Why I will Support Hon Uhuru to increase govt domestic borrowings

Tomorrow All Kenyans wait with crossed fingers if Hon Uhuru will increase VAT tax,etc
I will be keenly watching oh how we will raise money around 109 Billions to fund govt needs I will want him to ask Ksh 100 Billions from local markets but tie this amount on key developments programes and NOT salaries allowances.

Let Uhuru borrow Ksh 100 Billions to support Kazi-Kwa Vijana Initiatives Buy of lands to settle IDPs,Buy machineries to help coconut farming, buy machinery to start small scale hydro power thinsg that are tangible and can raise more resources which he can tax too through indirect taxes like VAT

Inflation and interest rates will go up but we should also not reject to support Hon Uhuru to borrow heavily to support development programe I hope we wont allow some treasury mandarins to steal such funds

THE Kisumu Mayor Sam Okello, a man who was only fished from the coastal town of Mombasa by the Prime Minister Raila Odinga who nominated him as a Councilor and immediately imposed him on the elected civic leaders to become their Mayo9r after his own businesses were alleged to have already gone burst if facing serious rebellion.

He is likely to go down in history as a one term Mayor. His previous election was controversial as the elected civic leaders vehemently opposed the idea of imposing an outside to be the Mayor of the lake side town. Okello is a non=resident. But his mentor Raila Odinga had an up-hill task of persuading the City father to accept Okelloi. Raila convened an impromptu meeting of all the elected civic leaders at the Rock Motel, which is located twenty kilometers north=west of Kisumu on the main Maseno-Busia road.

Raila coerced the Counmcillor to elect Okello telling them that he [Okello] as an experienced and successful business tycoon in Mombasa would use his wealth of experience to attract more investment for the town. And the Councilors reluctantly gave in and picked Okello as their Mayor, though the majority of them had maintained reservation..

The Kisumu City fathers are seriously divided into three camps. Okello still enjoys the backing and support of only seven Councillors led by Raila Odinga step brother Omondi Odinga and one heckler called Onunga of Nyalenda.Ward Odinga represents Milimani Ward.

Coun Omondi Odinga had good reason to support the Mayor. He was recently awarded lucrative Council tenders to repair and renovate Central add Arya Primary Schools within the Municipality, while his sister Anyango Odinga scooped another tender of repairing Jamhuri and Taifa Parks. The tenders are worth millions of shillings.

Those on the firing line, who are expected to give Mayor Okello a run for his money include the populist Coun Pamela Jossy, the immediate former Mayor Coun. Priska Auma and the controversial Kolwa East Ward Coun . Robert Oruko Otuge a firebrand who has given sleepless nights to the Kisumu Town East MP Shakeel Ahmed Shabbir.

It was revealed during politically charged meeting at the ODM kisumu branch off the Kakamega road, that the Mayor has been dishing out lucrative tenders exclusively to his loyal supporters.The same is with devolving funds disbursed by the government for development activities within the Municipality. The town is entitled to both LATFD and Cdf funding formits socio-economic projects.

But a damning report compiled by the National Taxpayers Association, an independent, non-partisan organization which had carried the forensic auditing of all government aided projects in the Town has inflicted a big damage on the Mayor. And if the NTA auditing report is anything to go by,Okello re-election could be a foregone issue.

..The detailed audit report by NTA has revealed that the City had received the sums of Kshs 15,m778,350 for the 2007=2007 financial year from LATF and unspecified amount from the CDF committees from both Kisumu Town East and Kisumu Town West. Both the two constituencies are part and parcel of the Kisumu municipality therefore the Council is entitled for allocation of the devolving funds from the government meant for projects in the two parliamentary constituencies.’

Out of the colossal amount of money received by the Council under Sam Okello’s Mayor ship, it budgeted for Kshs 11,722,875 for the financial year 2007-2007. And out of the amount received Kshs 4,045,175 mysteriously disappeared and remained unaccounted for.

The Council had the largest number of abandoned , unfinished. and ghost projects, which had already consumed and exhausted the budgeted amount, but for which the work never took off from the ground for some unexplained reasons..

Some of the semi fished projects were classified as “A” class. These are projects in which the amount of construction work put up so far is almost over 90 per cent and above. Most of the projects were classified by the team of auditor as being of class ‘B’ and class’s’. B class are these projects where the work done is medium averaging between 60 and 80per cent, followed by C class in which the construction work done is between 40 and 50 per cent. There are also several projects which were classified as Class’ “C” with the work done is below 40 per cent and those of class D which had consumed the budgeted amount but only between 10 and 3o per cent of total work done.

A good number of projects within Kisumu Municipality were categorized and classified as “Missing” and yet a lot of taxpayers money has been squandered on them..

The project status are listed as follows; ‘complete, incomplete/stalled, incomplete and does not exist.

Among those listed by auditors as ghost or missing include Oriang’/Kianja Primary School in Central Kajulu Location in Kisumu Town East Constituency. Kshs 736,649,00 allocated to this project is now considered lost. Unac counted for sums is Kshs 736,349 and only Kshs 300/- as put to proper use. The rest are his.

Another missing project is Migosi Health Centre in Kondele suburb. Was allocated Kshs 800,000,00.Theproject failed to take off and the money remained unaccounted for to date.

The Rotary Club, which is located right in the town was given Kshs 200,000.00 and this money too remained unaccounted for because the project did not take off the ground..

A School by the name St. Mary’s had tow projects budgeted for. One was an E,C.D project for which the sums of Kshs n600,000.00 was set aside and given. Nothing is on the ground to justify that the work is done, and the auditor have reported that this money remained unaccounted or. The second project at the same school was worth Kshs 500,000,00.This money has also gone to waste and could not be accounted for. The two projects are within the North Ward in Kisumu Town West constituency, which is represented by Hon John Olago Aluoch.But the Mp was not immediately available for comment.

The second project at the same St.MARY’S school consumed another allocation of Kshs 500,000,00 Jamhuri Park in Milimani Ward also consumed Kshs 580,000,00 but the amount of work don is sonly 18 per cent, other projects considered as having been abandoned unfinished include Manyatta Market Sheds which consumed Kshs 500,00, but only Kshs 348,200 was properly utilized leaving Kshs.150,000.00 unaccounted for.

.Other project which were classified as abandoned half way include Simba Katuoro Road Kshs 800,000.The auditor had marked those project left unfinished and those with shoddy work and por workmanship as being of class “C” and most of Kisumu Town’s projects fall under this category. All were carried out during Sam Okello’s mayor ship. Most project constructed under the former Mayor Coun. Priska Auma had been classified “A’ and “B” meaning that these projects were almost 90 to 95 per cent work done.

Sam Okello Mayor ship has also been shrouded with numerous allegation of land grabbing and illegal selling of Council’s houses and land plots to private individuals.

Until he was made the Mayor, Sam Okello was a perennial Parliamentary election loser in Muhoroni constituency. which he had unsuccessfully contested three times on a KANU party ticket and only joint.

It is not clear whether Prime Minister Raila Odinga would for the second time come to Mayor Okello’s rescue, but as the situation stands, and the hostility being displayed by the Kisumu residents against the Mayor his chances of clinching the seat for the second time are said to be very remote and slim.

Iam glad with discussion for the youth forum,well we have all the power to form youth struggle and human rights and fighting corruption in our beloved country, and the question is how far can we go with this?remember aleader is born not elected.another challenge is,our aged politicians are scared of youths,in that once we get that power,we can spoil there assorted soups on the table.another thing is we have seen some youth leaders being eliminated (assasinated) for the truth they stand for.upto date no one (GOK)has ever come up with truth on there killings.

Hi People,
I completely agree with you guys on having a party of our own. In fact in many of the meetings that i have attended in the minor youth groups around, they all echo the same sentiments. from having a party to identifying potential leaders to fill all leadership positions.I am for it 100%, my concern is this, as its said,’The branch doesn’t fall far from the tree’, lets please ensure that the leaders we elect will not follow in their predecessors steps. Their character should be tested first, Abraham Lincon ably stated, ‘Nearly all men can stand adversity, but if you want to test a man’s character, give him power.’ Well let me not get ahead of myself, we’ll cross that bridge when we get there, just food for thought. On the other matter of having TV and Radio shows, that should be taken up, the youth in these media houses should do something about it asap.It will do us a lot of good.

This is getting us somewhere. I am pleased and charged by the ideas and from you all.

On TV/ Radio for the group: This is a very good idea that can easily reach and charge the others who might not be subscribing to this group. The challenge now is to the fellows at the media and particularly the FM stations. While i would appreciate the vigor put in by some like Caroline, most of the others need to up the fight. If we could have people with acquaintances to them (through whom we could reach them), i would suggest we sign a kind of petition to have them included in the group or have a way of raising our plight through the media.

The lower chamber: While we could be waiting for constitution ammendment to include this, i think it makes no harm to have a forum in which we could engage the authorities by inviting them (MPS, PSs, Ministers, etc) on a face to face discussion with the youths. This could be possible by having them scheduled weekly or even twice a month through a committe or even through the conveners of NYC. (e.g. L. Otieno live: a citizen tv prog). Here we only need sponser who could then facilitate have it on air through the major media media.

Party: The main problem with the youth are the financial middle class. These people are mostly not willing to be involved in any agenda and are busy perfecting their own. Particularly because they believe that the political class is controlling and are therefore tired of it. By holding these already condemned parties we will not be making any good with it. The only solution is having a new party that is seen as a fresh mind to the whole idea of politics. It is no problem getting the so called “big” people latter when the youth are convinced that its a new crop. Mageria, while heavy weights make heavy weight parties, in this kind of revolutionary move we are taking, heavy weight parties can make heavy weight people. e.g madagascars heavy weight population made a heavy weight.

I fully support Bonnie in what he did. While i might be a coward he isn’t!

1 while we await the funds to start our own station how about engaging current national and community stations to carry these topics for youth to participate in. Can we identify our own experts in the fields of concern to lead the discussions on already existing stations. They are always looking for fresh and captivating content and this will be providing it for them. Caroline, Fareed, Marcus, Maina, Munene, Ciku, DNG, etc you are all youth. Kindly make this happen.

2 the idea of a 2nd chamber is great but requires a constitutional amendment I guess (lawyers please shed light). This would bridge the morality gap our leaders openly exhibit. Wish we could do it like yesterday.

3 as for a youth party, I think what we need to do is infiltrate existing parties and take over from within. We should seek to be relevant and influential in the current parties. It’s cheaper and we benefit from the infrastructure. If we are focused and persistent in spreading this word thru NYC it is easier to be at the helm sooner rather than later. A new party will require already established names and their funding in order to have the impact we would require. Look at Tip Tip Party for instance. Heavy weights make a heavy weight parties.

Time for action.

Dear All,

I want to contribute to this debate of responsible leadership and good governance which I find very interesting and empowering as well.

First, What Bonnie did was excellent and shows how our political awareness has advanced in the recent past.

I want to say that there are many ways of killing a cat and what Bonnie did was just one of the many. Kudos to him because from exprerience of myself living in the the western world this is a very powerful tool for the oppressed and the powerless to express their disgust to those leaders who have cut themselves off from the common citizens. More Bonnies in future will definitely make a big difference.

Our cat being as big as it is from years governance without accountability and complete disregard of personal responsibility among our leaders we definitely need many more ways to deal with the democratic etiquette breakdown in our country particularly through a youth-led political revolution.

1) My first suggestion is to increase our recruitment drive through the media -even if starting our own radio/TV station dedicated to discussing promoting youth issues about youth, development and the future of Kenya. This radio station can feature role models from across all the the development sector, the civil society, the youth in the diaspora and world leaders alike giving views about how to develop youth talents in all their spheres of life ie politics,business, music,drama and in their other careers and proffessions.

Important national issues can be scheduled on prime hours of the day like evenings for contributions from youth and general public . Such topics could include the constitution, succession battles, scandals in government and public sector with view to encouraging youth to engage wholly in matters of national importance.

2) My second suggestion relates to the current constitutional review; Since the issue of tribalism is as old as when western democracy was being introduced in our country and probably older than that (I am not an historian!) and also because our MPs can nver be trusted where it comes passing laws regarding their own payment as well as their high rate of absence from parliament proceedings I would like the Youth to press for the second chamber of parliament in Kenya.

The chamber would have regionally nominated personalities representative of local communities.

Such people will be people who have wide experience in particular areas eg- religious leaders, traditional value and history experts, retired senior government officialsreknown businessmen people who have excelled in other fields such as sports or even former Presidents and Prime Ministers. Most importantly the chamber to have representatives from various nterest groups such as the Youth, Workers Unions, the Civil society, the Kenyan Diaspora Community and probably the head of certain missions working in areas that would be affected by the individual policies to be tabled. And of course the relevant Minister /Permanent Secretary can be called to attend particular sittings.

To cut the costs for the taxpayers down we can have such posts voluntary and members can only get travel and sitting allowances if nominated .

This Second Chamber (headed by the head of state ) will not have more powers than 1st chamber but the president will have a duty to decide if to pass a bill into law if the second chamber has reservations. In other words the second chamber will have the responsibility of admistering checks and balances to the activities of the 1st chamber ( elected MPs) headed by the Prime Minsiter to make sure that MPs there are not driven by greed and other influences when passing important policies.

Since I have not gone through the current draft I apologise if this is something that has already been proposed in the draft.

But the key thing is the Youth will do Kenya alot of pride if they can sort the issue of tribalism and press for checks and balances to our greedy MPs once and for all through the creation of the second chamber of parliament.

3) My third suggestion is for the Youth to form and register our own political party.

eg The Youth Party of Kenya or whatever name you want to give it – This party will ensure that come the next general elections we shall have a voice of our own, agenda of our own, candidates of our own and even our own President of choice who the National Youth conferederation will choose to back or field.

From experience it is very hard to make a major difference if you work from the peripheri and to have our representatives in the parliament we shall be assured of our views being driven through to the highest policy making organ in the country.

Please note that my reference to Youth does not mean people who are in experienced untested, and poltically challenged but leaders with youthful ideas and who conform to the current changes in political arena across the globe.

With these few i look forward to your responses and meeting you soon when I visit Kenya in August.

What Bonnie did should really scare the political leadership-a middle class
award-winning guy announced on radio he was going to heckle the president in
a national stadium, left the studio to the stadium, sat with the crowd, knew
he would most probably be alone, but still stood up and shouted ‘Unga’! Did
he know he would get in trouble, be ridiculed, maybe worse? Of course did.
But he wanted to pass a personal message to his leaders, and he did. Did he
do it the ‘right’ way? Who are we to judge-we haven’t done anything
ourselves.

What did Bonnie achieve? The media took up his story and now a lot of people
know another way to be heard, he started a discussion that we are all
engaged in, political cartoonists have featured what happened, the president
actually referred to it, and got himself in trouble with religious leaders
coz of how he did it, the political class are realizing the tide is rising
and they will be even more nervous the next time they are before a crowd,
etc (reminds me of the guy who threw a shoe at Bush)

As we go about talking about how we will do the big things that require
10,000 or 100,000 people, to make change happen, some men and women are
doing small things that are keeping the process of change happening. You do
not have to agree with what they are doing, you do not have to want or be
able to do it, but do not shoot it down unless you have done or are doing,
not saying, something yourself.

On this particular process that Kenya has embarked on, history will judge us
by what we did or didnt do, not by what we said we would do.

Folks,

Ogego should do a honourable thing, behave like a gentleman, step down and leave Embassy Office of Diplomatic representation in Washington. Whoever is backing him up to fight President Obama are fooling themselves and they should know that Ogego cannot match President Obama by all standards. He cannot force President Obama’s administration to work with him by force if he does not qualify or is disqualified for any reason. He does not understand how protocol works here. His head-swell and doing things in a primitive stupid way will not get him anywhere. He is exposing naivity and stupidity to try to out-do President Obama. What he is doing is a mockery of the highest order. He should advice his employer, that his services are not needed here in the USA.

This should also warn the Coalition Government of Kenya to check their acts……….

Mr. Ogego, should better stop playing cheap Kenyans politics here…….By confrontation and ganging up to embarrass or fight President Obama will not take them anywhere. If they are harbouring a fight (because of guilt concious) with President Obama they should say so in the open. This round about roller coster is headed to no where. Dont play us dummy……….we know all the reasons why they want to nominate a Diaspora representative here in the USA to challenge or be an opponent who will readily serve their backward interests.

Let them get it straight into their derailed heads, whether they kithni or speak in tounges, President Obama is the President of the United States of America………..

Government Of Kenya has spent a total of Ksh 23.2 billion over the last three years on motor vehicle related expenses, even though on June 15th 2006, Amos Kimunya, Minister for Finance said that “Ministers, Assistant Ministers and Permanent Secretaries will be allowed only one official car each to ensure equity. I have factored the savings arising from this measure with a view to providing transport allowances to all civil servants. Therefore from 1st July
no public officials will be expected to use official vehicles to and from
duty.”

This was followed by Office of the President circular Ref: OP.CA3.23/1A of June 30th 2006 which adopted an official transportation policy “to address weaknesses observed in the existing transport policy which was characterised by mismanagement, high maintenance costs and inefficiency, lack of parity in allocation of transport facilities, proliferation of vehicle models and idle capacity due to the imbalance of number of vehicles and drivers, lack of
capacity to enforce regulations on the4 use of government vehicles and e3scalating costs of providing government transport which stood in excess of Ksh 4 billion per annum, without corresponding improvement in service delivery.”

The Financial Secretary’s statement was in response to headline media coverage which had stated that public vehicles of luxury model were on sale secretly at throw away prices. At the time the Financial Secretary stated that Treasury’s records indicated that 488 vehicles had been sold by December 2008 through open tender, and the sale had realised a total of Ksh 194,061,335 which had already been paid into the Exchequer.

Another 811 vehicles had been advertised for sale and as of November 25th 2008 were awaiting tender committee awards. A further 789 GOK vehicles were under process to be sold by advertisement in early January 2009.

In total therefore, the Government had retrieved 2,088 vehicles from public departments for sale under this scheme.

It is now slightly more than a year after I made big move from the
country to the great city under the sun, Nairobi. It has been the
greatest year in my life in so far as learning new things is
corncerned. And this is why I have decided to write to my fellow
villagers in the city and share some experiences as well as explore
the various ways in which we can make money. In all, I wish to discuss four things.

The first is language. Fellow villagers, please note that there are
very many people in Nairobi who do not and will not understand that it
is not my fault that my ancestors decided to do away with the letter
‘L’ (though I do concur with them that there is no need to have two
letters that sound almost the same). The Nairobians also do not seem
to support the idea by my friend Omondi’s relatives that there was,
and still is, no point in calling fish, fish when you could just as
effectively communicate by shortening the name to ‘fis’. For this
reason, fellow villagers, let us learn to write (sms) more and talk
less. The saving both in money and embarrassments are bound to be
great if we do.

My second point is to do with vehicles, or in simple Nairobi language,
cars. I have learnt that anything on four and more wheels is either a
car or a mat (matatu) in this city. I have also learnt that people in
Nairobi will travel across town and pay good money to see cars (the
type of which we have been paying to travel in) paraded in what is
called the ’concours de elegance’. I now believe that a few of us,
fellow villagers, stand to make very good money in domestic tourism by organising for trips to Gatundu etal to see the old model Chevloret
pick-ups and Bedford trucks. We could also use these same vehicles to transport the urbanites there and charge a premium for this classic
travel.

Not surprisingly (to most from the village), my third point is to do
with food. I (and hopefully most of us) had, mainly through the mass
and popular media, heard of Pizza (pronounced as pitsa and not Bithaa) and Capuchinos(most probably misspelled). These had however remained foreign to (all of) us. But in my year in Nairobi, I have not only had the great honour to sample these foods but have also learnt that it is possible to pay a person who has most probably never tasted a food, to stand on a busy road advertising this same food. I am also still to find a joint that sells tea in a glass and king sized chapatis for ten bob each as they do back home. It would therefore be a great economic venture if any one of us villagers would set up such a joint.

The last thing that I wish to discuss for now is medicine. This is one
area where am proud to note that we villagers are way ahead of our
urbanite brethren. For one, we learnt quite early on that herbs like
Muarobaine (Fortious medicines) and Kieruma (Aloe Vera) can cure any disease (including suspected diseases). The Nairobite is only now catching on to this, interestingly the awakening is starting from the buses (particularly those destined to Kawangware, Rongai and
Kitengela). The ‘doctors’ in this buses however seem to have gone one better that the villagers and have discovered that provided you
package the same ‘thing’ in different packages, you can sell ‘it’ as a
painkiller, toothpaste, ‘dawa ya kuongeza nguvu (za kiume, kike na
hata kitoto), dewormer and even as a beverage. At this rate, the posh
hospitals (where they take your height and age, test your blood
pressure, sugar lever, heart rate e.t.c. regardless of whether you
went there as a patient, was escorting one or had just come to pick
your girlfriend) may either have to close down or start stocking these
super drugs.

With that my village mates, ret me finis and hask that you put your
khoments hapa chini.

Other participants will be the major investors from Western European countries, business leaders and policy as well as decision makers who will sit together to discuss regional integration in preparation of the planned Common Market for the region.

In this important seminar slated for June 15 and 16,the participants will also discuss the issues related to the build up of the East African Common Market.

Organized jointly by the East African Legislative Assembly, and the East African Business Council and the European Parliamentarians for Africa [AWEPA}, the seminar will scrutinize and examine the related themes of agriculture and the impact of climate change..

Regional seminars involving the private sector and focusing on sensitizing parliamentarians on the need to stimulate an environment conducive to business and investment were last held by EALA and AWEPA in Arusha in 2996 and in the Kenyan capital, Nairobi in 2007.

As East African moves towards the establishment of a common market, delegates to the next week’s Dar Es Salaam meeting will also be able to draw on the experience of Fernando Matos Rosa,the Secretary General of the Brussels based European Business Council for Africa and Mediterranean[EBCAM}. This organization represents the interests of over 4,000 mainly private sector companies, across the European Union[EU},all of which are involved in Africa.

· The meeting in Dar Es Salaam will also be addressed by Omar Issa, Chief Executive of the Investment Climate Facility for Africa [ICF}, a mufti-million dollar initiative with private sector support.ICF was established on the recommendation of the Tony Blaire led Commission for Africa in 2005..

A key strategic theme for the ICF, which includes simplifying administration in order to facilitate cross-border trade, This area remains continuing concern for business in the East African region.

“here are major problems ,Intra-community trade is not working as it should. The free movement of goods . across borders often thwarted .Privatization of the railways system has not progressed, with the result that landlocked countries like Rwanda has to pay far more than it should for the cost of its imports,” said one leading businessman in Nairobi..

The Kenyan businessman cited availability and cost of power as major constraint, caused partly by declining levels of water..This latter situation is believed by many as being liked to the onset of climate change to the region, including erratic rainfall patterns which are already causing hardship for farming communities and problems for agriculture in general.

Africa’s common position on climate change, adopted by Africa’s environment Ministers in Nairobi on

May 29, will be set out at the seminar, along with the need mainstream climate change adaptation measures into national and regional development plans, policies and strategies.

“The Western world bears the largest responsibility for the causes of climate change,” says AWEPA

Secretary General Par Granastedt, and Africa suffer the worst consequences.”

At the end of the seminar,, Parliamentarians, will emerge better informed on key subjects such as harmonizing legislation and proposals in support of the new East African Common Market.

WHEN members of the East African Legislative Assembly {EALA } held their regular session last week in the Burundia capita, Bujumbura, they were confronted with a very special and unique problem, which requires their urgent attention..

A team consisting of the Burundi Albino Association led by their President Kazungu Kassim and lobby groups who petitioned the legislators requesting them to prevail upon the governments of the partner states in the East African Community to protect the Albino community from reckless and senseless killings of their members..

The group pleaded with EALA members to put pressures on EAC member countries food every thing within their powers to stop the uncalled mass slaughter of albino in the region. Member states of the EAC are Kenya, Tanzania, Uganda, Rwanda and Burundi. The EALA is the legislative body governing the EAC. It has the elected members from all the five countries.

The Burundi albinos group is working closely with the lobby groups and civil societies in all the five countries to stem rising killings of albinos in the region.

In Tanzania alone close to 42 albinos have died in the past one year in mysterious circumstances, which local people do associate with witchcraft.

The group told EALA members of harrowing tales of the challenges they face as “Albinos citizens” in East Africa.”The spate of albino killings witnessed recently in Burundi, Tanzania, and Kenya was increasingly becoming a major concern of the civilized society in the region. “they said.

A Kenyan EALA member who took part in the encounter told this writer how he was shocked on hearing the version of stories narrated by the Albinos ,The Kenyan legislator, however preferred to remain anonymous. saying he was touched by the stories until he had to shed tears.

The trend, the lobby group said, reflected poorly on the individual governments and impacted negatively to the region’s human rights record.

There is a need for the EAC to consult more with civil society defending the rights of EAC citizens and the rights of the disabled in particular, in order to examine the situation and develop more option for deeper cooperation at the regional levels, “said Mr.Kassim

The killing of albinos in East Africa raised great concern last year. Alleged trades in albinos body parts, believed by some people to have magical power as well as conferring longitivity on the lives of those who use them as talismans or as potions, has been going on for years, But only come into the international limelight in 2007 when the underground industry, which is centered around Tanzania fishermen and traditional healers – left dozens of adult and many children hacked to death.

Slain albinos are typically having their dead bodies being dismembered, wit their heads, limbs and genitals dried or roasted and grinded into powders or hacked into pieces that are sold to clients as protective charms.So the albinos virtually became endangered species like the Rhino and its horns used to be until the animals were almost whipped out of the universe.

.in Tanzania, for instance, over 45 people have died in the past year and in. In Burundi, it is reported that over nine{9} people have died in the five months up to March this year..

Both the UN Secretary General Ban Ki=moon and the American Secretary of State Madame Hillary Clinton have condemned the attacks and termed them as barbaric and primitive.

Last week, news agencies reported that the Burundi Albino Association heaped a lot of praise on Tanzanian President Jakaya Kikwete’s efforts in trying to contain the killing and for encouraging other EAC partner states to follow suit.

However, the Albino’s organization said that, though considerable progress had been made in the human rights issues in the EAC region, the current killing and the hostility portrayed towards the albino community, showing that the region is still a long way from achieving full respect for human rights.

At the end of the encounter, EALA members donated USD 700 to the albinos association.

Kenyans,

The ability to lead people in difficult situation now like in kenya
today is a matter of using the authoritative power of the leaders in
charge. If these leaders can wield their authority during a crisis like
now by effectively focusing the combined power of their group, then they are able to attack problems like a fierce tiger with wings, flying over the four seas, going into action confidently whenever there is an
opportunity. If leaders loses their authority and cannot focus the power of their group like in Kenya today, they are like dragons cast into a lake, they may seek the freedom of the high seas, but they are trapped and cannot get loose. Most of the time a leader will not be able to please everyone I hope Kibaki and Raila knows that or do they?. since this is true, if a leader have a choice, it is probably better those who are competent and displease those who are not just to make Kenya move forward.

We as Kenyans we have disappointed President Obama very much: This includes, Kibaki, Raila, Mps, Ministers you and me, infact all carrying the Kenyan name etc. Here we see Obama a man who worked very hard to achieve what he has got today. I remember Obama`s campain time: He Obama placed his father on the forefront during his fight for the top job, the man was not and has not in any minute been a shamed of his fathers country or his fathers background, Kenya. Obama visited even the kenyan slums. He placed his Kenyan roots first in all his fighting for the top job. BUT what have Kenyans done?. We have just let the man down completely just by simple humanbeing stupidity, greed, and ignorance. Kenya would have been the first country to tap the development opportunity between USA and Africa. But instead what do Kenyans now get?. Even the simple Delta airlines which was supposed to fly to Nairobi now is not going to travel to Nairobi may be until after 2012, you might be suprised that the airline will be visiting Ghana very soon. It is ashame that even the USA ambassonder in Nairobi have seen that it is a waste of time talking to Mps and instead is directly now talking to the youths. Will the youths also do what the Mps have done or show same intelligence?. What our Mps does not know is that when a top USA ambassoder is talking to youths, he is not doing it from his own head but those are direct notes from the white house.

The Kenyan present governmnet is a let down and it is already
registering a lower economy than what Somalian pirates and thugs are generating in Somalia today. Infact this government is just a waste of tax payers money and it is just like a degrading sewage to the black race again. This governmnet is taking blacks to the dark days when the British used to say these words:` Blacks do not have the brain to rule themselves`, When we British came to Kenya they were still sleeping with goats in the same house; no clòthes etc`We the British are the ones who gave them clothes and told them how to read and write their names etc kind of staff“. I hear that Kenya economy is not far much better than Mugabe`s so guys where is the coalition government that most of the Kenyan elites wanted to be give a chance has taken Kenyans to?. To Kenyans living in USA, it is time to stand up and bring the kenyan glory back, do not sleep it is not the right time to go to bed yet. The USA president is very proud of his fathers roots and is just looking for a better Kenyan who can bring that glory back, a kenyan who have peoples heart and is for the common man. That is the point Kibaki and Raila have completely missed. Any intelligent humanbeing, who had time to listen to Obama`s speech to the muslims must have grabbed the idea and the main point. On Genocide: Enough Of Enough!

The organization Enough! claims its mission is to “end genocide and crimes against humanity” and yet in one of the most perverted foreign policy initiatives ever it’s calling for the U.S. to invade Central Africa in pursuit of Joseph Kony, leader of the vicious Lord’s Resistance Army.
At the same time, Enough! would have the U.S. military align itself with the army of Uganda’s President Yoweri Museveni, who is possibly an unindicted war criminal who is actually being investigated by the International Criminal Court (ICC) at the Hague for alleged war crimes committed in the DR Congo; the revelation was in a 2006 front-page report in The Wall Street Journal.

The alleged crimes committed by Uganda’s army and Uganda-financed militias in Congo, when Uganda occupied eastern Congo between 1997-2003 included massacres, mass rapes, looting of Congolese natural and mineral resources, destruction of Congolese homes, and ethnic cleansing.

The International Court of Justice (ICJ) subsequently ruled in favor of the Congo government on the civil complaint in 2005 and awarded $10 billion in compensation, not a dime of which has been paid.

According to The Wall Street Journal’s 2006 news report, the ICC took up the criminal investigation after the Congo government referred the complaint to the Hague.

Presumably, the ICC might be guided by the evidence that the ICJ found compelling. Why then would Enough! and other organizations, unless they have hidden agenda and want President Barack Obama’s Administration to be aligned with a potential unindicted war criminal?

Museveni himself fears the investigation and takes it seriously, and so should Enough! The Wall Street Journal reported: “President Museveni of Uganda asked U.N. Secretary-General Kofi Annan to block the Congo investigation, according to one person familiar with the matter. Mr. Annan replied that he had no power to interfere with the court, this person said.”

Moreover, two of the leaders of the murderous Congo militias financed by Museveni, Jean Pierre-Bemba, and Germain Katanga, have been indicted and arrested and are already at the Hague.

So is Enough! really serious about peace in Central Africa? Is it on a mission to discourage the ICC’s probe by trying to steer a policy that would bind the U.S. into an alliance with Museveni? Certainly the ICC takes signals from the U.S. Administration.

Enough! has issued many statements decrying genocidal acts in Sudan’s Darfur region and for long demanded action against Sudan’s President Omar Hassan al-Bashir.

Enough!’s silence with respect to atrocities directed or commissioned by Museveni and his sometimes allies, Rwanda’s President Paul Kagame and the terrorist he sponsored in DR Congo, Laurent Nkunda, is deafening.

That Kagame and Nkunda are responsible for genocide in Ituri and eastern Congo has been well established by Human Rights Watch and is known to Enough! Even the New York Times, which for long had treated Kagame and Nkunda with kid gloves, conceded in an article headlined “Rwanda Stirs Deadly Brew of Troubles in Congo” on December 4, 2008, that the Rwanda president was financing Nkunda’s massacres and even supplying the men and arms.

Where are the press releases from Enough! calling for the ICC action against Kagame and Nkunda?

Enough! issues press releases deploring massacres and mass rapes in DR Congo without clearly stating who the responsible agents of these crimes are—as if they occur in a vacuum.

Enough! correctly attacks ongoing atrocities in the Darfur region and those committed by Joseph Kony’s Lord’s Resistance Army (LRA) but demonstrates selective outrage elsewhere. Is this done by design? Is this clever duplicity? After all the information about the other crimes are out there.

How can an organization that purports to fight genocide and war crimes pick and choose? Is this not an unfair and even immoral demand to impose upon the victims of such crimes? One is either outraged by all mass crimes; or one is simply engaged in duplicitous “outrage”.

Enough!’s double standards are most glaring with respect to Uganda.

Uganda invaded Congo when it was still known as Zaire, in 1996. The invasion was popular; it rid the country of dictator and kleptocrat Mobuttu Sese Seko.

In 1997 Uganda again invaded Congo. This time, the mission was occupation and illegal enrichment through pillaging of the country’s resources, as detailed in Human Rights Watch’s “Ituri” report.

So why is Enough! not demanding that the ICC also indict Museveni for the war crimes in DR Congo? Instead, Enough! wants more warfare in Central Africa.

Last December, while George W. Bush was still in office, Uganda’s army launched a U.S.-coordinated and financed attack against the LRA called “Operation Thunder”. It was Bush’s gift to Museveni for sending troops to prop up the weak Somali government installed by Ethiopia at the behest of Washington.

The attack backfired –Kony was not captured and only increased his mystic by eluding U.S.-backed Ugandan forces. Kony’s forces then reportedly resorted to a vicious campaign of killings against Congolese civilians.

Ironically, there had been no combat, killings and destruction for more than two years, as Uganda’s government had negotiated peace with the LRA, from 2006 to the end of 2008.

Impatient with Kony’s reluctance to sign a final peace treaty, Uganda’s Museveni resorted to what both he and Bush seemed to favor in resolving conflicts: militarism.

The Obama Administration should not be lured by organizations such as Enough! into this trap; the victims are civilians—women and children primarily.

If President Obama is willing to dialogue with Korea’s Kim Jong-Il; Iran’s Mahmoud Ahmedinajed; Cuba’s Raul and Fidel Castro; and even with reasonable elements of the Taliban in Afghanistan, why promote more bloodshed in Central Africa without exploring other options.

Obama is no Bush; that’s why he beat a Republican candidate.

Enough! own vision for Central Africa is very clear; in a most chilling manner. It has posted a paper, “Finishing The Fight Against The LRA” on its website www.enoughproject.org
Here’s what Enough! boldly declares:

“Operation Lightning Thunder did not end the threat of the Lord’s Resistance Army, or LRA, and it sparked harsh reprisals by the LRA against civilians in Congo. Yet, it would be an even greater tragedy for civilians if key states in the region and the international community lost their collective will to end the threat of the LRA once and for all. What is needed now is a second Ugandan-led operation against the LRA. This new operation must place civilian protection front and center.

In addition, it will require stronger and more effective support from the United States and the international community, and the full commitment from the Congolese government and army to complete the job in a reasonable timeframe and operate in all LRA-affected areas of northeastern Congo. If the United States takes the lead in supporting a new Ugandan military operation, as Enough believes it should, it must provide solid planning, intelligence, coordination, and logistical support—and take greater responsibility for the executing and outcomes of the operation.”

What manner of cold-blooded madness is this? What kind of organization that purports to fight genocide would call for more bloodshed in order to “stop” bloodshed?

Of course it’s easier to advocate warfare when it’s done on someone else’s backyard with the victims being someone else’s African daughters and sons.

Enough! is also excited about the recent Bill introduced by Senators Russ Feingold of Wisconsin and Sam Brownback of Kansas, hoping it will lead to more U.S.-sponsored war in Central Africa. The Bill, borrowing language from Enough! is called the “Lord’s Resistance Army Disarmament and Northern Uganda Recovery Act of 2009.”

The Bill contains good elements when it calls for multi-million dollar financing of recovery in Uganda’s devastated Acholi region. Even then, U.S. representatives would have to be involved in the monitoring. Corruption in Museveni’s government is so rampant that even money sent to combat HIV/Aids was embezzled according to Uganda news reports.

The Bill’s problematic part –actually favored and promoted by Enough!– is section (3), or “statement of policy” and in part reads that, it’s U.S. policy, in furthering the goal to end the conflict in northern and eastern Uganda and other affected areas by “eliminating the threat posed by the Lord’s Resistance Army to civilians and regional stability through political, economic, military, and intelligence support for a comprehensive multilateral effort to protect civilians in affected areas, to apprehend or otherwise remove Joseph Kony and his top commanders from the battlefield, and to disarm and demobilize Lord’s Resistance Army fighters…”

The U.S. must not align itself with Uganda’s military establishment in escalating conflict in Uganda and Central Africa. That’s precisely what Museveni wants; that’s a strategy he’s pursued for 23 years, with only deadly and destructive consequences.

It’s also allowed him the excuse to extinguish political opposition to his regime.

Moreover, while it was fine for Bush to become mired in “Operation Thunder,” President Obama, a Constitutional Law professor, may want to maintain a firewall with a potentially unindicted war criminal, with respect to the Congo atrocities; even while working on other matters with the Ugandan government.

The Feingold-Brownback Bill also contains a section about accountability; not surprisingly Enough! as well as the Ugandan government have not been highlighting this.
The Bill supports “a body to investigate the history of the conflict, inquire into human rights violations committed during the conflict by all sides, promote truth-telling in communities, and encourage the preservation of the memory of events and victims of the conflict through memorials, archives, commemorations, and other forms of preservation….”

Thorough investigation into the history of the conflict between Museveni’s army and the LRA, would result in Museveni possibly sharing a jail cell with Kony in the Hague.

Ironically, if the Feingold-Brownback Bill could lead to removal of both Museveni and Kony from Uganda’s political stage, peace would be restored in Central Africa almost overnight.

In the edition of the Nation yesterday, their editorial talked about the issue of ‘Mijinjo’ Island. They said and I quote; ‘Museveni correctly think it is a shame to wrangle over a small territorial dispute when we should be fighting for the creation of an East African Federation.’

Check who is talking. Who is it that has invaded another country? If Museveni correctly believe that it is a shame to wrangle over small territorial disputes, why then has he invaded Migingo Islands?

Did the person who authored this editorial at the Nation put his mind to proper use before coming up with such an absurdity? Can the Nation quote Museveni on this issue and add the term ‘correctly’?

Anyway, I do not want to doubt the intentions that inspired the Nation to come up with such an editorial.

It brought me to ask myself a few questions. What are the roles of the police and the Army? When they graduate from their respective training colleges, the police swear to uphold and enforce the rule of law in the country. To this extent, when they are on patrol and they come across crime, they do not wait for any orders from anybody else. They act on the spot and the law takes its course.

Similarly, when the members of the Armed Forces graduate from their training colleges, they swear to protect the territorial integrity of Kenya from any external aggression. This is their cardinal responsibility. This is why we feed them that lavishly at the barracks. What I would have expected from our armed forces was a report that they had beaten the hell out of these Ugandans and then they wait for orders from their Commander-in-Chief.

I did not expect that members of our armed forces will plead luck of orders when Kenya is invaded, while, that is the reason for which they exist.

It makes the whole issue of Migingo look very silly.

Can Kenyans remember how Museveni took the Okellos in circle during their fight in 1986? Museveni was signing a peace deal with the Okellos and at the same time, tightening his grip on Uganda inch by inch. That is what he is doing with Kenya now.

Our ministers travel to Uganda to negotiate about our Island and immediately they return, Museveni adds to more solders to the Island bringing the number to 4. Our ministers and his go to Migingo and an official from the Fisheries Department in Uganda shuts down our Minister in the presence of 2 Provincial Commissioners and Police Commanders, and all hell breaks loose.

Our team run to their boat and comes back to safety and immediately Museveni sends in some 2 more police making the number to 6. He then goes to Zambia and meets with our CinC and they agree on spending Kshs 140 million to confirm what we all know; where Migingo is. Immediately they come back, Museveni sends in a Brigadier to take command of the Island and levy new taxes. Thereafter, he sends his spin doctor Mr. Opolot to come and bully our own spin doctor Mr. Alfred Mutura. Opolot made our Mutua tremble with fear at KICC in a charade of a press conference.

The following day, he sends his Minister of State for Foreign Affairs Mr. Isaac Isanga Musumba to come and tell us in Nairobi that if we doubt where Migingo is, we can go to hell, sorry, Hague.

Surely, can the Nation in their Editorial quote Museveni as correctly thinking that it is a shame to wrangle over a small territorial dispute?

Things must be very elephant at the Nation. Or do they know the secret that Mutua and Kibaki are privy to?

Kenyans must demand action over Migingo 2nd April 2009

The world must know that for the last eight months, Yoweri Museveni of Uganda has been levying taxes on Kenyans leaving at Migingo Island, an Island in Kenya, 15 Kilometres from Muhuru mainland of Kenya and 260 Kilometres from the nearest mainland in Uganda. This is an act of aggression.

During all that time, the world famed ruthlessness of the Kenya Police against Kenyans and the brutality exhibited by the Kenya Army in Mt Elgon and Wagir against Kenyans has been conspicuously absent. The Kenya Police even took off from Migingo at the first sight of 2 armed Police Officers from Uganda.

Yesterday, Migosi Raila Odinga was emphatic that Migingo belongs to Kenya and that the Ugandan flag that has been hoisted there for the last eight months must be lowered immediately. He went on to say that only 6% of Lake Victoria belongs to Kenya. As a partner in this government, I would have wanted to hear from him that all those Ugandans at Migingo have been arrested for being in Kenya illegally, and are been detained at Kodiaga Prisons awaiting to appear in Court.

If 94% of the Lake belongs to Uganda and Tanzania, then, johana mane ma ooro Museveni mondo okaw Migingo Islands? [What is this madness that has made Museveni invade Kenya?]

Why are we negotiating with Museveni? If the Army, the Police and the politicians can not reclaim Migingo, the people will, the people of Kenya must. We will stop all transit vehicles to Uganda, either through rail or road transport. We must stop all transit vehicles either by rail or road into Uganda with immediate effect.

It is very simple;

1] The Kenya Police must immediately arrest all those people masquerading as Ugandan Police at Migingo. They are in Kenya illegally. Do not negotiate this. It is so sad when an invader shuts down our Minister in the presence of 2 Provincial Commissioners, the Police Commanders and the press. Why is the Police Commissioner being sent to Uganda to negotiate with the invaders? Why has he never been sent to negotiate with Kenyans in areas of conflict? They cannot fool us!

2] The Armed Forces of Kenya must cease being ornaments best used for passing out parades. They must defend the territorial space of Kenya. They must not negotiate with Museveni over any bit of an inch of Kenya. They must repulse those invaders with the full force that they can. Why move into Elgon and Wagalla with such might and force, and put your tails between your legs when your services are most needed? When Kenya has been invaded?

3] The Commander-in-Chief of the Armed Forces of Kenya must know that Kenya has been invaded. He must act to protect Kenya and Kenyans. We do not eat new Districts. We eat the fish that Museveni is now controlling at Migingo. For Gods sake, can those people who meet Kibaki daily tell him that Migingo has been invaded and has been under the firm grip of Museveni for the last 8 months? And that he is the Commander-in-Chief of the Kenya Armed Forces, as Mutula and Kalonzo likes reminding us.
Unless he and they know something that we do not know.

The Commander-in-Chief’s response to the Migingo crisis, now in its eighth month, leads most of us to confirm that there is a deal between him and Museveni. This deal is a fulfillment of favours earlier extended, or a deal expected in future. And that future is 2012.

If we look at how Kibaki has bestrowed Kenya in the past 6 years, I am convinced that the president does not mean well for Kenya. If a part of Kenya can be invaded by a country like Uganda and he keeps silent, then his leadership is wanting. It is also not by surprise that the President has refused to visit that same part of Kenya for the entire period he has been President of Kenya.

Museveni had invaded Rwanda and Kagame beat him so quickly and so ruthlessly that he cannot try again. He invaded DRC and again, Kagame came to the rescue of DRC and beat him there. He tried Tanzania and he knew the repercussions. He knows that Tanzanians will beat him and follow him to Kampala and topple him, the way they did with Idi Amin Dada.

He tried South Sudan, and the rag tag army of the southern Sudan dared him. They were ready for him any time, day or night. He cannot dare Ethiopia. He knows that Menes Zenawi does not take those kinds of jokes lightly.
He then turned to Kenya and invaded Migingo and for eight months, his flag has been high as he collects taxes from Kenyans.

The fact that our trigger happy police force could fold their tail and take off speaks volumes. What is the rationale of unleashing too much force on students who are just rioting while you turn a blind eye to an invader?
Where is the force needed? Against our own or against the invaders? I cannot believe that our normally ruthless police force could have left Migingo in fear of Museveni. There must have been an order to withdraw.

I also do not believe that our ceremonial ornaments in the barracks are that cowardly. They invaded Mt Elgon and beat our own Saboat people ruthlessly. There must have been an order for non interference. If our Army can beat people senseless in Mount Elgon and in Wagir, what can stop them from beating these Ugandans from Migingo?
Or, is it that our police and army are at their best against civilians, people who have no guns? People who cannot defend themselves?

Surely, if the Police could cordon off Uhuru Park for a whole one month in January 2007, can they surely be so afraid of Museveni and his team at Migingo? If the Police could kill so many Kenyans just to ensure that Kibaki became our President, can they not kill these 2 Ugandans at Migingo? Can they surely be so afraid in Migingo?

No. It is not the Police, it is not the Army. It is the Commander-in-Chief.

If the President does not want to take action, Kenyans must now defend their territorial integrity. We did it before by uprooting the Railway line to Uganda. We did it before by stopping all transit vehicles through Busia and Malaba.

If Uganda has invaded Kenya, and the Kenya Police and Army are under instructions not to intervene, Kenyans must take the law into their hands and protect our boundaries.
It is a shame that a rag tag army in Somali can act so swiftly whenever there is territorial violations while an Independent Kenya, cries baby.

It is sad to note that the President is doing nothing to promote peace, national healing and reconciliation in Kenya. He is refusing, for purposes of expediency, to be the symbol of national unity.

It looks to me like Migongo is an advance post for 2012, and we must view it as such. Kenya must not loose any inch of land, more so to Yoweri Museveni.

If the Army and the Police are under instructions not to defend us, let us defend ourselves. Sijivuni kuwa Mkenya!

A concerted effort is underway to rescue the Gwassi Hills from further environmental degradation and destruction of rain forest.

gwassi Hills have gone dramatic and systematic degradation in the last fifty years, which saw the destruction of its forest, which for many years had also served as rain catchment areas.

The main component of this degradation is the continued decimation of its forest resources for immediate short-term subsistence needs of the local communities and for long term commercial purposes..

Other component of environment degradation are population pressure on available land, soil erosion, encroachment by farmers and the indiscriminate burning of the forest.

The Gwassi Hills a confgolemaration of 24 high and steep hills located in what used to be Suba District until early this year hen President Mwai Kibaki announced its sub-division and the creation of a new administrative district called ‘Gwassi” district in an area ,which previously covered the entire Gwassi Parliamentary constituency electoral area.

The district has an area of 1,048 km2 and is one of the 35 or so new administrative districts in Kenya’s Nyanza Province.This district is located in South-west parts of Kenya along Lake Victoria. It is an ideally serving as the frontier between the Kenya-Uganda border inside Lake Victoria..

Gwasii Hills are under serious and severe environmental stress. Indiscriminate and wanton destruction of forest of Gwassi Hills is taking place on large scale and unabated.

This rapid depletion of resources in the region is taking place due to a number of factors including, the recent massive immigration of people to the region from other regions of Kenya, uncoordinated felling of trees for building, charcoal burning and cutting of wood fuel

Other contributing factors include the clearing of forest bushes for farming, cultivation of bhang cannabis sativa],lack of sustainable utilization of resources provided by the hills, inadequate forestry guards and rangers to address the problems, accidental and deliberate fire outbreaks.

Deforestation of is proceeding at such a rates that it is likely to catalyze exogenous processes hat have the potential. Of destroying the entire environment and hence drastically reduce the production capacity of the hills.

Depletion of resources of the Gwassi Hills has had many serious consequences. The weather pattern and climatic conditions have changed resulting in unreliable rainfall, reduced water flow from springs upstream, increased soil erosion, emergence of deep galleys, loss of biodiversity, reduced crop yields, loss of aesthetic beau of the environment and the siltation of the shores of Lake Victoria. Some of the hills have turned into dry Savannah. Furthermore. because of environmental degradation, the economy of the region is also adversely affected..by large scale destruction.

He reduction in relief rainfall has translated into reduced agricultural productivity, food deficit and Abject poverty in the hitherto one of the richest and food high yielding region along the Lake Victoria.

The present situation dramatically contrasts with the past when these Hills used to be a paradise of wild fruits ,rare species of indigenous trees, plants of medicinal value unique creepers, and wild vegetables.

The hills also provided important forest products such as timber and building poles ,not to mention scenic and aesthetic beauty of its flora and fauna. These were God’s free gifts of nature to human kind .In terms of resources endowments few places can rival Gwassi Hills.

GWASII Hills are located approximately 40 kilometers to the South-West of Homa-Bay town in HomaBay district, and about 20 kilometers south-east of Mbita point town in Mbita district.. Other additional attraction is the Gwassi hills are overlooking the two major fishing and densely polulated Islands, namely Mfangano and Rusinga, and another smaller islands like Kiwa, Takawiti.Remba, Ringiti,Pyramid and the contentious Migingo island, which is currently the source of furious diplomatic spat between Kenya and between Kenya and Uganda.

The Hills lie between latitude of 0o31,0038’8 and longititude 34 0,15E..The Hills rise an altitude of 1,000 meters at the upon hilly plateau These hills form a series that seem to have fragmented by donatives processes from much larger Volcanic cone of a base approximately 80 kilometers in diameter almost he . size of Mt. Elgon.

The district ‘s altitude varies from 1,143 meters to 2,134 meters above the sea level. The main relief feature in the district is the upland plateau, which is composes undulating surface characterized by residual highlands of which Gwassi Hills are to the south and Gembe Hills to the north of the district.

The unique Ruma Hills is to the far south east. It is unique, because here is the only place in Kenya and the entire African continent with rare white antelopes, which is the size of duikers but slightly small than

Impala. It is called in the local Luo vernacular Ojuaya or Nyajuaya, and it lives up on he hill-top and rarely come down for waters, The antelopes are estimated to number about 200,though there are report of their number getting dwindling by days due to intensive poaching by the local communities.

Nyajuaya is slightly smaller than the beautiful Sitatunga, which loves the swampy land as its habitat. Its presence has slipped off the minds of the Kenya Wildlife Service, which has a well staffed camp at the nearby Ruma National Game Park, the home of another rare antelope, the Roan Antelope.

Gwassi district has hinterland equatorial type of climate that is modified by effects of altitude and closeness o Lake Victoria which lowers the temperature. Thus the weather around the lake is pleasant all the year round.

The first mass bush clearing in Gwassi Hills was reported in 1954.However,iit was until 1970s when some immigrants and local people started to settle on the main Gwassi Hill Forest, though by the time it had already been gazette by the government as a forestland..

These people “invaders” were engaged in massive forest destructive activities, which include cultivation, pit sawing, charcoal burning and bhang growing.

By the year 1984, these activities had turned large area of forestland into farmland. In the same year and with the assistance of the Provincial Administration in Nyanza Province the squatters who had encroached on the forestland were forcefully evicted.

These eviction were later halted abruptly only after when it was discovered and realized that some of the illegal squatters had fraudulently obtained the official registration number of their farms. However, with the assistance of the Ministry of Lands and Settlement, the registration of their parcel numbers s were duly nullified in 1988.The number of the illegal squatters at that time was said to be

Victoria, the sport fishing on Rusinga and Takawiri Island and wide island and a wide variety of birds in the various provide very important tourist attraction sites in the district.

Violating law, damaging legal system building: The enforced disappearance of Lawyer
Tang Jitian

We are a group of Chinese citizens working in a legal firm. We have learned from witnesses, lawyers Lan Zhizue and Dong Qianyong, that our colleague Tang Jitian was forcefully taken away by an officer of your public security branch at 2:00am on the 4th of June 2009. Tang has since been missing. His family is very worried about his personal safety and is anxiously searching for him. We strongly protest against this illegal deprivation of Tang’s personal freedom. We urge you to immediately release lawyer Tang Jitian and demand accountability for the unlawful detention of our colleague.

Background:

At 6:30am on 3rd June 2009 lawyers Tang Jitian and Lan Zhixue just finished their discussion of a case they were working on, in room 316 Yaxin building, 63 Sihuan Beilu, West Haidian District, Beijing. Police from Sijiqing substation took them in for questioning without giving any valid reason. Lawyer Tang was kept in police custody until 8:00pm This is longer than the 12 hour time limit for a summons according to law.

On the way home with lawyer Don Qianyong accompanying, Lawyer Tang Jitian was followed by police of Sijiqing substation and two internal security police of Haidian district branch. When both lawyers got out of a taxi at East Erhuan at a footbridge next to the airport highway they were stopped by four police. Internal security police surnamed Zhang requested lawyer Tang for a ‘talk’. Tang refused the summons due to the lack of legal procedure, failure to produce any legal document and no valid reason being given. Four police then started to use force with him.

At around 2:00am on 4 June 2009, two more police in plain clothes arrived. The other four police escorted lawyer Tang to a car. Tang pushed against the car door, police then lifted his legs up and threw him into the car, then drove the car away. His whereabouts is unknown. Up until the end of 6 June 2009, lawyer Tang has been missing for more than 60 hours.

Since our country resumed law in 1979, the state has put effort into rebuilding and further developing the legal system. We have been happy to see in 1998 and 2004, that the state has written into Constitutional Law the wording of “The People’s Republic of China exercises the rule of law, building a socialist country governed according to law.”. “The State respects and protects human rights”. We see this as great progress toward building a legal system.

The current Constitution of Communist Party of China (below CCPC) adopted on 21 October 2001, stated in its general program: “The Communist Party of China in accordance with the general requirements for democracy and the rule of law, equity and justice, honesty and fraternity, vigor and vitality, stability and order, and harmony between man and nature and the principle of all the people building and sharing a harmonious socialist society.” And in chapter I, article 2 it states “Members of the Communist Party of China are at all times ordinary members of the working people. Communist Party members must not seek any personal gain or privileges, although the relevant laws and policies provide them with personal benefits and job-related functions and powers.” Also under chapter I article 3 point 4, it states, “To conscientiously observe the Party discipline, abide by the laws and regulations of the state in an exemplary way…”

However, from the incident of lawyer Tang Jitian we are sad to note that police of the Haidian District Branch of Beijing Municipal Public Security Bureau not only did not abide by the laws and regulations of the state but malpracticed by violating the law. Sijiqing substation has arbitrarily summoned two lawyers, forcefully taken them in for questioning and illegally detained them for as long as 14 hours. Later, the internal security police again illegally followed lawyer Tang Jitian and illegally deprived him of his freedom, roughly handling him and putting him in a car by force.

As a legal worker, the purpose of our being is to guard the Constitutional Law, to make sure it is implemented correctly and to defend the dignity of people as guaranteed by Constitutional Law. If a citizen can be arbitrarily detained, forcefully disappeared or arbitrarily summoned without following legal procedure, how fearful people’s life is! We wish to see our country, China, to be a state with law and order, with anticipation that state powers are under restraint and are accountable under rule of law.

It has been reported that a team of fisheries experts from Kenya and Uganda are set to join their counterpart ins from Tanzania in the Lake Victoria town of Mwanza in South-Western Tanzania later this month to chart the way forward regarding the management of water resources.

Among the issues that had been blamed for poor fish stocks in the Lake Victoria were fragmented laws by the three countries sharing the water body, which experts argued affected the overall output..

One case was that it is only Kenya, which has puts in place a four months ban to fishing aimed at allowing breeding and maturity..

The Mwanza meeting comes in the background of a ban last week slapped on the establishment of new fish processing factories around Lake Victoria.

The latest move come against the background of the reportedly dwindling fish stocks in the lake.

According to statistics recently released, Kenya harvested 111 tones of fish last year compared to 117 tones the previous year representing a shortfall of six tones.

The Deputy Director in charge of Fisheries Department in Western Kenya, Mr. Michael Obadha recently said during an interview in his Kisumu office that the scarcity of fish has already forced at least five fish processing factories to shut down. The closed factories, he added, have sent home their workers after declaring them redundant.

He defended the latest ban saying the Lake was already struggling to sustain few fish processing companies that remained operational, adding that there was no room for new entrants

“It is not logical to set up more factories yet the ones which are operational cannot even sustain work three times as week in full capacity,” Mr. Obadha told the DAILY NATION in another interview.

Fish processing in the region earn a combined income of Kshs 6 billion annually from exports of its highly valued Nile perch.

The freeze on the establishment of new fish processing industries is among a raft of measures that the government of Kenya has taken boost stocks in the water body.

Other measures geared towards protecting the much prized Nile Perch species include the restriction of fishing of Omena to two kilometers inside the lake.”This Mr.Obadha explained was meant to protect the breeding grounds which are mainly on shallow ends..

The deeper the fishermen go into the lake the lesser the chances are that they will catch young fish and interfere with the breeding grounds,” said the director.

Fishermen will also be restricted from using light lamination during their fishing expeditions, a move Mr. Obadha said was lights attract Omena{the smallest fish species in the lake].

Interestingly, although fish stocks have been dwindling over the recent years past, earning have, according to the statistics from the Ministry of Fisheries increased by Kshs 2.i billion.

This trend, Mr. Obadha explained was due to increased demand, which had pushed the prices up. Falling supply and over commercialization of fish are, however, now threatening to lock out those who have over the years depended on the sector for their livelihood.’.

Mr Obadha said that currently one kilogram of the Nile perch is fetching Kshs 250 with the average sizes offish standing at six kg. This was way above the reach of most households.

Lake Victoria Nile Perch has been on high demand, especially in European and Middle East countries markets where it fetches the highest sales figure.
