Message from Derrick S. Boone, Ph.D.:

Greetings,

I wanted to let you know about a great opportunity here at Wake Forest where you can get a FREE education and get PAID while you’re doing it. Our Dean of the Schools of Business is the former CEO of PepsiCo and very committed to diversity. He’s gone around to his CEO friends, who have agreed to donate a bunch of money to pay tuition and fees, provide a stipend, and a job, to diverse students. The details are below. The problem is, response to the program has been dismal! As a faculty member, I would be embarrassed for him to have to tell his CEO friends, “thanks so much for your donation, but unfortunately I have to give it back because we couldn’t find Any students who wanted it.” So, I need your help. Please contact me if you, or ANYONE you know is interested in the program. I want to help out as many young scholars as I can. Don’t worry about whether or not you (or they) have taken the GMAT, etc. All you need to do at this point is JUST APPLY.

About the Program:

The Master of Art in Management program is designed specifically for liberal arts majors only. The MA degree program is a 10 month intense study of the basic functional areas of Business. After graduation and working for approximately two years, all MA graduates are eligible to apply to Wake Forest as part of the MA/MBA joint degree program and get the MBA in one year. The new Dean, Steve Reinemund, has created a new scholarship for diverse students pursuing the MA degree called the Corporate Fellowship.

The Corporate Fellowship provides full tuition and a $21,000 stipend to cover living expenses. Additionally, each Corporate Fellow will participate in a practicum. The practicum has two components, educational and professional development. Each student will be assigned a mentor that is a high level executive with their sponsor corporation. The mentor will oversee an educational project covering 4 of the functional areas of business using their own corporation as the subject.

The student will visit the corporation 3 – 4 times during the program to present his/her results of their research project. Additionally, the “professional development” component of the fellowship provides career coaching and leadership development for the students.

The goal for the corporation is to be able to groom and hopefully, hire a top candidate from a diverse background for their organization. Of course, there is no obligation that the students accept any offer of employment. Still, the student benefits, even if they are not ultimately hired by their sponsor corporation in that they have the MA degree and the type of experience that will make them more marketable.

Kibaki, Raila tie reform agenda to a bigger dream

General Kaguoya

With all due respect, I would like to assure you that your HWY V-2030 South, is a fantasy dream sir. You said a whole lot of stuff to implement by 2030 but to my amazement you didn’t mention any plans you may be having on how to elimenate corruption, neportism/tribalism, insecurity and how you are going to creat jobs. How are you going to implement these so called reforms before you even curtail let alone control corruption? There is no country which can succeed socially, politically and economically with corruption peaking almost 200%. Your fantasies will only lead us down south instead of the other direction. And, Raila is absolutely wrong to refer to you as a reformer. What have you reformed so far? Tribalism and corruption, the judiciary, public infrustracture are even worse than the old Nyayo days. You have spent millions and millions of the poor farmers and tax payer’s money on the consistitution commissions and to this day nothing has come out of
those money swindlers commissions. Our healthcare facilities are in a dilapidated conditions worse than those of Zimbabwe or Haiti. One can’t even find the simplest antibiotic (aspirin) in most of these facilities. You recently renewed the contract of the anti-corruption czar again the wishes of the Kenyan people. This fellow was suposed to be Kenya’s watchdog for corrupt folks. But did he deliver his dues? Agwambo should take back words (Reformer) and apologize to Kenyans as a flip of the tongue.
Best wishes with your fantasies!!!

President Kibaki and Prime minister Raila Odinga are under pressure to reform Kenya with a new constitution, and on Monday they again gambled big by tying reforms to an even bigger dream.

On the week after Chief Mediator Dr Kofi Annan left with the warning that 2012 elections could be murkier and bloodier than 2007, unless reforms are effected, the Kenyan leadership cast its eyes farther into 2030.

This is the magical year — under the Vision 2030 they are pushing — when Kenya should be, a “globally competitive and prosperous

country with a high quality of life for all Kenyans.” By 2030, if all goes according to the script, crafted by planning experts, Kenya’s economy is expected to, “grow to a GDP per capita of over $3,000 at today’s prices by 2030, which is about six times what it is today.”

But Monday President Kibaki said to reach this doorway, and for Kenyans to walk into a transformed and sunnier country with an annual per capita income of Sh233,000, Kenya must have a new constitution.

“The key flagship project under the political pillar is the delivery of a new constitution. Already, we are making substantial progress in the constitutional review process,” he said, as he moved the Grand Coalition’s bar on reforms by taking in beyond 2012.

Another life

Kibaki once again promised the nation that both dreams, though interdependent, were attainable and within grasp, and it appeared the twin issues of reforms and trial of suspected post-election kingpins belonged to another life if not day. The President cast the picture of a country on course, and different from the one painted by the increasingly critical international community, especially President Barack Obama administration, the 27-member state European Union and Canada.

Obama, Annan and the world think they are slow on reforms but President and PM argue Kenya is on highway to 2030

As Kibaki and Raila threw in their new and even bigger gamble, there was little to show for the increasing pressure and the drawing closer of the country’s date with International Criminal Court in the Hague, in whose radar are believed to be six Cabinet ministers. Justice Minister Mutula Kilonzo yesterday delivered the ICC Chief Prosecutor Luis Moreno-Ocampo’s letter to Kibaki and Raila (see separate story).

The only reference to 2007’s ugly spot on Kenyan’s collective psyche, going by the President’s speech, was the fact that economic growth fell from 7.1 per cent to 1.7 per cent the following year.

Speaking at the launch of Vision 2030 Delivery Board at Harambee House, the President conceded: “It must, therefore, be understood that the journey towards Vision 2030 is not easy. It requires sacrifice, hard work and determination. We must endeavour to consistently move up the ladder of the vision targets with the required pace.”

He exhorted Kenyans to, “take this opportunity to make history by being the generation that will fulfil the dream of our founding fathers — the dream of building a prosperous, equitable and stable country.”

He painted a picture of Kenya standing on three strong pillars — social, political and economic reforms — and assured Kenyans the Grand Coalition Government is firmly under his and Raila’s stewardship.

Raila, who also has a raft of assignments to deliver the dream under his belt, listened keenly to the man he, the previous day, described as a “reformer.”

The day was devoid of Annan’s warning last week to Raila and Kibaki that Kenyans were losing confidence in their leadership and that impatience over delivery of reforms was growing by the day.

The political reforms on which the President pinned his vision of a more prosperous and grander Kenya, with a higher quality of life, are anchored on six strategic areas: “the rule of law; electoral and political processes; democracy and public service delivery; transparency and accountability; security as well as peace building and conflict management.”

He outlined the six key areas of development in this area as, “tourism; agriculture; manufacturing; wholesale and retail trade; business process outsourcing and financial services.”

He defined the social pillar as the building of a, “just and cohesive society, which enjoys equitable social development in a clean and secure environment.” He explained: “To achieve this goal, we have to transform eight key social sectors, namely education and training; health; water and sanitation; the environment; housing and urbanisation as well as gender, youth, sports and culture.”

He added: “It must be borne in mind that all the three pillars of the Vision 2030 are anchored on the firm foundations of macroeconomic stability; continuity in governance reforms and enhanced equity and wealth creation opportunities for the poor.”

The Board is chaired by Equity Bank MD James Mwangi.

Reaping benefits

He said transformation of the country’s political system under Vision 2030 is envisaged in the rule of law, electoral and political reforms, entrenched democracy and public service delivery, transparency and accountability, security as well as peace building and conflict management.

Kibaki noted that Kenyans have already started reaping the benefits of the Vision 2030 projects, and as a result the economy is set to improve.

He, however, stressed the need for hard work and determination to transform the country into a newly industrialised state.

“The success of Vision 2030 will depend on our determination and hard work. From our struggle for independence to winning gold medals in sports, it is clear that with determination we can succeed,” he said.

REFORMS: WHAT AILS THE JUDICIARY?

From: odhiambo okecth

Ambrose Redmoon once said that courage is not the absence of fear, but rather the judgment that something else is more important than fear. We have taken the step to examine what ails the judiciary because our pleas to many practicing advocates to take the bull by the horn is met with fear and trepidation. Many advocates would not wish to raise their heads above the water. They want to exist like submarines so that they are not earmarked. It is not that we do not fear the judges and magistrates. We fear for the judiciary more. Someone must tell the Emperor that he is naked. The reputation of the judiciary in Kenya is cascading fast towards that of the police. The Kenyan population lost confidence in the police long time ago. That is why they take the law into their hands. Equally few believe that they can get justice before the courts of law. Loss of confidence in the judiciary is encouraging extra judicial dispute settlement mechanisms such as Mungiki courts. So what ails the judiciary?

Judicial systems within the Commonwealth tend to be very conservative in nature. They are based on English law which itself is based on common law that grew from the English feudal systems. The system was defined through the master and servant relationships. This means that the law was skewed against the servant. Only the law of equity attempted to stem this imbalance. Kenya which as a protectorate and colony adopted the English laws mainly via India tends to be even more conservative. When conservatism is blended with corruption and assumed infallibility it makes lethal concoction of justice. Let us explain. On average judges and magistrates (the bench) in Kenya thrive by harassing advocates (the bar). Either because they are lazy, incompetent or both, some judges and magistrates deride advocates who try to complicate matters by citing precedents and pinning the bench. They hate burning the midnight oil trying to decipher the principles espoused in the decided cases. Any student of law knows that the law grows through precedents. Advocates rue their profession when they encounter some vengeful members of the bench. These are judges and magistrates who hate assertive advocates. Corrupt members of the bench have been known to turn accused persons or litigants against their advocates by demanding some consideration in exchange of favourable judgments. They belittle the role of the advocates. Where benefit has accrued cases are fast tracked. Judgments are made in rehearsed pantomime and woe upon cases following the normal procedure. These are postponed for eternity. Cases of corrupt judges and magistrates are not restricted to Kenya or to this age. Many Centuries ago the British Poet Alexander Pope observed – “The hungry judges soon the sentence sign, and wretches hang that jurymen may dine.”

We hasten to observe that great judges are distinguished not by the positions they hold or the awesome power they wield over advocates but by the enduring judgments they make. These are incorruptible men and women who are committed to dispense the law and who are thorough, painstaking, learned and clear. They have a thorough grasp of the existing rules and principles. They give masterly judgments. Lord Denning, one of Britain’s longest serving and most respected appeal judges was immortalized by his liberal judgments that strengthened the law of equity. When he died he was eulogized as a legal innovator who did not feel restricted by literal interpretations of statutes. It was said “His judgments were a model of lucidity. He was prepared to use the law for its true purpose — in the interests of fairness and justice.” His compatriot Judge Baron Atkins equally distinguished himself as one who relied on testing the law against the demands of common sense and the interests of the ordinary working man. He introduced the principle that ties cause and effect in the landmark case of Donoghue v. Stevenson concerning the alleged adverse effects from an alleged snail in a bottle of ginger beer served in a cafe in Paisley. The case established the modern law of negligence in the UK and, indirectly, in most of the rest of the common law world, with the major exception of the US.

Kenya has also its respected and learned judges who have made landmark judgments. The late Justice Madan was a much respected judge who made bold decisions. Others like Judge Cotran defined the place of customary law in our legal system. Recently Judge Phillip Waki demonstrated that we have men and women who can be relied upon to define the next course of Kenya’s history. Although his was not a legal judgment, he gave legal guidance in a Tsunamic issue threatening to tear the nation asunder. Like him there are many more wise, learned and dedicated judges and magistrates to whom we give our tribute. . But our regret is that they do not seem to have adequate opportunity to influence the course of timely justice for all. Instead they remain buried within the rot that depicts the judiciary in Kenya as not only oppressive to the vulnerable and marginalized but also as the greatest agent of poverty creation and promoter of inequality in Kenya.

For all intents and purposes the judiciary has resisted pleas to reform. If it responds at all it stirs into incestuous measures to blindfold the ‘ignorant’ public. It fails to recognize that in this modern day and time, the citizens know and understand the law. When a case is decided wrongly, they know but are helpless to do anything about it. It is not only the Magistrates and the Judges who are read in law. Many in the public are well conversed in law and can detect cases where there is out right judicial manipulation. The citizens Jury has now decided. Like any other arm of the government, the judiciary must undergo radical transformation.

The Government has embraced the concept of performance contracting for her employees as a means by which output can be measured by the people. It has also gone a step and decided that such performances must be evaluated by the public, the people who consume such services. Performance contracts go hand in hand with Rapid Results Management Concept where deliberate effort is put in place within a set time frame, preferably 100 days, to achieve results. Rapid Results Initiative are hence used to establish results based culture in the delivery of service while enhancing the management and implementation skills required for producing results. The citizens are prescribing such measures to overcome the cancer of pending cases where decisions have been made after 20 to 30 years.

It is gratifying to note that several sections of the Government have signed Performance Contracts to enable the public, who are their principal employers, to vet their output. This concept has been resisted by the Judiciary. We want to put a case that should compel the public to insist that members of the judiciary are subjected to a rigid regime that ensures Rapid Results that will ensure that the public regains confidence in the dispensation of Justice in Kenya. Several cases have been pending at our registries all across the country with litigants complaining of either delays in judgment or misapplication of justice. Very simple cases that should take only a day to decide are delayed for as long as 10 years. Yet, the public cannot query what actually goes on in the courts. The citizens cannot understand the cause of such delays especially where Magistrates and Judges come to the courts late, listen to a few cases as they drone in monotones that are incoherent to the litigants, and then promptly disappear. They act like conveyor belts giving new dates for all the files that are placed in front of them. Cases of people traveling from far distances get shallow attention as the Magistrate or Judge promptly give fresh dates for hearing, without taking into account that litigants have traveled from far. Litigants are punished instead of receiving justice. We also have cases of outright incompetence from the men and women sitting in the Bench. We feel that this has been occasioned by the secretive ways in which they are appointed based not on their professional competence but on their friendship to the appointing authorities.

A time has come for the judiciary to take judicial notice that the citizens will, if nothing is done to their satisfaction, rise against the system and ensure that impunity, corruption and perfidy are eliminated for ever in our courts.

Mr. Kinuthia Wamwangi is a Local Government Consultant, while Odhiambo T Oketch has extensive experience in Performance Contracting and rapid Results Initiatives and is the Chairman- Stakeholders Evaluation Team at the City Council of Nairobi.

Moi’s indelible mark on education and peace

From: odhiambo okecth
Date: Mon, Oct 12, 2009 at 7:51 AM

Mr. Joe Ombuor, in his piece in The Standard on Saturday10th October 2009, chronicles the achievements of Mzee Daniel Arap Moi in the education sector and his efforts at finding solution to the problems of Southern Sudan. It basically drove me back to history of what education used to be. About Southern Sudan and the achievements they have indicated, I do not know.

I went to school when we used to pay Kshs 20.00 at the chief’s camp per term. We were then given pencils, rulers, exercise books, and text books the whole term in school. I only used to take my signed filled exercise book to the school office and I was given a new exercise book in exchange. The school had cartons of supplies, chalk, dusters etc.

This was up till 1978 when Mzee Jomo Kenyatta died. I was then in class 7 reading for the Certificate of Primary Education –CPE. I joined Form 1 in 1979 and again, fee in secondary school was very manageable. The cost of transport in those poor roads was also manageable then.

Then Mzee Moi came with Free Primary Milk in primary school. I am happy it found when I had left primary education and was already in secondary school. He then started what they then called Free Primary Education. Remember, we were only paying Kshs 20.00 and all educational material was given to us.

But when Mzee Moi came up with the first Free Primary Education, educational supplements started disappearing. That is when education started going to the dogs. Parents started paying more than Kshs 20.00 in support of Free Primary Education. With Free Primary Education, government supplements started disappearing, and I would have expected Mr. Ombour to investigate this and come up with an informed opinion.

Parents started buying pencil, exercise books and text books in support of Free Primary Education. That is when parents started paying tuition fee in support of Free Primary education. That is when other hitherto unknown authors started appearing on the scene with different books in support of Free Primary Education.

Do you remember Safari Book 1, 2, 3 and 4 as texts that were immortal? Do you remember Primary Mathematics series? Then we had General Science Text Book. Those were the only books used for tuition instructions when we were paying Kshs 20.00 tuition, payable at the chief’s camp. Books were available in the schools and for each subject, the teachers came with enough text books to be shared in class. These were promptly collected as the lesson ended. But when Mzee Moi came with his version of Free Primary Education, many versions of the same subject texts were introduced as part of the curriculum and parents were told to buy all these books in support of Free Primary Education.

This is when our children in the lower primary began being subjected to reading all subjects from Mathematics to English to Geography, to History, to Ethics to Everything. With the coming of Mzee Moi to power, Free Primary Education came with costs hitherto not seen by parents. This is the time they killed the Kenya National Equipment Scheme, all in support of Free Primary Education. Perhaps Mr. Ombour might do a research on how Kenya National Equipment Scheme was looted under the Moi watch and eventually killed.

The rest as they say is history. Free Primary Education under the guidance of Mzee Moi became such a costly affair for the parents in Kenya to an extent that Mzee had to think of new avenues of creating pretended soft landings. He started building schools and naming them after himself. This is how all the Girls schools named after Moi were built. And in building these schools, the school head teachers in collusion with the Parents Teachers Associations made a kill.

They extorted money under the now infamous Building Fund to support this expansionist enterprise of Mzee Moi. Schools were built, very magnificent yes, but very shallow in out put. Pupils were subjected to grater coasts to sustain this ill move. This is the time Mzee Moi came up with the Quarter System that condemned students to their villages. This is also the time all teachers were posted back to their own villages. Vintage Moi.

It is also worth remembering that it was under Mzee Moi that all of a sudden the 7+4+2+3=16 system of education was changed to 8-4-4=0 system. Journalists will recall that the change was so abrupt to an extent that it created jam when there was double admission at the university at the first admissions of the Moi Graduates. That marked the death of quality education in Kenya.

And this is known all over the world; that Mzee Moi messed the education system in Kenya. And I bet it is time we all faced the truth. Mzee Moi killed our education system that was of high quality, and subjected our children to experiments and mediocrity. Some isolated cases of brightness managed to still shine through though.

We nowadays have graduates who cannot communicate effectively, courtesy of Mzee Moi and his 8-4-4=0 system of education. Our children stopped playing in school because of Mzee Moi and his 8-4-4=0 system of education. Children have stopped being children because of Mzee Moi. And I cannot for once give him credit on education.

He created all the mess that will take strong will to clean. Parents must rise up and demand answers; what does a child in class one do with all those books as currently listed for them?

There are areas where I can give Mzee Moi all the marks, like opening Kenya to all the corrupt networks, like creating impunity, like entrenching tribalism, like maintaining the cost of living at low levels- prices of essential commodities and like killing football in Kenya.

But to credit Mzee Moi with building several schools and forget the pain the parents have born with the heavy costs therein attendant is to miss the point by very wide margins.

Tanzania in Transition – Violent Conflicts as a result of political and economic reform

From: Mwana Habari

Tanzania in Transition –
Violent Conflicts as a result of political and economic reform
Kurt Hirschler, University of Hamburg

Tanzania is known to be an “oasis of peace” (Hofmeier 1997) on the troubled African continent. Although Tanzania is among the few African states that have experienced a “classical”war –a war between two independent states (Matthies 1998) –the East African
country can look back on forty years of relative internal peace and stability. No civil wars, no military coups, no state-collapse, no warlords, neither ethnic nor religious, neither political nor social clashes have tormented the country and its people. [1] 40 years of peace and stability are unquestionably the greatest success of the country that is still one of the poorest countries in the world. But an increase in violent conflicts within the last few years seems to endanger this success. It appears that unavoidable reforms have helped the country out of its economic and political misery, but to the price of increasing violent conflicts.

The Day the Colonial Police deported Julius Nyerere out of Nairobi

From: Leo Odera Omolo
Date: Sun, Oct 11, 2009 at 4:39 PM

THE DAY THE COLONIAL POLICE DEPORTED JULIUS NYERERE OUT OF NAIROBI AS THE RADICAL TOM MBOYA FACED THE WRATH OF THE LAW.

Historical News Background By Leo Odera Omolo In Kisumu City.

It was in the middle of the month of September, 1959.The colonial police, in collaboration with the defunct all white members Kenya Regiment, the General Service Unit and other security agents, launched a midnight operation, to flush out of the Kenyan capital all the political agitators.

Close to 40 political personalities, who were giving the colonial administration the sleepless nights, were rounded up in this massive security operations code name “Operation Anvil”.

Those netted in this massive security operation, after being identified and sorted out, were bundled onto police trucks and driven back to the rural homes. This was done under the State of Emergency, which was still in force after its launching on October 20th,1952 by the colonial Governor, Sir Evelyn Baring.

Upon reaching their rural home district , the captives were released to their location chiefs, under the supervision of the white District Officers{DOS}, and were issued with firm instructions restricting their movement to within their locations.

Under the same orders, they were also required to report to the nearest police station and local District Commissioner on a monthly basis, and never to return to Nairobi .The unlucky ones, were dispatched to detention and restriction camps in the Northern Kenya, mostly in the small town of Maralal in the remote Samburu district.

Among the victims of the “Operation Anvil” was Mwalimu Julius Kambarage Nyerere, who was one of the leading nationalist in the struggle for freedom in the neighboring Tanganyika.

Mwalimu was a leader of TANU, a party which was the brainchild of a Kenyan technocrat working in Dar Es salaam, Mr. Dome Okochi Budohi, who I suspected had come from the Samia community in Western Province.

Budohi later returned to Kenya and joined the editorial of the weekly BARAZA, as one of its sub-editors, under the late Mr. Francis Joseph Khamisi, an excellent and prolific writer-cum-politician. In 1961, Mr Budohi deputized in LEGCO for the late Peter Habenga Okondo for three months. Okondo had gone overseas, and it was customary for the LEGCO members to appoint someone to warm up their seats whenever they went abroad.

The late Jaramogi Oginga Odinga, the then Member of Legco representing Central Nyanza, was the first to pick up someone to deputize in his absence. Jaramogi had picked up the late Dr. Isaiyah Owala Awino from Nyakach, an accountant by profession, who acted in his place for three months while Jaramogi was visiting India.

“Operation Anvil” security operation covered the entire Eastland’s areas of the City, where there was the biggest concentration of African population.

Nyerere was picked up at about 1.45 A.M at Mr Tom Mboya’s house No.38 in Ziwani Estate and driven to Embakassi Airport in the chilly and wee hours of the night and left in the cold. He was instructed to take the first morning flight to Dar es Salaam. It was purely an act of deportation without repatriation order issued by the government.

Nyerere had earlier on in the morning of the previous day had a brief stop-over in Nairobi, on his way to Dar es Salaam, after returning from a visit to Edinburgh in Scotland and London in the United Kingdom. He spent most part of the day paying courtesy calls on a number of Kenyan politician of the time. He met Ronald Gideon Ngala in Parliament Building and they had lunch together. He later paid a courtesy call on Jaramogi Oginga Odinga, and the two had a lengthy discussion also in Parliament Building.

Later in the evening, Nyerere accompanied Mboya to his House at Ziwani Estate. They had long conversations, tackling many political issues affecting the entire Eastern African region.

On that day, I had gone to Mboya’s house and waited for a long time before the two arrived at about 9.p.m. I could not afford to walk back to Kaloleni Estate, where I was putting up with a relative, because it was too late. Mboya was so kind as to offer me accommodation at his house for the night.

I had an appointment to see him on personal matters. I was then a young budding writer, aged about 22.

I was introduced to Mr. Mboya by my aunt’s son, Mr Zacharia Orwa, who later served Kenya as a District Commissioner in many places, retiring at Busia district. Zack Orwa was Mboya’s contemporary. They all hailed from Rusinga Island in South Nyanza District and were almost of the same age, and close friends for years, until they parted upon death.

I was also born in Rusinga Island, but my parents had migrated to Kanyamkago in 1948 while I was a small boy, and we later settled in East Sakwa Location, Rongo district where I grew up. Mr.Mboya came to our home in Rongo in 1949 in the company of his boyhood friend Zack Orwa. The two had brand new bicycles which they bought in Nairobi and I admired their bikes.

I suspected the two were looking forward to meet with a young lady who was a primary school teacher in our neighborhood at he time. They used me as a conduit in arranging for the young school teacher to meet with them at our homestead, which was then located at Rinya-Pikwar area. The two left after a brief meting with the young lady, and I never saw Mboya again until I heard over the Radio that he had won a Legislative Council seat for Nairobi area, and that he had also secured some scholarship for Kenyan youths to study in the American Universities It was a big euphoria and every young educated men and women in our villages were talking about going abroad under Mr.Mboya’s patronage.

I too wanted to try my luck. But due to the fact that I had inferior educational background, I did not qualify to benefit from the program. But Mr.Mboya had detected some writing talent in me and advised me to developed my writing knowledge. And owing to my skillful knowledge of Kiswahili writing I became an instrument in writing some of the reports appearing in UHURU, a PCP’s political newsletter edited by the late Elijah Omolo Agar. This endeared me to Mr.Mboya, and at times, I used to spend some evening time with him.

Back to the fateful night at Ziwani. The police came past midnight. They were in several lorries and land-rovers. They parked outside Mr.Mboya’s small two bedroom house. I had settled for the night on a sofa seat, while Nyerere slept on Mboya’s main bed. His host settled on a small spring bed, but the two were in one room where they chatted away until later hours of the night.

At about 1.20 .A.M, there was a big bang on Mr.Mboya’s main door. The bang was so loud that it woke me up. I jumped on my feet and quickly peeped my eyes outside through the window. I saw a large number of policemen, both black and whites. The black African policemen were carrying big rifles while the white officers were armed with pistols of service revolvers.

The banging was accompanied with a harsh tone of someone commanding in Kiswahili. “Fungua Fungua lango sisi ni Polisi”. I panicked and ran towards Mr.Mboya’s bedroom. I knocked and told them about the presence of a large number of policemen outside the house. Mboya told me politely to open the door for them to come in. I obliged and opened the door, and about ten or more policemen, both blacks and white and a Sikh {Kalasinga} burst in.

That was when some of them took away Mwalimu and escorted him to the airport.

These policemen ransacked Mr.Mboya’s house and turned everything upside down, while looking for certain documents. Mr.Mboya, wearing only a night sleeping gown, sat on innocently and patiently, while sitting on a small stool, as the search continued for three hours, only stopping at about few minutes to 5 am.

The policemen then asked Mr.Mboya to accompany them to his City Offices, which were located at Alvi House on the then Queensway {Now Tom Mboya Street}.There the search continued for another four hour, ending at about 8.30A.M, when Mr Mboya .was driven back to his Ziwani Estate house in a police land rover, looking tired an dejected.

A huge crowd of on lookers and sympathizers had gathered outside the house, inquiring to know Mr.Mboya’s fate. His long time political friend and staunch supporter, Mr Alfred Aketch Mingusa, was the first person to arrive. But he, and other friends, immediately hired a taxi to the City Centre, to find out what had happened to their friend {Mboya}. Both of them came back few minutes later traveling in a police land rover.

While waiting to board a plane for his Dar Es Salaam home, Nyerere had phoned Mboya’s house at about 7.A.M. I picked the phone and lt was Nyerere on the other side of the line. He told me that he had left a number of important files and one of his brief cases in Mboya’s house. He requested me to ask Mboya to make concerted efforts to ensure that these files were delivered to him in Dar Es Salaam within a week..

The next morning, the EAST AFRICAN STANDARD, which was then the only daily newspaper, came out with a banner headline reporting of the major security dragnet in the City. It carried some photographs of the victims who included Elijah Omolo Agar, Stanley Mathenge, Jesse Mwangi Gachago, J.M Oyangi Mbaja, M.D.Odinga, F.W.J Mukeka and about 30 other leading politicians. Some of those who were detained were sent to restriction camps or deported back to their rural homes by the colonial government. Hundreds of ordinary job-seeker were also netted under the law of vagrancy and emergency regulations.

Uhuru, the PCP newsletter, which I was actively writing for, immediately ceased publication following the detention of Mr.Omolo Agar, its editor.

Before the end of the same week, and while Nairobi was still smarting from the effect of one of the biggest security operation, I was dispatched by Mboya to Dar Es Salaam. The purpose of the journey was to deliver the Nyerere’s files, which the TANU leader had hurriedly left behind at Mboya’s Ziwani House Nairobi. It was one experience which I shall never forget in my lifetime. This is because it was the first time when I took a flight in a plane. Indeed it was a harrowing experience, for the one and half hour flight, in a Comet Plane..

Mboya had instructed me to trace either Mr. Michael Kamaliza, a trade unionist or Mr. Rashid Mfaume Kawawa, the Secretary General of the TFL {Tanganyika Federation of Labour}, which was an equivalent to the Mboya headed KFL, and that any of the two would help me trace Mwalimu Nyerere in Dar Es Salaam. I did that and met Mr. Kamaliza, who took me to an African location, a place called Kinondoni, where Mwalimu was addressing what looked like a seminar or a workshop of TANU cadres. Mr. Kamaliza booked me for two night in Mawesi Hotel..

The next day, Mr Kamaliza took me to Nyerere’s office. Mwalimu looked worried and very much concerned of what had happened in Mboya’s house the previous week and inquired if anything bad happened to Mboya. He told me that they had spoken over the phone, but he was still a worried man..

Malimu told someone whom I can’t remember his name to give me some out of pocket cash money for my upkeep while in Dar Es Salaam, but when I insisted that I had sufficient money given to me for the trip by Mboya, Mwalimu insisted that since I was his personal guest, that was the way the Tanganyika people treat their guests. So I was given Tshs 2020/ at the TANU office, This was a lot of money at that time. Even the whole members of the Legislative Council were only earning a monthly salary of Kshs 830/-per month.

Reading through the files, I realized they were containing minutes and programs of the PAFMECA. The Pan African Freedom Movement for East and Central Africa, which Nyerere and Mboya, and others had launched at Mwnza the previous year. Some of the files were connected with the university of Edinburgh and TANU matters.

Before I boarded a plane back to Nairobi, Mwalimu entertained me to an afternoon tea at the Africana Hotel, where I met him with the late Mr.John Rupia, Mr Nsilo Nswayi, Bibi Titi Mohamed and his old friend, Mr Paul Bomani. This meeting became a milestone to my future operations as a journalist in this region, because these people helped me to meet with many politicians of the day in Tanganyika and I became very intimately attached to them. I was actively writing articles and feature reports to the DRUM Magazine {East Africa’s Edition} under the editorship of Mr.Alan Rake, Mr.Mboya’s Englishman journalist friend. He had a small office portioned from Mboya’s KFL offices at Alvi House. Perhaps my association with Mr. Rake and the late Boaz Reza Omori, the former Editor-in-Chief of the DAILY NATION had actually shaped up my writing prowess and professionalism.

I remained in contact with Mwalimu until his death. He had such a sharp and wonderful memory. Whenever he saw me during regional and international conferences, such as the OAU annual meetings of heads of state and governments summits in Addis Ababa, Mwalimu would jokingly shout at me saying, “Mtoto wa Mboya”.

On one memorable occasion, I escorted the late Dr. Robert John Ouko to Nyerere’s rural home in Butiama, near Musoma. Ouko had just taken over from Joseph Odero Jowi as the Minister for the East African Affairs based in Arusha. Ouko was requested to deliver a personal message to Nyerere urgently by the late President Jomo Kenyatta. Ouko apparently had seen Dr.Nyerere talking to me intimately in Arusha during one of the international gatherings, and thought I would be a better conduit for him to use to reach Mwalimu Nyerere.

I accompanied him to Butiama via Migori, Sirare and Musoma. But upon arriving, we found Nyerere engaged seriously in the game of Ajua with some local elders, so we waited for two hours. He greeted me, telling Dr.Ouko that he had known me since I was a very young and slender man. But now I was bulky, may be due to eating too much of “Nyerere in Kisumu”.

Ouko was surprise that Mwalimu wa also fluent in Dho-Luo vernacular even better than Milton Obote, who is a closer cousin of the Luos.

Thank you very much my good friends/s

What is happening now should not worry you simply because, this is the time that Kenyans alone can stand and defend there morals.
In any society where there is moral decay always what happens is immorality.

Killigs like what happened 2007/2008 this is due to most of the unaddressed injustices from the previous regimes, minus lying,Kenya is being finished by aVIRUS called OUR PEOPLE …..OUR PEOPLE…….are being targeted ….or what do you think?

When shall we as Kenyans become WAZALENDO if we talk of OUR PEOPLE and not my country?

Where can Kenyans who were once respected can stand and talk as a Kenyan and be having a positive picture before the audience without being seen as election thieves, killers,a people who does not respect DEMOCRACY and the VOICE OF WANANCHI TUKUFU.?

Once a person is over sixty eight years of age and still serving under one position, what does that mean?

Nobody has been born and is able to be there………What if this person dies????????vacuum vacuum my dear Kenyans, people have been Educated for what reason,if yoyr grandfather is still working in the GK,not even your dad,?

Worry not we need A DJ either from WAZALENDO or MILITARY to restore the image of Kenya in earlier eighties.

Subject: Rearming in the Rift-Valley-GENOCIDE BEING BREWED AS WE WATCH!!!

Reports that tribes are rearming in the Rift Valley are shocking as they are disconcerting. That tribeS can actually buy guns in readiness for 2012 even as we anticipate to host Ocampo shows the level to which things have degenerated. The threat of international trials won’t stop anything, we must stop it ourselves.

This is not idle talk. The rearming was bound to happen. For one, the two rival tribes in the equation have genuine fears. The Kikuyu have realized following the mishandling of the IDPs and the dragging of feet to try post election violence instigators that political expediency take precedence above justice.

On the other hand, following the way the government has been talking of perpetrators of violence from one side of the mouth, it seems only the Kalenjin were involved in the raping, killing, maiming and burning orgy. Little focus is being given to the organized groups that we pulling passengers from vehicles in Naivasha and Limuru, fully financed apparently by top government officials and the plan hatched at State House. TV footages have very clear faces of people the government could trace and arrest for a start like it did soon after the PEV in the Rift Valley.

Two things emerge here. One,both groups have realized that they are on their own against each other and government is not standing in between. It is thus foolhardy to wait for the government which is taking no concrete steps to stem another round of voilence by trying those implicated in the last one.Secondly, while the Kikuyu fear a repeat hence the arming, the Kalenjin fear retaliation. This is a sad situation that should not even be envisaged.

The skewed manner in which Kibaki has been filling the top ranks of the Police force could have send a chilling mesage to the Kalenjin that bows and arrows will not help against the arsenal they are against, a state machine being prepared to be unleashed upon them. The Luo had a taste of this in January/February 2008 so it is not far fetched. In this scenario, their fears may have driven them to the extreme, buying guns in readiness for what is increasingly looking very likely, GENOCIDE!!!!

All Kenyans of goodwill must not allow one man to drive Kenya back to where we came from, the precipice. Pressure must be brought bearing on Kibaki and his cabal to ensure justice for PEV victims, that the reforms of the police force, Judiciary,Electoral Commission and Constitution MUST be achieved whether he likes it or not. If the price is mass action like in 1990s against Moi, so be it. We cannot wait as GENOCIDE is brewing right infront of our eyes and we do nothing about it.

The Rwandese must be looking at us and saying,”the gods must be crazy!!”

Dear YPs,

Is it possible that the Bible is one book that has brought us so much confusion? We have changed our culture and values because of this Bible book and what is written in it. I think Africans should go back to their roots, and realize that we brought up real men through cultures like polygamy. A man or woman learnt real values in the traditional culture. We had our own beliefs. We did not need some fake preacher to tell us how to get saved and live life.

Our systems were working.

There was respect, honor, real values. Real discipline. We had the whole community getting involved in the affairs of our children.

I submit that the Bible was the beginning of our downfall as Africans. We were colonized by religion. We need to open this for discussion.

What do you say?

Greetings Bwana Mumia

I beg to differ with your point of view, and it honestly is not a valid point at all. The Bible has not taught us how to live in sin at all, if anything it is the complete disregard of what the Bible stands for that has brought our downfall. We may have changed our culture because of the Bible, but have we stuck with the Bible?

Along the way, some have strayed from the Bible teachings and that is not the fault of the Bible.

Remember, not everyone who calls themselves a Christian is really a follower of Christ. If we adhered to the teachings of the Bible as a community, then believe it that there would not be a pleasant place to be as in that community

Mumias,

i greatly differ with you. The Bible came in to shed the light to our hearts. It gives us the mind of our Creator and helps us to align our thoughts and behaviours more to what He expects of us.

As bwana Kennedy said, its the lack of adherence to godly principles that has brought us the downfall. remember if we loved one another as the Bible urges us, we wouldnt kill, not steal, no corruption, no wars, money intended for hospitals, education, roads would be spent on such.

MR Mumia i don’t want to sound rude but i think you have missed the whole point ,it is not the BIBLE that has colonized us it is the western culture teachings and practices that stink ,mind you the bible is the constitution between God and “christians” . i think the reason why they introduced the so called freedom of worship is for people like you, just practise what you feel like but dont critisize others , no body forces you to do what the bible says and so i think you should practise what you think is good for you , some of us don’t even know about the traditional practises u r talking about and won’t like to be associated with them either.oops sorry but thats the way i see it.

lastly don’t confuse yourself.talk about the western culture and not the BIBLE. very few understand it .and it will alwayz remain like that .

I think Mumia has a point. Even Kenyatta said, “those guys came holding a bible, and told us to shut our eyes and pray. By the time we said Amen, we were holding their bible, and they had our land.”

ACTUALLY, religion is a weapon. Anyone who tries changing another person’s religion is an enemy for which most religions prescribe a death penalty. EVEN christianity. Some of our cultural practices were repugnant and had to change, but my view is that the bible has complicated matters. Especially coz it is interpreted inconsistently.

Check this true story: A POLICEMAN on Saturday caught his wife in action with a pastor at two afternoon in a lodging in Kisumu. He forced the two love birds to march through town completely naked, until other cops had to intervene after about two Km. Now, everyone puts the words Pastor and Bible in one category.

Isn’t it the same Bible which says that

But there were false prophets also among the people, even as there shall be false teachers among you, who privily shall bring in damnable heresies, even denying the Lord that bought them, and bring upon themselves swift destruction. 2 And many shall follow their pernicious ways; by reason of whom the way of truth shall be evil spoken of.

2 Peter 2:1-2 (KJV)

Yes, they are there today and have made the way of truth be spoken evil of just like you have done. But the simple questions is this, if you have your own traditional way as you propagate and several of the elders (which still used to happen) preach water and drink wine, does it make your traditions bad? If two of your siblings are thieves and two are not does it make your parents bad parents? does it mean the parents taught them how to steal? of course the focus will be on the thieves (and media attention) and not on the other two who are good citizens.

Even as the Bible foretells of false prophets and teachers, when we do stumble across them we tend to render the Bible as false…isn’t that ironic? How many true Christians exist today…many. Have you tried to highlight them…or is it the stray seeds that are more interesting? Tell me of which system that ever existed in this world where there was no stray seeds, even the traditional ones?

I have read of true Christians in our recent times who have gone to a point of death for the sake of others. Maybe we should try to take a look at them as well as we also look at bad seed just to ensure we are not bias.

The bible as it is now, is to be blamed. It has been too much “doctored”. Any one who has studied biblical greek and hebrew can tell so. And the reason is mainlyl this. Taht the original languages in which the bible was written have a wider semantic range ie meaning range…so that often we dont have suitable english equivalents. And so that i dont seem to be beating around the air(aimlessly that is for beating the air in itself is not bad), let me give one illustration.
Rom 8:31. Most translations use the conditional “if” God is for us but in the greek text it is the factual “since” God is for us who can be against us.
Now that is just a tip of the iceberg. Some of this things if we get to know them…..

Cheers.

I would beg to differ with you the language usage has been done over time to make it more easier for people to understand and read. Take for example the verses you have just given because one has used if and the other since does it change the meaning to an ordinary person with basic English command?.

To be frank the Bible gives the way forward at the same time it warns of the dangers you will encounter as you move on.

The Bible was given to guide the Christians on how to keep their faith but when you study the Bible for educational purpose you are bound to find it weird the way you are putting it just remember the guys who were building ‘MNARA’ to reach God what happened to them.

Believe me if you interview those who do the confused things and they know the Bible they will talk about have been Christian but they have backslide that mean they know they are doing contrarily to what the Bible teaches.

There is a big difference betweeb if and since. ‘Since’ is definite, while ‘if’ is suggestive. “If God is with you” means there are chances he might not be with you. Since God is with you means it has already been decided he is with you.

Unfortunately the book you mentioned in its present form is source of the worst obscenities. Talk of rape, homosexuality, incest, harems, drunkerdness, murder, prostitution etc. I do not know why the church condems these vices yet anybody who reads the bible is able yo pick up ideas and practice them.

What I see in all the mail on this subject are the two common words, “I THINK”. That is enough reason to get us thinking. Everyone should let everyone think, but the Bible should ideally not be open to discrete interpretation. There should be one version from which then, we would be able to share one with another. As things stand now, the bible is no longer one book, because you can never quote a single verse without clarifying which version you are quoting from. I THINK.

Then the protestant one has more versions than I can keep track of. And THEN, even the protestants cannot agree on what their Bible says, and they frequently have to resort to Pangas and RUNGUs to sort their issues out. Honestly, what do Christians expect observers to think?

Simba,

You are attacking God as having inspired obscenities in complete ignorance my brother. First and foremost whatever was written in the bible was to warn us and show us the truth as it is, that which holy. The bible has account of good happenings and bad ones……same to quaran. Whatever is called “Jihad”……so what does the the quaran say? Doe it have historical account of what things happened? If so there must be some bad occurences, however if it doesn’t, then when was it written? I may launch an investigation into the origins of quaran at this point.

Well I also tend to think moslems are the worst pretenders……..If you give me quaran then I shall be able to read for you a few sections which moslems don’t fulfil and a few sad accounts of bizzare happenings. The fact that some bizarre occurences are recorded in the bible does not mean that God condones such acts…….so would be conclude that God allowed those acts to happen!

By nature we human beings are the ones capable of doing nasty things ourselves…..remember massacres in world history {Adolf Hitler} because we have free will and conscience.

The fact that some bizzare happenings are recorded in the bible does not mean God condons evil…….”He lives in inapproachable light, and in Him there isn o darkness, righteousness and justice are the foundation of his throne, he sits on high and darkness surrounds him”

Please, you’re arguing from a very shallow and uninformed point of view!

Yes the same bible speaks of “hypocrites” meaning, there are some “wanna be’ christians. At this stage let us not get into debate of who is a genuine christian or who is a “hypocrite”…..all shall be known whe God finally judges the world and reveals to us who his true sons and daughters are!!!

Do not criticize the bible or christianity on the basis of only one aspect alone……..have a holistic appreciation of facts about it. The fact that some people fight yet they call themselves christians doesn’t make the faith a failed one, furthermore even you have your personal sins which you commit against the faith you uphold……..don’t you. Brothers

When one reads the bible is one supposed to read what it says and take it literally or is there a another meaning other than what it says? Take for example from Leviticus – 27 ‘A man or woman who is a medium or spiritist among you must be put to death. You are to stone them; their blood will be on their own heads…” and from Exodus 22:18 18 “Do not allow a sorceress to live” These biblical verses were quoted and used by Christians to murder thousands of women more than 1500 years into the Christian era. Did God allow Christians to do this? Is there some context we are missing? Would it be wrong if one took these verses to mean we all have a duty to kill witches? Is the bible to be taken literally or do we ignore parts of it like these?

The parable of the great supper (Luke 24: 14-23) was used by Christians as justification to torture other human beings who were non-believers for centuries in order to compel them to join their faith. Why did God allow this? (Modern translators e.g. NIV realised the danger of these verses and have now “translated out” the word “compel” from this verse but kept the meaning.)

Atrocities by Hitler anyone? – well, God of the old testament has some of his own too – he clearly commanded his people to commit genocide, he commits infanticide on innocent first-borns in Egypt because of the Pharaoh’s stubbornness and in probably the most notorious in 1 Samuel 15:3 he issues a direct command “Now go, attack the Amalekites and totally destroy everything that belongs to them. Do not spare them; put to death men and women, children and infants, cattle and sheep, camels and donkeys”. Did he allow this or command it? Why? Clearly this is immoral by every measure of our morality. The story of Noah demonstrates that because God is unhappy with the wickedness of man, he decides to do something about it himself. He kills every living thing on the face of the earth other than Noah’s family and thereby makes himself the greatest mass murderer in history (though I don’t believe this story – it illustrates the point well) – it is easy to become numb to all the killing and murder in this book.

These points I raise is not to denigrate the bible or your faith but to show you that the bible is questionable and cannot be used as an absolute truth or moral authority in our lives today. You must test everything you read including the bible and filter it through your intellect. Do you know that just about 150 years ago Christians owned other human beings (just like we own livestock)? Why did God allow this?

It is not shallow and uninformed to question the Bible, it an act of enlightenment.

The Bible is an ancient work that has not changed with the times while our knowledge and enlightenment has grown with time. Much of the morality in the bible (especially in the Old Testament) is hopelessly out of tune with today’s world – and must be questioned for relevance and/or usefulness.

If God is the creator, the giver of life, isn’t it within His rights to take away that life. Oh yes, now we have the wisdom to question His ways and His morality…

But I thank God for it is by faith that the righteous shall live. And not only did He take away the lives of those who sinned before, but He has promised to do so again. He didn’t spare the angels who sinned and will not spare us who sin just because based on our wisdom it is immoral. It is Him who gave and Him alone has the right over life. Do I question that, no I won’t for my wisdom is nothing compared to His…unless off course the God we believe in is a man.

Christians, I always do say this; that salvation and the message of the cross is foolishness to those who are perishing. Choose to follow the wisdom of man, but just before you do, take your time to see where that wisdom is taking him…take a look around you at the emerging world where people have chosen not to retain the knowledge of God in them.

If you think the bible is confusing or brought western culture to us, try aethism or tradistional religion. My grandmother, before she passed away, used to tell us we should never stop going to church because before she was baptized and became a christian, she was in bondage of ghosts and spirits of ancestors who used to visit at night and beat them up if there was no food in the pot! This ended abruptly the day she was baptized!

so I would wish those who want to be go back to traditional ways to do so and share us their experience down the line

Hi,

It is indeed healthy to discuss the holy book objectively for God himself says come let us reason together and worship the Lord with all your heart, soul and mind. However, it is tantamount to taking a retreat from reality to state that just because the bible sites cases of sin it condones it.

Simba, the true mirror of the heart beat of God is the bible in it’s entirety-it’s gist and prime message. It would also be well advised and worthwhile to study the biographies of Jesus.

In a nutshell, Christianity is not had,it is impossible through human strength. God seeks a relationship with his most precious creation, you and me. No wonder Jesus ransomed us with his life.

Hi, Jerry. I am not saying anyone is good or bad. All I am saying is that as things are, any dispassionate observer would be confused. The Bible itself says, quoting Jesus, “YOU SHALL KNOW THEM BY THEIR FRUITS.” Meaning, according to me, that we can look at someone and know whether they are a true follower of Christ or not. What puts me off are some ppl who appear to prescribe standards for others while ignoring the realities on the ground, or addressing others as if they are silly.

read what has been posted by many Africans and wonder why every one is up
in arms in praise of Obama receiving the Noble Prize. You see I woke up
last night about 4 am and saw the posting from my dear friend Gook stating
that the Norwegians had gone bonkers. And I stated a very limited concern
about this appointment, I even suggested what we expect from this
presidency which is to do his damn job. Man was I attacked the whole
yesterday with all name calling. So this time I am not going to wait for
Africans to make an intelligent discussion on the issue for to them it is
time to drink for Obama got a peace noble prize. But I am going to use the
limited time to comment on the reaction from the international community,
those that decided to comment about this silliness and see how we as
Africans differ in this reasoning.

I take my self to be a man that follows news closely but it never fell on
me that Obama was among those nominated to receive the prize, in fact my very reaction was when was he nominated? Until when I read Pat Anderson’s posting that actually the nomination took place when Obama was 14 days in office. And it occurred tome that I missed it for that is when I had my daughter in hospital and I was some how cut off the communication grid. So The Norwegians nominated him for in 14 days into his presidency, Obama had proven him self to be a man that builds peace. If that is not stupidity you tell me what is for in 14 days, Obama had not even learnt the corridors of the God dammn white house. The Israeli government was very fast do denounce this nomination and for a very good reason, this administration does not have a secretary of state, many of the state issues are not only directly done directly by the White house, but I still wonder if on any international traveling or any home conferences whether this president has ever traveled with his foreign secretary. I don’t seem to remember that. So when you do not have a vibrant secretary of state, you fail to make negotiations and that is what they have found out in
Middle East. The Administration has made its proposals and both the
Israelis and Palestinians have refused to accept them. Obama wanted the
housing expansion to stop the Israelis refused and to today they are still
building. Israel Tanks have re entered Gaza on several time under this
administration to not caring about the calls from White House to stop.

The Palestinians rejected the bend over the Americans wished. Bottom line remains that in the entire 9 months this president has been in power he
has not brochure even a single peace agreement.

Former winners of this prize went all way from Nelson Mandela that heard the news and made no single comment about it, to Les Walessa that wondered how he got it this fast. For you see men like Walessa fought and defended peace to receive it, they were not nominated 14 days in office. Obama him self was surprised and stated very well that I am surprised and honored for he knew down in his heart that he does not deserve it. By the way, my poor Tsivangirai of Zimbabwe that was among the nominated was puzzled about this appointment as well. This man was beaten and blood all over his face to being jailed when Obama was sitting in Chicago flipping a bugger, and here we are. Sadly enough Obama has to go to Norway to receive it but that is the end of that prestige price, especially if you saw the gasp of air that took place in Norway when that announcement passed.

United Nations was a good organization until when it started to be
controlled by the Americans and British save the Russians and Chinese.

There are those of us that think that UN will never regain its usage till
it moves from New York. But it reached its lowest ebb when it started to
nominate countries like Libya to head the security council, nations like
Uganda that have two million displaced people, to be members of the
security council, it became a joke that I would not be surprised if
Khomeini becomes the assistant secretary of the UN. That is when UN became irrelevant. The nomination of Obama has made this Norwegian prize irrelevant that I wouldn’t be surprised if some of the past recipients
return it to Oslo, for the Israelis are really pissed. The Africans though
are drinking in ecstasy, for this is great. Do you realize how this
history is being written about all of us as Africans? We elected an
African to lead we even gave him a Nobel prize and he still screwed
America large.

And the Toronto radio stations have got it very right this time, to make
the announcement from Norway accompanied with an immediate “But Biancey has a best CD of all Times……. …….”

Everybody knows that what is happening in Afghanistan is the fault of
the Americans right from the word go. Firstly they promoted instability
in the country during the 1980s, when they sponsored the mujahedin
(including Osama bin Laden) to distabilise the Soviet backed government.

When the Soviets finally walked out, the Americans also abandoned
Afghanistan leaving it to eventually fall into the hands of the Taliban.
Apparently their protege, Osama was so pissed off by this that he turned
against them. What is particularly heartbreaking is that Afhgan lives
were used as pawns in a CIA project that was nothing more than an
egotistic attempt to spite the Russians. In the process huge problems
were created not only for Afghanistan which is still unstable today, but
for many other nations today. For example British lives are being lost
because of mistakes that were unilaterally made by the CIA 20 years ago.

American lives are being lost because of the same mistakes.

had only been in office for two weeks when the nominations were made,
not very long for hm to prove himself one would think. There is a great
deal of unhappiness and anger both here in Britain and the USA at the
high death rate in Afghanistan, the British public would certainly like
our troops out. The British were in Afghanistan in 1890 something, we
didn`t win that war either!

public protest forced Tanzania to abandon its multimillion dollar biofuel projects

From: Leo Odera Omolo
Date: Wed, 7 Oct 2009 23:56:14 -0700 (PDT)

TANZANIA GOVERNMENT IS FORCED TO ABANDON ITS INVESTMENT WORTH MILLIONS OF SHILLINGS AFTER A STORMY PROTEST OVER PLANNED EVICTION.

News Analysis by Leo Odera Omolo In Kisumu City.
TANZANIA has suspended investments worth millions of dollars after a
storm of protest over the eviction of farmers out of their ancestral
land to make way for biofuel project.
It has since been reported that Dar Es Salaam will not start any new
biofuel project before the government reviews the selection criteria
for such investment.
The government has also halted allocation of huge chunks of land to
biofuel investors.
Under fire from international and local environmentalists, the
government said it will stop further acquisition of land by biofuel
investors, pending clear procedures and policies in such investments.
The government in recent past has faced even more serious questions
since newswires reported two weeks ago that more than 1000 rice
farmers across the country would be evicted to pave the way for
biofuel projects.

The criticism peaked up last week when a researcher from Sokoine
University of Agriculture, Mr Kenneth Bengesi Kitunda, said the
government was treating biofuel investment as a “bottomless pit” at
the expense of farmers.

A senior government official told a local media house that President
Jakaya Kikwete has ordered all regional authorities to halt current
and future biofuel projects and acquisition of land from the
villagers.

The coordinator of the biofuel project in the Ministry of Agriculture,
Food Security and Cooperatives has halted acquisition of land by
investors ,until there are clear procedures and policies.

The ban came at a time when, already 40 companies have biofuel
projects in the country . The government said it was waiting for the
Cabinet to pass and approve regulations. “Thereafter, we will prepare
policies to pin down investors once they have done something against
the interests of the country“, said Mrs Mfugale.

Fear of food shortages and pleas from peasants and environmentalists
forced the government to suspend the allocation of thousands of
hectares of arable land and eviction of rice farmers over biofuel
projects.

The new move highlights the growing problem of feeding the nation as
investors in biofuel expand into farmland and villages, inducing
farmers to abandon food crops..
Mrs Mfugale has ordered the local government to stop selling land to
biolfuel investors until clear procedures and guide lines are issued..

“The government went wrong, we have to stop and set out clear
procedures to biofuel investments,’ she said.

The decision to halt biofuel investments is likely to have a knock-on
effect as the government has already spent USD3.1 million secured as a
grant from Sweden and Norway to strengthen policy legal framework to
support a sustainable biofuel industry in Tanzania.

Mrs Mfugale said the government had little knowledge of the presence
of biofuel investors, but it is doing all it can now to get into a
full picture.

The Ministry of Agriculture, Food Security and Cooperatives has
already identified broad land uses from its land use categorization.

Farming and livestock take up 47.5 per cent ,forest, bush land and
wetland 37.1 per cent, water resources, seven per cent, wetland 9.8
per cent, build-up areas 0.3 per cent and bare rock 0.3 per cent.

A local weekly reported recently that it has been informed that the
three main potential land users are already threatened by the
introduction of biofuel, especially jetropha cultivation.

Farming will give away 17.5 per cent to biofuel investors; pastures
and meadows suitable for livestock, will give way 29.4 per cent and
forests, woodland, bush and grassland will give away 37 per cent. They
are also likely to displace farmers and livestock keepers.

The Tanzania Investment Centre has already set up a “land bank” of 2.8
million hectares, identified as suitable for investment projects .

It has set aside 1.1 million hectares of land for agriculture, 1.4
million hectares for housing estates, as suitable for investment
project, 587,880 hectares for industry, 445,90 hectares for mining ,
238,930 hectares for ranching and 711,027 for tourism.

Judiciary MUST embrace Performance Contracting

From: odhiambo okecth
Date: Sat, Oct 10, 2009 at 11:43 AM

The Government has embraced the concept of performance contracting for her employees as a means by which output can be measured by the people. It has also gone a step and decided that such performances must be evaluated by the public, the people who consume such services.

Performance contracts go hand in hand with Rapid Results Management Concept where deliberate effort is put in place within a set time frame, preferably 100 days, to achieve results. Rapid Results Initiative are hence used to establish results based culture in the delivery of service while enhancing the management and implementation skills required for producing results.

It is gratifying to note that several sections of the Government have signed Performance Contracts to enable the public, who are their principal employers, to vet their output.

This concept has been resisted by the Judiciary. And I want to put a case that should compel the public to insist that members of the judiciary are subjected to a rigid regime that ensures Rapid Results and more so, makes the public to regain confidence in the dispensation of Justice in Kenya.

Several cases have been pending at our registries all across the country with litigants complaining of delay in ruling and in other cases, misapplication of justice. We have very simple cases that ought to take only one day being delayed for as long as 10 years, yet, the public cannot query what actually goes on in the courts.

We have cases where Magistrates and Judges come to the courts late, listens to a few cases as they drone in monotones that are incoherent to the litigants, and then promptly disappear. They behave as conveyor belts giving new dates for all the files that are placed in front of them.

Cases of people traveling from far distances to come and listen to their cases being handled gets shallow attention as the Magistrate or Judge promptly give fresh dates for hearing, without taking into account that litigants have traveled from far. It is like the litigants are being punished instead of receiving justice.

We also have cases of outright incompetence from the men and women sitting in the Bench. This has been occasioned by the secretive ways in which they are appointed. Some are appointed not based on their professional competence, but based on their friendship to the appointing authorities.

We have a case of a woman who was appointed a Judge simply because she had sued a senior person for child maintenance. We also have others who were appointed Judges because they offered sexual services to the appointing authorities. Yet we have some who have simply been appointed to act like official gate keepers. They serve the interests of the appointing authority; they do not serve the law.

But then, we also have men and women in the Bench who are beyond reproach. They are prompt in courts, they talk very clearly, they dispense justice with the efficiency that it deserves, they delay no cases and above all, they are well learned in law; people we can call with all confidence as learned Colleagues.

Not all lawyers are learned colleagues. Some just went through law classes as a matter of convenience.

The Chief Justice knows about all of this and that is why, he is resisting the Judiciary being put under Performance Contracts and them embracing the concept of Rapid Results Initiatives.

In this modern day and time, we all know the law. When a case is decided badly, we all know. It is not only the Magistrates and the Judges who are read in law. Many in the public are well conversed in law and cases where there is out right judicial manipulation, we will all detect it. And this is why we ought to demand that Magistrates and Judges are committed to Performance Contracts and Rapid Results Initiative.

Through such engagement, the public will help stem the rot that is our judicial system. Magistrates and Judges who perform should be commended and promoted. Those who under perform must to go back home, while the official gatekeepers will be shamed.

It is through Performance Contracts and Rapid Results Initiatives that we will be able to clearly determine how many cases each Magistrate and j Judge handles in a day, and how many of such cases are dispensed with.

The public must demand that the Judiciary staff in the bench are subjected to bench marks as defined in the Performance Contracts. The Chief Justice owes the country this unless there is an official oath he took in secret to serve and promote corruption in the Judiciary.

EAST AFRICAN NATIONS TO FORM A STANDBY MILITARY FORCE?

From: Leo Odera Omolo
Date: Thu, Oct 8, 2009 at 3:22 PM

THE EAC IS SHAPING FOR THE CREATION OF A PAN-EAST -AFRICAN JOINT MILITARY FORCE TO CHECK ON TERRORISM AND ANY OTHER FORM OF SECURITY THREATS.

Writes Leo Odera Omolo In Kisumu City.

DELEGATES at the just concluded East African Community Peace and Security regional conference held in Kampala this week have proposed for the establishment of a Pan-East-Africa standby military brigade.

But the proposal, which the Secretary General, Mr Juma Mwapachu, described as very popular, will have to be adopted by the EAC heads of states summit scheduled for Arusha later in November this year .

When in full operation, the military unit is expected to intervene in a number of states during national disaster, civil conflicts, piracy, terrorism and other forms of security threats in the region.

“From this conference, there is consensus we really need this force to respond where there is disaster or security threats within any of our member states”, Ambassador Mwapachu told the delegates.

Ambasador Mwapachu, however did not disclose when the force would be inaugurated, but only said it would depend on the consensus of the heads of state of the EAC, at their next summit schedule for next month in Arusha, Tanzania

”It is our heads of states to decide whether or when we need the force to be in place,” he said, adding that the region was already experimenting with the aspects of security co-operation through joint annual military exercises.

“We are collecting ideas on when it can come into force..Its intervention would be proceeded by an invitation by the affected member state, following the pre-intervention appraisal by a group of eminent persons or jurists, if the leaders adopt the proposal at the earliest opportunity”.

The Secretary General said that besides more military war games in the Northern Tanzania, each EAC member state has posted a full-time military attaché at the EAC secretariat in Arusha.

He said the intervention without the consent of the affected government could be counter-productive and engender military opposition even if they supported the idea of creation of the standby military force in the region.

Members of the East African Community are Kenya,Tanzania, Uganda, Rwanda and Burundi..

President Obama makes me proud

From: odhiambo okecth
Date: Fri, Oct 9, 2009 at 6:51 AM

President Barrack Obama has just been nominated the winner of the prestigious Nobel Peace Prize. He joins our own Nelson Mandela, Wangari Mathaai, Desmond Tutu and all those people of repute to have achieved this lifetime feat.

In congratulating President Obama, I want to look at Kenya and the sort of leadership that we have been voting in after every 5 years all through in the last 46 years. President Obama came from a background that does not boast of any political history, yet, in very few years, he was able to climb the political ladder from being what Alfred Mutua called a Junior Senator to being the President of the United States of America.

This is a feat we can learn from as Kenyans.

Can we be able to move with someone else to the promised land? Must it only be these people who have been there to lead us all the time? Are we capable of rising to the occasion and uniting in solving our own problems as Kenyans.

President Obama has been in the front line urging good governance for Kenya, but as Kenyans, what are we doing about it? We are busy strategizing Kalonzo style about 2012. Instead of focusing on the reform agenda, we are busy building alliances against Kenyans. We look at ourselves as Kikuyus, Kambas, Luos, Luhyas, Kalenjins instead of focusing on our Kenyanness.

Then we think of how we can unite to antagonize the rest of Kenyans. Can someone like Kalonzo leave that old Kanu mentality of zoning Kenya against others? Can he and his like think of all Kenya at the same time? That is our paradox. Smallness.

When President Obama is winning the Nobel for efforts he has put in place in entrenching peace across the world, what can our leaders be feted for? Corruption? Nepotisms? Tribalism? Ineptness? Rudderlessness?

And all this just because of us. It is us who vote these people into power every five years, it is us who sing their songs of praise, it is us who kill for them, it is us who will argue and defend their wrongs, it is us…..

In congratulating President Obama, I want to draw comparisons of what we can achieve for Kenya as Kenyans; we can unite and vote out impunity, corruption, ineptitude, nepotism, tribalism and rudderless leadership by voting all the elements who patronize the same vices.

We need to register as voters and overhaul the entire political spectrum right from the Council level to the Presidency. We have time on our side and I believe we can do it. They will not help us achieve this as leaders, they will only come in to fight for spoils, not reforms.

After all, Kenya is leading in IT connectivity and exposure.

Congratulations to President Barrack Obama, at least we have people who have seen leadership in you; Forget Gore Vidal.

Dozens of Albinos fleeing killer witchdoctors in Tanzania seek asylum in Kenya

From: Leo Odera Omolo
Date: Thu, Oct 8, 2009 at 8:18 AM

DOZENS OF ALBINOS HAVE FLED THEIR HOMES IN TANZANIA FOR FEAR OF BEING KILLED BY WITCHDOCTORS AND ARE NOW SEEKING ASYLUM IN NEIGHBORING KENYA.

Writes Leo Odera Omolo In Kisumu City..

HUNDREDS of albinos fleeing their native homes in Tanzania will be readily accorded political asylum on humanitarian grounds.

Close to 50 albinos have been killed in Tanzania and their bodies dismembered and some organs removed.

Three people were last month sentenced to hang by the rope by a Tanzanian court sitting in the Central region Town of Shinyanga. The convicts were given the right of appeal against the mandatory death sentences within 14 days.

The Kenyan government has asked its officers at the Coast Province to register all albinos crossing the common border from Tanzania into Kenya so that arrangement can be made to protect them.

Scores of albinos threatened with deaths in Tanzania have sought refugee at the coast in the past few months, according to a report by Kenya’s fast growing NAIROBI STAR DAILY newspaper.

Although some do enter Kenya legally, majority come through the porous border to escape the wrath and death from witchdoctors in Tanzania who could cross through the two highly porous border points –Lunga Lunga- and Taveta and other parts of the Kenya’s coastal district of Malindi.

Some of the groups of albinos now living in Malindi with their relatives and friends have already expressed fears to the local provincial administration officials and the police. They have expressed fears that they could still be kidnapped or abducted by the agents of witchdoctors in Tanzania, who are reportedly hunting them like antelope for their treasured bodies parts, said to be used in medicinal charms by the witchdoctors.

Sources at the Coast Provincial headquarters based in the coastal port City of Mombasa said there is a ” high possibility” that the lives of the albinos could be in a state of grave danger in Kenya’s coastal region.

A number of albino people taking refuge in the region have expressed their suspicion that unknown people from Tanzania are still pursuing them secretly through the Kenya-Tanzania border post of Lunga Lunga.

And although the registration of albinos began over three weeks ago, only a few of them have come forward and reported at the Provincial Administration offices to be registered. It is, however, believed that they fear arrest because most of them are in Kenya unlawfully, after sneaking through the porous border routes..

In Malindi, the office of the District Commissioner {D.C}has already forward the names of the first lot of albinos to the P.C’s Offices in Mombasa.

Killifi D.C., Katee Mwanza, was quoted as saying, ”We are asking them through their organization to come forward and register with us so that we can offer them security. There are a number of albinos who are Kenyan citizens and also Tanzanians in the district, however, none of them has reported to the DC’s Offices for registration.

Last year, albinos in Tanzania and their counterparts in Burundi petitioned members of the East African Legislative Council, which is the legislative body of the East African Community, to plead with their governments, to give the endangered albinos the maximum security protection. Their association also faulted the slow process that the prosecution cases of those charged with the killing of the albinos in that country was taking .

But in Dar Es Salaam, Tanzania President, Jakaya Kikwete had instructed the police to crack down on witchdoctors suspected with the deaths of albinos, and to arrest and prosecute any suspect before a court of law.

International Human Rights Training

From: Chang Kun
Date: 2009/10/8

International Human Rights Training

The International Human Rights Training Program (IHRTP) is at the heart of the Equitas’ activities. Since 1980, this annual three-week training session brings together approximately 120 participants from over 60 countries. The IHRTP provides a unique opportunity for human rights workers to deepen their understanding of human rights and of the essential role of human rights education in effecting change. As recognized by the United Nations:

“There is a growing consensus that education in and for human rights is essential and can contribute to both the reduction of human rights violations and the building of free and peaceful societies. Human rights education is also increasingly recognized as an effective strategy to prevent human rights abuses.” Goal

The goal of the IHRTP is to strengthen the capacity of human rights organizations to undertake human rights education efforts (e.g., training, awareness campaigns, information dissemination, and advocacy) aimed at building a global culture of human rights. To this end, the Program places a strong emphasis on the transfer of learning and on follow-up activities. Participants attending the Program develop an Individual Plan for putting their learning into action as part of the training. Therefore, when submitting their application, both organizations and Candidates nominated should consider how the transfer of learning might take place within and beyond the organization after the Program.

Objectives

By the end of the IHRTP, participants should be able to:

*
use a framework based on internationally accepted human rights standards and principles to analyze the issues and situations encountered in the work of their organizations
*
determine how to incorporate participatory methods and techniques into their human rights education work
*
indicate appropriate ways for putting their learning from the IHRTP into practice in the work of their organizations
*
identify opportunities for future collaborative and networking activities essential for furthering the cause of human rights
*
determine strategies for promoting gender equality in their human rights education work
*
employ a basic evaluation process for assessing the results of their human rights education work

Selection Process and Bursaries

A Selection Committee will review all applications. In addition to the requirements previously listed, consideration will also be given to overall gender balance and geographic representation. Given the number of applications and limited space available, we are unable to accept many worthy Candidates. Your understanding is greatly appreciated.

Through the support of the Canadian International Development Agency (CIDA), Equitas has funding to award a limited number of bursaries to selected Candidates. Once eligibility has been determined, the Selection Committee will award the bursaries to the Candidates who best meet the requirements. Due to the limited number of bursaries available, there is no guarantee that the selected Candidates will receive funding. Therefore, we strongly urge all Candidates to immediately begin seeking funding from other sources.

Your application must include:

*
The completed Application Form (Part A completed by the Director of the Candidate’s organization; Part B completed by the Candidate)
*
The Memorandum of Agreement duly signed by the Candidate and the director of the Candidate’s organization
*
Two supporting letters from national and/or international human rights organizations (other than the Candidate’s) familiar with the Candidate’s work and/or the work of his or her organization
*
A brochure (and/or mission statement) describing the Candidate’s organization

TAARIFA KWA VYOMBO VYA HABARI

Mimi naitwa Dk.

(c)Ubongo: Mwaka uliopita, 2008, Mhe.

(d)Ini, Figo, Bandama, Kongosho: Mhe.

Wiki mbili zilizopita, Mhe.

Mhe. Rais hana matatizo yoyote.

(i)Damu: Tumekuwa tunamfanyia Mhe.

Tatizo pekee ambalo limekuwa likimsumbua Mhe.
