Raila Odinga is either too honest or he does not understand the art of negotiations. Raila should have understand going into this cabinet formation talks knowing very well that PNU was going to try to get the upper hand. But insteadn Raila laid out a proposal that does not give him any wiggle room. On the other hand KIbaki is playing the win win game with Raila. We all know what PNU wants is to retain the current 17 cabinet ministers without switching them around. But instead of just proposing that to ODM, Kibaki is smart enough by bringing a proposal that he knows is unacceptable and unattainable. Now kibaki’s next move is going to be , that he is willing to back off the 44 member cabinet to 37 with conditions that he retains the current cabinet of 17 as it is. By doing so, now Kibaki will have been seen as taking a compromise and this will force Raila to accept the proposal whereby getting into the PNU trap and game plan. Raila should have come up with anrealistic proposal too, then compromise a week later. With the current proposal ODM brought to the table, they cannot afford to back down an inch or else there will be no real power sharing.

    ACCORDING TO THE ACCORD ANY FOMER MEMBER OS THE SEL-APPOINTED KIBAKI CABINET WHEN HE HAD 100% EXCECUTIVE AUTHORITY REMAINS “ILLEGAL”

    -THE ACCORD STATES “CABINET MINISTERS APPOINTED UNDER COALITION COULD NEVER BE FIRED WITHOUT WRITTEN CONSENT AND AGREEMENT OF COALITION PATNERS”

    -AS SUCH ALL ‘GREEDY MINISTERS PREVIOUSLY APPOINTED BY KIBAKI MUST VACAYE THEIR POSITIONS TO PAVE WAY FOR COALITION CABINET.

    -RAILA AS THE COORDINATOR AND SUPERVISOR OF THE GOVERNMENT MUST BE ALLOWED TO HAVE VERY HEAVY INPUT IN NAMING THE CABINET OR ODM FACE SOME SERIOUS LEADERSHIP CREDIBLITY ISSUES.

    -THE GOVERNMENT BERAUCRACY MUST BE AS SMALL AS POSIBLE…WITH FREE ENTERPRISE ECONOMY AND LOWER TAXES.

    -ALL ASSISTANT MINISTERS POSITIONS MUST BE ELIMINATED AND REPLACED BY PERMANENT SECRETARIES.

    -ALL DISTRICTS MUST BE ELIMINATED AND KENYA BE GOVERNED BY PROVINCIAL COMMISSIONERS…THIS WILL ERASE ETHNIC CLASHES

    – POLICE COMMISIONERS MUST SERVE UNDER CIVIC LEADERS OF THE INDIVIDUAL CITIES AND TOWNS WHO CAN HIRE OR FIRE THEM

    – THE DEVOLUTION OF WELATH MUST BE COMMUNITY BASED-UPWARDS TO THE CENTRAL GOVERNMENT-NOT THE OTHERWAY AROUND….THIS WILL BE AN INCENTIVE FOR LOCAL GOVERNMENTS TO BE PRO ACTIVE IN DEVELOPING THEIR AREAS WHICH IS IN TURN GOOD FOR THE OVERAL ECONOMY.

    Raila has no reason to be appeasing PNU.

    Just because the accord below signed between “Kibaki & Raila” ensures a 50-50 “Executive Authority Powersharing” betweenthe two “Kibaki & Raila” it doesnt bestow power of any kind to any other Kenyan over the two “executives”.

    PNU – ‘other ranks’ starting with Kalonzo Musyoka must know they are surbordinates of the two and the voters-they are neither equal or greater than the two authorities.

    THEY [ MPs ] WILL NEVER MAKE, CREATE, OR INTERPRATE ANY LAWS IN KENYA -EXCEPT THOSE HAVING BEEN GIVEN THE AUTHORITY OF PARLIAMENT – after the accord.

    THE MISTAKEN VIEW CURRENTLY BEING TAKEN ESPECIALLY BY[ PNU]AS IF THE FORMER KIBAKI GOVERNMENT HAS BEEN RECOGANIZED BY ANYBODY IS WRONG AND THE PRESENCE OF THAT ACCORD BEING GIVEN PARLIAMENTARY AUTHORITY CURRENTLY BEING DEBATED UNDERSCORES THAT FACT.

    AFTER THE ACCORD IS GIVEN CONSTITUTIONAL AUTHORITY BY PARLIAMENT THEN RAILA WILL BE ALLOWED TO START FORMING HIS GOVERNMENT STARTING WITH THE NAMING OF HIS TWO DEPUTIES [NOMINATED FROM BOTH PARTIES]

    A] I THEN SUGGEST HE SHOULD IMMEDIATELY A BOLISH THE POSITIONS OF ALL ASSISTANT MINISTERS AND REPLACE THEM WITH PERMANENT SECRETARIES TO DIFFERENT DEPARTMENTS- COALITION GOVERNMENT DOES NOT EXPAND UNMANAGEBLE GOVERNMENT BUT INSTEAD SHOULD SHRINK IT FOR MORE EFFICIENT SUPERVISION.

    B] HE SHOULD DISMANTLE ALL THE DISTRICTS AND TAKE KENYA BACK TO ITS ORIGINAL FOUR PROVINCES SO THAT KENYA SHOULD BE MANAGED BY PROVINCIAL COMMISSIONERS ONLY-SCRAP ALL POSITIONS OF DCs WHICH HAVE BEEN POLITICISED AND USED TO DEVIDE KENYA INTO ETHNIC GROUPS MAKING KENYA REDUNDANT AND INCREASING ETHNIC CLASHES.

    C] DIMANTLE ALL POLICE COMMISSSIONER POSITIONS AND LET THEM SERVE UNDER THE CITY MAYORS OR OTHER CIVIC AUTHORITY WHERE IF THEY DONT PERFORM THE CIVIC LEADERS WILL BE RESPONSIBLE FOR THEIR FIRING AND HIRING WHO ARE ELECTED OFFICIALS- I WAS ASTOUNDED WHEN I READ THAT THERE ARE 1000 POLICE CHIEFS IN KENYA -YET ALL THAT CARNAGE WENT ON UNABAITED AND EVEN MUNGIKI IS STILL IN EXISTANCE!

    ODM-MUST KNOW THAT UNDER THIS ACCORD IT IS RESPONSIBLE [BY STRENGTH OF PARLIAMENTARY MAJORITY PER THIS ACCORD] TO DELIVER GOVERNANCE AND SERVICES OF WHICH ANY FAILURE MUST BE SQUARELY DIRECTED AT RAILA AND HIS ODM

    I disagree with Washington Okechi’s view and suggestion that the ODM proposal should have been an unrealistic one. The backdrop of the negotiations is a country that was on the verge of civil war and therefore there is no room to play politics with millions of lives of Kenyans. Clearly stated the writing is on the wall the power sharing is now constitutional and no room for mind games as suggested by Okechi. For your information ODM is solid as a rock, a place where you experience political maturity. Those games Mr Okechi is suggesting are old games that will not work in the Kenya of tomorrow
