When we have this debate and conclude it, the thing is Kibaki has already signed the darn thing. What is the media calling it?

Draconian? Well, very good coinage of words there but then again, something to get us thinking.

Positive side of Kibaki shining the bill is, the media fraternity now knows that they ought to put in place mechanisms that are strong and credible like the LSK to deal with their erring lot, and The’re many believe me. Let no one lie to us that media fraternity is clean and spotless like they always want us to believe. A wake up call, before the law is amended, get your house in order!

The bill talks about the government reading your mail. Its all mail including those sent through the post office. The minister doesnt have to have a court order now but now will do so at his own liking. Infact its something which sends chilling messages on the spine of Kenyans and my take here and encouragement to Kenyans is to really minimise the use of Post office mails and also Kenyans who are fightingg for freedom in this country must stop using mail addresses from wananchi online, iconnect, access kenya and all local ISPs. Use gmail and yahoo and hotmail. The Kenyan government have no capacity to hack onto your Yahoo, Hotmail a d Gmail and I can bet myself onto that.

The government is talking about deciding content including all radio and TV content before they are even broadcast. Let me tell you Bw Mureithi that it will always not be Kibaki in power. You might be supporting this because its KIbaki in power. But this law might be used against Kibaki. He and Michuki might be looking at the short term effect of it but their are politicians who have done what they are doing without realising that they will and might even be the first victims of such laws.

How will CCK know that a program or coverage is balanced. Do theey need only something balanced to Kibaki or to all? I dont know how CCK will implement that.

My take on the bill is that the E-transactions, Signatures and Contracts are easier said than done. The electronic Kenya gazzette is ok and the government will iomplement that but what is evident is that the good parts of the bill are going to be very haard to implement. very evry hard to implement

But all readers of BidiiAfrika musst be ready for this and must start taking steps in making sure that our right is not denied. Lets make it hard and increase our exposition of this governments ills and evils. We cant be stopped and we are the only remaining opposition and must never allow ourselves to be silenced

The Kenyan media have had a way with arrogance. We have all been victims of this and NMg and Standard group have all been involved in very wide ranging arrogance and denying the youth of this country a chance to succeed. I am not supporting them being raided when Saitoti feels like. Its not in the best interest of my old ffolks and all our parents who have no other avenue of being informed

The good thing about this is that the ACT might just fastrak the democratisation of Kenya. We will fight for our rights with more vegeance and there will be more Nyayo house and such like chambers in the near future and all international spotlight in Kenya will make the government understand this

I recall bodies such as the Kenya Private Sector Alliance getting engaged and for a long time participants being asked to contribute. i therefore disagree with the writer in the Sunday Nations analysis on page 13 magazine that nobody had complained about e-commerce. Indeed, we did and the bill is the fruit we’ve been waiting for. Let media stakeholders not trash the communications bill just because of one section.

Go for the amendment instead. I entirely agree with the presidents action otherwise this would have remained elusive, just like the constitution amendments we’ve been longing for.

Guys,

A lot of elements have been supporting what Raila did, infact some have gone as far as saying that he Raila really brought peace during post election violence. But the big question is still unanswered: Did he Raila really bring peace when he backed down and left Kibaki to have more than 70 ministers and assistant ministers?, or did he really bring peace when he accepted that Kibaki retains all the high portfolio ministries?. The events now happening in Kenya today since the coalition governmnet was formed just tells us we Kenyans that the ODM including Raila just only postponed the war may be upto 2012 and to any bright thinking Kenyan I do not think that any peace was brought. So foxes be ready for a tight fight, may be perhaps a real civil war in the near future. I do not see any lasting peace this grand coalition has brought. The only thing we do not see now is that nobody is being killed as it happened during post election violence but the PNU is really laying all grounds to win the war in 2012, could it be war of words or of guns the PNU will carry the day, and they will be on the winning side the way things are going on today in Kenya. By the way I hear that Mungiki are being secretly rejuvenated and the youths who were sent to Uganda for training are almost ready to carry their duties should they be called back, so what will ODM do?. Are other sides or opponents of PNU really getting ready to thwart this threat?, or are just waiting to count bodies and the media to have massy on them to report again to the United Nations for help?. Kenya might not be a safe place to live in after 2012 if no radical change is done now ladies and gentlemen. It will be too late for a lot of luos living in Nairobi, central province even Momabasa etc, even in Kisumu town, because those are the places mungiki will hit first and next time they hit it will be in a big way. Let us not blindly sleep all the time, if no radical change is done now, then I advice that before 2012 election let all luos in those risky zones migrate back to nyanza.

New law: Raila calls crisis meeting

As outraged Kenyans protested against the endorsement of media raids in a draconian law by President Kibaki, matters were bubbling in the delicate Grand Coalition Government.

Reports indicated all was not well as a line was drawn between friends of the media and the hawks in Government over the punitive Communications (Amendment) Bill 2008 signed into law on Friday.

Prime Minister Raila Odinga has called a crisis meeting of ODM ministers and legislators to reassess the partyÂ’s “standing in Government” this Wednesday.

The PM considers the development as a slap in the face after he had publicly assured Kenyans that the President would not append his signature to the controversial Bill.

The move by the President has caused ripples in the media fraternity but there are indications that it could have even more devastating effect on the Government.

Of great concern is that the simmering tension in Government could have dire repercussions on the political stability, including derailing the ongoing reform agenda. Raila meets ODM top guns on Monday afternoon to address national crises. Sources said the agenda is food shortage, ECK, media freedom and state of the coalition before the joint party NEC and parliamentary Group meeting on Wednesday.

Close associates of the PM and Vice-President Kalonzo Musyoka have confided in The Standard on Sunday that they were not consulted over the decision to assent to the Bill.

“The move is unpopular with the people and our feeling is that the President wants to go down with everybody, forgetting that some of the key players like the PM and the VP have a political future beyond 2012. Of course Raila and Kalonzo will resist his unorthodox manouvres,” a minister observed.

Current crisis

Our sources trace the current imbroglio to political developments towards the end of last year. The source of the friction was the manner in which the cancellation of the annual State House dinner dance was communicated.

According to our sources, the PM and VP were kept in the dark until the eleventh hour. The PM reportedly received a call from an official of State House informing him of the cancellation, while a Permanent Secretary reportedly conveyed the VPÂ’s message via a phone text message.

“However, the VP is not making a public protest about the whole matter because the President is his boss and only him knows best how to handle the issue if he feels aggrieved,” added a close associate of Kalonzo.

Nonetheless, the politician explains that the VPÂ’s record on Press freedom is clear: “As far as he (Kalonzo) is concerned, it is not over yet. Media owners should now dialogue with Government on the offending clauses and sort out the standoff.”

For Raila, though, it is a different story. There is a strong feeling among his allies that Kibaki disregards his opinion and “acts as if he won a clear mandate to run the country alone”.

Although the National Accord and Reconciliation Act 2008, which ushered in the Grand Coalition Government, places the PM at par with the President, in practice the story is different.

ODM founder member Mr Mugambi Imanyara says the party leader and members were ignored during the signing of the Bill. This, he observes, casts aspersions on the Grand Coalition Government.

“Even as we convene on Wednesday to agree on the way out, the general feeling within the party leadership is that we shall sponsor a private memberÂ’s Motion to delete all the offending clauses,” says Imanyara, the partyÂ’s Secretary of Legal Affairs.

Surprise turn of events

Meanwhile, a senior PNU party operative and close ally of the President has expressed surprise at the turn of events. Noting that the President has “a lot of respect for the PM and consults him frequently on matters of national interest”, he blames the PM for “acting emotionally” over the Media Bill question.

“I know for sure that the President and the PM get along very well and are in agreement over a number of issues. What I do not understand, however, is how these decisions eventually get overturned,” he says.

The Standard on Sunday has established that the two leaders routinely hold briefing meetings every Wednesday mid morning, either at State House or Harambee House.

“Even when he wanted to effect changes on diplomatic postings to our embassies abroad, he dispatched (Head of Civil Service) Mr Francis Muthaura to the PMÂ’s office to compare notes. And because ODM leaders protested heavily about the list, the changes have not been effected two months on,” says the official.

Nonetheless, ODM feels aggrieved and will this Wednesday meet to iron out burning issues. Top on the agenda are the Media Bill, the rising fuel and food costs as well as the question of the Electoral Commission of Kenya. Members are irked by what they perceive as interference by the Muthaura over the transition process after the disbandment of ECK.

Weighty matter

“The matter is weighty. On Monday morning the PM will meet top advisers and party officials to consult ahead of the NEC (National Executive Council) and PG (Parliamentary Group) meeting on Wednesday,” divulged a party official.

“We want to draw a clear line of what ODM can take or canÂ’t take in this union. We are quickly losing identity and we want to remain loyal on the platform that we campaigned for,” he added.

And while ODM appears to have taken a uniform and firm decision on the Media Bill, there are divided voices for and against the Bill within PNU, ODM-Kenya, Narc-Kenya and Kanu.

Nyanza marvels at surprise results as public schools improve

Though they only produced five candidates in the top 100, Nyanza schools are upbeat about their performance in last year’s Kenya Certificate of Primary Education (KCPE) examination.

Education officials and teachers are excited over what they termed as ‘surprising’ performance.

However, there was also a see-saw battle between private and public schools. Green Hills Academy, a private school in Kisii Central, produced the region’s best candidate, Adino Barry Magenya, who scored 446 marks.

Private schools performed better in general, but in Kisumu Municipality, public schools made remarkable improvement, says education officer George Omondi.

He said 138 candidates scored above 400 marks, up from 58 in 2007.

One of the public schools that outshone the private ones is Arina Primary, where 16 candidates scored above 400 marks, compared to six in 2007. At Arya Primary, 15 candidates posted more than 400 marks.

Other public schools that performed well in Kisumu included Victoria, Xaverian and Ogango primary schools.

Top private schools that did better included Josana and Golden Elite. Josana produced the only candidate from the Municipality in Nyanza’s top ten, while Golden Elite was the best overall in the municipality.

In Gucha South District, private schools stole the thunder from public ones. The District Education Officer, Mr Elisha Omalla, cited laxity and understaffing as the main reasons for poor performance by the public schools.

“Private schools are well established and have better facilities and this gives them advantage over public schools,” he said.

However, Tabaka Girls’ Boarding Primary, a public school, emerged the best school in the district with a mean score of 340. But more private institutions posted better results.

Omalla cited Pace and Tabaka academies as the outstanding private schools.

In Gucha District, public schools beat private ones.

Charles Onchangwa, a quality assurance and standards officer, who released the results on behalf of area DEO Risper Owino noted that public schools had improved performance.

Kenya Primary School Heads Association Gucha branch chairman Mishael Nyarango lauded public school heads for the good results, despite reported irregularities in two schools.

Notable private schools missing at the top included Elsa Academy in Ogembo, Echabumbe and Kenyenya academies.

Nyanza Provincial Education Officer Geoffrey Cherongis pledged to hold meetings and chart the way forward to reclaiming the region’s lost glory in academics.

Like other provinces, Nyanza was affected by examination irregularities. More than 200 candidates from 19 centres had their results cancelled.

Generally, the province had 113,326 candidates, with 50,173 of them being girls. None of the candidates made it to the national best ten but the province produced five in the top 100 candidates, two of them girls.

There were four girls in the province’s top ten candidates. The province’s best female candidate, Diana Achieng’ Otieno of St Teresa Primary School in Siaya, got 444 marks out of a possible 500.

Luos,

We are one of the best tribes now in this planet, believe me or not. 50% of our genes will be ruling the richest and the most powerful country on earth today, but what do we luos have?.

We are the only tribe which seems to know almost everything which needs to be done to uplift our sufferings, but when it comes to actions we are the last. Our Province nyanza is growing backwards but we are more concerned about what should be done in the Kenyan parliament than what should be done in Nyanza.

We are the ones crying mouth wide open for democracy in Kenya while we the luos are hardly expressing democracy in Nyanza. Look at any nyanza election, whether pre-candidate nominations, etc whatever you call it. We have the worst record. Can somebody tell us who won the preliminary ODM election in 2007 in Ugenya, which James Orengo now represents?. We know very well that Orengo did no win it, so who won?. And how did Orengo got the post?.

We were the first tribe in Kenyan history to produce a woman member of parliament, but now with all the democracy we do claim we have today or try to bring to Kenyans, how many women members of parliament do we have today?, ZERO, look at even how many rift valley have, What a shame ?. Do you want to tell us that luos do not have educated daughters, sisters, or mothers, why are we letting 50% of our forces down or unused?. We have a lot of empty MEN debes telling people to vote for so and so, you can even be beaten if you ask why at the same time we cry loud for democracy in Kenya.

Now we want a party, is it the main agenda? or is it the most important thing today to be done?. Just as somebody said always remember to do the essential first then the less important later.

Or I forgot, it seems that all our leaders have crossed to the Kikuyu`s side and are now serving Mungiki instead of luo youths who are still lingering in prisons or jobless, by the way who voted for those leaders who have now crossed over to Nyeri?. Are we not the luos who did it, and we have been doing it since 1963. In 1963 Oginga was given leadership by the British, but what did this great luo leader did?. Told the British he does not want to lead, but he would prefer Kenyatta to do it, then some years later he started telling luos that Kenyatta is leading very badly so let us revolt and stay poor for 45 years.

I hear we need to frame the constitution on Bomas draft, is it true, it looks a great idea, but the Bomas draft have nothing much better other than the Majimbo and to the diaspora the dual citizenship, otherwise it can be still be manupulated just as they are doing the present constitution, where Mps do not pay tax. But the Draft have also it suprises: The most first suprise that will affect the luo extremist and the Odingaism or Railaism in luoland is this. The Draft states very well that a president should not be above 65 years of age. So Raila is automatically out of the presidential race in 2012. Kenyans have never been clever enough, because any draft or constitution being suggested are made sometimes for individuals or to exclude some individuals, non have been made when considering what our beloved country Kenya needs (the Bomas was against Moi). Guys : can we see why Kenya is not moving forward?. Look at even fuel today the country lacks fuel at a time when a barrel of oil cost only 40 dollars, while at the time when the barrel was costing 150 dollars there was fuel, what a paradoxical life we do enjoy in Kenya ?. Some empty debes will try to convince you that because of christmas people travel alot and therefore more cars then no fuel, rubbish, what about lack of ugali?. Whether you travel or not you need almost the same capacity of ugali, but why is it not available?. In 2001 he Kibaki and Raila told Moi that he was stupid, because lack of food was linked to rain, a natural phenominal. Moi said it did not rain so poor harvest equals no food. Raila went a head to ask Moi to tell Kenyans why there was food in Egypt, where it hardly rains while in Kenya there was not enough food. Ladies and gents why is there not enough food when Raila and Kibaki are all ruling?. How quick do we forget?. In Nyanza still no food, but in nyeri they have enough and infact throw some to the dustbines, so, so what?.

Our country is hijacked and lead by people who are politically incapable of bringing development, these people think that development means taking all the tax payers money and banking abroad or stealing as much as they can, corruption is the order of the day. Or to them development simply means, bringing german cars, japanese motorbikes, filling your shops with foreign goods etc, making good lights on the street etc. Infact some of these leaders do not even know how a simple mobile phone works, how a television gets images etc. While they occupy high positions in the governement and still claims that they are capable of bringing development, what a peace of CRAP.

Guys ; form any party you want but define its goals first and how it differs with the ones we do have today, and how that party is going to help luo nyanza have food on the table. May God bless you and please take luos out of this Odingaism loan, we have been paying for 45 years.

Stop him how now? Go to the streets? Uproot railway lines? Civil disobedience? I do not think this is the avenue.

First off, we can not say that the media has been totally nonpartial in their reporting, no media house can say it is always without a point of they to further their interests, corporate or otherwise. That law can be changed later, let us not lie to ourselves, the media had all the time to regulate themselves but did not take any real action towards that regard, now they know, they ought to wake up and lobby for that law to be changed, otherwise democracy is not easy, it is not given on a silver platter, it has to be struggled for. You’re right. Kibaki & Co. Ltd can do nothing to stop the internet as a tool of communication. Worry is: internet accessibility is still low in Kenya (Africa) especially in the rural areas where votes are. May be it’s time we started village internet centres, eg one in each contituency!

Opposition candidate John Atta Mills has won a tight presidential run-off in Ghana, electoral officials have said.

The announcement came after results from the last constituency to vote extended his lead over Nana Akufo-Addo – his rival from the governing party.

Mr Akufo-Addo’s party boycotted Friday’s vote in Tain constituency, citing security concerns there.

Claims of rigging have been made by both sides and the electoral commission has pledged to examine any evidence.

Much as I may know this, I can’t imagine anybody in his/her right mind would think of such a myopic idea. I do not think from the lessons we have learnt now, we cant just sit and watch helplessly! Surely we are now beyond the masses that were cowed for over 24 years, we have some little space to air our disatsfaction, and we must use that space to do exactly that. Simon,

Your question may make sense to most people in this mailing list but not to the hungry man or woman on the street whose only hope to lay down the yoke of poverty was firmly pinned on the election out come.

When Kibaki and his brigade ( Muthaura included) rigged election, his propaganda machine was busy telling people of central province that they did it to protect them from the villains without the province. Even today many people from central Province still believe that if Kibaki didn’t become the president they would have all disappeared save the ones in exile. I don’t know what you as person believe but the election results have always and will always have some impact on the civil behavior particularly in Kenya for as long as politicians maintain their current tactics and Kenyans keep electing them to Parliament.

The role that Muthaura played during the campaigns and post-elections times reflected him as an extremely partisan character as opposed to what is expected of him as a civil servant. He is therefore not trusted by many Kenyans and most people will always read mischief in his moves even if he was right. He made his own bed and it sounds like you owe him some sympathy. Many Kenyans who lost their lives never had the luxary of such academic arguments while those who lost their livelihoods may only be interested in practical solutions which can assure them a secure future. But how can Muthaura be part of that solution unless we are reading the pages upside down! He was part of the schemes which ECK implemented. It all boils down to sacred cows and spend-ables. The 600 ECK officers were spend-ables and now they have taken their rightful position………SPENT FORCE. Kibaki is in State- House while Muthaura is calling the shots and nobody can touch them …… yet they issued the menu delivered by the ECK.

So Simon ndugu yangu, before you lecture Kenyans on social responsibility you need to appreciate some hard facts in social psychology.

If the head of civil service can act with such impunity it reinforces that current prevalent belief amongst the citizenry that the leadership of the country has never and will never ever act in national interest. Kibaki signs Media Bill ————– Kibaki must be stopped

President Mwai Kibaki has signed into law the Communications Amendment Bill, 2008 ignoring protests by the media stakeholders.

In a statement to the media, Kibaki said he had received numerous appeals from the industry asking him not to assent to the bill.

“I have carefully considered the concerns that were raised by the media which mainly relate to Section 88 of the Kenya Communications Act, 1998 which gives the government power to restrict media operations during a state of emergency,” he said.

Kibaki is now urging the key stakeholders in the media industry to address queries raised by Section 88 separately.

“This section is in fact contained in a separate Act, the Kenya Communications Act, 1998. Therefore, by refusing to assent to this Bill, I will not have addressed this concern of the media,” he said.

The President noted that the Kenya Communications Amendment Bill, 2008 addresses issues critical to the country’s economic development in regards to electronic transactions like M-PESA, which has employed over 12,000 Kenyans in a span of one year.

“Indeed, by and large, the regulation of the electronic transactions in Kenya creates room for the pursuit of the ideals of Vision 2030 while regulating the electronic media would promote and safeguard our culture, moral values and nationhood,” he further stated.

The law also addresses regulation of the Business Processing and Outsourcing (BPO) sub sector, which has created over 5,000 jobs.

There are many things that I am still trying to understand, but these three have always puzzled me!

-Why siblings/brothers and sisters fight, hate each other/one another, don’t talk to each other/one another and go about destroying each other/one another!

-Why people who were once very intimate friends and shared many things and good times together slowly but surely turn against each other, start destroying each other and/or share information that was only meant for them during the good times!
-Christians/congregations of different faiths don’t like one another

Today, I will focus on the last point:

-We must understand that we all come from different backgrounds and therefore will never see things the same way
-Some of us are what we are because of our parents,siblings
-Some of us read the scriptures and made a personal decision based on the word to join some church
-Some of us were influenced by some preacher or friends
-All of us believe very strongly that ours is the best and I see no problem with that! How come! Listen! If you don’t believe in something, then you are likely to fall for anything

So, how should one react when, say,
– you ccme a cross someone who believes otherwise?
– you come a cross a book that teaches against your beliefs?
-A friend starting talking about his/her faith thus putting yours down!

There would be many different approaches but allow me to suggest the following:

-You don’t have to feel bad or start cursing, thus loosing the qualities that each child of God should have!
-This will be a golden opportunity for you to share your faith as you understand it. As you do this, begin and proceed with an open mind.
-Make sure that you know what you believe and be always ready to defend it
-It’s not enough to remind others that even so and so who belongs to the club of the rich and famous is a member of your church! That may not qualify as good enough reason!
-Without any doubts, your best defense will be the word of God. “Thus says the word of God,” is more powerful than thus preaches/teaches Pastor Birai or so and so.”

But if you forget anything else, please remember this, “after all is said and done, we are but brothers and sisters!” We serve and love the same God and each one of us is trying to understand and do His will. To this end, let us pray for one another as we seek to understand Him better. Shall we?

The majority of Ugandans consulted in the on-going public hearings by members of the East African Legislative Assembly have totally rejected foreign ownership of land by citizens from other East African states, a position that has also been articulated by Tanzania.

The Ugandans say that consultations on land in the on-going Common Market negotiations should be suspend until the region has formed a political union.

“We have to move very slowly on land issue process of different tenure system and legal regimes in the region. Let us wait until after the political federation, then we can talk about land”.

“the land issue is very sensitive and crucial within Uganda and Tanzania. There is no need to rush, said a Ugandan Legislator John Arupa Kgyagi during a recent public hearing conducted in Mbarara Town.

The Ugandans according to the analysts would force partner states within the East frican Community (EAC) back to drawing board since technocrats from the five capitals have already recommended in the draft common market proposed that land as a prime factor of production should be available to East Africans for ownership on equal terms.

Mr. Clement Kandole, the District Commissioner for Mbarara who has been involved in the negotiations between Uganda and Tanzania after he later expelled thousands of Ugandans and Rwandese from the country, also did not mince words about the protocol

“If Tanzania is concerned about land, why cant we go slow, Mr. Kondole said. They harbor quite suspicions about our people (occupying Tanzania ) when we are talking about slow tracking, they track about comprehensively, look at the underlying factors. Let us first build consensus in the region, said Mr. Kandole.

Uganda is currently reviewing its land laws to stop end massive evictions experienced in the past, which ignited violent conflicts between tenants and land lords who acquired huge chunks of land as colonial tenure. It is suspected that the view held by Ugandans on land is pegged on their experiences in these violent land clashes.

This development reinforces a sharp split between the partner states that emerged since the common market negotiations kicked off.

Tanzania has been viewed by other EAC members as a stumbling block to the negotiation process due to its apparent refusal to agree with other partner states on a critical provision of the draft protocol such as free movement of persons, rights of establishment and residence, and permanent residence.

Dr. Kaula added that Tanzania had attended the next meeting held in Nairobi where it made known its stand on the proceedings from the Kigali meeting.

In all regional meetings held in Kigali, Bujumbura, Nairobi, and Kampala and recently in Zanzibar , the Tanzanians have either stayed away or flatly rejected the proposals to consolidate the fore economies into one giant regional economy.

However, all the disagreements have been exhibited at the technical level of negotiations. This was one of the major reasons the East African Legislative Assembly Launched parallel consultations to collect the views on the public on the common market negotiation.

Meanwhile Tanzanians has detected itself saying its track records in the on going regional integration process again of allegation that is delaying negotiation of the East Africa Common Market protocol, saying it is nearly putting the interest if its Citizen interests.

Tanzanians Minister for East African Affairs and Corporation Dr Diodorous Kamala explained “I have told our expert involved in the negotiation to be very conscious before they sign anything that may go against our national interest”

The Minister emphatically cleared that Tanzanians would only sign agreement and treaties that safeguard its national Interest

“These are very technical issues hat needs careful consideration,” said the Minister.

Dr Kamala took a swipe at people who were “ignoring the facts on the ground” while accusing the country of delaying the whole process.

“It is surprising to hear these allegations because the common market negotiation should have started in 2006 when consultant should have started in 2006, when a consultant was to study a protocol: However, talks only got underway in August 2007>when the model was presented,” Dr Kamala told a Nairobi publication the EAST AFRICA.

Clarifying the chronology of the events, Dr Kamala said that the discussion were further delayed when Uganda wrote a letter to the secretariat to deter the talks as they were preparing rot the common wealth heads of government meeting (CHOGM)

The political crisis in Kenya also complicated matters and added to the delay as many more meetings were deterred. And when the next meeting was prepared, Tanzanians was posting the8th Leon Sullivan’s summit and so we wrote to the EPC secretariat requesting a postponement, that they (secretariat) claimed no to have received the letter and went head and convened the meeting in Kigali/Rwanda which ended up been consulted meeting because one member, Tanzania was missing, “Dr Kamala said”

According to the laid down rule a quorum for any substantial meeting of the EPC requires the attendant of all partner states.

In essence if you look at the whole scenario, Tanzania has in no way delayed the discussions because most of the issues were highly technical and needed time to conclude.. even th4e experts tasked with the work have said it is bigger and tougher than they had anticipated” said Dr. Kamala.

Dr. Kawola had made similar statements at a recent public hearing on the EAC common market protocol in Zanzibar, where he alleged that there was a lot of “hypocrisy” and ‘selfishness’ in the way the integration process was being conducted. He said that even the Zanzibar hearing, the EAC Secretariat asked for more time.

The public hearing session in Dar-es-salaam follows similar forums conducted in Kigali, Nairobi, Bujumbura, Zanzibar and Kampala.

The Minister disclosed that the EAC Secretariat was in the process of engaging a consultant who would study how the service industry could be liberalized. The protocol on its own isn’t enough because there are schedules involved. Imagine, the schedule on goods took four years to complete. Now we have those on labor, capital and services.

Will Kibaki Ever Deliver a New Constitution?

In the firts year of Kibaki’s presidency,2002 – 2007, we were given several promises. Chief among them were:

* A new Constistution
* 500,000 new jobs annually
* 500,000 new housing units per annum

Deadlines and timelines to the above are now irrelevant as we all know nothing was achiweved on these and several others. Anglo-Leasing and other mega-scandals saw to that.
In February 2008, as he started his illegitimate second term Mwai Kibaki promiseed a new costitution within one year. All other promises were contigent upon a new costitution being in place. Kenyans can take consolation that there’s still one month left to the first anniversary of that promise. Will Kenyans have a new constitution any time soon?
We are waiting. Kenyans are known for their patiency.

2 Corinthians 3:2 ” You yourselves are our letter, written on our hearts, known and read by everybody!”

If such be who we are are, then we are expected to do at the very minimal the following:

1. Show the world that we are different in all that we do!
2. Be the peacemakers everywhere and not the trouble makers!
3. Be role models at home, school, work place, church and the community!
4. Speak, dress, eat, walk, think, write,behave and reason as disciples!
5. Be at the forefront in assisting those who really needs help. Yes indeed! We are our “brother’s keeper,” and must be willing to be the modern day good Samaritans!

Is this possible? Absolutely! But on condition that we remember the following:

-Without Christ, we will do nothing (John15:5.)
-We must “Let this mind be in you that was in Christ Jesus.”( Philippians 2:5)
-Examine ourselves daily “2 Corinthians 13:5)
-Surrender daily.
-Remember that we are but strangers in this world! “1 Peter 2:11)
-And the last but not the least,we have been called to “Arise, shine, for your light has come and the glory of the Lord rises upon you!” (Isaiah 60:1)

The question is, ” Are we prepared for this kind of challenge? ” “Are we willing to go wherever the lamb leads?”

Indeed! Weak and sinful as I am, I stand to be counted by declaring, “Here I am Lord! Please send me to the mission field as you deem necessary!” How about you!

This man Muthaura has no business staying in public office doing public services. He has defied all protocal and ethics of public service. Mr Francis Muthaura is appointing a team from former ECK employees to manage the transition of the proposed Interim Independent Electoral Commission (IIEC). He is opening old wounds which are still terribly sore. Mr. Muthaura is meddling with IIEC by appointing Mr. Chege back to Commission behind back doors to do a repeat of their dirty jobs as was seen during 2007 election fall out. Mr. Chege with colleagues in cohort as cartels almost drove Kenya to a deadly civil war with many lives lost as a result of their coup. Mr. Muthaura along with Chege and others blackmailed Kenya during 2007 Election, plotted a coup to overthrow Kenyans’ democratic election rights by installing Kibaki as President yet Kibaki did not win the election. It is clearly a known fact that President Kibaki did not win 2007 election. After all that has transpired, how could he Muthaura second Mr Chege back to the Commission? Do they think Kenyans both local and in the Diasporah with friends and sympathizers from Foreign Nationals are naive? This must be condemned in the strongest term and must not be allowed.

This is not a season time to fight or exchange hard stance. Muthaura and other power hungry lots want to take opportunity of this festive season to mess out Christmas and New Year celebration mood of peace, love with showers God’s Blessings. This is a defining moment people are tuned to recollect in both body and spirit, to spend quality time with family and loved ones in a sombre atmosphere which for 12 months is rare to families and is equally hard to comeby. Mr. Muthaura and company, with evil intentions, see it is fit to raffle the jungle by sneeking unwanted characters back into doing public service. Mr. Chege and team have been given red card to vacate public office and have been shown the doors. Muthauras’ action is not just messing with a household business but that of National standing and of grave public interest.

We feel we have been cheated and taken for granted for far too long by President Kibaki and cartel….. for this reason we want Mr. Muthaura, with immediate effect vacate the public office. President Kibaki should not hesitate to ask him to step down. PEOPLE DRIVEN FORCE MUST EVICT MR. MUTHAURA FROM OFFICE WITH IMMEDIATE EFFECT. Mr. Chege along with cohort and others should be arraigned to court to face charges of genocide and treason. Let us all in total condemn this act if we want to weed acts of impunity and chart-out forward-strategy formula for “the Kenya we all Want”.

By copy of this email, as a Diasporan speaker, sounding my voice on behalf of many voiceless across the Globe request Kenyan Public, Civil Societies, Human Rights networks, Faith Based as well as sympathizers World wide with Foreign Communities to stand-up with Kenyans to press President Kibaki to have Mr. Muthaura removed from public office with immediate effect. Let us not rest until Mr. Muthaura is removed and shown the doors. The likes of Muthaura have turned hardcores requiring iron fists. So we cannot apply diplomacy anymore here because they do not understand that language. They are incorrigible. The general public have endured and sacrificed too much pain, we will not go that route. They are too frail we will not contain nonsense from the likes of Muthaura who only understands force. Unless such stringent measured are strictly adhered to, people of Muthaura behavioural characters will never change to cope with PEOPLE’S DEMANDS. They are thick skinned and selfish. They dont care, they only care for themselves with their nuclea families along with their cohorts.

Therefore people, Kenya will not change unless we weed all these rotten characters from the Government system by force before they influence more rotten and lethal spoilers detrimental to Kenyans Peace we are painfully striving to restore.

The world cannot afford to let Kenya collapse because we still have 90% good people. Let us in solidarity deal ruthlessly if necessary with the 10% who do not want CHANGE who are glutton minded and are ready to go any amount destroying nature and lives so we can save 90% that are ready to accommodate CHANGE a lasting solution to Unity, Love, Peace, Security and tranquility which the majority 42 tribes in Kenya are longing for so dearly.

Let us not relent, since the force we have steadfastly pursued in the past since 2007, we are now able to see spots of emerging progress however thinly veiled.

Yes, we can take a short break and deal with this urgent matter before it gains ground. We will then all lookforward to 2009 pregnant of peace with unending Blessings from God.

Prime Minister Raila Odinga and the Head of the Public Service have clashed over defunct Electoral Commission of Kenya (ECK).
The PM’s office is accusing Mr Francis Muthaura of unilaterally appointing a team of former ECK employees to manage the transition to the proposed Interim Independent Electoral Commission (IIEC).
The PM’s office said Muthaura’s action was illegal and wants it reversed.
In a confidential memo from the Office of the President, 38 members of staff were redeployed to be “in the transitional team” awaiting the IIEC, which is yet to be constituted.
In the letter written on Monday, December 29, senior ECK officials totalling 38 were allowed access to their Anniversary Towers offices in Nairobi to oversee the changeover.
Of these, 31 are ECK employees who will band up with six officers from the Ministry of Finance and one from the Ministry of Justice.
The 38 officers form a transition team to ensure smooth changeover from the ECK following its disbandment by Parliament.
The memo asks the Administration Police officers at the offices to allow the listed staff, among them ECK Secretary Suleiman Chege and the Registrar of Political Parties Lucy Ndung’u, into the offices.
Barred from office
Former ECK employees were barred from accessing their offices after the Government sent them on compulsory leave.
The decision by the Government to send the more than 500 ECK employees home was reached after President Kibaki assented to the Constitutional (Amendment) Bill last Wednesday. An interim electoral agency is to be put in place to carry on electoral reforms.
Sources at the PM’s office said Raila was incensed at the new turn of events. A Press conference that he was to address was cancelled at the last minute as he flew to Mombasa with his family.
The letter reads in part: “Following the disbandment of the ECK it is now necessary that appropriate transitional arrangements, pending the appointment if the IIEC, be put in place to oversee cross cutting issues relating to assets, liabilities, obligations and staff of the defunct ECK.”
It further advises Muthaura not to allow any of the 22 commissioners and members of staff of the defunct ECK into the premises: “All former commissioners and members of staff are barred, by operation of the law, from accessing the records, offices and the premises.”

Muthaura messing up again

At this time in history when Kenya is beginning to recover and regain her steps in the world of normalcy,
Amb Francis Muthaura is at it again. How can he second the Mr Chege back to the Commission? IIEC is supposed to right the wrongs of ECK and to that extent, we do not need Chege to be anywhere near the new Commission. He is the single individual who, in partnership with Muthaura, almost brought this country down.

It is time Muthaura was shown the door, for the man is in his dotage and his usefulness to Kenya is now questionable. He is the single source of pain in the smooth running of the coalition government. He is the one who is fronting some other people to come in and spoil for war.

And he knows that the National Accord was signed between Kibaki and Raila as equal partners. Kenyans are watching keenly what next Muthaura will come up with.
