KENYA: WORKERS CALL FOR THE PROBE OF KAJWANG’S IMMIGRATION DEPARTMENT FOR HAVING ALLOWED ALIENS TO TAKE UP PETTY JOBS AT A LOCAL SUGAR PLANT IN NYANZA.

Both Kenya Anti-Corruption Commission and the Parliamentary Committee on Agriculture have been urged to move with speed and probe the circumstances on=
which close to 39 immigrant workers have been allowed to take up petty jobs in a sugar manufacturing factory in Nyanza.

The workers at the Kibos Sugar and allied Industries want the 48 alien workers from India kicked out and their places taken over by qualified Kenyans.

Some of the immigrant workers are retired and pensioners in the own country, and have been issued with work permits to take up petty jobs such as store keepers,.

Workers have alleged that some of the aliens finds their way into Kenya as priests coming for religious gatherings, and then ends up getting employed on petty jobs which more Kenyan are qualified to perform.

The jobs specifications for the alien workers include security, supervisors in boilers, electrical mechanics, boiler operators, welders, fitters, timekeeper clerks and store men.

Their salaries varied from Kshs 40,000 to Kshs 105,00. The highest paid local personnel is earning Kshs 45,000per month on the company’s employment and is working as boiler engineer, But these foreign workers are not subjected to statutory reductions such as for the NSSF and NHIF.

The company has a work force of 344 employees at its Kibos based factory, which is producing approximately 150 tones of made sugar per day, and pays deduction of about Kshs 137,600 employees including staff and directors.

The company has only 13 local staff and the highest paid is Eng, Alfred Adagi OIwiti whgo is=C2=A0 a boiler engineer. He is earning Kshs 45,000 per moth, while highly paid employee is a MrWilfred Pundo Sumbawho is taking home Kshs 17,000 permonth. Otrhers are Samuel Otok Obinda Kshs 15,000 a carpenter George OIduor Apul Kshs 12,00 and James Atego Awanga also a carpent who earns Kshs 12,000.

Others are boiler foreman Phillip Olima Midigo=C2=A0 a boiler foreman Kshs 7,500, Dan Onyango Omoro Nyanjong=E2=80=99 a canbe yard supervisor Kshs 12,000 Lawrence Ouma Odoyo=C2=A0 Kshs 9,000, another cane yard clerk Dan Muga Koga ,Kshs 9,000,another boiler operator George Kamnola earns Kshs 8,500 ,his colleague Shadrack Ahori Dodo earnws Kshs 8,500, Michael Odoyo Seeh Ksh[1]s 8.500,JamesOtieno Opere Kshs Kshs 8,500,John Odhiambo Okumu Kshs 8,500,Vincent Omondi Bollo Kshs 7,500,Fred Akomo Ochieng,Kshs 7,500 and another boiler operator Shadrack Ahori Dodo Kshs 8,500.

The local workers views the huge gap between the pay-slips of the local and that of the foreign workers as an insult to the dignity of Kenya in their own=C2=A0 mother land. Moreover they said some of the jobs filled by aliens workers can easily be filled with the locals. The reason why these jobs must be [2]

What is so strange is that most of the aliens work under the supervision of their more experienced local workers, and yet they earn ten times more than their local colleagues.

The workers want the government to intervene and ensure that no foreigners are allowed to take up a simple employment that Kenyans are capable of doing.

Most of the sugar companies including the Mumias Sugar Company, which is the largest in this country is managed and manned by local experts of African origins or native. The same is also happening in the tea industry, and the workers are wondering why the government should allow an investor to violent the job and employment guideline or policy of Kenya, which stipulates that a foreign expert may be employed only in a place where local native cannot be found.

This particular firm should be probed by the two institutions so that its reasons for employing foreigners on petty jobs could be established.

It must be made to account for its reasons for employing these imported foreigners from India who are performing odd jobs that could well be done by local personnel skills in all the section of white sugar production and as such does not need any foreigners come here and grab=C2=A0 petty jobs such as time keeper and boiler o0erator or security services.
The workers the immigration Minister and his team to make an abrupt visit to the plant and verify their complaints and if possible eject the fore8gn workers.

Two senior directors of the firm=C2=A0 Mr Ragbhir Singh Chatthe the companychairman of b0ard of directors and the managing director Sukwinder Singh Chatthe could not be reached for their immediate comment.

USA, NC: Timberlake humiliates the Immigration department at high court

Raleigh, North Carolina – Chairman of Placenta Party of Kenya Quincy Timberlake was on Friday released by the Principal Magistrate Ndwiga after humiliating Immigration officials in fresh investigation into his nationality. He was acquitted of being in Kenya illegally.

“This is the beginning of the end of my political detractors and everybody who wanted to discard our marriage, they tried to use cocaine in suit cases and it failed, they tried to use deportation through immigration and it failed and they’ve remained with Finger of God case as a cult case and it shall fail on Nov 4th” He warned.

Immigration officials claimed they arrested him at Comarock on April 1 but Timberlake was picked up from their Runda home and driven to Nyayo House, the Immigration Department headquarters, for questioning, not Comarock.

It was also discovered that members of the church who followed him there said the officials later drove out of Nyayo House with Timberlake to an unconfirmed destination which was known court through his lawyer that the destination was Limuru which is against the law.

The lawyer wanted to know why both Esther and Timberlake were driven towards Limuru but the Immigration prosecutor Mwangagi said that these were orders from “above”.

In an affidavit filed by the investigating officer Alphonce Lumosi, Timberlake by then was suspected to be a foreigner holding a Kenyan identity illegally. Now the court discovered that Timberlake is a Kenyan and the judge declared that he won’t be deported as he’s a Kenyan natural born citizen.

Timberlake has now vowed to attack back painfully and warned that anybody who stood his way and caused him degradation, emotional, physical pain and psychological damages must pay back too.

He also warned of a cartel in the media industry who were being used by the “above” senior officers in government not to air his news on TV and newspapers that their days were numbered as he got all their phone communications and video clips at hand through his powerful invincible security network, Plashinet.

Immigration prosecutor Mwangangi admitted that Timberlake was a Kenyan only he held two Kenyan passports and a forged South African passport. He also insisted that court establish where Timberlake was getting his finances from.

Timberlake remained tough to the immigration agents during court procession and vowed not to be pressed again in Kenya’s history. He told them off that they wanted him pinned down because of his wife Esther Timberlake who their boss wanted. He also threatened to sue their boss next.

This was the toughest battle Timberlake met in court and now he’s proved Kenyans he belongs to this land. He dared the government to factorise more charges and bring them to court.

He even warned Raila that he was going for him after doing enough damages to him and his wife Esther in the past year.

He also warned PM Odinga to stop interfering with his media conferences by phoning the anchors sympathetic to him not to air any news from Placenta Party by threats of sack the way he kicked out political analyst Mutahi Ngunyi.

Timberlake now vowed to officially apply for his American, Canadian and British passports which temporarily cancelled.

He owns several businesses abroad and was unable to go due to these numerous uncouth court battles cooked by his foes, thanks to his secretly organized invincible Plashinet intelligence.

Results from his servants, Timberlake has now forwarded 31 critical video clips and phone recordings to KACC, Kenya Police, CID, his attorneys and NSIS.

“It seems that only friendly media houses shall survive my scathing court attacks which I will do anything positively under the law to ensure that they pay me for damages.” He told Reuters.

” I will defeat them one by one and bring them to Kenyan eyes and they’ll explain how much they received to to defame me and my wife Esther but only my friendly media houses shall escape this scorching knife.” He said.

The Placenta Party chairman said the recent constitutional referendum was a rehearsal for his presidential race and he was ready for Raila Odinga since he declared to work William Ruto.

“We knew our destiny right at the referendum. A clever man kills three birds with one stone,” Timberlake said.

“My hands are clean. They began with the money purported to be imported from cult charges and they failed. I am innocent and even if I am not, how come people have cases in courts, including the government itself including the immigration of whom I have 31 video clips from them receiving bribes from passport and foreign work permit seekers?”

He cited the motion of censure by Ikolomani MP Boni Khalwale and investigations over the maize scandal as some of the plots by his rivals to destroy his political career. He also promised to merry publicly come Monday when Khalwale will now finally go home after loosing court petition to Benard Shinyalu.

“It is him who begun humiliating me in parliament, he should leave Ikolomani seat which he’s been occupying illegally”. He said.

Timberlake was also fined Ksh 40,000 or 4 months in court for having a forged South African passport.

NETHERLADS: CONTROVERSY PERSIST OVER THE DEATH OF A KENYAN

The family of a 29 -year -old man who died mysteriously while reportedly in the custody of immigration police in the Hague-Netherlands now accuse the Kenyan authorities of turning a blind eye into the incident .

Addressing journalists who converged at his Kisumu residence, the father of the late Franklin Otieno Othieno who died on Sunday last week while allegedly being held by the immigration authorities in the Hague said he had officially written a letter to Kenya’s ministry of foreign affairs through the Permanent Secretary to help in probing the matter but so far he is yet to receive any response.

The father of the deceased said he suspected there could have been a foul play over the death of his first born son who had gone to study pharmacy in the United States of America eight years ago and was due to return home when the family received the shocking news on Monday last week.

Mr. Lucas Othieno said it was curious that the Kenyan authorities were not keen to get involved in investigating circumstances surrounding the death of his son who was through with his studies in June this year at the Houston College in the US.

The family insisted to be told by the authorities in the Netherlands why their son was being held and how he died.

They said information they were receiving from the Dutch authorities in the Hague and that from their Kenyan counterparts were conflicting and has left room for speculation as to what realy took place.

Earlier the authorities in the Netherlands had reportedly gone ahead with plans to fly the body back to Nairobi, Kenya’s capital city which is approximately 500 kilometers away from Kisumu where the parents of the deceased reside.

Indeed according to the family,plans were complete and the body was due in Nairobi’s Jomo Kenyatta International Airport by tomorrow,Tuesday but they had to shelve the plan when the family threatened not to travel to Nairobi to collect it.

”If they dare bring the body to Nairobi and not here in Kisumu then they must know where to take it because we will not go to collect it”He said.

Yesterday the deceased’s parents demanded that an independent autopsy be carried out on the body and the procedure be witnessed by a family lawyer or a representative of the Kenyan government so that the cause of death can be established.

”How can they be in a hurry to bring back the body of my son without allowing somebody from his family to witness the autopsy?.This is unacceptable given that the country where my son died is known to champion human rights. Even if he was being held for whatever reason, why do they lock out the family in the whole incident.We need to know why he was being held and what killed him”? Said the father.

But a source from the Kenya’s ministry of foreign affairs said the government was not ready to bear the cost of carrying out another postmortem on the body as demanded by the family insisting that all extra costs in relation to the incident must be met by the family.

The late Othieno who hails from Siaya Alego,the little village known for the roots of the USA president Barak Obama, was reportedly in touch with his girlfriend, also a Kenyan living in the US before he died.

The news of his death was broken to the family on Monday last week by the same girlfriend who is reported to have been rung by the authorities at the Hague but the deceased father disclosed that she had very scanty information regarding the incident that is likely to spark off a bitter international row between the two states.

The Hague is known to be center where those who commit crimes against humanities and other atrocities are tried at the International Criminal Court where even a section of the Kenyan political leaders suspected to have masterminded and financed the post poll chaos in the East African nation are to be tried upon conclusion of investigations by the ICC chief prosecutor Luis Moreno Ocampo.

KENYA: BROKERS TAKES OVER ROLES OF REGISTRATION OFFICERS IN KISUMU’S BIRTHS OFFICE

All manner of brokers have pitched camp at the civil registration offices in Kisumu east district and they are conning unsuspecting members of the public seeking to obtain birth and death certificates with impunity never witnessed before.

Like the official government staff attached to the department, the brokers report to work at the offices as early as 8.00am and remain busy both inside, at the corridors and outside the offices until 5pm – the official time government offices close.

They wake up the following day to do what they have now perfected – conning people with impunity.

And they have been at it actively since March this year when the minister for immigration Gerald Otieno Kajwan’g issued a directive requiring all children joining class one and KCPE candidates to have birth certificates.

They take strategic positions once at work. One of them, a tall dark middle aged man identified by our sources at the office as Pastor is always at hand to receive new applicants outside the offices.

During our under – cover investigations, we found him armed,as always with forms which ordinarily one would expect to get only from the government’s own staff and not a total stranger posing as a civil servant .

The others pose as clients waiting to be served while in real sense are keenly watching out for unsuspecting members of the public who wish to be ”assisted”.

Strangely the officers for hire have created confidence amongst those seeking services there to the extent that they even keep in their custody, vital documents such as original national ID cards from those who have been promised assistance.

When we visited the offices this team was shocked to see the ”officers” carry government documents like forms B3 and B4 which they were dishing out to those making applications to be issued either with the death certificates or certificate of birth.

We learned that several people who landed into the hands of these crooks lost ID cards and thousands of shillings at the same time besides wasting several months waiting for processing of documents these conmen had no ability to give them.

The crooks confidently handle clients as though they have been hired by the government to help with the exercise and to a casual observer,nothing seems to go wrong with what they offer.

Things appeared very rosy for them until last week when several people who previously dealt with them began to smell they could be dealing with conmen operating side by side by a few dishonest staff from the department who are also alleged get their cut from the brokers deals.

On Wednesday last week while waiting to be served, applicants were treated to a rare drama by an irate woman whose son had been tricked by the same conmen posing as civil registration officers.

The woman in her early Fifties had accompanied her son to the offices in March this year to help him get a birth certificate. They then began the long and painful wait. Little did they know that they had been served by brokers posing as members of staff.

When she realised she had been duped she stormed the offices and caused a serious scene.

Officially, those who seek late registration are required to pay Ksh 170 and those who do so as soon as a child is born pay Shs.50 only and a receipt must be issued.

According to officers working in the office who talked to this writer but asked not to be identified, the process should ideally take up to or about two to three weeks before one is issued a birth certificate, that is if it is for late registration.

However the young man’s case was handled strangely. When they visited the office for the first time in March this year ,the young man armed with his national ID card allegedly presented his case to the district registrar who listened and directed him and the mother to another female officer.

They claimed that It was this female officer who allegedly introduced them to one of the brokers identified only as Timothy.She allegedly described the guy as an efficient fellow who would ensure their case was handled fast and to their satisfaction.

Soon the ”officer cum broker” began making several demands in the name of trying to help because the case of the young man who is also a Form 5 student in Uganda was a complicated one.

According to the student they were forced to part with shs 3000 after they failed to raise shs 5000 that the broker had earlier demanded to speed up the process of issuing the certificate.

”But we did not get a receipt for the payment and we did not demand either to be offered one on the simple understanding that we were being assisted.moreover I desperately needed the document to help me apply for a pass port” said the boy during the interview.

After waiting for so long,the young man’s mother could not hold on any longer and on Wednesday she decided enough was enough and no more promises would stop her from telling the officers she was fed up and she caused a scene that shocked everyone present. Business at the busy office came to a near stand still although briefly.

”So many people have suffered quietly in this office but I have had enough of this frustration. Now it is time it is made public. Am ready to even ring the minister in charge of this department.Hon Kajwan’g if that will help push things here.” She shouted in front of the district officer in charge.

Independent investigations revealed that a Mr. Timothy who made away with the 3000 shillings from the mother and her desperate son has since gone underground after word went round that he was being sought over his activities at the office..

Staff from the department whom we talked to confirmed that the man had been working there as a volunteer for sometime now.

”We had a small number of staff which could not handle the influx especially when the program began although it is not clear to us how these guys got the green light to work here. it is however true that they have been here for sometime now. some of them have even learnt how to clean the registers ” one officer observed.

He alleged that when the directive was made and it was apparent that staff at the station was overwhelmed, Nairobi asked their boss to look for additional staff from the department of the national registration bureau which also falls within the ministry but it was not clear whether he made any attempt to get them.

We caught up with one of the brokers named Edwin who categorically stated he has also worked at the offices for two months now.

Edwin who had no slightest idea that our team had a video camera and that our conversation with him was was being recorded even declared himself a government staff attached at the department.

He later changed his story after this writer challenged him to show him his Job card or any document to prove he was indeed a staff there.

He claimed that himself and Timothy who disappeared after obtaining thousands of shillings from other unsuspecting clients were just helping with the work load but insisted they were allowed to do so by people who work there.

It was however clear that the minister’s directive opened up a fertile ground for con artists to swindle many Kenyans here who in their desperate efforts to comply landed into the wrong hands.

Efforts to get audience with the area district civil registrar of births and deaths were futile. When he was reached on his mobile, he said he was still busy and promised to get in touch with this writer. He did not and subsequent attempts to get his comments failed when now his cell phone was switched off.

REPORTS SAYS THE SUSPECTED TERRORIST WHO ESCAPED IN KENYA IS A WANTED CRIMINAL IN AUSTRALIA.

The Kenyan police at the coastal port City of Mombasa have arrested four more terror suspects.

The four were rounded up and taken into custody as they embarked out of an international flight at the Moi International Airport. The police, however, could not tell as to where the suspect’s flight had originated from.

The Coast Provincial Police Officer {PPO} Leo Nyongesa, said the suspects were not among those listed as dangerous terrorists on the police website.

“We are still interrogating them to find out more about them and that is why they have been taken to Nairobi,” he said.

An eye witness at the busy Moi International Airport said he saw five men being driven in a vehicle outside the Coast Provincial Police headquarters. The suspect, he added, were driven straight to Moi International Airport, located few kilometers outside the Coastal City, from where they were supposed to be flown to Nairobi.

But a source at the Airport alleged that all the airlines operating between the Jomo Kenyatta International Airport in Nairobi and the Moi International Airport in Mombasa had declined and rejected them as passengers. It has yet to be confirmed whether the suspected flew to Nairobi or were given tight security escort by road.

Of late, the Kenya police have maintained intensive security surveillance in all major border points on illegal foreigners.

Meanwhile, information has emerged that the runaway terror suspect earlier arrested at the Kenya-Uganda border is wanted in Australia for allegedly planning to attack an army base in Sydney.

According to agencies and security sources in Nairobi, Hussein Hashi Farah had escaped a police dragnet in Australia that saw his four accomplices arrested for planning to attack Holsworthy Army Base and helping send people to Somalia to fight with al-shabaab Islamic militia, which is a proscribed terrorist group.

The other four suspects arrested in a dawn raid on 19 properties across Melbourne in Australia were identified as Abdirahaman Ahmed 25, Nayet El Sayed 25, Yacqua Khayre 21 and Saney Edow Aweys 26.

They were arrested last August 4, 2009, and have since been charged with conspiracy to plan a terrorist attack.

Prosecution in a Melbourne court alleged that Aweys, with four others, planned to arm themselves with guns and walk into the army base in Sydney Southwest, and kill many soldiers in a suicide attack.

Transcripts of Australia Federal police telephone intercepts tendered to the court last year showed Aweys praising Allah for coming down on the “filthy people” of Australia through the Victoria bushfires, global financial crisis and drought.

Official sources in Busia and Nairobi say Farah travel documents showed he had visited Kenya on November 25, 2009 and that he had landed in Addis Ababa and connected on a flight to Kampala, from where he found his way into Kenya.

His name, however, was put on the most wanted men list of terror suspects after Australian authorities alerted other international and friendly countries security agencies in the region.

“It seems he has been coming here and sneaked into Somalia,” said a senior police officer who requested anonymity.

Farah escaped from police custody hours after he had been arrested and booked at the Busia Police Station in Western Province two weeks ago.

The three police officers who handled Farah have already been interdicted by the force while two prominent businessmen have been charged with aiding a suspect escape from lawful custody. The incident happened on March 13, hours after the arrest.

Farah had in his possession Kshs 258,400, all in US dollars when the immigration official arrested him as he attempted to have his paper cleared for entry into Kenya from the Ugandan side of the border. He was supposed to have been escorted to Nairobi immediately under a tight police security for further interrogations.

Authorities believe Farah, who is on the list of prohibited immigrants, might have escaped and sneaked back into Uganda. Suspicion, allegation and rumors that the suspect might have used his dollars to bribe his way out of the police custody cannot be simply dismissed and wished away. Bu top security officers in Uganda came out spiting fire on Wednesday and categorically denied hat the suspected terrorist is in their country.

Farah holds an Australian passport. Anti-terror detectives had identified him as one of the operative Somalia based al-Shabaab militias and he has been placed on international watch list, but his mission in Kenya is not clear. Obviously his mysterious disappearance has embarrassed and dented the good image and reputation of the Kenya police force.

Investigations have since established that the suspect was given “special treatment” while in custody. Two anti-terror police units will soon be launched at both Busia and Malaba border posts, separating Kenya with Uganda in Kenya’s Western Province.

Following the terrorist’s disappearance, the Australia government has since written to the Kenya’s immigration Ministry demanding to know Farah’s whereabouts.

But Immigration Ministry in Nairobi has since in turn written to the Commissioner of Police, Mathew Iteere, requesting for more information on Farah’s whereabouts.

KENYA: HACKNEYED POLITICIANS ARE LOOSENING OUR CITIZENSHIP TIES AND UNDERMINING OUR PATRIOTISM

Dear Sir/Madam,

Is it possible for one to profess love for one’s country and in the same vein hate its citizens with unlimited passion? Absurd as it may sound yet this is the paradox that is increasingly defining the relationship between the electorate and the many diabolical politicians. They are so stone cold to the fact the contempt with which they hold this country is threatening to loosen the ties of citizenship and greatly undermine our patriotism.

Hackneyed politicians are furiously and callously driving the country to a precipice. Sample this; honorable Zakayo Cheruiyot, is overheard in a political rally spewing incendiary remarks to the effect that “the Kalenjins will assist the police in apprehending those who will throw stones.” He only stops short of stating why and when this “turbulence” will take place. Yet the Government has not found it necessary to question him over his “prophetic message.”

In another related incident, honorable George Thuo alongside a section of the central Kenya legislators are overheard trashing the prospective meeting between the Prime Minister and President Mwai Kibaki. With such theatrics, the public is left wondering as to who exactly stands to gain if the high political temperatures are sustained in this country.

Curiously, the same legislators have been heard elsewhere opining that those currently fighting graft are engaged in a diversionary tactics to scuttle the constitution making process even though there isn’t any iota of evidence to remotely suggest an interconnectedness between the fight against corruption and the constitution making process.

As the above scenarios play out, the country is now being subjected to the conjecture that conspiracy theories to discredit targeted political personalities and political parties have started being manufactured. I have a hunch that the public will be fed to more and more of this political conspiracies.

From the above incidents, one does not need to be a professor of politics to be able to tell that unconscionable politicians are deliberately orchestrating a political disorientation. This political disorientation is a perfect smokescreen for this cabal to throw a protective ring around those implicated in graft. Secondly, they hope to use it as a reason enough to disembark from the Grand Coalition Government (GCG) and hope that President Kibaki will have the carte blanche to invite renegade ODM Legislators to form a Government of National Unity (GNU).

Such reasoning is childish because the GCG is not about an individual as these Legislators seem to think. GCG was conveniently put in place to accommodate the disenchantment of a larger part of the electorate arising out of a flawed electoral process. That is why the National Accord and Reconciliation Act succinctly states that no side of the two political parties (ODM and PNU) can realistically govern without the other. Neither can PNU nor ODM undergo a mutation to become an acceptable ruling party outside the GCG. It therefore follows that any attempt at prematurely disembarking from this political structure must inevitably give rise to a general election failure to which another politically instigated blood letting will be ushered in. This is the chilling reality that must be accepted by these conniving politicians.

Political leaders must therefore come to their senses and begin to appreciate the fact that the citizenship of this country needs and craves for better leadership. Such leadership cannot be demonstrated through their criss- crossing the country to hold political rallies with a view to spreading vile disinformation with overwhelming rhetorical force nor in manufacturing targeted political conspiracies.

Landmark decision by the Kenyan High Court resolves the dual citizenship issue for Kenyans in diaspora

Justice L. Kimaru of the High Court of Kenya released a landmark
decision on the issue of citizenship on 22 January 2010. That decision
puts to rest the odious attacks on me by the Party of National Unity
(PNU) and other malicious detractors over the unfounded allegation
that I lost my citizenship because I allegedly acquired Canadian
citizenship and passport. PNU busybodies went berserk and called on
the Prime Minister of Kenya (PM) to fire me purportedly for “working
illegally.” They went further and demanded that I be prosecuted for
“lying” ( I don’t know where, when and how) about my “status.” PNU and
other malicious miscreants knew that I have never lost my citizenship.
They also knew that I have never lied about my status; nor have I
broken any laws. They know that I have never renounced my Kenyan
citizenship and remain a proud and patriotic son of the soil. But they
didn’t care. Their intention was to besmirch my reputation. They
wanted me to wrestle with them in the mud they had created so that
they could smear my reputation with cow dung.

Full-page paid advertisements were published by a section of the print
media (Daily Nation and The People) too eager to please their puppet
masters. Electronic media was used to scandalize me during prime time
news for more than one week. A few misguided individuals reeking with
green envy and rancid jealousy went to lunch with the false stories.
They perpetuated the falsehoods through fake “letters to the editors,”
“opinions,” “cartoons”, “news briefs”, and “news analysis” (Standard;
The People; Daily Nation; Sunday Express; The Star; and Weekly
Citizen)) of the cow dung they had thrown while pretending to respond
to articles I had published in the Star newspaper on important
national issues affecting Kenyans. Those were issues of corruption,
abuse of power, good governance, constitutional change and an end to
impunity.

Other idlers on the Internet took off with the libel and have
continued to defame me with the hope that they might distract me from
persistently pursuing social-justice issues and performing my
functions at the PM’s Office. Some confused, inept, malcontent and
clearly ignorant MPs from Nyanza Province joined the fray without
knowing or understanding what the issues were.

Without exception, the idlers never bothered to respond directly to
the issues in my articles. None of them challenged the factual
accuracy in my articles. Unfortunately for the malicious, the
libelous, the envious and the jealous busy-bodies, Miguna has remained
a solid rock, cascading on course (with other committed compatriots)
towards the total liberation of Kenya. No amount of malicious filth
will prevent that eventuality.

Now the High Court has said: ‘Wait a minute; a Kenyan citizen by birth
does not and cannot lose his/her citizenship merely by acquiring a
foreign one or passport; he can only do that if or when he renounces
his citizenship, and the person advancing the allegation of lose of
citizenship has the burden of proof!” That was my position all along.
I kept telling the Kenyan media that they were wrong to clutch on
straws; that the onus was on PNU and the idlers to prove their
allegations by adducing credible evidence. It is now time PNU, the
gullible and mendacious Kenyan media and all those miscreants to
publicly apologize to me.

This is sweet redemption to me and the ODM fraternity, coming on the
heels of another major High Court ruling at Mombasa: the one that
relegated the former MP for Matuga, the Lingala bellowing Ali
Mwakwere, to political oblivion. I relish the adage about the “wheels
of justice grinding slowly;” very true indeed.

It all started with an election petition by Mahamud Muhumed Sirat
against the MP for Wajir South, Abdulrahman Ali Hassan. Mr. Sirat had
sought to nullify the election of Mr. Hassan over allegations of
electoral malpractices. Rather than deal squarely with the petition on
its merits, Mr. Hassan made an application seeking to have the
election petition dismissed with costs on the basis that Mr. Sirat was
not a Kenyan citizen. He argued that Mr. Sirat had voluntarily
acquired the citizenship of Australia and therefore owed allegiance to
the government of Australia. Mr. Hassan further argued that the
petitioner, being Australian, was not eligible or ought not to have
been registered as a voter in Kenya and could not have qualified to be
elected an MP in Kenya. Finally, Mr. Hassan argued that Sirat lacked
legal and constitutional capacity to institute or to proceed with the
petition.

Along the way, Mr. Hassan recruited gullible immigration officials and
an ODM minister to boot who managed to howl Sirat from the sanctity of
his home into the State dungeons on mere allegations of a political
opponent. Forget about the presumption of innocence. Mr. Hassan
vigorously argued that Sirat had no locus standi to file and present
an election petition; that even the Court had no jurisdiction to hear
the petition. Sirat was supposed to be detained and deported without
being heard!

In response Sirat argued that Hassan’s application was frivolous,
vexatious, incompetent and an abuse of the court process. He stated
that the application was only meant to frustrate him from prosecuting
the petition. Sirat also asserted that he was a citizen by birth, both
his parents being Kenyan. Further, he indicated that he had valid
Kenyan national identity card and passport, duly issued by the
immigration department. Finally, Sirat denied ever having renounced
his Kenyan citizenship in preference for an Australian one. He
produced copies of his birth certificate, national identity card and
Kenyan passport as evidence of citizenship. Sirat also produced copies
of his academic certificates to establish the schools he attended in
Kenya.

In his judgment, Kimaru J. stated that Sirat, “by virtue of his birth
in Kenya, and the fact that both his parents are citizens of Kenya, is
entitled [to] citizenship of Kenya.” The judge stated that section
97(1), (3) and (7) of the Constitution of Kenya does not deprive a
Kenyan citizen by birth of his citizenship upon acquiring nationality
of another country. He opined that sections 88, 90, 92, 93, 94, 95 and
97 of the Constitution only “prohibited persons of a particular
category who are citizens of other countries at the time Kenya
attained independence”. Those sections do “not apply to citizens of
Kenya who acquired citizenship by virtue of their birth from acquiring
citizenship of another country after attaining twenty-one years of
age.”

And finally, Judge Kimaru stated what amounts to a judicial left hook
clincher: “[E]ven assuming that the petitioner had indeed acquired
Australian citizenship, there is nothing in the Constitution that
specifically prohibits the petitioner from acquiring such citizenship
while at the same time retaining his Kenyan citizenship provided that
Australian law allows for its citizens to acquire and have dual
nationality.” The only exception is when a person specifically
renounces his Kenyan citizenship and acquires citizenship of another
country that does not allow dual citizenship.
Since Mr. Hassan produced no evidence that Sarit renounced his Kenyan
citizenship – and that even if he was able to do that, he would still
have to prove that Australia did not accept dual citizenship – the
Court concluded that Sarit remains a Kenyan citizen. The judge also
ruled that copies of a foreign passport are mere pieces of paper that
could have been generated or downloaded in any cyber café. The
possession of a Kenyan national identity card and passport, the judge
ruled, are prima facie evidence of citizenship. The Court refused
Hassan’s invitation to look behind or beyond the national identity
card that the petitioner possesses as prima facie evidence of his
Kenyan citizenship. Kimaru J. stated that the Court “lacks
jurisdiction to invalidate or declare invalid a national identity
card”, which have been duly issued.

With this milestone judgment, Kenyans have hope in the reorientation
and reform of our judiciary

IS OUR COUNTRY KENYA SINKING OR NOT???.

Something is seriously wrong with our country. This country is either sinking or completely going bankrupt.
A country which has been independent for almost 46 years:

– Can not finance her own education, can not provide education to her future, can not provide enough food for her citizens. Guys: if Kenya can not provide education to her future generation then what type of future are we talking about?
– The system is encouraging human slavery. Without proper education, future Kenyans will be looking for low paying jobs, not only in Kenya, but also outside Kenya, in places like Saudi Arabia, where Kenyans are already being thrown through the window to die.
– USA has also just given the information that they are stopping financial aid to the government: So please tell us, if our government is also being financed by foreigners, then where does the money come from to pay Mps all those figures?. The other month the British government issued a statement that the money they gave for primary education was already pocketed by thieves.

-The new constitution is also at the dwindling state: I can not understand why a country so much polarized with tribalism, still wants to divide people more. We used to read the colonial history in Africa, how whites did the divide and rule system every time they wanted to conquer an African. So why is our new constitution still full with this adding more constituencies, who will this divide and rule serve?. Why dividing again a country full with a lot of divisions, ( from tribal, to religion, poverty, rich, education for poor are already different for the rich etc). Why another presidential system after it has failed the country for 46 years?. Why not to experiment on another system: Remember God help those who help themselves.

-A country having lots of unsolved scandals, from Goldenburg to unpaid for Hotel like Grand Regency.

-Child abuse in the coast is being shown in Television almost every where including Europe. Countries like Finland have made even documents on pedophiles in the Kenyan coast. What is the government doing?. Lands for private Villas are over sold in the coast and now even threatening the tourist industry itself. Whose interest are these things being done on?. In Nyeri, Kibaki`s back yard, children as young as ten have to sell sex for food.

-The post election violence creators and the victims are not yet resolved. Kenyans are still in Uganda as refugees after the violence. The country is full with courts and the so called judges, but can not even try the post election criminals herself. This is an indication that the country is having no leaders to do all these at a time when they are eating or even over eating what the country’s tax payers can not afford.

– The country has gone down that even terrorists take to the streets to demand equal rights, what type of system is this?. Soon you will see pedophiles doing the same, when people like Wagner are just being released like that.

– Just imagine how Lord Dalamere treated Africans and now his grandson is just killing Africans like a fly, 46 years after independence and nothing is done. I wonder sometimes when I hear a fellow Kenyan writing that we do have a lot of progress; where is that progress?. Can somebody tell me?

– The future of Kenya now completely lies on the young generation. The so called present old generation have let the country down and are sinking it. But how will the young generation manage it with all those debt these Mps have eaten and are still eating? Next time you might wake up to find that you are a foreigner in your own country, since Kenya is being sold indirectly in bits and bits. Go to the coast you will see that your movement is already restricted.

– Let the young generation take this dwindling constitution away from the present monsters who think that they are the stakeholders, so they deserve the right to do what pleases them, or what pleases their bosses.

With all these problems unsolved and a foreign government or governments financing our daily life and most important, future strategic systems like education: Guys I am afraid to tell you that we are already indirectly colonized again. What a pity after 46 years of dictatorship, then again going back to the ghetto.

The above amount is the money that the Minister of immigration wants to steal and ROB the Kenyans.

Let Mr. Otieno Kajwang explain  why there is necessity to go from Kenya to South Africa then Miami in Florida, then to Europe, Switzerland and then back to Jamaica!

Stealing and robbing Kenya with this contemptuous way is beyond description! There have never been money to cater for Kenyan citizen’s needs, yet there are 40 million to take sight seeing tour?

Mr. Kibaki, we know you are not caring or capable of doing anything for Kenya. Can you at least do one sane nice thing for Kenya? Issue an order to send this man to the border of Tanzania, and send him back there. He came from there right?

Alternatively, this cleric has done nothing against Kenya, leave him alone, and he would soon go when he is told to leave or when his Visa expires!

40 Million, to be spent in such a manner is horrible. At least if we were rich, we would not have bothered! But for heaven’s sake we can not afford it!

That amount are geared to going into the minister’s pockets, and the few officials at the department of immigration.

Kenya is in serious trouble, there is no preparedness for any kind of Emergency! Look at Haiti now! Are you happy the way they are hapless, even to get out and pick up a dead body on the street? How complex is that to do?

They, the Haitians are living under the yoke of black men, who took over from the French. They are living in a nightmare, in a manner of Kenyans. Their country is run, in a manner that Kenya is run and managed! Haiti, is like Kenya, and if we do not wake up, sorrow is yet to visit us!

465 Nigerians are dead right now in Jos, why? well it is exactly what Kenyan Officials are doing now, harassing the Citizens without any genuine reason! For years, the Nigerians have failed to care for their citizens and the nation is now reaping her fruits of those years of neglect!

Kenyans have been with Muslims for years, why are we now going over head mistreating them in 2010? Are they not still the same Kenyans as they were all those years past?

Americans are playing a different game, but the Kenya’s game is this; Can I put food on the table and buy clothes for my kids? Can I be able to save them from death when they get ill tomorrow? Where will I be next, after being rendered homeless, evicted from my home?

Will I be the next Police victim of execution?

This are the very important things that Kenyans want solved. They do not care about some remote cleric who is out talking in unreal, beneficial way to Kenyans. He can never convince any one with reasoning mind!

How would their talks help the poor and poverty stricken populace to solve their children’s issues. Things such as, lacking schools to attend this year. How would the 40 Million wasted on the Alien cleric solve Kenya’s problems?

How did this man end here in Kenya? And why can’t he go back the way he came into Kenya? Who issued him with the Visa to be in Kenya in the first place?

If 526,939.79 Dollars are spent, it will not be because we had to, it is because the Minister Otieno Kajwang has stolen it for personal use!

It is a fleezing and a true day light robbery!

WHY IS MIGUNA MIGUNA AN ISSUE?

I was not born yesterday. The best way to create enemies is to outcompete your friends. Now that Miguna Miguna has outcompeted his friends and enemies, they have chosen to blacklist him. Correctly so though, Miguna is a Canadian citizen, and he should own up to that. However in Kenya, where the law is for them and not for us, Miguna and those who employed him hoped to pass.

If Anglo leasing went through and everyone kept quiet, including the noisy PNU, then why should anyone make noise about a poor child from Nyando becoming a Canadian citizen, then moving back to be an adviser of the prime minister? 

In my village and many other communities, this would be a miracle. It would be a reason to  praise God. This is an achievement of godly proportion, and though I had said before that “olund Miguna Miguna ok e dish mawatoke”, Miguna still stands out as a fighter, and no one, including me, can take that away from him. It is ok to call a spade a spade though, even when your competitors are involved in bad governance, hence you try as much as you can to do right.

However, in my view, the PNU contention is a mere vendetta. The Somalis, born in Somali, are running around and working in Kenya. Why should Miguna Miguna, born in Ahero, not live in Ahero and by extension Kenya. Africa is screwed and screwed but that is another topic.
 
For Nyanza MPS to gang up against Miguna, something must be extremely wrong and I bet you , I know what it is. Raila eventually found someone who has a complementary chemistry to his. Anyone who has met Miguna says he is arrogant. At the same time anyone who has met Raila says he is not openly arrogant. However, he is openly cunning. Arrogant/ cunning, we have a match. Miguna is the complementary half Raila has been waiting for. The luo MPS can cry as loud as they want, but I must say, Raila has made his choice. It is Miguna Miguna. Raila found the rest to be psychophants of which Miguna is not. Believe me Miguna is a man who can tell you and I repeat, “olundi ok e dish mawatoke”.
 
As an Obedient student of Raila, he was expelled from the Nairobi University. He believes in Pan Africanism, which is Odinga family’s  brain child. What else can Raila ask for? Miguna comes from a small village in Wawidhi. I come from Kakola, a little bit bigger than Wawidhi, but with no member of parliament candidate. I watched Miguna on NTV and in comparison to his days on campus, and high school, Miguna has turned out to be a man I can campaign for in Nyando. Outa must retire. He has no national outlook as Miguna. He should be aware of this.

There is only one thing I ask of Miguna. Obey the law sir. Stop embarrassing the prime minister. Be a Kenyan citizen, until the law allows for dual citizenship. The Kenya of yesterday is not the Kenya of today.

Kenya gets stuck with a controversial Jamaican Muslim cleric who has preached himself out of countries.

KENYA SAYS THE COST OF DEPORTING THE CONTROVERSIAL JAMAICAN MUSLIM CLERIC  WOULD AMOUNT TO KSHS 50 MILLION OF TAXPAYERS MONEY. BUT IT HAS FOUND NO COUNTRY THAT WOULD ALLOW HIM EVEN TRANSIT LANDING RIGHTS.

There is an ongoing police crackdown on foreigners in Kenya, following last Friday’s bloody riots in the capital, Nairobi which left scores of people dead, many injured and property of unknown value looted or destroyed.

Last Friday, rioting Muslim youth took to the streets simultaneously in the capital city, and in the coastal port city of Mombasa, immediately after the midday prayers.

The Muslims were protesting what the demonstrators termed as “illegal detention” by police of the controversial Jamaican Muslim preacher, Sheikh Abdullah al-Faisal.

The controversial Muslim cleric had sneaked into the country using what are locally known as “Panya routes” or “rat routes” from Tanzania, and crossed the border incognito into Kenya via Lungalunga border post at the coast.

His presence was immediately noticed by the hawk-eyed Kenyan security intelligence, and he was arrested  by the uniformed police on December 31st, 2009 at Nyali Mosque in Mombasa. Thereafter, the government of Kenya has made several attempts to deport him out of the country, but all in vain.

First, the government deported him to the Tanzanian border, claiming that he should be Tanzania’s responsibility, since that is where he had entered Kenya from. But Kikwete’s government would hear none of it, and blocked his entrance into Tanzania permanently.

Then an attempt was made by the Kenya government to deport him to Gambia, a plan which looked quite promising for a while.Through inter-government negotiations, the Gambian government had agreed to allow him into their country. He was flown from Nairobi to Lagos on a commercial airliner, en route to Gambia.

The plan however unraveled in Lagos, after the Nigerian authorities could not allow him to alight from the plane that had flown him from Nairobi to Lagos, for transit to a connecting flight to Gambia. He was thus flown back to Nairobi in the same plane that had flown him to Lagos, the very same day.

The Gambian government has since then sent word to Nairobi that they would now not accept the controversial Muslim cleric into their territory. The same goes for all other countries with embassies in Nairobi, who have also indicated that the cleric is banned in their countries.

Today, Kenya’s immigration Minister, Gerald Otieno Kajwang talked about the frustration that the government of Kenya is facing, and the options it was considering to have the matter resolved etc.

The minister admitted that the Kenya government is stuck with the unwanted Muslim cleric, not knowing exactly what to do with him. No country in the world would allow plane carrying the controversial preacher the landing rights for neither refueling or transiting permission to any country of his choice.

The Minister said that the possibility of chartering an airplane to fly the controversial Muslim cleric directly from Nairobi to Kingston, Jamaica is logistically impossible. “The Plane would have to stop somewhere en-route, for the purpose of refueling. But no country is willing to grant such facilities”, he said.

The Minister revealed that the government is in dilemma, and frustrated, not knowing what to do next. He said the cost of a direct flight from Nairobi to Kingston is being estimated at Kshs 50 million. “This money is not there. Even if it is there, there is also the other logistic constraints, because the plane will have to stop at one or two other places for refueling”, the minister lamented.

“We are still negotiating with other friendly countries, but the chances of success is very slim. The money involved is also very colossal as it would come from Kenyan taxpayers money”.

Kajwang said the government has contacted several friendly government, but none was willing to even allow its territory to be used by the plane carrying the controversial Muslim cleric. He readily admitted that the government was facing frustration and embarrassment as well.

The controversial Muslim cleric, who preaches the sermons of racial hate, and religious discrimination between the Muslims and Christians, at times making war-cries, sneaked into Kenya from Tanzania after visiting Tanzania, Malawi, Zambia, Nigeria, Angola, Mozambique. He is believed to have been heading to Somalia, in order to link up with the Al-qaeda backed Al Shabaab militias, who are fighting to overthrow the UN and AU backed  Somali Transitional Government.

But as the Kenyan government engaged on quiet diplomatic maneuvers and intensive negotiations, in a concerted efforts to find the ways and means of facilitating passage home for its unwanted guest, the Kenya Muslim leaders have announced another planned demonstration to protest the continued detention of Al-Faisal by the government. The demonstration will take place soon after the Friday midday prayers at the coastal port city of Mombasa. The police  have banned the demonstration of any kind, but the clerics have insisted that the protest match will take place with or without the police permission.

The next protest match is aimed at demanding for compensation and an apology. They said two of their people were killed, 14 other injured and hundred held hostage by police inside the Jammia Mosque in Nairobi.

The civic society, however, wants the government of Kenya to charter a plane to fly Al-Faisal back to his home in Jamaica as soon as possible, in order to restore peace and stability.

A sharp division has, however, emerged among the Kenya Muslim clerics and leaders. The moderate leaders have cautioned those planning for another demonstration to abandon it as it serves no meaningful purpose.

Kenya’s Internal Security Minister, Prof George Saitoti, has  blamed “violent” foreign elements  from a neighboring country for last Friday mayhem.

The minister appealed to the Muslims in Kenya to remain calm. He assured the Muslim community in the country that they would not be targeted, adding their civil liberties would be upheld and respected, therefore they have nothing to fear.

The Minister said that the government would open an inquiry into the violence, adding they would deport Al-Faisal out of the country as soon as possible.

The  on-going police dragnet and clamp down on foreigners has extended from Nairobi to several towns in Western Kenya like Eldoret, Kisumu, Busia, Bungoma, Webuye, Kitale, Siaya, Kakamega. It has so far netted hundreds of foreigners discovered to be in  Kenyas without property documentation.

Those netted include Ugandans, Tanzanians, Rwandans, Sudanese, and those from the Democratic Republic of Congo and Somalis. Even the Maasai watchmen from Tanzania, who had invaded Kenyan towns in their hundreds, have been rounded up, arraigned court and deported back to their home.

US government grants Temporary Protection Status for Undocumented Haitians living in the US

Please find a press statement below from Secretary of Homeland Security, Janet Napolitano, regarding the situation in Haiti and Haitian nationals in the United States.

As part of the Department’s ongoing efforts to assist Haiti following Tuesday’s devastating earthquake, I am announcing the designation of Temporary Protected Status (TPS) for Haitian nationals who were in the United States as of January 12, 2010. This is a disaster of historic proportions and this designation will allow eligible Haitian nationals in the United States to continue living and working in our country for the next 18 months. Providing a temporary refuge for Haitian nationals who are currently in the United States and whose personal safety would be endangered by returning to Haiti is part of this Administration’s continuing efforts to support Haiti’s recovery.

At this moment of tragedy in Haiti it is tempting for people suffering in the aftermath of the earthquake to seek refuge elsewhere. But attempting to leave Haiti now will only bring more hardship to the Haitian people and nation. The international community has rallied to deliver relief to Haiti. Much has already arrived and much more is on its way. The Haitians are resilient and determined and their role in addressing this crisis in their homeland will be essential to Haiti’s future.

It is important to note that TPS will apply only to those individuals who were in the United States as of January 12, 2010. Those who attempt to travel to the United States after January 12, 2010 will not be eligible for TPS and will be repatriated.

The Department of Homeland Security continues to extend sympathy to our Haitian neighbors and support the worldwide relief effort underway in every way we can. Four Coast Guard cutters have arrived in Haiti, in addition to a variety of Coast Guard assets that were already in the area to support military air traffic control, conduct damage assessments and rescue people in need of assistance. The Federal Emergency Management Agency (FEMA) continues to work closely with the U.S. Agency for International Development (USAID) and the State Department—the lead U.S. federal agencies in the response—while coordinating the deployment of state and local Urban Search and Rescue Teams from across the country to Haiti and standing by to provide food, water and other resources as requested. U.S. Customs and Border Protection (CBP) has provided aircraft to support response efforts.

Mr. Miguna Miguna did not renounce his Kenyan Citizenship, therefore he has not broken the law, says Immigration Minister

KENYA’S IMMIGRATION MINISTER COMES OUT IN SUPPORT OF THE EMBATTLED RAILA ODINGA’S AIDE AGAINST ACCUSATIONS OF DUAL CITIZENSHIP.

KENYA’ Immigration Minister, Gerald Otieno Kajwang’, yesterday came out in full support of the embattled Raila Odinga’s aide, who is facing allegation that he had registered himself twice as a citizen of both Kenya and Canada.

In an interview  with NTV forage last night, the Minister said Mr. Miguna is a Kenya citizen by birth.

“I have looked at his personal file and there is no evidence that he has  ever renounced his citizenship”, the Minister said.

Mr. Miguna Miguna, Mr Odinga’s adviser on coalition affairs, has of late found himself under tight scrutiny by politicians aligned to PNU wing of the coalition government. They wrote a letter to the Prime Minister, Raila Odinga, and copied it to the Head of Civil Service, Ambassador Francis Muthaura, calling for his immediate sacking, citing his dual citizenship, which makes it illegal for him to engage on any kind of employment in the country without a work permit.

The letter, which has been described as malicious and libelous by Mr. Miguna Miguna, and which was copied to all newsrooms, asked Mr. Odinga to fire his aide, who is a lawyer by training, from the coalition management team, for alleged breach of the constitution.

Defending himself from accusation, Mr. Miguna Miguna said,  “I am a Kenyan By birth, I have never renounced my citizenship, which is the only way I could have lost it”.

He went on, “Publishing expired passports is both malicious and misleading. The onus is on those advancing the ridiculous claims to prove them”.

In his response, the Prime Minister Mr.Odinga told newsmen that he had asked the Immigration Minister, Otieno Kajwang’, to issue a statement. This was after he had received the letter of complaint from the PNU regarding the validity of Citizenship of the vocal Mr. Miguna.

On Tuesday this week, Nyanza MPs held a press conference in which they scathingly criticized the abrasive Mr. Miguna Miguna for publishing a hard-hitting article in one of the Kenya’s dailies questioning how the retired President Daniel Arap Moi had acquired property, including the Kaptagich Tea Factory and the surrounding  land and tea plantations. The Luo MPs said they were upset that Mr. Miguna Miguna wrote that Mr Moi had only colonial level four standard of education.

A number of MPs from Luo-Nyanza who were reached for their immediate comment appeared to be unanimous that Mr. Odinga’s most trusted aide seemed not to be getting on well with other leaders.

It did not come as surprise to see Hon Fred Outa, the Nyando MP, who hails from the same constituency with Mr. Miguna, as living under fear and panick, that the abrasive lawyer might be planning for his ousting, come 2012.

But the Immigration Minister yesterday exonerated Mr. Moiguna Miguna of any wrongdoing.
