the envelope. Raila changed tunes, perhaps realizing that The Hague Prosecutions would touch them and might require both of them to step aside, albeit temporarily. Fearing that Kalonzo would benefit as the temporary president, Raila pressed that those in the Waki envelope be tried locally. Local Tribunal would spare Kibaki since he is above the law, and therefore, it would also spare him because per the national accord, he is equal to Kibaki, the other principal.

3. With the envelope opened and the names in Ocampo’s radar, Kibaki and Raila have been unable to marshall support for Local Tribunal. At least, as of the time this analysis is being made. The cabinet is divided and time is running out. Something had to be done. Is this the execution of the plot against arap Ruto?

4. Ruto cries out for help. Some think he has threatened Raila. Ruto cries aloud, indeed we hear him but to the amnesic mind and ear, it sounds like blackmail. in 2008, it sounded like a hero.

5. Meanwhile Kibaki and Raila eat fish and ugali together, while drumming for support for conserving the Mau. Have they succeeded in wagging the dog?

Kenyatta betrayed Odinga then killed Mboya. Moi killed Ouko then betrayed Raila. Kibaki killed Mbai then stole victory from Raila. Kalonzo betrayed Raila.
Ruto and others stack by Raila when Mungiki, AP and regular police was butchering Luos. Raila say’s he is prepared to pay the price to save Mau.

My 10th great grandfather, Ragem sayest thus, “Jayadha…..cham kuon gowadu. N’gwech biro, to koth bende biro motin’go pee!” which translates thus “My Friend ….eat Ugali only with your Brethren, a storm is brewing, prepare to run!

But where?

I may be wrong, but I am honestly scared. Politics is a dirty game. The only gear needed is a strong heart. I have high cholesterol, high BP, and I am currently being fed high salt diet. I do not know about you, I hope you understand my condition. I too is prepared to pay the price, for cheRuto, my wife!

Last year in October,

I advised regarding Kenya’s post election violence as copied below. My advice has not changed. If fact, it is immoral and a conflict of humanity’s interest to allow those those who are already accused, even if they are not proved guilty, to determine jurisprudence and subsequent forum for their trial.

However, progress towards The Hague has been made. Even the politicians will soon all see the weight and ramification of being signatory to the Rome Statute and the ICC. Kenya sacrificed her sovereignty, but will soon gain a rebirth. ICC is a good thing for Kenya. It will be the 3rd and last liberation.

The Hague, like the alter that Abraham laid his son Isaac, has already done it’s job. Either buy just being there, buy flexing it’s muscle through Moreno, or by eventually trying the alleged perpetrators of crimes against humanity.

To avoid the Hague, Kenya’s rebirth still MUST occur, because this rebirth was a promise from God, which arises from the many years we prayed thus:

Ee Mungu nguvu yetu. Ilete baraka kwetu. Haki iwe ngao na mlinzi. Natukae na udugu. Amani na uhuru. Raha tupate na ustawi.

Amkeni ndugu zetu. Tufanye sote bidii. Nasi tujitoe kwa nguvu. Nchi yetu ya. Kenya tunayoipenda. Tuwe tayari kuilinda.

Natujenge taifa letu. Ee ndio wajibu wetu. Kenya istahili heshima. Tuungane mikono pamoja kazini. Kila siku tuwe nashukrani.

Inherently, we Kenyans are peace-loving and forgiving people. It is not our wish that we send our sons, daughters, mothers and fathers for trial and imprisonment in a foreign land. Yet, for the predicted rebirth, or third and last liberation to occur, we must.

However, my 10th great grandfather Ragem declares thus; For the rebirth to occur without The Hague, the following MUST occur

KIBAKI
He must strip naked in public, metaphorically. He must give up the privilege of being above the law as president. If he is in The Waki Envelope, he must resign and be tried, not for stealing the 2007 election with impunity and swearing himself in a haste, but for ordering, or condoning the armed services as they brutally and fatally quelled post election violence, and particularly targeting certain tribes. These notwithstanding, he could be found innocent in a court of just law.

RUTO
He must resign and vote again for a local independent tribunal. This will be the beginning of proving his innocence. The evidence against him is circumstantial, unlike Kibaki’s who was the commander-in-chief of those who executed orders.

MUTULA
He must resign and face trial for advocating for PNU and Kibaki in the face of a stolen election, nothwithstanding the innocent blood of the protesters. He must be tried for negotiating for Kibaki, while he remains a proxy for Kalonzo. By doing this, he deceitfully and through quasi legalese made Kibaki believe he was the duly elected.

KALONZO
He must resign for betraying Kenyans by supporting a candidate who lost, in hope of staying a heart-beat away from the presidency at whatever cost. That cost was over demise of 1,400 Kenyan lives and the current constitution crisis.

RAILA
He must step aside in good faith and face trial if his name is in the evelope. If his name is not in The Waki Envelope, he must be inaugurated as the 4th President Kenya, and appoint Kibaki as the 3rd Prime Minister if Kibaki’s name is not in The Waki Envelope, or if Kibaki is found innocent. This will be in good faith and in the spirit of forgiveness, bestow to the old man a stately exit.

All mentioned in The Waki Envelope must resign and wait for the outcome of the trial.

If all above are in the The Waki Envelope, then the best worse thing is to dissolve parliament and call for elections.

Dear Kenyans,

By now, I am sure that it is beginning to dawn on us that Kenya as we knew it, is gone. Hence only last week, I advised:

As painful as the memories are, it is impossible to prosecute and convict, (without a shadow of doubt) most cases of Kenya’s post election violence. Unless all Kenyans, including the international community, resolve, cooperate and pursue, to nab and prosecute both the big and the small fish, it is a case of nolle prosequi.

I still stand by my free legal-political analysis. To this I again add more simple legal and political advice. Interested parties can ignore at their own peril.

Whereas it is not disputed in the eyes of all and specifically the findings of the Waki Commission that criminal and inhumane deeds were executed by some during Kenya’s post-election violence, Kenya must be disqualified and disbarred from prosecuting any case stemming from the post-election violence for reasons stipulated herewith:

a) the current president is involved and he is above the law of the land per the current constitution. To wit, any legal action against anyone else, regarding any case, directly or indirectly related to the post election violence, is nolle prosequi, until the president leaves office or until the law is amended to allow the president to be indicted, whichever occurs first.

b) the current PM and some of the current law makers are involved, and to allow them any opportunity to set up a tribunal, or pass any resolution not to set up one is conflict of interest which renders any case of the post election violence nolle prosequi if tried under such an arrangement, even if the head of the tribunal is foreign, provided that the case is tried in Kenya.

c) other than the court martial of the 1982 coup suspects, Kenya as a nation has not been able to concluded or implement any recommendations of any commission or inquest. Any such body was set up to sweep problems under the rug or simply to cool off political and public tension stemming from political assassinations or any corruption scandals. Hence the onset of impunity.

d) because Kenya is a signatory of the international Criminal Court, and because of (a), (b) and (c) above, the ICC is the only body with legal jurisdiction set up to prosecute any alleged criminality or violation of humanity anywhere in the world particularly when laws of a sovereign nation interfere with the administration of justice.

Wherefore, as a sovereign nation Kenya has every right to reject the recommendations of the Waki Commission just like any accused has the right to plead innocent. I advice and agree that Kenya law makers should reject or disqualify themselves from setting up a tribunal in Kenya. However, since the Waki Commission was set up under the appointing authority of mutually accepted international mediator, under the direct authorization and supervision of the United Nations, the Waki Commission acted within it’s mandate to hand over it’s list of alleged perpetrators of violence to the official mediator, for prosecution at the ICC, in Hague.

Therefore, unlike business as usual, the perpetrators of violence will be indicted, regardless of whether they are a sitting president, PM, MP or officer of the law, and solely based on evidence, and without prejudice. They will be arrested wherever they are, whenever it is deemed appropriate by the International Prosecutor, then they will be tried, prosecuted and if found guilty, will be jailed. Remember, there is no death penalty punishment at the ICC.

For once, Kenyans will receive justice. Those found innocent or those left behind will continue to perform the functions of the nation. The clock is ticking, and the guilty need to be afraid, very afraid. Not because it is all hallows eve, but because they know they are guilty.

People,

Sometimes, people do crazy things that were unexpected. Sometimes they crazily don’t do what is expected. This causes disappointment to those who relate to them at a distance, (the public) and those who know such people well (the confidantes).

It will be in perfect honor to Michael Jackson, and great for us his fans, if he was given a state funeral.

I am disappointed that Barack Obama, or congress has not even thought of offering Michael Jackson a state funeral. Personally, I reached out to Rep. Nancy Pelosi and Sen. Barbara Boxer about this, and their answer was that there was no precedent to go by. I insisted that this would be a first and that, with the Democrats being the majority, especially today since they just gained a filibuster proof majority, they preferred not to pus the envelope.

It appears that state funerals in the US are only for sitting or retired presidents. This is despite the description of the term. A state funeral is a public funeral ceremony held to honour heads of state or other important people of national significance. They usually include much pomp and ceremony. Generally, they are held to involve the general public in the mourning process after the family of the deceased give consent.
Michael Jackson was not just important enough, and was of little significance to Americans. Perhaps his body should be handed over to the United Nations, for a global or international coalition funeral.

I am disappointed and saddened, that the King of Pop, was taken to the LA Coroner’s Office in a van instead of a hearse.

I am disappointed, but will feel consoled to learn if Michaels family turned down a state funeral offer, or if he wanted a private funeral in his will. The British were smart to give Diana a princess burial even when she no longer was. Otherwise the world would not have forgiven them.

Interestingly, my 10th great grandfather, Ragem informs me that Michael Jackson had sought to know his roots and had asked for DNA testing and matching. It is reported that the researchers he hired determined that his closest match was with a small nilotic tribe settled in on the shores of lake Victoria in East Africa! Hey Obama and Raila, if US cannot do a state funeral, lets send him to Nyalgunga, because his clan might just be Umira Kager or Aoro Wango before the Portugese scattered us all over the world.

Which reminds me of my second disappointment. Raila was advised to put more energy on constitution change rather than this PEV thing. Ocampo will net fish from either side despite his name telling that he too might be from the shores of the lake we know. There are certain things that are not worth fighting for.

I wish Obama, Pelosi, Boxer and Raila would look at the man or the woman on the mirror, nd tell them the change their ways about certain things, like smoking.

Mine is THE GIRL IS MINE. Indeed, one weekend, I accompanied a friend for burial in Lelechwett. There, in the little shopping center, a beautiful PYT was the shopkeeper. She was dark, my complexion. As if by design, Michael Jackson’s THAT DARK GIRL IS MINE was playing on the transistor radio. She was shy, and had a pretty smile. I like her, fell in love and later asked for Cheruto’s hand in marriage. It has been great. Perhaps Michael Jackson played a role in getting us together. Whether you believe this or not, his song certainly did, and we still hold hands when this song plays.

Michael Jackson, you rocked the world. My 10th great grandfather, Ragem say you still will! Rest in peace Wacho Jacko.

C I V I L – R E V O L U T I O N

Kenyans,

Since the monotonous reign of Daniel arap Moi many of us, including Kibaki and his ilk have yearned for reforms. However, the reforms have been brought and also slowed down by the current political elite. For Kibaki, the urgency stopped once he got the presidency. For Raila, frustration led to stupidity, then confusion and finally wisdom.

The commoner, like you and I, have wondered whether Raila or ODM will out-wit Kibaki or PNU and vice versa. Many have wondered what their plan B will be. Of course, the lawyers are currently working like hell to prepare for the legal repercussions. I am certain that Kibaki will dissolve the cabinet and reconstitute it with another as he masquerades firing all Raila sympathizers. He will constitute another cabinet of the deceased Government of National unity. Raila on the other hand is hoping to stamp his majority authority and shut down parliament. He is even prepared to engage mass protest, which will very well entice Kibaki to quell, a precursor to rule with an iron fist. Naturally, Kibaki being a Mungiki himself will even bypass parliament what with all his cronies in central bank, he will attempt to manage Kenya like he would his wives and pocket.

Whereas I do not hide the wish that I would rather Raila was president {Hello, he won the last elections hands down}, and whereas the constitution seem to favor Kibaki in appointing Kalonzo leader of Goverment Business and Chairman of HBC, the National accord and the political mood of the country favor Raila.

I put it to you that neither Kibaki and his group nor Raila and his group have plan B for tomorrow. The two were given one last chance to work together and save Kenya. After one year, they have realized that what they signed is not in their personal interest. They have put the interest of the commoner second to theirs.

The commoner has watched in the periphery, unable to do anything. The commoner has doubted and second-guessed their own capability. Hungrier, poorer, bereaved, invaded and raped, the commoner has been unable to change the destiny of the Kenyan nation. Okoiti Omtatah, Mutahi Ngunyi, and many others have tried to inspire us to identify the next leader from the common, but we have had cobwebs in our eyes. That is, until tomorrow.

Tomorrow is Kenya’s day of reckoning. The commoner will begin to take back Kenya from the political elite, because the political elite have screwed up. The commoner will use no guns, no threats or machetes, yet tomorrow we will identify Kenya’s 4th president. What is certain is that tomorrow will not be usual. It will be unusual because the commoner will outsmart the veteran politician. What is not certain is what the commoner will do with the power they will hold in thier hands tomorrow. Is it possible that the power is so hot that the commoner might just thow it back to the political elite? If the commoner is Kenneth Marende he just might. But to who? Maybe to the non-violent Okiya Okoiti Omtatah Obangonamasese.

Raila, Jomo Kenyatta’s political relations with Jaramogi Oginga Odinga fell apart, and this among other more important issues like land grabbing, is the reason Kenya is the way it is today. This also was the onset of tribalism. You have done very good to mend the situation and end this curse, and to this you get an A minus.

However, you are not being treated kindly and we are fed up. Kibaki has pata poteyad you more than three times already yet you should be able to know there is no ace in those cards. Even a two year old would know that the father is bluffing if he came home the third day without peremende. Kibaki is not honest in his dealings, yet you keep giving it a try. Fine. You may have the patience of Job, but please, understand that other Kenyans may not, and this is not about you. It is about us.

Listen, you joined Arap Moi to strengthen his government when he needed you most. He rewarded you with Uhuru. You said ‘Kibaki Tosha!’ You even crisscrossed the country and campaigned for him when he was debilitated. He reneged on the MoU. Kibaki stole the last elections from us and the whole world caught him red handed. You compromised for the sake of the dying and agreed to share power with him on our behalf, yet he rewarded you with Karua, Kimunya, Karaitu, Saitoti, Kalonzo, Kilonzo, Uhuru, and others with fat ministries. Though you managed to get ‘jukwaa bila choo, nusu mkeka na baraza bila PC’ You were outsmarted. You were not and have never been an equal partner. Like Abonyo said, when Kibaki was away, you were not, have never been, and may never be in-charge as long as Kibaki is president.

You have finally said enough is enough! So, like a spouse in an abusive relationship, like a child who has finally told his bully “I have had it. Today I confront you”, you must act completely differentley from the way you and your predecessors have acted in the far and near past, with the way you have dealt your cards at the negotiation table. This is because, your opponent has not changed, and will not change in this part of the world and especially at this point in time.

So, wuod Ragem, what must you do differentlythis time? You must only agree to deal in the full glare of the public eye and ear! No more, no less. Yes, do not agree to any deal in private! Only an imbecile will trust Kibaki’s word with all you have experienced already. Let Kibaki not charm you with “Sweetie, Wadura Mera. Nengwendete mono, rehe peremende.” in private only because he wants something. I am calling on the world to witness that I have pointed to you that this is Kibaki’s language in the dark. Remember also that real men do not do too many things in private with another man, lest they be called gay. Make him say his position in public, as you do yours. We all thought his kitchen cabinet, or spouse or Mt Kenya mafia interfered with his decision and that he was held by the balls when it was time to act decisively. No no no. Hapana! We were wrong. Do not be fooled again either. There is only one hardliner to reforms. It is Kibaki, and he is his own man. Deal with him squarely forthwith, forthright and openly. Make him hold his cards on the table, and trade yours openly also. If it cannot be live, have it recorded by independent media with an open understanding not to edit the video and agree that it be aired later to all of us.

If you do not get this deal, do not deal with kibaki alone again. Come back to us and let us force changes through civilian mass action. If you do not deal with Kibaki again openly, do not cry to us again. Things are falling apart. The center cannot hold. Please re-evaluate your priorities. This coalition government is not what you envisioned. It will fall apart shortly and consume both Kibaki and you. Currently, our private polling is indicating that your approval ratings have taken a nose dive. Kibaki’s have always been low and will not be running for elections again. If elections are called today, the mood of the country is ANY outsider will win.

As for you, a good number still view you as someone who has brought about change in Kenya, but whose hands are tied down so low, with a knot so tight, they are almost giving up on liberation.

Agwambo, let me tell you without reservation, that if you do not support Ruto, it will be the biggest betrayal case I have witnessed. Ruto might have screwed up in awarding tenders to brokers, but this is nothing compared to Goldenberg, Anglo Leasing or Kimunya’s Grand Ragency scandals. These scandals killed many more that the consequences of Ruto’s blunder if any would. Yet to date, nothing has been done to perpetrators of these major scandals. As a matter of fact, most are still sitting in the cabinet. Ruto has done nothing wrong, but mere failure in judgement and if you and ODM do not support him during this PNU orchestrated siege, you will be worth nothing to me and many more. I am a long time supporter of your ideals and leadership because I believed in them and not that you are my tribesman.

To prove my point, if you do not support your ODM colleague, I will withdraw my support from you and give it to this man, William Ruto arap Seromei because of his honesty. Agwambo, let me repeat, do not betray this good man. He put you in power. If you do, ‘mene mene, mene mene tel uphasi’ to you.

So what if the names in the Waki envelope go to The Hague. After all it is the only place that Kenyans can get justice. Kibaki stole elections and brought about harsh consequences to Kenyans, of which we are still paying price what with these curse-like frisky calamities of Nakumatt and Molo fires. To continue working with this man and give up Ruto, is the biggest case of hypocricy i have known.

Agwambo, I would rather than see Ruto crucified and do nothing, you get out of coalition government of 50/50 bul@#$%^ notwithstanding the PM post!.

Today, someone I do not know has made my day. No, no no, hapana! He has made my year, fifteen times over. Yes, I have missed this piece of art for 16 years, and today, though it is 4 days after Christmas, it finally felt like I was in Lundha, my home village. This piece of art, has brought memories of my trip during ‘mwezi wa decemba.’ As I remember how my parents pushed and shoved to get in the Third Class Coach, and the trip in the Steam Engine from Odhumo to Butere especially when I was sneaked in through the window, tears of joy fill my face. Yes, these were the days of Baba Biro, Ngware Inn, Akamba and Malaika. These were the days of trying so hard just to get my transistor radio to catch VOK, but barely. You have defied all, risked all, held back nothing though you could have and asked for nothing just to make me, an unknown person have a complete Christmas. The black T Shirt campaign forms part of a larger campaign where Kenyans have over the past few days held demonstrations, rallies, boycotts as they are protesting against the ongoing food crisis, the escalating prices of basic commodities, the high price of fuel and the MPs culture of impunity.

The urgent help required is:

ü cash bail for each person arrested,
ü tracing and visiting all the arrested at the various police stations where they have been taken,
ü lobbying for their immediate release, and
ü any other help you are able to render.

I too have questioned how and why Raila could renege on duly representing the interest of the people who gave so much to put him in office. I have used intelligence and have been assured by counter-intelligence that the PM may just be on the right track. Bestowed on the PM, and the Raila you have alluded to, is intelligence that we can only speculate about. However, the base is rightly worried and here is where political wit is lacking. On this you have your finger on the pulse. Kumekucha, Raila’s perception may be that he has caught a lion by the tail, and must continue holding lest it bites us. His supporters need to believe, not just in his desire and ability to end impunity, but in theirs. What is the cost of ending impunity? Is it losing a life long dream to be president? MLK gave his life for the world to appreciate his work. Madiba spent 27 years in prison to change SA. Raila has already given about 8 years in detention and recently he contended with giving up claim to victory and with sharing power albeit not 50/50. What more is he prepared to forfiet to change Kenya? Reverse intelligence indicate that Raila has not changed his position on what should be done to those arrested on allegations of fanning post election violence. Quite the contrary, his position is that many are innocent, except that in freeing them without fair jury, the guilty will slip through, and the cycle will continue.

Kumekucha, I am miles away from home, but I am able to read the situation in Kenya, get and decipher reciprocal intelligence and counter- intelligence. I take it that as you celebrate your anniversary, you will read the situation very well so that when you decide to spill the beans, let it be nothing but the absolute truth.

Why Has Raila Veered Off So Badly?

I am baffled.

I want to speak in very raw terms here because I think something has gone gravely wrong. I watched the Prime Minister speak at the Safari Park Hotel yesterday, literally fortifying his stance that the Waki Report be implemented to a T. As I watched, I had to scratch my head in amazement at what the man’s strategy is. Where is he going with this fervent call to implement a report that his support base in the Rift Valley is vociferously opposed to? And when that full implementation takes place, where will he find new allies to help him realize his lifelong dream of being president of Kenya? Does he intend to revert to the painful old alliances that have been fraught with jealousy, treachery and outright betrayal?

The way I see it, there are two sides to the Waki Report. There’s the political side. And there’s the legal side. Prime Minister Odinga is obviously winning the legal side handsomely, and in the process he is driving his supporters away. Because he is driving his supporters away in the Rift Valley and elsewhere, he is losing the political side of this equation in a spectacular way. For a politician of his stature, that is an astounding failure. Many ardent followers of this man have been with him because they saw in him someone who had his ear on the ground, who detected the direction of the political winds, who knew when to make tactical retreats. What has gone wrong? Is it the men and women around him who have insulated him from the groundswell of opposition to his leadership style? Has the power of his office suddenly blinded him?

I’m disturbed that it turns out to be President Kibaki who now calls for forgiveness and reconciliation . This was a matter the Prime Minister would have had more moral authority to call for than the president. But since this is something I’ve championed in the past, I salute President Kibaki for going in that direction. Indeed, I maintain that it’s the only viable way to deal with the disunity occasioned by the failed elections of 2007.

But it’s never too late.

The Prime Minister is an intelligent man who understands the power of perception. Our Rift Valley brothers and sisters are not defending one of their own because they think anybody is guilty, they are reacting to the perception that since becoming Prime Minister Raila has not seemed very attentive to their issues. Incidentally, vast swathes of Luo Nyanza voters feel the exact same way as their Rift Valley counterparts. If this trend crosses over to Western Province and the Coast, tell me where the Prime Minister will get his votes from in 2012. An alliance with Martha Karua? Maybe Uhuru? My God! Maybe it’s because of the possibility of this scenario playing out that the Luo Council of Elders called on the PM to rethink his strategy. I concur.

I’m aware that I’ll be called a tribalist for addressing this issue as I have. But I go off on the premise that six out of eight provinces voted for the Prime Minister. What that means is that more than half the nation is looking up to him for direction, inspiration and an understanding of where this nation is going. Advocating that we turn over our sons to the Hague is not how to play this game. A local tribunal is the way to go. It strengthens our faith in our nascent institutions and affirms our hard-won independence. The kind of blackmail the European Union wants to subject our country to is unacceptable. They need to be told in no uncertain terms that we’re no longer a colony. We have to come to a point where we say no to the monies they give us, because they are using those funds to blackmail us. How low can they sink?

Mr. Prime Minister, the time to hit a U-turn is now. I’ve spoken candidly because this is a time for a brother to whisper to a brother that the zipper of his pants are down. I hope you pull that zipper up before the children come storming into the living room and chuckling at the peeping sight of your red undergarments.

Maybe it’s because of the possibility of this scenario playing out that the Luo Council of Elders called on the PM to rethink his strategy. I concur.

I’m aware that I’ll be called a tribalist for addressing this issue as I have. But I go off on the premise that six out of eight provinces voted for the Prime Minister. What that means is that more than half the nation is looking up to him for direction, inspiration and an understanding of where this nation is going. Advocating that we turn over our sons to the Hague is not how to play this game. A local tribunal is the way to go. It strengthens our faith in our nascent institutions and affirms our hard-won independence. The kind of blackmail the European Union wants to subject our country to is unacceptable. They need to be told in no uncertain terms that we’re no longer a colony. We have to come to a point where we say no to the monies they give us, because they are using those funds to blackmail us. How low can they sink?

Mr. Prime Minister, the time to hit a U-turn is now. I’ve spoken candidly because this is a time for a brother to whisper to a brother that the zipper of his pants are down. I hope you pull that zipper up before the children come storming into the living room and chuckling at the peeping sight of your red undergarments.

I believe you are right. Kenya is still in a situation that atrocities, such as genocide are not just possible, but probable. Our peace is so fragile, and our unity is held together by some type of cement that does not seem to set. Alliances are solely based on job positions, land, money, stomach and egos. Issues are not, and have never been what determine which side of the devide the politicians take. Again you are right. Our founding fathers bequethed unto us a song, a prayer whose lyrics are so relevant today. Based on your request to pray for Kenya, today I have sung our National Anthem, something I have not done in a long time. I still have hope. I challenge others to do the same, for there is strength in numbers when we petition the Supreme. Stand up whilst our leaders are wallowing in the miasma of politics as usual. Post Election Violence Case Is Nolle Prosequi In Kenya, But Not In ICC.

Dear Kenyans,

By now, I am sure that it is beginning to dawn on us that Kenya as we knew it, is gone. Hence only last week, I advised:

As painful as the memories are, it is impossible to prosecute and convict, (without a shadow of doubt) most cases of Kenya’s post election violence. Unless all Kenyans, including the international community, resolve, cooperate and pursue, to nab and prosecute both the big and the small fish, it is a case of nolle prosequi.

I still stand by my free legal-political analysis. To this I again add more simple legal and political advice. Interested parties can ignore at their own peril.

Whereas it is not disputed in the eyes of all and specifically the findings of the Waki Commission that criminal and inhumane deeds were executed by some during Kenya’s post-election violence, Kenya must be disqualified and disbarred from prosecuting any case stemming from the post-election violence for reasons stipulated herewith:

a) the current president is involved and he is above the law of the land per the current constitution. To wit, any legal action against anyone else, regarding any case, directly or indirectly related to the post election violence, is nolle prosequi, until the president leaves office or until the law is amended to allow the president to be indicted, whichever occurs first.

b) the current PM and some of the current law makers are involved, and to allow them any opportunity to set up a tribunal, or pass any resolution not to set up one is conflict of interest which renders any case of the post election violence nolle prosequi if tried under such an arrangement, even if the head of the tribunal is foreign, provided that the case is tried in Kenya.

c) other than the court martial of the 1982 coup suspects, Kenya as a nation has not been able to concluded or implement any recommendations of any commission or inquest. Any such body was set up to sweep problems under the rug or simply to cool off political and public tension stemming from political assassinations or any corruption scandals. Hence the onset of impunity.

d) because Kenya is a signatory of the international Criminal Court, and because of (a), (b) and (c) above, the ICC is the only body with legal jurisdiction set up to prosecute any alleged criminality or violation of humanity anywhere in the world particularly when laws of a sovereign nation interfere with the administration of justice.

Wherefore, as a sovereign nation Kenya has every right to reject the recommendations of the Waki Commission just like any accused has the right to plead innocent. I advice and agree that Kenya law makers should reject or disqualify themselves from setting up a tribunal in Kenya. However, since the Waki Commission was set up under the appointing authority of mutually accepted international mediator, under the direct authorization and supervision of the United Nations, the Waki Commission acted within it’s mandate to hand over it’s list of alleged perpetrators of violence to the official mediator, for prosecution at the ICC, in Hague.

Therefore, unlike business as usual, the perpetrators of violence will be indicted, regardless of whether they are a sitting president, PM, MP or officer of the law, and solely based on evidence, and without prejudice. They will be arrested wherever they are, whenever it is deemed appropriate by the International Prosecutor, then they will be tried, prosecuted and if found guilty, will be jailed. Remember, there is no death penalty punishment at the ICC.

For once, Kenyans will receive justice. Those found innocent or those left behind will continue to perform the functions of the nation. The clock is ticking, and the guilty need to be afraid, very afraid. Not because it is all hallows eve, but because they know they are guilty.

Plaintiff, by and through the undersigned counsel, and pursuant to United
Nations Rule of Civil Procedure 1.420 and United Nations Statute 83.60(2),
files this Motion to Recognize Mwai Kibaki as illegitimate President of
Kenya, Motion to Compel his Resignation, and Motion to Order fresh
Presidential Elections, and states;

1. Defendant has brought forth to the UN General Assembly a delegation of
the leaders of the Republic of Kenya, and purports to be the legitimate
President of that Republic. The 63rd Session of the General Assembly has
authority to declare defendant illegitimate. The Defendant appointed an
Independent Review Commission (IREC), to ascertain the truth about Kenya’s
2007 Presidential Elections, whose results were hotly contested, resulting
in chaos and many deaths. The Independent Review Commission (IREC) has
completed its work and made its findings open. It was impossible to tell who
won those elections. Hereto, find attached Plaintiff’s Exhibit A.

2. Defendant’s claim as legitimate is premised upon Kenya’s 2007 Election
results. Plaintiff is alleging that defendant lacks Kenya’s
Constitutional Authority to be President, to wit a swearing in of the
defendant as President was conducted hurriedly on the basis of a quasi
certification of the election by Samuel Kivuitu, Electoral Commissioner. The
certificate issued is defective because the Electoral Commissioner disclosed
publicly that he did not know the winner of those elections. Hereto, find
attached Plaintiff’s Exhibit B.

3. Further and in addition to the basis for the motion to illegitimatimize
Emilio Mwai Kibaki, the Plaintiff asks the United Nations General Assembly
to recognize dictatorship where a Head of State appoints the Chief Justice,
Attorney General and Commissioner of Elections, all of which are the
only institutions that legalize the legitimacy of the person those
institutions declare President, and the defendant defaulted in taking Oath
of Office for President, without 100% certainty that he won. The wrong
person  was sworn in as Plaintiff’s president. Evidence presented in and
as Exhibit A and B indicate that the heads of these vital institutions acted
contrary to the facts of the results, which were uncertain at the time and
remains so. Plaintiff asks the court of the United Nations General Assembly
to conclude that Kenya’s Chief Justice, Attorney General and Electoral
Commissioner  acted upon the demand or command of the ‘Head of State.’ Where
a Head of State is found to have interfered with the independent functioning
of the institutions of the Chief Justice, Attorney General and Electoral
Commission, the United Nations General Assembly must conclude that the
appointing authority is corrupt, and must resign. Hereto, find attached

WHEREFORE, Plaintiff respectfully requests the 63rd Session of the United
Nations General Assembly to enter an order without leave to amend declaring
Emilio Mwai Kibaki a usurper to the seat of the Head of State and
illegitimate President of the Republic of Kenya and must resign as do United
Nations’ abiding gentlemen and women do, and if such points are moot, as a
body of free Nations which are democratically governed, compel him
to declare the presidential elections null and void, and call for fresh
elections of the same as required by the current Kenya’s Constitution, to be
conducted under the supervision of the United Nations, or Iindependent
Commission under Kenya’s new Constitution, and grant Plaintiff attorney fees
and costs incurred in prosecuting this action, as accentuated by contingency
multipliers, where appropriate, to the full extent that such remedies, fees
or costs are available under applicable United Nations guidelines and laws,
and other such relief as is equitable, just and proper and not to exceed US
$1.00 Million.

President McCain? Switch On The Burton Of Your Imagination & Act.

People Of The World,

I send you greetings from my 10th great grandfather Ragem, who like Karua asks you to stitch on the burton of your imagination. lets roll.

During the recently concluded Beijing Olympic Marathon races we saw an athlete lead through and through, leaving the chase pack 800m to 5K behind, then they won. Now imagine how it would feel if after leading the race through and through, like Kenya’s Samuel Wanjiru did, you entered the stadium and found the competitor you thought you left behind at mile 23, finishing his victory lap before you. This is what happened to our very own Catherine Ndereba. She did not received the rousing welcome as she entered the ‘Birds Nest.’  As she raised her head seeking answers why the rousing welcome was absent, she realized her terrible mistake. Constantina Tomescu was finishing her race. Ndereba had dropped a little behind as the lead pack had surged on. She used her stamina and endurance to catch up with them and then accelerated to leave them behind. In accelerating she used one of her secret strategy – hold your head down and maintain the fast pace until all the challengers fall behind, or so she thought..

As a sportsman, I did not feel sorry for Ndereba, because in all fairness, she made a mistake and price by getting silver instead of gold. I also know she has won many marathons for herself and Kenya for which we are very proud.

However this is what happened to Raila, but unlike Ndereba’s situation, there was no challenger in the stadium when he entered, and indeed he received the thunderous welcome. Instead of getting the gold medal, it was given to Kibaki who was over 500K votes behind and Raila had to fight to even get the silver medal. To this day, I feel sorry and ashamed for Raila and as a Kenyan respectively, because I did not do enough to ensure safe elections and prevent the violence and the chaos that followed.

The depression that followed was massive exacerbated by the killings that followed, first by police, then by civilian against civilian. For weeks, I and many of my friends in either side of the divide were depressed. Some have not yet recovered from this. I learnt a lesson I will never forget and which I want to apply to the current affairs.

The US election campaigns are in high gear, and my 10th great grandfather Ragem, alludes to me that the number of Africans and People Of The World who are naturing an Obama presidency is almost 100%. I am unashamedly one of them, but here I would like you to turn on the button of your imagination.

Obama’s hereditary linage can be traced to my 5th great grandfather Mumbe, but I am not saying it. Therefore my 10th great has a right to predict that Obama will defeat McCain hands down. However, we will not know the US 2008 presidential election winner with certainty in more than 5 weeks, perhaps because of KYVUITu or Kentucky, Virginia, Utah, Indiana & Tennessee. Floridians like Kalenjins will vote right since they do not make the same mistake twice.

I am certain you have dismissed these prediction as silly. But let us for a moment just imagine it is Nov 4th at 11:00pm and there is no projection of a winner. How will your emotions do?

My 10th predicted right that the winner of Kenya’s 2007 elections would not be known outright. He was right. If I believed in the possibility, I would have been prepared for what followed. The experience we went through as Kenyans, and if we can believe in the possibility of an Obama loss even with 1% certainty, we’ll be able to live through 4 more years of the McCain & Palin.

Obama say’s in his website: “I am asking you to believe. Not just in my ability to bring change in Washington…. I am asking you to believe in yours”. Do you? If you do, but do nothing to help, will you have the patience the endurance and the stamina to wait 4 more years to do it?

All things being equal, I believe in my ability to bring about change by voting McCain and the Republicans out and I have the courage to ask you on behalf of Barack. However, politics is not religion and is said to be a dirty game. I have seen what McCain, Palin and the Republicans can do, while like Gandhi or MLK, Obama tries to play clean politics. Some of us choose not to see Bill O’Reily and hide in the comfort of Keith Olbermann. Do not be fooled, like Okondo or Okoth Otura, both are extreme and yes, they may be related if you notice what I do.

Unless we begin to act as requested by those emails Obama-Biden campaign keep sending to us regarding making calls, forwarding emails, canvasing and registering voters, we may sit around the TV one evening and see our candidate’s victory slip away from our fingertips.

I am certain by now you have activate the button of your imagination, and can see this happening. The good thing is that you can still do something, unlike the Kenya situation whereby we could not vote. You can also do nothing, and in this case activate the button of your imagination and visualize McCain giving his victory speech.

The next morning you will be required to report to work, and I am sure you will feel just fine. Perhaps you can also decide to be non aligned, and when the result finally come, you will feel fine. Just fine because you will wisely be prepared and avoid what temporarily halted Raila juggernaut.
