War Still Rages Over Tycoon’s Body

KISUMU – The body of the late Nyando tycoon Paul Isaac Odero is still lying at Aga Khan Morgue over two months after it was controversially retrieved from his grave in Wang’aya Village in Nyando District.

Two sons of Odero, Isaac and Peter, went to Court in early February of this year to challenge the move by the clan and other family members to bury the tycoon’s body in his native Wang’aya village.

Kisumu Principal Magistrate Abdul Elkindy immediately granted the orders permitting the plaintiffs to retrieve the body until the verdict of the suit is known. The removal of the body from the graveyard was, however dramatic. The prisoners who were sent to execute the order retrieved it without the coffin to the chagrin of villagers.

Notably, the tycoon’s wives Peres, Helida and Risper have ganged up with the two sons for the body to be buried in Muhoroni settlement scheme while the other wife Ogonda together with other children of the tycoon and clan members are in favor of burying the tycoon in his native Wang’aya village. The latter allege that those were the wishes of the late Isaac even though he didn’t put it in writing as a will.

This week the presiding Magistrate decided to transfer the case to the high court citing traditional customs inconsistent with the late Odera’s being a staunch Muslim.

For starters, the late tycoon has a galaxy of rental business and other properties like land webbing across Nyanza province’s major towns. He had five wives, four of whom are alive to date, and close to forty children.

A source in the family fraternity who talked to this journalist on condition of anonymity was, however, not happy with the prevailing tussle, wondering aloud who will foot the staggering accumulating bills at the prestigious Aga Khan Hospital mortuary after the determination of the suit.

“All these expenses being incurred at the mortuary and in court should have been channeled to the late Odero’s school childrens’ education kitty,” he noted.

ODM was pushing for 34, PNU was pushing for 44 that is a delta of 10. The people of Kenya were hoping for a “mean”, lean and clean cabinet of not more than say 24. How come the agreed number was not in this case a max of 39? Is this true power sharing? If anything for the sake of even numbers why not 38 then? PNU just wanted to show that they have the upper hand.

I expect to hear disappointment from ODM/Raila supporters.

I call for civil disobedience against PNU/ODM cabinet selection.

I expected ODM/Raila to send out a strong message against the needless and shameful teargas attack on honorable Dr. Wangari Muta Maathai. I was left dissadisfied and quit frankly discouraged on this matter.

The BIG question now is this: What else is ODM/Raila is going to compromise on?
To PM designate Raila Amolo Odinga (RAO): Please be careful not to let us down. We have come too far to sink!

The people who have been holding Kibaki at ransom for all this time, the same people who advised him to hijack the Presidency, are crooks. To them the country does not matter. It is their selfish plans that must go through.

These same people pretend that they are interested in finding a solution to those who were displaced in the Rift Valley, but the reality is that, all these crooks are interested in is finding ways and means to loot. They have realised that their plan cannot suceed if the peace and power-sharing deals become a reality. They plan to use those displaced in Rift Valley as “tools” for looting–those destitutes will be told that a FUND is being started to resettle them. They will then misappropriate those fundsin in the tune of billions and bank them in their accounts. The destitutes will then be given maybe something like Kshs 5000/= as compensation. The rest will go to these peoples’ pockets.

Now if you had a false illusion that those from other parts will also be compensated then you are in a bad dream. This plan of theirs cannot bear fruit if Raila and ODM are in Government.

So, as a retrogressive thinker, what is the surest way of breaking this deal?

They have done their homework and they have zeroed in on RUTO. If they get to Ruto in any way, then they are 100% certain that hell will break loose amongst Ruto’s supporters. This is a guaranteed way of breaking the peace and making their plan succeed.

Mark my words, they have never wanted this peace–they don’t want it, and they will never want it because they are not interested in it in anyway whatsoever, they are not interested in sharing the fruits of the Kenyan Government with the citizenry. So watch out. Ruto is one of their last cards to break this peace. Therefore, to ODM Ruto, must not go anywhere. Let him be there to stay. PNU can rant but Ruto ain’t goin’ nowhere! Got that?

Poor old man Kivuitu is a sick and arrogant man who has embarrassed and let Kenyans down for a long time. It’s time for this old-man to retire peacefully to his Ukambani home if he expects to enjoy his pension and the corrupt 10M Kshs. he was awarded by the MKM brigades to sell the presidential certificate to their homeboy. How can he decline to answer questions posed to him by the pressmen and refer them to “whoever gave them that report”. This is a very irresponsible answer which is tantamount to abandoning his job. If all he does is sleep in his office and caught unaware when asked questions by our messengers, then he needs to retire to Masaku village and sleep there for the rest of his life. Kenyans don’t need folks like Kivuitu as their election referees if he doesn’t know how to operate a whistle by himself. We need people who are quick and capable in thinking and give congruent answers to the public. He is NOT even remorseful for what he has caused Kenyans so far. He needs to go and apologize to Kenyan refugees living in various parts of Kenya and Uganda instead of acting silly and stupid!!!

And that is my two cent opinion.

Kenya: ECK Declines to React to ‘Serious Mistakes’ Report

The Electoral Commission of Kenya on Wednesday declined to react to a report saying it had admitted making serious mistakes in the way it conducted last year’s elections.

“We are not aware of such a report and we are only reading this in the papers today (Wednesday),” an ECK official said.

The report, said to have been compiled by ECK commissioners during a recent workshop in Kilifi, pointed out several irregularities in the election process.

It says that there was no communication between presiding and returning officers during the elections, whose disputed results sparked countrywide violence.

The ECK official, who did not want to be identified, said chairman Samuel Kivuitu was shocked to read the story on Wednesday.

“The chairman will not react because he does not know the source of the report,” the official said.

On Wednesday afternoon, Mr Kivuitu chaired a meeting of the ECK staff at his office.

It is not clear what was discussed, but sources said the chairman expressed concern at the report, which he believes was leaked to the Press by some commissioners or members of staff.

“The chairman has said that whoever gave you that report should react to it,” the official said.

According to the report, the black books used to assist voters whose names were missing from the official registers and those who were registered more than once could not be used because they had not been updated.

The report was given to the press by lobby group, Peace with the Truth and Justice, on Monday.

Mr Kivuitu declined to answer calls from the Nation.

The commissioners said the issue was so sensitive that, only the chairman could react.

ECK in spotlight

The report says that returning officers gave certificates to losers in some constituencies while others changed the names of people to whom certificates had been given. There were several irregularities in the whole election process, the report says, and this prompted some lobby groups to react.

The lobby said it would join those seeking to start private prosecutions against ECK staff and commissioners.

He was husband to Melissa and brother to Lynn Akwacha, Jean Onyango of Kisumu, the late Josephine Migadde, Mary Onyango of Bethlehem, PA, and Xandae Baridi of New Jersey.

He was also uncle to Donna and Velma Akwacha , Gracie Hargrove of Bethlehem PA, Tyler, Christian, and Sean Baridi.

He was brother in law to Grace Ogot Baridi of New Jersey, Wilson Akwacha of Kisumu, and Mwanya Migadde of Nairobi.

He leaves behind daughters Lani, Gracie and Jossie.

Family, friends and well wishers will be meeting daily at Mary Onyango’s residence

Tell me, now that the offer shares have a par value of 5 cents, how many Offer Shares make a real share ?

I think the more one buys, the best placed we all are at getting real benefit from the IPO. Otherwise, with the expected oversubscription, no one will get as many offer shares as they would want.

Kisumu Mayor, Town Clerk Walking a Tight Rope

KISMU MAYOR, TOWN CLERK IN TIGHT CORNER OVER DIRECTIVE.

The graft-ridden Kisumu city council’s recent decision to non-staff tenants to vacate its houses especially in the posh estate of Milimani has elicited sharp reaction from the current occupants of the houses and widened the political divide.

Talking on strict condition of anonymity, the enraged residents of Milimani took issue with the city’s new mayor Sam Okello and clerk Mr. Rashid Makiwiwi for allegedly implementing the directive selectively.

“Why spare some people and yet this was a full council meeting resolution,” questioned one resident.

“The council should apply directive fairly irrespective of one’s political status in the society,” added one of the fiery politicians in the lakeside city.

The duo, according to inner sources, are in a catch-22 position.Tthey are yet to serve some occupants of the up-market estate with the notice of vacation since they are prominent personalities in the Luoland political and business circles.

Prime minister designate Hon Raila Odinga, MP Hon Jakoyo Midiwo, ODM secretariat Prof Larry Gumbe, Mollasses plant official Mr. Israel Agina and banking expert Mr. Mkuria, among others are some of the high profile personalities who are reportedly being treated with soft gloves.

Unconfirmed reports further reveal that the city mayor who is a perennial parliamentary loser of Muhoroni seat and the town clerk held a secret meeting with some Asian tycoons at the exclusive Nyanza club in what is largely seen as a controversial bid to maintain the status quo.

Independent investigations also reveal that some of the council houses which were begging for refurbishment were rented out to organizations who repaired them in turn and on a contractual basis. These organizations were also issued with vacation notices although their repective contracts are yet to expire. This is likely to open a flood gate of legal suits against the financially crippled council.

Consecutive efforts to reach the soft spoken mayor and town clerk for comment proved futile by the time of going to the press.

A one-month notice to repossess the council houses was made at a full council meeting which was chaired by the city’s mayor and with town clerk as the secretary.

The clerk to the council Mr. Rashid Mwakiwiwi earlier said that the move was in tandem with the mechanisms being put in place so that the cash-strapped council can recover money it is owed by the tenants.

It was unearthed that the tenants owe the council over Ksh. 1M in rent arrears with some having to pay between Ksh. 200,000 and 500,000.

Furthermore, the clerk said some senior officers at the council have been compelled to live in non-council houses that are in deplorable conditions while the rent defaulters are enjoying the civic body’s facilities at the heart of the town and its environs.

The tough-talking Makiwiwi promised to read the riot act to those who defy the ultimatum.

My dad is greater than your dad!

When you think that you have heard or seen enough popular shows, then another one pops up.

The latest one, at least to me, called “My dad is greater than your dad,” has gotten me thinking.

This show compares the greatness of one father to others depending on whether or not he wins various programs/activities.

From the time I was introduced to the show, by none other than our youngest daughter, I have found myself asking this question: how do some children view their fathers?

This all depends on one’s experience with his father. Reflect with me on the following:

1. There are those who fondly recall their father for the many years of struggle to bring the family up amidst all the pangs and torture of poverty. Their father was always there for them in good times and bad times–teaching, guiding and praying for each one of his
children. Yes, even many years after his death, many still recall and miss their fathers.

2. There are those who were deprived of their dads at the time they needed them. They, therefore, grew up without a dad and have missed a father’s tender care over the years.  Each day of their lives, they look forward to the great re-union and a life together in the earth made anew.

3. There are those who were abandoned by their dads at the time when they needed them. Since then, all they have known is pain and an untold amount of torture. It was so
bad that they don’t want to recall anything to do with their dads.

4. There are those whose dads were so mean either to their mums or to the children themselves.  Their own father put them through so much that they don’t want to recall a thing about the guy.

In the end, each one will evaluate his/her father depending on what relationship they had.

Whatever your experience has been,  I want to remind all of us that we have a father that cares for all of us. He has always been there for us. Yes, I mean in times of joy and sorrow. He has never left us alone in this world filled with pain, hate, and uncertainty about the future. All He has ever wanted for you is a good life coupled with success. Listen to His ever present assurance:

Isaiah 49:14-15  I will never forget you.
Jeremiah 29:11   I have great plans for you.

Well, well, my father was a great father. Several years after he passed, I fondly recall and miss him. Yet, despite all that he did for me, I can with all confidence say that my heavenly father is greater than all dads in the world.

I am indeed delighted that the Lord of the universe is my father. How about you my friend?

You have got it right, and true, Kenyans are watching how Kibaki and his PNU team are behaving.

Hon Najib Balala got it right yesterday when, in a press statement, he said that the position of ODM is such that Hon William Ruto, will be a member of cabinet from the ODM side.

That was clear enough.

He again told that that the power sharing deal has been entrenched in the constitution, and to that extent, the principle of portfolio balance is such that if PNU takes Defence, ODM takes Internal Security.

If they take Foreign Affairs, we take Finance, and so on. ODM should also demand the vice presidency, given that PNU has the presidency.

Lets not leave anything to chance. The accord is between ODM and PNU, and the shared governance must start from the top, to the cleaner.

For this, ODM must not relent.

By deciding to negotiate with people like these goons, what we did was to essentially tell them that their stupid behavior has its reward. Is it any wonder that they now want to dictate who gets into the cabinet? And is it any wonder that they can’t understand they lost the election? Let it be made clear to the ODM that Kenyans will not tolerate a move to sacrifice the Hon William Ruto. The PNU side must understand that Kenya exploded in violence because Samuel Kivuitu declared Mwai Kibaki president illegally, then the Chief Justice hurriedly and illegally swore him in in a ceremony even the heavens didn’t bless. You want to know who committed a crime? It was Kivuitu, Kibaki, Michuki, Gicheru and all those who acted to kill and maim Kenyans after the election theft. I especially wonder why Grace Kahindi hasn’t been charged with murder and use of excessive force on innocent Kenyans. Why is she free to laugh at our sense of decency?

The Hon. Odinga and those who support him have climbed down for the sake of peace and accepted to work with the thieves and architects of the mayhem visited on Kenyans. But now that those hardliners are hell bent on holding all of us hostage, aren’t we justified to say enough is enough? At what point do we say we’ve given it our best shot, guys? It’s my humble opinion that if the Kibaki side does not move quickly to move the nation forward, we have to act to save Kenya. We need a lean and sensible Cabinet, and men who love Kenya like the Hon. Ruto must be part of it. Period. We can’t accept a situation where the likes of Michuki and Karua tell us who is clean? Just how clean can thieves be?

The time is now, President Kibaki, do what you promised to do or you’ll soon realize that there are ideals and principles for which our freedom fighters and founding fathers gave their lives…and we are willing to follow in their footsteps if push comes to shove.

Vice-President, Mr Kalonzo Musyoka and his running mate in last year¢s elections met for the first time since the poll results were announced.

Dr Julia Ojiambo led a team of officials from the Labour Party of Kenya to Kalonzo¢s Jogoo House office to discuss how they could benefit from Government appointments.

She said she had no hard feelings against the VP over the nomination.

“I am politically strong and relevant and no one should write me off,” she told journalists after the meeting.

Ojiambo said her party had provided a safe landing for Kalonzo during the battle for the control of the Orange party and, therefore, deserved some Government appointments.

“We deserve some positions in the Government since we have individuals in our party who merit them,” she said.

She proposed that LPK and ODM-Kenya manifestos be harmonised and incorporated in the coalition.

Kubebea said the two parties should strengthen their grassroots¢ structures ahead of the 2012 elections.

Kiluta said the meeting with Kalonzo had eased tension between the two parties.

“Things are now in shape and we want to exploit the political mood for the good of our party,” he said.

Sources told The Standard that Ojiambo was promised a plum appointment in one of the parastatals. “Kalonzo acknowledged the role Ojiambo played during the elections and promised that a major appointment was set for her,” said the source, who sought anonymity.

Former UN chief Koffi Annan said President Mwai Kibaki and ODM leader Raila Odinga have no alternative but to share power equally and must follow the spirit and letter of the agreement.

Let us back up a little: Did Annan really have to be forced to intervene again? You say Kibaki is the President of Kenya? What is Karua’s rank?

It’s called the Obama Organizing Fellowship.

When I was a young man, I was inspired by the Civil Rights Movement
and the idea of people working at a grassroots level to bring about change.

I got my chance on the South Side of Chicago, as a community organizer,
and it was the transformative experience of my career.

That’s why we’re introducing a program that’s going to train a new
generation of leaders — not only to help us win this election, but to help
strengthen our democracy in communities across the country.

If you apply and are selected, you’ll be trained in the basic organizing

will be assigned to a community where you’ll organize supporters. Assignments
will begin in June, and you’ll be required to work a minimum of six weeks
over the summer.

FEATURE: PNU Power Struggle is Damaging Kenya’s Image

It is evidently clear in the eyes of keen political observers that there is lack of urgency and faith by PNU in the need to equitably share power between them and ODM. The National Accord and Reconciliation Act 2008 which was recently passed into law and assented to by the president on the same day, made it clear that, under the circumstances in which the country finds itself, it will be 50-50 power-sharing and that this must be real power between two equal partners.

However, in recent weeks following the signing of this Accord, a number of PNU personalities have given Kenyans the impression that ODM is simply a guest in this grand coalition and that they must not point at what they want but simply take what they have been given by their host. Under the terms and conditions of the Accord, there is no host and there is no guest in the grand coalition. PNU must accept all or nothing under this law or leave power for those ready to govern as Kenyans are becoming impatient with unqualified rebellion.

It is even clear that the internal power struggle in the PNU corridors has more to do with Kibaki’s succession than portfolio balancing and the argument about real power sharing between PNU and ODM is merely a mirage to cover their shadow personal ambitions. This PNU power struggle is damaging Kenya’s image and Kenyans must resist the temptation by some greedy and uncaring politicians who least cares about the welfare of Kenyans and the nation to hold them hostage. Kibaki should immediately dissolve cabinet and appoint new ministers in consultation with Raila. Both teams must start a fresh with none having advantage over the other in the appointments.

It is with deep regret and sorrow that we announce the sad and untimely death of Mr. Daniel Ouma on March 19, 2008 in Michigan.

Daniel was born in Kenya in Suba District and spent almost his entire life in Kenya (Suba District) before he went to India for further studies and eventually to U.S.A.

At this trying moment, we are humbly inviting friends and relatives to join us in prayer and financial support so that we can give Dan a warm send off to his last resting place in Wakula, Mfangano Island, Suba District, Kenya.
