Orengo and Kimunya open legal battle over hotel sale saga

Folks,

I believe Kimunya is looking for more trouble. Going by the news, he prompted Orengo to act in the defensive. The Rt. Hon. PM Raila should have a formula for which to send such people like Kimunya to cells when they await finalization of their cases. His case is still being investigated, and here he is reshufling waters. He should await completion of matters at hand, (because he is being investigated in a host of a lot of things some of which are misuse of Government Office, lying with many twisting tounge, handling Public Property/properties like personal and private undertaking) etc., his conduct/behaviour in Public Office has been questionable warranting investigation. Consequently, I trust he should desist from stage managing arena for gambling. He is trying to create a fluid environment to cause to threaten people or confuse or corrupt the investigations. We will stay put until all reports are tabled.

There is no vacuum for meddling in this current Grand Coalition Government – so, if Kimunya cannot coil his tail, let the Government machinery show him how…………

This Grand Coalition Government is mandated to clean the house. There is no turning around or changing tactics. It is an obligation. Therefore, Kimunya is wasting time in playing tough – because he will, whether he likes it or not, melt down.

Yes, he needs to calm down……….

Orengo and Kimunya open legal battle over hotel sale saga
Published on 16/07/2008

By David Ohito

The stage is set for a legal battle between Lands Minister James Orengo and former Finance Minister Amos Kimunya over the Grand Regency Hotel sale.

Their lawyers sent demand notes seeking compensation for alleged defamation and threatened to sue each other.

Orengo’s lawyers wrote to Kimunya over a public statement that was aired and published in local media alleging that he had sought Sh3 million bribe from a city lawyer on July 6.

Through lawyer Pheroze Nowrojee, Orengo said: “The statements are untrue and constitute grave defamation. The allegations, which are completely unfounded and are of a serious character, have already been refuted by the other person mentioned in connection with it.”

Amos Kimunya Nowrojee’s letter demands unreserved apology, suitable withdrawal and that Kimunya should not repeat the publication of similar allegations.

“My client demands damages commensurate with this most serious violation and the injury caused and I invite your offer in satisfactory terms,” reads the letter.

Nowrojee says unless an unreserved acceptance is received within seven days, he would commence appropriate legal proceedings.

On his part, Kimunya’s lawyer, Mr Wachira Mari, similarly sent a legal notice to Orengo, accusing the Lands minister of libel and slander.

The former minister accuses Orengo of maliciously speaking against him on diverse dates in June and July and falsely claiming that the Grand Regency Hotel was sold secretly, undervalued and in contravention of the law.

Injured reputation

“Further, we have been instructed by our client that you altered a copy of the transfer document which you gave to the Press and superimposed a fake photograph of unknown black African male.”

Kimunya’s lawyer argues that Orengo’s words had disparaged his client as a Minister for Finance, MP and professional as a certified public accountant.

Kimunya alleges Orengo’s words portrayed him as corrupt, criminal, fraudulent and unfit to serve in the Cabinet.

– – – – – – – – – – –

James Orengo

“As a consequence of your publication, our client has been injured in his credit and reputation and has been brought to scandal, odium and contempt. Our client has been led to resign as a Government minister, the President has appointed a commission of inquiry into the sale of the hotel and the Institute of Certified of Public Accountants has threatened to expel our client from his professional calling,” the letter said in part.

Kimunya demands an unreserved apology through a Press conference retracting all published words and a sufficient offer of compensation.

Kimunya has since stepped aside as Finance minister to pave way for investigation into the circumstances leading to the sale of the Grand Regency Hotel.

Last week, President Kibaki appointed a commission of Inquiry, chaired by retired Chief Justice Majid Cockar to inquire into the hotel saga and make legal and administrative recommendations in a month.

The Parliamentary Committee on Finance, Planning, Trade and Tourism is carrying out parallel investigation under the chairmanship of Nambale MP Chris Okemo. National Assembly Speaker Kenneth Marende gave it two weeks.

RE: TINGA’S ECLECTIC AMBIANCE – 3T Effect

Dear Countrymen,

One gift that the Prime Minister in Kenya has is the ability to transform stumbs to carvings and shapeless stones to sculptures. The Tinga Touch!

When Hon.Raila was ‘dumped’ into the Ministry of Roads some 6 years ago, the Ministry was a minnow by then. He spent some few months there and in the face of all the technical and financial frustration, he transformed that Ministry into the powerful iconic Ministry it is today.

When the NAK coalition of Wamalwa, Ngilu and Kibaki was doing a lacklustre show in the initial phases, as soon as Tinga aka Agwambo steped into the scene, it trasformed into a political jewel overnight.

All Hon.Raila usually needs is a CHANCE. And once he has the chance he has a way of working things to bring about CHANGE.

Reminds me of a friend who usually says – if he applies for job, the only way to make sure he does not get it is to make sure he is not invited for an interview. Because if you do then that is it – he will always and sure get the job. For Tinga it is a Chance he needs. That is all.

Campaigns not withstanding, Kenya is yet to have its best President yet.

Talk of the Prime Ministers Office, many saw it as a minnow, powerless and toothless outfit, WRONG! It bites. And steadily we are all realising that that office is just as powerful and serves an excellent complimentary role to the presidency.

Look at our parliament today, is it not impressive? The Tinga Touch!

Let us give credit where it is due, whereas Njeru Githae is the most professional parliamentarian at the constituency level, Tinga is the most professional leader this country has ever had.

The Tinga Touch! – 3T

Whatever it is just let it get the 3T.

Unfortunately for some, the 3T is more like pure oxygen, it is fatal in large doses – corruption, procastination and empty rhetoric have no place when the 3T sweeps through a place. Ask guys at Treasury. Even minds are trasformed.

And the first person to notice was non other the President himself. Unfortunately his remarks were drowned in mourning since he uttered them just hours before the fatal crash that claimed two cabinet ministers.
He remarked that it is only Raila who seemed focused on the burning issues affecting the coutry whereas the rest were just steeped in what MM (Musalia Mudavadi) calls high voltage politics.

Why hide, politically there could be issues, but President Kibaki likes the way Raila does things. And as an educated person he takes it positively as opposed to the former who has harboured a kienyeji grudge since he ran into the 3T tractor some years back.

We wish our PM well in this delicate phase of things and we are confident that he will pull through as he always has and will.

The sun shall rise over our nation again and the moon shall never wane in the darkest of night.

3T! Godspeed!

LUO ” ELITES” IN SHOW OF MIGHT IN CITY PUB

BY JEFF OTIENO IN KISUMU

Some clique of Luo professionals working and residing in Nairobi are molesting and harassing clients in a city pub ( KUCHE KUCHE ) situated in the precincts of Nyayo National stadium Nairobi with glee.

Following persistent complaints from regular clients of that joint this Journalist decided to sojourn there to unearth the aggression of the chest thumping clique most of them Lecturers, Consultants, Insurance Executives with traces of marital glitches.

Inside the main tent there’s an exclusive table preserved for these clique of chest thumpers. Interestingly, the zone housing about four tables have no reservation indicators to may be restrain or direct first timers who could be nursing interests to sit in the “exclusive area.”

In a view to provoke the tormenting cartel, in the company of other two colleagues this Journalist decided to go there a little bit early and sat deliberately in the “exclusive zone”.

A waiter who seems to be working in conduit with the “elitists” group came to us running and on reaching just ordered us to stand up and go to where we ” belong”.

“You don’t belong here stand up and go to another table”, she thundered without even having the decorum to even welcome us as their clients.

We stood our ground to the chagrin of the bragging group who had come and had sat in the next table (zone) where they feel they don’t belong.

We could see them arguing who we were. A bid by another waiter who is part of the clique to make us bow to their demands was thwarted by a level headed bouncer who adviced them otherwise.

Sources confided to this scribe that the said cartel have no grass root structures in their rural homes and they hardly frequent. Though they are said to be proud owners of state of the art homes in the heart of the capital.

Re: I had a bad dream!

Today, Monday, July 14th, 2008, I woke up at the wrong side of the bed!
I woke up tired and scared as a cat that had been running for her dear life from a fierce and hungry dog.  I was awakened by a very bad dream!

Dream! Are they for real!

I know that both the Old and New Testaments contain several accounts on how God at sundry times spoke with His chosen people through the medium of dreams!  We even read of two-Joseph and Daniel-who had the gift to interpret dreams!

Ever had a dream! I know that the good Lord has continued to speak to His people through this medium. As many can testify, there are dreams that one would wish that they were real, while there are others that one would wish that they were not. The latter, is the kind I had this morning!

In my dream, I found myself in one of the homes where people had gathered to comfort a bereaved family. While there, food was served that I was also invited to take part. Seeing that I had just eaten, I refused to eat.
But the person insisted. After I stood firm, the person walked away so irritated for reasons I would not understand.

After some time, I excused myself and left. As I was going home, someone came running in need of talking to me. “You are indeed a man of God!” the guy said as I wondered what in the world he was talking about. “You are a very lucky person!” he continued to say.  “What do you mean?” I inquired! At this point he shook his head and revealed that the food that I had refused to eat had poison in it. He went on to say that the person who was insisting that I eat the food had put some poison in the food! As my heart started pounding so hard, I woke up only to find out that it was
a dream-a very bad one indeed.

But why such a dream! I don’t know! All I know is that the man of Galilee continuous to fight for His children, of whom I am one of them! Don’t you believe so!

As for me, I do!

What they’re bragging about

Obama for America

Dear Readers,

The McCain campaign is bragging that they are out-raising and out-spending us.

By collecting huge checks from Washington lobbyists and special interest PACs, they raised more money than ever before in June. Combined with the Republican National Committee, they now have more than $95 million in cash on hand.

I recorded a short video in my office about what we are up against. Now is the time to step up and make your first donation to help us close the gap.

Please watch the video and make a donation of $25 now:

Together, we have already accomplished so much in this campaign. But we cannot take it for granted.

This grassroots movement won’t just happen on its own. It’s up to you to make it happen.

Thanks,

Re: Fw: Loss of morals; I accuse the government

In the recent past, both the Nation and the standard have come up with details about the loss of morals amongst the youth of Kenya. This is a sad case because, our complaints about the content of TV music has gone unheard by the government and the same media now complaining.

Last Friday I was privileged to be in my house fairly early in the afternoon, and I tried changing channels on my TV so that I could get something reasonable. I failed.

All the channels, NTV, KTN, Citizen, KBC, K24 et al, had lurid music where people fondled, kissed, slept, and sang almost naked, and the word F*** was mentioned after every two words.

We have made as much noise about this. I even wrote to all the Station Editors and the Ministry of Information and Broadcasting complained about the content of such music, but no one ever responded, leave alone taking corrective measures.

The end result is the kind of loose morals we are seeing amongst our kids. They grow up aping what they see and hear on TV. They think that this is what must be done.

Secondly, music industry has been invaded by quacks and journey men. We have young artists competing to be called celebrities. Things are not made any easier by the journey men in journalism. If you open copies of the Nation and the Standard on Fridays, we have a page competing with obscenities. The language is foul, in bad English, yet it is meant for the youth!

How do you give good example by playing bad? The results are what we are seeing today being manifested in our youth.

We have some young artist doing really fine. I have no reason not to listen to Nameless, or Iddi Achieng. They play good music. The language is civil, and the message is apt. But not all these other young artists.

Thirdly, the government has abdicated her responsibility as concerns censoring the TV content. This has been left to journey men, people who have no moral standard, know nothing about kids upbringing, have no children of their own, and as such, cannot judge what is good for society.

What do you expect of a child editor, someone who grew up without strict supervision? Can he be the yardstick by which we want to judge and shape the future of our kids?

Fourthly, the government made a mistake to ban canning in schools. We grew up with the cane, and it shaped our sense of duty and our morals. Even in the Bible, it is stated, spare the rod and spoil the child. We have chosen to spoil our kids by sparing the rod.

I would be happy for the media to lead from the front. There is little worth in complaining about what you have actively helped to create. If you believe that the kids are truly getting spoilt, start by banning those nude music shows that you feed to our kids.

Secondly, have all movies that you give to the public censored for content. Remove all the lurid scenes and foul language. Thereafter, you will have the moral grounds to cast the stone.

Otherwise, you stand as guilty as the government in abdicating you social and moral responsibility to the society.

Dear Odhis,

I do concur with your deep sentiments on matters morality and the sort. On the flip-side though I do not wish to blame those involved but try to offer my two-cents worth of part of the solution.

First, I never blame the kitchen knife, gun, glass, human beings,HIV/AIDS,sex,money,nudity nor alcohol..for all our ‘sins’. The problem would rather lie with the attitude that we have toward the above mentioned issues. For example, would it be right to blame the kitchen knife just because ‘mwikali’ used it to stab ‘Wanjala’?

Should we blame,money,sex,nudity,e.t.c on the youth or media? What if I as an individual am obsessed with pornography, drug addiction and alcoholism. who is to blame?

Personally, I have NEVER smoked bhang or treated for a sexually transitted infection…e.t.c (Not that I’m good and pleasant, but when I was growing up I chose to have a focus in life, NOT faith related-in fact I’m an Atheist, but with deep personal principles that help me to live a happy life even with little resources that I may be having). This is a sincere personal conviction to you. Many only fail to have life goals with or without the drugs and women around. Do I have to sleep with a woman just because she is naked and ready for me and the environment is viable for that act? NO!

To be precise, sex is good when used correctly, not just for fun, same to money, a glass of wine or kitchen knife….Just my point of view but I do NOT dispute your genuine concern.

Regards,
Mundia.

For those of you who care to know, this is a system that was hatched many hundreds of years ago against the black person. It is called “Breaking” It uses a theory that, if you want to lord over the black person then the first thing you have to do is to “break” him. In the old days what they did was to kill the black person infront of many others then pick one amongest the remaining ones, and beat the hell out of him, ili iwe funzo kwa wengine wanao nuiya kukataa kusalimu amri.

After this they then “broke” the woman. This was done with the aim that subsequently the woman would subconciously break any of her new borns so that generations after generations would “salimu themselves to amri without the presence of the Master.

Well those times are gone and now they do not need the black person. So an agenda has been set for the destruction of the Black person. This is being accomplished through desease, drugs and guns, while on the African Continent it is done through. supply of guns to many mad leaders who end up butchering their citizens in frenzies similar to genocide, and now more recently a system has been put in place which makes sure that Moral decadence is thrown out the window. Sex and homosexuality then becomes the every hour consumption for Kids on National media.; The project involves also stopping discipline in Schools and increasing immorality there. The aim of this is to Break the child and prepare him to an earlier grave. It has worked sucessfully in Kenyan homes and schools. In short there will be no future Leaders and the society will collapse.

It is Psychologicall. It works with the mind of the Young people.

Kenyan leaders are big fools to let this go on. It is called the “Willie Chip” I urge you to reaearch on Willie Lynch.

Re: The enemy from within!

Conventional wisdom assumes that when everything else has failed and the enemies from outside are after ones blood, the family members and friends are supposed to stand by and at least give some kind of support.
But Biblical archives and daily experiences say otherwise!

Throughout the centuries, many have been so hurt and disappointed to know that their down fall or troubles were brought about by those least expected. Take a look at the following:

*Genesis 4:8 Tells us that Abel, son of Adam, was killed by his own brother
*Genesis Chapter 37 tells us that Joseph was sold by his own brothers
*My elder brother, friend, and the man from Galilee was was given hard time and was opposed by his brothers, religious leaders and some of His disciples.
*In his zeal and passion to plant churches, the apostle Paul became an enemy to many and was opposed and given hard time by those from within

HOW ABOUT OUR TIME?

*Many religious leaders and pastors have been taken a back to know that those behind their sorrows were fellow colleagues.
*Many Christians have been shocked beyond belief to discover that indeed some of the brothers and sisters in Christ don’t like them. Worse still, they wish them evil.
*Upon promotion, good lucky,or a sign of doing well, many have found themselves facing several challenges only to discover that the one behind all this was one they considered a friend.

The solution to all this is to pay attention to the words of our Lord-Jesus Christ, the man from Galilee: He said: “and a man’s enemies will be those of his own household.” Mathew 10:36

As we go about our daily lives, let us remember that not everyone is happy with us. We should therefore be cautious, talk or share less, and depend entirely on the man from Galilee. Shall we?

Just a thought!

Kenyans in the west(Europe, USA etc) will be affected mostly by Kibaki`s new alliance

Kenyans,

This new Kibaki`s Alliance with Iran`s president Mohmond Ahmadinajad, Muammar Gaddafi and even the chinese president Hu jintav will not bring a lot of positive side effects to Kenyans hopping to join Europeans or USA Universities, or Kenyans hopping to do good business with the west. Infact it might even affect the already Kenyans living in Europe or USA in future. Visas to USA or Europe will be almost impossible to get if Kibaki do persue this type of relationship.

IRAN or Libya have no high technology, neither do they have distinct universities which will compensate the now USA or European universities already accomondating Kenyans today. Another point is that Kenyans will hardly have any opportunity to get jobs in these two countries, you can even forget about china at the moment already.

Another point is that these countries do not know what is called democracy we Kenyans are now fighting for today. Iranian women hardly show their faces in the open, human right abuse is more than enough. China is even taking weapons to kill people in DARFUR. what the hell is Kibaki thinking. And why should Iran have an oil refinary in Kenya at the time USA or Isreal are already thinking of striking Iran??. Is Kibaki realy thinking a head or just for today?. Kenya has had very good relationship with Israel, and let us not think the Israelist will still maintain that if we open all our doors to Iranians.

Re: The Sagana Factor

Sagana State Lodge. It’s somewhere out there in Nyeri. A rich colonial history. I don’t know who owns it, but it doesn’t matter. What matters is what was said there by the ODM Leader and the President back in February, about a month after Kenya had undergone a wave of bloodletting unseen in Kenya since independence. As the two protagonists met in that secluded lodge, they’d left behind an anxious nation that was literally begging for a way out of the political impasse that had engulfed it for weeks. Both of them had haggled with their lieutenants for a softening of position, and both had been held hostage by the intransigence of their communities. Yet both realized that for Kenya to work together, some very serious negotiations had to be slapped on the table and difficult decisions made.

I revisit the meeting that took place at Sagana between Kibaki and Odinga because you won’t understand the road-map to 2012 until you come to grips with what went on at the state lodge, an edifice given to Kenya by the Brits. Impeccable sources have confirmed that the meeting at the lodge was like the meeting Jomo Kenyatta held with Moi in Gatundu before the founding father of the nation left to meet his Maker. Historical accounts have it that it was in Gatundu that the late founding father promised to pass on the torch to Moi if Moi signed on to protecting Mama Ngina and the children, the wealth and the wider Agikuyu community. Moi, being the humble and cunning Vice President that he was, accepted the terms of the old man. And so Mzee Jomo Kenyatta beat back the Ngoroko and other nefarious Mt Kenya organizations that sought to deny Moi the throne.

Fast forward. After the unprecedented death and mayhem of December and January, it became obvious to the thought-leaders in Central Province that the community had veered too far off track and was marching away from the rest of Kenya. The wise men in the community therefore started seeking ways to make amends. To these wise men, there was no way to make amends without making the Prime Minister central to their schemes. It is in this light that President Kibaki and the ODM Leader sat at Sagana and drew the map right into 2012. What I can reveal is that the clamour to install the Prime Minister as an Agikuyu elder is a leaf out of the Sagana playbook. I can also reveal today that barring any unforeseen circumstances, the coalition President Kibaki and Prime Minister Raila Odinga put together will ride on into 2012, or until those two gentlemen decide it’s time to implement the Sagana Plan. And by the time the Sagana Plan comes to fruition, the son of Kenya’s first Vice President will be the new President of Kenya. You can take that to the bank.

But it’s now clear that a section of the ODM coalition, especially members of Parliament from the South Rift, are very unhappy with the incremental rapprochement between the Big Two and the general realignments taking place on the political landscape. What our friends from this corner of the Rift Valley may be failing to take into account is the fact that the Prime Minister has in mind a coalition that brings Kenya together. A national coalition. He’s already a Luo elder. He’s an Arap Mibei. And soon he’ll be an Agikuyu elder. What you see emerging is the beginning of something that should have taken place right after independence…the birth of a nation. The fulfilment of The Mau Mau Prophecy. For forty five years we’ve been led by men who failed to create cohesion and understanding between us. Men who watched with glee, and even cashed in, as Kenyans fought Kenyans. That will change starting 2012, or sooner.

Given the significance of the Sagana Plan, it is now crucial for Kenyans to create a pathway to lasting peace. The fire and brimstone rhetoric that has characterised our discourse as a nation must now give way to development and honest healing. Of course there will be moments when we must shout like hell to correct a wrong, just like we did with Kimunya, but even such nuclear option moments must be conducted without attributing the sleaze of one man to an entire community.

Does that make sense? I think it does.

So as we look into the future, let’s be optimistic and proud of where the nation is going. The foundation of a stable and prosperous nation was laid at Sagana. Yes, this is a classic case of something good springing out of a truly desperate situation. The future is now ours to shape. We will only fail if we allow the squabbles and the disappointments of the years gone by to cloud our thinking.

Let’s all go to Sagana!

For Love of Country,

Sam,

Let the players tell the tale of Sagana Lodge. Let it come from the horses mouth. It will go down in History and people will judge them squarely. People will respond unequivocally rather than when it comes from third party it may take equivocal turn of event. It may be dismissed as mere rumours. That does not imply there shouldn’t be question marks.

Kenya is for Kenyans, Kanyans are now informed, it is no longer the days of the old The Civil Society is up and about. One man show is no deal. Kenyans have woken up from slamber and are getting out of slavery. Deal or No Deal, Kenya is destined to forge development for all irrespective of who is who. It will take a little while but it will never be the same again. The dew is drifting.

Re: Fw: Open Letter to President Kibaki

 Dear President Kibaki,

I am writing to you this email letter with a heaviness of heart.

I have been watching the drama of political turn of events in Kenya with amazement and sadness.  I along with others including those voiceless Kenyans were expecting that you take an immediate action on Kimunya after a Vote of No Confidence to save Kenyans from the state of collapse by instituting right measures of transparency but this was not seen as a priority matter of concern in your Agenda. Instead, you decided to host Mt. Kenya Mafia a tribal grouping to the privacy of your State House a move construed by many to mean a designed scheme to dwindle away from reality and deprive Kenyans of their DEMAND and achievement to Transparency, Justice, Human Rights and Good Governance – a contrust of expectations of Kenyans in their quest for the same.    Your silence up till now speaks volumes, and your behavioural attitude is highly questionable.

Will you do service to Kenyans for once? The whole world is watching this this your act of autocracy to dominate in your Rulership, a situation contravening your agreed share of 50/50 Grand Coalition Government regardless of the try/error factors for a second chance. Kenyans willingness cooperation backed with Koffi Annan and Team intervention, along with The Leadership of American Government pressing on motivation factors for compliance, and as stated in signed agreement on a Grand Coalition Government Document, you continue to steer around consequences upon which you contravening the principles and continues to suppress the Kenyan Republic is clearly a manifestation of your deliberate actions of incompliance.

We have seen the Ministers from ODM section of Ministries to be operational serving the Public as is deemed right but under duress and extreme strained fear from your section. This culminates from your oppressive interference and by your PNU cartels. We have also seen your sluggishness in handling prime matters of National Importance which calls for serious concern requiring urgent intervention.

Your behaviour is undermining and frustrating the ability for Kenyans to institute their skills and talents in order to forge ahead with Developmental Agenda, with the first item top on the list “the Constitutional Reform Policy enactment” – so to institute Constitutional guiding principle for Democracy to reach millenium goals as budgeted in the past. In the wake of this scenario, Kenyans will never rise above abject poverty a condition in which they are now in, and in extension, putting Kenyans in a state of hopelessness and subjecting the Nation of Kenya to brain drain.

In my view, this conception requires an explanation to the people of Kenya and the world an evidence of which actions should be taken against you. You also need to explain further, why Citizens of Kenya should not resort to International help to force you out of office as well as ask their Parliamentarians Legislatures to prefer a Vote of no Confidence, so you step aside and provide for an investigation so collective action be taken against you on your wanton behaviour which is totally out of place.

By copy of this email, I request the good office of the United State of America to join with the rest of Kenyans, Africa and the World in their Foreign Mission to intervene in a special way and do the needful.

I have also attached YouTube Videos and Cuttings from the Local Kenyan Media (Newspapers) for your ease of reference.

Thanking you all in anticipation to resolve this ugly mess in Kenya.

I love you all and may God continue to Bless you.

Sincerely,

Michuki takes over Finance docket
BY ANTHONY KAGIRI

NAIROBI, July 11 –

President Mwai Kibaki has appointed John Michuki to the Finance Ministry in an acting capacity.  In a statement from State House, the President also appointed Public Works Minister Chris Obure to double up as Roads Minister. Michuki will also continue to head the Environment docket to which he was appointed in January this year. The appointment to the Treasury follows last Tuesday’s resignation of Finance Minister Amos Kimunya who was hounded out of office after the controversial sale of the Grand Regency Hotel. The roads ministry fell vacant following the death of Kipkalya Kones who perished in a plane crash on June 11.

Re: Police teargass Bunge la Mwananchi Jeevanjee meeting!

Dear Kenyans and friends of Kenya,

Bunge La Mwananchi¢s Jeevanjee Gardens meeting ground was the scene of scuffles with the police yet again today, 11th July at 1.45pm.

Bunge La Mwananchi members had gathered for debates at their ussual meeting place in the park. Their discussion at that timewas about Witchcraft and Superstition.

The participation huge (could be estimated at 250) this maybe because of the amazing tales of witchcraft and superstition as different communities narrated their stories.

While members were engrossed in the debates and counter debates, the police officers from Central Police Stattion showed up an announced and ordered our members to disperse threatening to beat them.

Some of the people scampered for safety, but we urged our members not to obey that order. We told the police officers that we were not going to comply with their orders because it violates our civil liberties, our individual and constitutional rights. We told the police officer that Jeevanjee is park where Kenyans who cannot afford something to eat come to while away their lunchtime break before they go back to work. We also meet here to discuss matters that affect us individually and communally, and that is human right.

When it became apparent that we were not going obey their orders; the officer stepped aside and called for reinforcement. In a shortwhile the Officer in Charge of Station (OCS- Central) appeared with another contigent of 6 anti-riot police. They rained teargas in our meeting place dispersing everyone caught in the melee. They attempted to arrest Samson Ojiayo but on second thought they let him free ( FYI we have some parts these caught on camera).

When the tension had eased, after about 20mins, I approached the OCS to demand an explanation over their repeated attempt to restrict Bunge La Mwananchi¢s meetings at Jeevanjee Gardens, yet this our traditional debate venue and meetings have been held there in the past without police interference.

The OCS indicated that he was receiving and acting on orders from his superiors as far up as being above the rank of PPO. It is good to quote him here, said in swahili: ” do not ask me questions, I have a job and my job is to make sure you do not meet here”, “I told you that you should find alternative place to meet not in public square where you disturb people”. “We are not going to arrest you so that you can make money…we will know what to do”. He further informed me that if Bunge La Mwananchi wanted to meet in peace it had to be registered so that they can know who we are but they cannot be permit us to just exist.

On further persuasion, he also informed me, said in swahili: “personally I am not against you meeting here. I received orders and I have told you that before”. Then he added that if any complaints were to be lodged by Bunge La Mwananchi they would have to be lodged with his superiors as far above over the rank of PPO for anything to be done.

It is important that I mention that since 31st May 2008 after Bunge la Mwananchi held a peaceful protest against unchecked increase of food price, the protest which was violently disrupted and also had our members arrested by police officers; there has been a concerted effort by the Government of Kenya machinery not to allow us to meet. Our members continue to experience police harassment and threats; sometime our members have been arrested and kept overnight in the police cells only to be released without prefered charges in the morning. We have had also incidences of plain clothed police giving threats that our members are going to start disappearing like Mungiki. Till 630pm we had police stationed at the park to make sure we do not meet.

This trend reversed or subsided a little for a couple of days when Hon. Julius Kones demanded a ministerial statement in parliament from the Minister for Security on why the police were harassing and threatening Bunge la Mwananchi members. The Minister for Security was not available to take the question. However, it seems the police officer have gotten new energy and they are back to harass us.

This is a systematic determination by the government machinery to role back our democratic gains by cutting back our civil liberties, individual and constitutional rights. This should and must be resisted. We are calling on Bunge la Mwananchi members and friends both at home in diaspora to come to our rescue. We need to go to our courts for help. We need finances to carry out this. We need legal expertise. We need some ideas on how to frame the issues. We want your support…please get in touch with us with whatever support you can give or find out what you can do.

We will definately ensure that we carry our activities according to the existing law. Time for political chaunivism, confrontations, clashes with police etc are over. We need now to embrace a new political dispensation of progressive politics of patriotism , democracy and development using the exisitng channels. The police have a role to restore law and order and not harrass people like this even during this time of peace.

We must recognize the effort that was done by our forefathers including Mzee Jomo Kenyatta, Oginga Odinga – the doyen of opposition politics, Joseph Murumbi etc. We must also recognise the second generation including Martin Shikuku, Charles Rubia, James Orengo, Raila Odinga, Gitobu Imanyala, Paul Muite etc who fought through the street amidst tear gas and thrown in jail several times, suffered the dictatorial regimes. The job was not finished. We are here to complete this mission.

Its true and a reality that the current crop of leaders are not going to finish the job. They are recycled products and have no regard to the ideals of what these second generation did -planting the seed of democracy. The mantle was passed to us – we are the generation to finish the business, and usher Kenya to a complete change, patriotism, democracy and development and far above ensure that the spirit of pan africanism is rejuvenated.

The constituion review has remained where it was left at Bomas…..and yet the same faces that were defeated to launch it are promising the same time and over again. What we are instead seeing is Grand Regency, Immigration, etc – all in the name of corruption.

We are now seeing a band of current political entertainers who owe allegiance to nothing except their pockets. Who do not regard the common plea of the ordinary Kenyan. Who do not embrace the ideals of being Kenyan. Who are fond of discussing personal issues in Parliament and not upholidng the spirit of patriatism, democracy, and development. We are seeing a bunch of people who do not have an agenda on any day for the development of the nation. We are seeing leaders who do not see street children, beggars, poverty disease etc. We are having leaders who do not know what is happening in the underground corrupt cells of Nairobi City Council. We have leaders who use chopper and are not seeing the road to Kisii, Kisumu, Mombasa….even the potholes next to Parliament. I am glad that we have leaders who do not have an agenda for traffic jams and provide a strategic plan.

What Kenyans need is real change from the traditional ideas of confrontation and start seeing one another as champions of democracy and development. We need to refocus ourselves to the current global development and make sure that we position ourselves not only in domestic issues but also ensure our struggle result in good result. What Kenyans need is not coffee talk shows. What Kenyan need is not to see the leaders use their money to start 2012 competition. Martin Lunther said ‘ what have you done for others today’. I re-phrase the question – why start this campaigns when we have done nothing as yet?

We recognise the need to have social grouping with real agendas that promote this ideas and ensure that our needs are well addressed. Social evil in our midst need to be stopped by all means and purposes. Dialogue and not clashes with police should be embraced.

By the police stopping Bunge la Wakenya is tantamount to what we have fought and won in the past. This is not the time to see police with tear gas and helmet with rungus chasing their own brothers and sisters on the street. Its time to have mature reasoning and use different mechanism to get our message across. We might not have been luck to be born into well to do political families. We havent inherited any political plate. We are the under-dogs. Down cast, negelcted, forsaken and destitute. But we believe that God has a plan that is unshakable. Our nation is a citadel of peace, a lighthouse from where the beams lights Africa. We are not ready to let that go. We need to have the torch send sparkles of change. One of my favourite Evangelist said ‘Change is painful, persistent, powerful and yet permanent’ Its also time for Kenya and Afrika.

And this is the spirit come 2012 – WE NEED A DIGNIFIED PARLIAMENT THAT WILL CHANGE OUR DESTINY, PROVIDE RESOURCES EQUALLY TO ALL KENYANS regardless of tribe, age, education, gender, sex, or religion.

BREAKING NEWS Kibaki makes cabinet appointments
By Online Team

President Mwai Kibaki has appointed the Minister for Environment John Michuki to also act as Minister for Finance.

The Minister for Public Works Chris Obure shall also act in the Roads¢ docket.

The appointments were announced through a press release by the Presidential Press Service and will take effect immediately.

The Finance ministry appointment comes in the wake of former Minister Amos Kimunya¢s resignation on Tuesday to facilitate investigations into his role in the sale of the Grand Regency hotel to the “Libyan investors”.

The Roads portfolio became vacant last month following the death of former minister Kipkalya Kones in a plane crash.

President Kibaki has appointed a commission of inquiry into the controversial sale of the hotel to specifically seek to find out the roles that Kimunya, Central Bank of Kenya Governor Prof Njuguna Ndung¢ u and Mr Abuga, the bank¢s board secretary played in the sale.

Last week, Parliament passed a vote of no-confidence in Kimunya, accusing him of irregularities in the sale of the hotel, the Safaricom IPO and a money printing deal with De La Rue.

Earlier a Cabinet committee chaired by Prime Minister Raila Odinga had recommended the resignation of Mr Kimunya and all other public officers involved in the sale.

My dear sister Naomi,

you are absolutely wrong on the “Longetivity in service” issue. Case example: John Michuki — he has occupied senior govt positions since the colonial govt. Tell us how Kenya has benefited economically or otherwise since independence because of his services? Are you aware that Kenya retrogressed 24 years back while he was part of govt?

Also, Kimunya is a terrible example to give — there’s a big difference between leadership position and pawning. FYI Kimunya was a pawn of Kibaki and had not been granted any powers to execute his Finance office. He basically did what he was told, and that’s why Kibaki is suspected to be the “Libyan investor”. Open your eyes Naomi.

Michuki is the wrong person to be at Treasury.

As the world moves forward, Kenya is retrogressing into the old age, where techno-savvy decisions are of no benefit to us.

This is a disappointment. If the seat was tailor made for one from Central Kenya, then we still have many techno-savvy guys from that part of the world, people who can move with the current pace of world trends.

Michuki is a colonial relic, and his knowledge does not fit in at Treasury.

Re: Lessons from a mistaken fruit!

For reasons I can not explain,I dislike peaches. And so the other day,my wife brought in what I thought was very good looking peaches. My dislike for them would not allow me to even think about them. I therefore told myself to leave them alone.

And so today after taking lunch, I laid on the sofa for a siesta. My wife started eating the fruit and offered me some. My reaction was quick and very negative. But she persisted and went on to say that it was indeed
a sweet fruit. “I don’t care for peaches,” was my response. “This is not
a peach,” answered my wife. “It belongs to the family of peaches but not one as such,” she added as though I needed to know all that.I agreed to taste and sure liked it. Do I need to say that I looked stupid and ignorant! What I had all a long thought to be a peach was a nectarine-
a very sweet fruit indeed! After I tested and liked it, I went for some more!

This incident reminded me of Psalms 34:8, “Oh taste and see that Jehovah is good: Blessed is the man that taketh refuge in Him.” Psalms 34:8.

Just like I did, there are some people out there who have closed their ears and hearts to certain doctrines. They have heard so much about them that any mention of any one of them only irritates. Such doctrines include but are not limited to the 7th day Sabbath, the state of the dead, health reform, tithe and offerings, and many others.

There are some others who tasted the Lord once and for various reasons went back. Since then, they are so bitter with God and anything church related. Any little mention of it, just irritates them.

Whatever your situation is, I hope that my negative attitude towards
a fruit so sweet may be a lesson to you as well! Do you see my point!

Just a thought.

Why Should Christians pray, support and vote for Senator Barrack Obama?

By Rev Okoth Otura

Toronto-Canada

As the American citizens head for the poll this coming November 2008, there are a number of factors that the Christians across the world might expect them to consider before casting their votes.

• More importantly, will the next President of America protect Israel and foster peaceful navigation for the world crisis?

• Will the next President of America positively influence and back the magnitude of social and humanitarian programs being ran by the Christian Faith based Organizations?

• Will the next President of America Broker peace and confront the general distrust of the growing tensions between different religious in USA and the World?

CDM-K however, sees Senator Obama as a believer of the Cross of Jesus Christ, who as openly confessed Christ as his Lord and savior and therefore we feel that he can bring about solidarity between the US and the World at a time when the world desperately needs solidarity to deal with war, terrorism, social issues, diseases, poverty and ignorance.

Senator Obama is the right choice who can promote the Christian-democratic perspective in the USA and maybe across the world, for he has demonstrated his faith and hope in the Lord Jesus Christ in all his relationship and work with the church and communities.

CDMK is convinced that Senator Obama can bolster and actively generate Christian-Social and political solutions that can contribute to the well-being of the global village.

CDMK believes that Jesus Christ calls us to follow Him in every area of our lives, including the realm of politics and therefore, since the Americans still lack a true Christian Political Party, Senator Obama deserves their prayers, support and their votes.

The CDMK also believes the Bible is certainly not a political program but the teachings of Jesus, nevertheless, it provides the fundamental elements for just governance, political authorities, including those in power now, are called to work in this spirit and serve the people of God in their pursuit for justice and freedom.

CDMK recognizes that the Kingdom of God cannot be simply identified with any political cause; but we affirm that it demands the pursuit of just government and the promotion of a well-ordered society, the same quality which Senator Obama has demonstrated in his lifestyle and campaign trails speeches.

CDMK rejects the idea that religion is merely the individual’s private affair. The Christian faith has been fundamental to North America and world society and is irreplaceable. Christian faith influences and shapes the character of humankind, the said which Senator Obama publicly has confessed.

Hence, CDMK bear a responsibility to affirm our prayers and support to Senator Obama in accordance with our understanding of his approach and commitment to transform Christian-Social political principles in the US government.

For the above mentioned reasons, we therefore appeal for all the Christian Political and faith based organization leadership across the world to pray and support Senator Obama.

CDMK further humbly appeal for the entire Evangelical and any other Christian faith-based organization in USA to vote for Senator Barrack Obama this coming November 2008 as the next President of the United States.
