Paul putting together an ECK is not so hard once Kenyans resolve that what they need is fresh elections. Electoral Commissioners are Kenyans appointed to conduct elections through the Constitution. So once calls from all corners of Kenya for fresh elections are made..there will be an electoral body to handle the elections. I tell you if we remain with this coalition for the next 4 years..wait and see what will happen in 2012..Massive Rigging and we shall back to December 2007 again.

I hope you read Mutahi Ngunyi’s article..the Media Bill is a prelude to massive rigging in 2012 and then silencing the media using the law..Uhuru Kenyatta at Finance will the conduit for campaign money for Saitoti..and swearing in Saitoti at night is no big deal..according to this deal..Kenyans will fight..make noise ..demonstrate but the rigged in candidate will stay..maybe we will have another negotiated coalition government..with whats going on..kenyans should forget a new Constitution by 2012..and Kenyans should forget that Tribalism will even be tampered with..It will always remain so long we have masses that are willing and ready to support tribalism and even defend tribalism and corruption..Havent you read in this forum people defending Kibaki and Kimunya??? havent you read people playing the card of lets blame them all..just as they did when PNU rigged in 2007? We are a long way brother but lets all be hopeful..

If Kenyans could shun tribalism..unite and vote in leaders according to their policies and not tribe then we can get rid of this yoke and build this country..we talk well in these forum..we even hate tribalism in these forum but when it comes to voting we vote tribes not policies..Who knew that Kibaki would handsomely win Central Province after the Artur Brother scandal..the Goldenberg..the Anglo-leasing..tribalism..no new Constitution..no respect for agreements..skewed allocation of resources..But people of Central still voted for him..because he was one of their own nomatter what he does to Kenya…who knew that anyone would vote for the Wako Draft which gave the President even more powers than he currently has?..people from central saw it differently..all they wanted was Kibaki at state house period nomatter what he stands for..Lets be honest with each other..and lets discuss hard issues..lets not run away from discussing tribalism..the eyesore in Kenya..

While I trully appreciate the views you have taken, I would like to hear your proposals on how we woud conduct an Election in the absense of an ECK.

Thae politicians seem to have conned us again. What we need first is to push this govt to put an ECK in place but calling for election without one is like shooting ourselves in the leg.

THank you for your compelling reasons for another mediation team to sort out the mess in the Coalition. However, I wish to disagree with you on this.

That the coalition has failed to deliver is clear for all to see. The uneasy cohabitation within the partners is apparent to all. I do not see a thing to mediate about. Will it be mediation between Kenyans and a few politicians who cannot deliver? Would it be another round at Serena hotel between the same current failures in parliament? Or is it mediation between the same old, confused, ideologically bankrupt tribal political parties? Another round to have the Karuas, Rutos, Odinga’s, Kibakis and all the crowd of them to bask in the limelight of a nation that cannot even feed her people? No, we are tired of all these. Let them be given an ultimatum by the Kenyan people. Right now. Or the people power must now be applied with the mightiest of forces. We can do this. We must do it.

ANOTHER MEDIATION TEAM IS URGENTLY REQUIRED TO AVERT A POSSIBLE FALLOUT IN THE COALITION

The Coalition government is a product of Kofi Annan led mediation team, entrenched and brought by the enactment of National Accord Act; an act that stipulates among others the conditions upon which the coalition government mandate shall come to an end. This is captured in the clause that say “….. In the event and circumstances that one party to the coalition withdraws from the coalition, the government shall cease to exist and as such fresh election would be called.†This means that withdrawal of one party either ODM or PNU will automatically lead to the collapse of the coalition.

The parties to the Coalition at this moment may want many Kenyans to believe that all is well within the Coalition; but the emerging and continuous differences and quarrels, open and public criticisms, the corruption and scandals, the blame games and the Ministerial defiance to the government policy of collective responsibility, is a clear show case that days ahead for the coalition government will not be a bed of roses. These are early signs that should raise the common man’s eyebrows on the question of commitment of the partners in the coalition towards making it work.

Of the recent past, the government and the parliament has behaved and treated Kenyan people in manner likely to amount to and suggest of their defiance to heed to the will of the citizens. The landmark being their refusal to pay tax, recycling of Kimunya back into the cabinet, the passing of the Communication Act 2009 and exporting maize to Sudan, at a time when Kenyans are starving to death. The politicians have given us every reason to believe that they would do anything without any sense of second thought to frustrate the aspirations of the Kenyan people; no wonder the report recently released by Steadman Group indicates that most Kenyans have no confidence in this Coalition government.

Most decision taken into consideration and implementation by this government is never a reflection of the national good. Thus the nation may one day wake up to a rude shock of one or both party declaration of their withdrawal from the Coalition; after all the parties have been behaving like two governments in one.

This is why we as a nation, although we are known never to plan in advance, must think of creating another mediation team to mend the emerging and threatening cracks within the Coalition government. The continuous unpopularity of the Coalition Government also calls for a quick intervention so that Kenya does not find itself in another phase of mess and confusion.

The wise men and women of this nation must begin a deliberate initiative and consultations on how to create a homegrown and home thought strategy to ensure that even in the event of fallout in the coalition government, Kenya will be able to have a safe landing and transition; after all not many are inspired by this government . The interest here is to ensure that after being battered by this political class and coalition government, Kenyans should not again find themselves in their brutal hands waiting for a solution for the problems that they created for us.

Civic education is urgently required to educate and enlighten Kenyans on the superiority and seniority between, connecting and distinguishing the Constitution and the National Accord; at the moment, we are not sure whether we are governed by the constitution or the national accord. The entire parliament was sworn as per the constitution while the government is a product of National Accord which is not entrenched in the Constitution.

The disbandment of ECK, compounded by both failure and delay of the government to constitute another ECK complicates this situation further, because it leaves Kenya in a precarious position. May the coalition collapse; the country will have no Electoral body to oversee the elections as required by the constitution. Besides in the scenario where the president either die or resign before the five year term, the country will find itself in a leadership stalemate courtesy of a constitutional – national accord conflict. The former states that is such a situation the Vice President is the second in command, while the later puts the prime minister second in command.

The risk and the uncertainty ahead can not be left in the hands of our politicians. They failed in 2007 and it took the intervention of a mediation team to bring normalcy, peace and a deal in the name of Coalition Government in Kenya, ending months of ethnic killings and destructions.

This is why we must look for such a team early enough before we start counting on unknown damages. The religious, the media, the private sector and Civil Societies groups should therefore read the writing on the wall and play the leading role in ensuring that this country does not slide back to any position of disadvantage or political captivity by the political class.

PRIME Minister Raila Odinga yesterday hinted he was not involved in the reappointment of former Finance minister Amos Kimunya to the Cabinet after his perceived role in the controversial sale of the Grand Regency hotel. In an apparent reference to Kimunya’s reappointment even after the Cockar Commission found he should take responsibility for the controversial hotel deal, the ODM leader said each partner in the Coalition Government has the prerogative to appoint whoever it pleases and so cannot dictate to the other who to be in the Government.

“Each side of the Coalition has the prerogative to appoint whoever it wants and so I cannot dictate who is appointed to the Cabinet,” he said. Raila spoke at the American Embassy in Nairobi when he paid a courtesy call on US Ambassador Michael Ranneberger to congratulate him on his Government’s successful transition of power that saw Barack Obama who has Kenyan roots become the 44th President of US.

Raila said while he acknowledged the ongoing public outcry over Kimunya’s reappointment under the collective responsibility principle that bides both ODM and PNU entities in the Coalition , the latter reserves the right of its choice of individuals it appoints to the Cabinet. This latest development is a clear sign of the widening rift in the Government coming just days after President Kibaki reappointed Kimunya to the Cabinet. The Cockar Commission that investigated the irregular sale of the hotel, renamed Laico Regency, found that the Kipipiri MP should shoulder responsibility for the same.

Raila has over the last few weeks been under the spotlight in the Media for his inactivity as the supervisor of Government ministries to provide direction on the numerous cases of graft bedeviling the Government. He reiterated the Government’s commitment to fight the vice saying action was being taken in cases already identified and that action would be taken on any other cases that might come up.Ranneberger said it would not be business as usual between Kenya and his government until the culture of corruption and impunity in Government was dealt with.

I think it is ridiculuos and shameful that the same characters that made Kenyan’s maul each other a year ago have now turned full circle. It is not even clear if they are in cahoots or each side is trying to steal as much as ossible to out do the other.

For instance, is the PM complicit in the reinstatement of Kimunya to cabinet, elevation of Uhuru? Do the President’s men know about Raila’s maize shenanigans? Someone once said that the worst thing about Moi is that he himself was involved in corruption. But what makes Kibaki better if he is not involved but is silent or indeed as it seems unable to stop the carnage?

It is a shame that this historic times ala First-black-President-in USA are also times when our own history is about wallowing in the worst of times in all spheres. When you think about it no Kenyan leader-not even Raila (especially not him) has any moral authority over Robert Mugabe.

Kibaki should not be singing zero tolerance to corruption and yet he is engaged deep to the neck through his cronies and expect the people to just keep quite!!, So I think you will be doing your country a service by talking against the ills (corruption) perpetrated by these politicians, otherwise you may be the one seeing everything through a tribal lens!!

Today I will beg leave from reason and push a conspiracy theory. I call it a conspiracy because I read a pattern in President Kibaki’s actions. A pattern that suggests a possible manipulation of the 2012 election.

But before I make my argument, allow me to mention Mr Raila Odinga in passing. To repeat myself, I believe Mr Odinga has been set up for failure by the President.

I say so because the Prime Minister can organise people ”against” an idea.

However, he is weak at organising people in ”support” of an idea. This imbalance makes him look like a ”deconstructionist”.

With the cameras on him consistently, he is bound to reveal his true nature.

He actually did so this week. He told reporters to focus on the ”goodies” he brought from India instead of asking ”useless” questions about the maize and oil scandals.

This comment was ill-conceived and in bad taste. And this is why whenever Mr Odinga gets an opportunity to shut up, he must grab it with dear life.

This way, he will have enough time to study President Kibaki’s silent schemes.

Now I must plead temporary insanity and advance my conspiracy theory. For starters, the 2012 election will be rigged. And I say so because nothing has changed.

The players are the same and their motives are intact. In other words, an orange tree cannot bear oranges one year, and bananas the following year.

If nothing has changed, we should not expect them to rig in 2007 and be of good behaviour in 2012. And although both principals are guilty of manipulation in 2007, the man to rig the election in 2012 is the President.

Consider my hypotheses. One, President Kibaki has motive. In fact, his motive is two-fold. During the Moi era, he led the GEMA community for 27 years. They languished in the cold, and their businesses had to fold. Now that they are back, they will protect their turf.

The Kibaki motive, therefore, is to craft a succession that will protect GEMA — at least at face value. And this brings me to his second and real motive. His interest is not GEMA; it is the protection of property. In fact when Mr Uhuru Kenyatta was appointed Finance Minister, I exclaimed aloud “â€|what a joke!” But when I cooled down, it dawned on me that his appointment had only one purpose. The man will not create new wealth; he is there to protect old wealth. Period!

My second hypothesis regards the Kibaki choices and actors. If his motive is to protect wealth, who will execute the brief? Which crony will succeed him?

Is it Mr Kenyatta? My submission is that the propertied are shameless. If Mr Kenyatta is the man to protect their turf, they will install him and swear him in at night if they have to. However, I doubt that he is their choice. More so because Mr Kenyatta himself told us that: “â€| some people claim that I am in the Waki List”. If he is indeed on this list, he will have to climb down from his new high. He will have to resign pending investigations as required by the Waki process. What about Mr Kalonzo Musyoka, the Vice-President?

This man is not wealthy; he is just rich. Riches can be squandered in one generation, but wealth takes generations to exhaust. And because Mr Musyoka does not understand wealth, he cannot be on the Kibaki short list. The same applies to M/s Martha Karua. She is just a peasant from Gichugu; not sufficiently pedigree.

Although she has promise, they view her as nothing but a clever> ”chatterbox”. This leaves us with only one man — Prof George Saitoti. He is Kikuyu and not Kikuyu.

Similarly, he is wealthy and wealthy. But is he acceptable to President Kibaki’s supporters? In my view, this is not important. If they have to beat the GEMA peasants into accepting the good professor, they will. And this brings me to my third hypothesis. If President Kibaki has motive, and a potential successor, what are his methods of executing this plan? He started early. First, he signed the media law.

And on this one, the media owners goofed. One philosopher said “â€|you do not recite poetry to a man carrying a sword: you draw your sword”. The President signed the media law with a pen on one hand and a sword on the other. He was on the war path. But instead of drawing their swords, the media decided to read him some poetry. And, because of this, they lost the initiative and have to negotiate on the President’s terms.

With the media contained, he can impose a successor if he wanted to! His second method of execution relates to ECK. And my take is that ODM was duped into disbanding the commission hurriedly. Although they will appoint the new Independent Commission together, the choice of officials at the commission country-wide will be influenced by Mr Francis Muthaura.

And if this is true, the election bureaucracy will be built to respond to President Kibaki’s schemes. This will make rigging more believable. The third execution method will be force. A curious finding of the Waki Report is that the Administration Police unit had grown exponentially. Expert estimates show that it is now at close to 20,000 or three army brigades. This unit is directly under Prof Saitoti’s command as Minister for Internal Security.

It is the unit they used to fix the rioting mobs last year. The officers in the unit look like robots and are better equipped than the regular police.

Tanzania has secured a colossal amount of money to the fine of USD 43, 000 from the United States to revamp its 1,000 km central railway line from Dar el salaam to Isaka in the Shinyanga region.

The Ministry of Infrastructure Development disclosed at the weekend that the Barlington Northern Santa Railway Company of the US have clearly signed and improvement of the line, which was built in the early 1900s.

The funding has been sourced from the US government through the US Trade and Development Agency and Barlington Northern.

The project will see the line carry more weight and train moving taster. This is expected peed up cargo movement between the lastly cargo, Rwanda and Burundi as well as reduce congestion at the port of Dar el salaam.

Tanzania’s Minister for Infrastructure and Development Dr. Shukuru Kwambwa, said at the weekend that the US Trade and Development Agency has contributed USD 838, 600 while BNSF gave 289, 600 for the feasibility study and modernization of the railway.

“The Development of the central line is important to the establishment of an important regional transportation,” said the Minister.

Eventually the same company will also conduct another railway line from Isaka to Rwanda and Burundi. The study seeks to upgrade the railway to a standard gauge allow trains to carry more weights and move train up to three times taster that the current system.

Last year the US government granted Tanzania USD 615, 000 for the Central line under the US African Trade lanes partnership, which was proposed to fund early investment analyses of upgrading of the Dar el salaam- Isaka railway.

The deal was signed by Larry Walter the director of the US Agency at the Minister Dr Kwambwa in Washington DC.

The project is part of the Central Development corridor for Tanzania, Rwanda and Burundi.

Experts say the revamping of the Central line, coupled with renovations currently being undertaken on the Tanzania, Zambia Railway Authority (TAZARA), will ease congestion at the Dar es Salaam port.

Stakeholders of the Dar el Salaam port met last week with President Jakaya Kikwete and resolved to and congestion as the facility with the next weeks by removing 5, 332 containers currently piled up at the port.

Participant of the meeting asked the container should be moved to Inland container depots which have a total capacity of 8,300 containers.

Congo and Zambia which rely on the services of the port, would also be consulted over the improvement of the port services, said a statement issued after the meeting

The meeting expressed concern over a tendency by some importers to form the power into a go down, a practice that leads to congestion

Participants at the stakeholders meeting included representatives from the Tanzania International Containers Terminals Services, Clearing and forwarding agencies, the Tanzania Transporters Association are container deport.

The central railway line is servicing an important region full of gold and Diamond mining companies therefore in is one of the busiest line in the west, most of this mines are located in Shinyanga and Mwanza regions and required efficient outlets to the sea

I was listening to the BBC over the weekend and heard a program reviewing the role of George W. Bush over the last 8 years. It seems to my mind there is a whitewash going on, they talk about how tough his period of tenure was, how he is a charming, respected by the European political establishment. I say HELL NO!

Let us not forget the litany of complaints we have against ‘Dubya’, not now, not ever:

Ø He stole the election. Got his own brother to rig him in and claimed that is was fair;

Ø He manufactured a war and invaded a country under the pretext of ‘weapons of mass destruction’ and caused to be killed countless Iraqi nationals;

Ø He refused point blank to allow US troops to be subject to the ICC and international conventions that infringed on the US’s god given right to kick ass anywhere, anyhow;

Ø Extended the same immunity to support staff of the US military when they were under ‘no’ I repeat ‘NO’ judicial oversight in Iraq (note not one single successful prosecution of any US misconduct in Iraq (Abu ?? prison excepted);

Ø He arrested and detained people at GitMo against all international conventions and illegal even under US Law;

Ø Using Homeland Security invaded the privacy of Americans at will and I hate to think what he did to the privacy of non-american individuals;

Ø He permitted torture as a method of extracting information from the detainees;

Ø He set up a puppet regime in Afghanistan so he could give his oil buddies a pipeline and mega profits;

Ø He failed to find Osama;

His only claim to competence is that another 9/11 did not happen under his watch yet he actually was asleep at the wheel and allowed it to happen in the first place.

I do not harbour animosity towards the ex-president (well a little), I just do not like the ‘rehabilitation’ of GW Bush and pretending that he was not the monstrous F*** U* that we endured for the last 8 years.

Also realise that ideally, roads should be marked with clear signs where you should not make wrong turns etc. Remember, you may be driving in a new neighbourhood or worse still, be a foreignor trying to find your way.

How many of our roads are clearly marked so drivers can clearly see the dos and don’ts? you cannot possibly know all the right and wrong turns all over the country. If you are not meant to park at certain areas, they ought to be marked as such. At my other job are magazines and tabloids that are placed at the front end. Some of them are so negative that I wonder why people buy them, leave alone reading them.

The last several months,some of them have carried negative articles on President Obama and his family!

Today, one of them caught my attention, “What’s Obama hiding from Americans?” As if that headline was not enough, they added, “8 shocking secrets that will tear his presidency apart!

A few minutes later, a customer walked in and pointed my attention to the article. He went on to say that he had read the article and it was nothing but silly stuff!

But the headline spoke to my heart in a different way! Right there,
I found myself doing some hard soul searching questions! Here is what the headline challenged me to focus on.

-Out there are couples who are doing stuff that they are hiding from each other
-Out there are employees who are hiding some stuff from their employers
-Out there are church members who have information that they are hiding from one another and their pastor
-Out there are pastors, including myself, who have information that they are hiding from their church members
-Out there are some leaders/Governments that have information that they are hiding from their people

If some of the hidden information came to light, it will no doubt cause untold havoc.

There are but three who know all that is happening in secret circles.
Here they are:

-The person in question
-Those that he is doing stuff with
-God himself

With time, those in the inner circle will sure tell on you! The only one who will never embarrass or tell on you is the good Lord.

Well, are there things that you are doing that you are not supposed to be doing? The best solution is to repent and follow a different route! Don’t wait until you are caught. Let the past be the past. Chose the right path and follow it! I sure want to go that route! How about you?

People, there is urgent need for PRAYERS FOR OBAMA PRESIDENCY AND THE REST OF AMERICANS.

It is common knowledge that such feelings do come knowingly or unknowingly by the spar of the moment when people let anger overtake their best selves. The change of leadership to a Black American person and especially with a descent from the origin of African whose father’s roots are from Kenya an African country from the third world, will not augur well or be stomached easily by many. This is a situation we cannot go to blame game scenario for such reactions.

However, because of years of tradition by the American to protect their values and virtues and respect of human dignity which Americans have have enjoyed for decades, change is healthy many should embrace. It is important that those harbouring dislike for President Obama to adjust from their comfort zones, face realities of change since change is a way of life resulting from circumstancial environmental pressure and for purposes of humanity and survival, to avoid destruction and failure of this Great Nation of the world. It is fundamental for American citizenry to have a common united front in order to face challenges of world crisis and to retain the world’s super power position. The quotes and quotes of ………. The Catholic Church in Kenya has come out bold enough and asked the grand coalition government partners to act in the challenges and myriads of problems facing the country.

The twenty four Bishops led by their chairman of the Kenya Espiscopal conference John Cardinal Njue called for an end to the culture of impunity if challenges facing the nation were to be addressed.

“None in high places has been prosecuted for crimes that have been under investigation,” Said Njue.

He said poor governance had been caused by corruption and impunity.

In a lengthy statement release after their day long meeting held at Dimese Sister’s Retreat

Centre, Karen, the Bishop called for the full implementation of the National accord signed by president Mwai Kibaki and Raila Odinga last year following peace negotiation brokered by former UN Chief Dr Koffi Annan.

“We should avoid having two center of power,” they said.

The Bishop challenged Kibaki and Raila to respond to the needs of all Kenyans. They said the current constitutions should be respected as we await the new one.

The Bishop expressed concern over the illegal exportation of maize. “If the allegations are true then we demand action,” they added.

On the contentious Kenya communications (Amendment) Act 2008, the Bishop called for sobriety.

“We appeal to the media for the responsible accountable and uphold professional ethics in the technique of the duties”

The Bishop called for dialogue between teachers and the government to and the ingoing skills.

At the same time cardinal John Njue has asked Kenyan’s intelligence net work of poor performance.

He wandered hoe the maize and oil scandals took place without them (intelligence) knowledge.

The appointment of the MP for Buret Franklin Bett as the new Kenyta’s Minister for Road was well received in Kericho and Litein Towns.

And so is the appointment of Mrs Beatrice Kones as an Assistant Minister for Home-Affairs. But the community seemed not to satisfied still and felt, it could have been allocated more full cabinet slots taking into account its voting strength and numeraty of Kipsigis in parliament..

Bett, a former State House Comptroller and long time close political associate of the ODM supreme Raila Odinga was all the same expected to clinch the cabinet position following his long duration as a member of the ODM. He was nominated by Mr. Odinga and had served in the ninth parliament as an MP

Many members of the community had a high hope that the former powerful PS for Internal Security and Provincial Administration Zakayo K. Cheruiyot, who is the MP for Kuresoi in the volatile Molo district would fill in the gap to succeed the late Kipkalya Kones.

Cheruiyot has of late emerged as the most respected community leader in the Southern Rift.but the appointing authority who is none, but President Kibaki had settled on Bett, perhaps ostensibly on the advise of the Prime Minister Raila Odinga.

Cheruiyot, however, is well known as not being an apologist and does not entertain politics of sycophancy. He said to be a principled man who does not speak to please.

A number of the Kipsigis political personalities interviewed most welcome the appointment. They include the chairman of the UDM, Lt. General {rtd}John Koech and a prominent Kericho Politician Mr. William Kipkemoi Arap Kettienya, who felt the community deserves more portfolios in the coalition government in order to make look rather representative.

Gen Koech said the community was pleased with the appointment taking into account Hon Bett’s experience in both public and government affairs, and expressed the hope that the Minister would thrive to unite the community .

The appointment ignited enthusiasm and dances in both Bomet and Litein Towns ,, where bands of people were seen discussing it in low tones at the various centers. One elderly farmer in Litein said. It is like a thanks giving to the late Kones family in particular and Bomet constituents in general. “We are pleased and thanks the President Kibaki and the Prime Minister Raila Odinga for having considered the hitherto forgotten Kipsigis people

The general feeling around the entire Kipsigis community is that the newly appointed Ministers would popularize the coalition government in the region and could easy tensions recently sparked by the planned eviction of thousands of Kalenjin families in the contentious Mau Forest Complex..

UN appoints Kenya’s Justice Aluoch to ICC

Kenya’s Appellate judge Lady Justice Joyce Aluoch has been appointed as a judge of the International Criminal Court.
Justice Aluoch beat tough competition, trouncing renowned judges from across the world to capture one of the highly coveted positions.
Following the appointment by the UN General Assembly on Monday, Kenyans who find themselves accused of crimes against humanity may just face, their very own at The Hague.
According to the ICC website, Justice Aluoch was elected at the final round of the vote and garnered two thirds majority required and will serve for nine years.
Her election came two months after a Kenyan diplomat Zachary Muburi-Mwita was elected one of the vice presidents of the ICC secretariat.
Speaking to The Standard from New York, Justice Aluoch expressed delight and surprise at the appointment.
“I do not know what to say. This is God’s miracle. It was tough. We have been here since January 6 lobbying for the position and God has come through for us.”
The ICC is an independent, permanent court that has jurisdiction to try persons accused of the gravest crimes of international concern. These crimes include genocide, crimes against humanity and war crimes.
According to its website, the ICC is a court of last resort. “It will not act if a case is investigated or prosecuted by a national judicial system unless the national proceedings are not genuine, for example if formal proceedings were undertaken solely to shield a person from criminal responsibility”.
Kenya has been under the spotlight from the ICC Prosecutor’s office following the recommendations of the Waki report concerning the instigators of post-election violence.
The Waki Commission recommended that should the government fail to constitute a local tribunal to investigate those suspected of perpetrating the violence, the list of suspects should be forwarded to the ICC.
Justice Aluoch has extensive judicial experience spanning over three decades pitching her in the highest court in the country, the Court of Appeal.
She joined the judiciary as a District Magistrate in 1974 and rose through the ranks to her current position. Justice Aluoch was elected to the High Court in 1983.
She holds a Masters Degree in International Affairs from Fletcher School of Law and Diplomacy, Tufts University in Boston, USA. She graduated from the University of Nairobi with an LLB and also holds a Diploma in Legal Studies from the Kenya School of Law.

Final round
According to the ICC website, Aluoch was elected at the final round of the vote and garnered two-thirds majority required and will serve for nine years.
Her election came two months after a Kenyan diplomat, Zachary Muburi-Mwita was elected one of the vice-presidents of the ICC secretariat.
Aluoch first beat a host of 11 African lawyers and judges to become the first Kenyan to sit on the ICC Bench and would be joined by Monageng Sanji Mmasenono from Botswana.
The ICC Bench is composed of 18 judges carefully elected to represent various regions.
Competition to serve on the Bench of the ICC is stiff and for Aluoch to be elected, Kenya had to put up a serious campaign to lobby for her candidature.
“The ICC has jurisdiction to try war criminals. Getting elected to serve in the ICC is no mean feat. The process is highly competitive and Justice Aluoch deserves a pat on the back,” said former nominated MP Njoki Ndung’u.
Ndung’u praised the Ministry of Foreign Affairs, the Attorney General and Kenyan delegation for what she termed a great campaign to get Aluoch elected.
She said the appointment was good news coming at a time when the US President Barack Obama, who traces his roots to Kenya, assumed office.
“International positions rarely go to women and an African for that matter. This is a major achievement and will serve as an inspiration for many Kenyan women. The fact that she got the highest number of votes goes to confirm the international community’s confidence in her,” she said.
The Law Society of Kenya chairman Okong’o Omogeni welcomed Aluoch’s election and said it was a great honour to the country’s legal profession.
“I congratulate and wish her all the best. Her appointment to the ICC Bench is a statement of the international community’s confidence in the Kenyan legal system,” said Omogeni.
Knowledgeable
Ndung’u said this would open doors for more Kenyans to be appointed to international positions.
Aluoch has extensive judicial experience spanning more than three decades. She joined the Judiciary as a district magistrate in 1974 and rose through the ranks to her current position. She was appointed to the High Court in 1983.
Apart from serving on the Bench, Aluoch is knowledgeable in human rights and international humanitarian laws, especially on children’s rights.
She also served as the chairperson of the African Union Committee on the Rights of the Child in Addis Ababa between 2001 and 2005.
Wealth of experience
In 2000 Aluoch was appointed a judge of the International Tribunal for war-affected children.
Currently, she chairs the Multi-sectoral National Task Force formed by the AG to implement the Sexual Offences Act, 2006. She holds a Masters degree in International Affairs from Fletcher School of Law and Diplomacy, Tufts University in Boston, USA. She graduated from University of Nairobi with a Bachelors degree in law and also holds a Diploma in Legal Studies from Kenya School of Law.
Aluoch singled out Mr Mwita, Kenya’s Ambassador and Permanent Representative to the Kenyan Mission in the UN in New York, and the legal officer, Stella Orina as having played a pivotal role for her to be elected.

On July 14 last year, ICC Prosecutor Luis Moreno-Ocampo requested the court to issue a warrant for the arrest of Sudanese President Omar Hassan Ahmad al-Bashir for alleged crimes of genocide, crimes against humanity and war crimes in Darfur region of western Sudan.

It is now imperative that this government is dissolved and fresh elections called. This may sound harsh and too soon but there comes a time when hard decisions have to be made for the sake of posterity.

The people of Kenya must start a peaceful revolution that will reclaim their country and give it direction. We must, if need be, refuse to be governed like this, refuse for our money to be taken by thieving Ministers gatecrashing into functions for which it has been made clear they are unwanted, stealing food meant for the poor and conniving with crooks to defraud our country and its institutions. We must refuse to pay taxes if our taxes will not be used to satisfy our needs as a country. If the worst comes to the worst, we must be ready to sacrifice comfort for the sake of our future generations.

It is time to demand that this government steps down because it is no longer leading us somewhere but just anywhere a new day brings…..and that could be right into a failed state situation.

I therefore submit that fresh elections be conducted within the next 1 year to elect a leader that is not shamed by decisions he makes knowing very well that he does so on our behalf, with confidence and with our mandate.

The Onus of changing Kenya is on Kenyans not Obama not any body out side Kenya. Last time Obama was in Kenya he talked about corruption and you all know what followed. Kenyan ambassador to the US Ogego attacked Obama before he Ogego presented his credentials. Now they are on the first line to congratulate him. Our turncoat leaders do not have class nor do they get ashamed of their deeds. One thing we have to learn is a person does not change his/her characters by changing parties, three quarters of mps are Kanu life members, regardless of which party they belong to today they are still Kanu members that is why we still have the same problems we had during Kanu rule. Look at how the same people who abetted Kibaki’s corrupt re-election are the ones who are championing for new constitution and electoral changes. My question is are they genuine or have they seen an opportunity they wan to use by making these changes?

It is indeed very sad to see the direction this rotten country is going. It appears that most so called educated people have sunk so low in their selfishness that they can knowingly rape their own mothers to satisfy their lust for wealth.
Looked at with a very sane mind, this teachers strike is an glaring example of how Kenyans do not look at the entire economy .We may soon be like Uganda under Idi Amin, or Zimbabwe where people are more concerned with the amount of money they have and not the purchasing power.
In addition, about sixty percent of Kenya is not having a regular income, they also face the same cost of living that these exam cheaters are crying about.What is the use of having alot of food when your students, next door neighbor is not even able to have one meal aday. This is what is promoting thuggery and uncontrolled corruption.
Teachers have better things to ask for thjat this free money. The classrooms are missing so many things, the respect for the noble profession is gone, the books are not there, information technology, science labs, teacher student ratio and so on just to mention a few.
Teachers just as most working class are the reasom why the second liberation failed. It is time for teachers and all working Kenyans to grow up and stop acting up like little kids.It is sad to see some teachers even inciting primary school students to demonstrate on their behalf. Nowonder we have too much property destructio and loss of lives in schools in the name of strikes. This in my view is the height pof moral decay, lack of professionalism and will lead us doen the path of destruction very fast.

As much as you stress on the issue of teachers to be paid ”de-stress/hardship allowance” you need to look at the real side of the coin. One,separate the teachers and the KNUT union;teachers are paid by patriotic Kenyan tax-payers and parents for the service they deliver in the educational sector,now that they are on strike against their own service contract;who should pay the other one if the game was to be made fair? Teachers should payback tax-payers and parents for breaching their contract with them! If not the government should assist the tax-payers to retain their money by not paying teachers for what they have not earned. Life can’t be that simple; You just sit in the name of striking and you earn what has been hard-earned by others.Two,The KNUT Union is an employee of teachers,when they failed in their negotiations,teachers were supposed to sack them for none service delivery but not come up to do what is not in their mandate by going on strike at the tax-payers expense! The KNUT negotiated,the Gok gave its side of version by accepting the terms but then over a certain period of time; source of contention with KNUT! The UNION wanted it to be implemented from Jan.2009.Sincerely speaking, where did the UNION expect Prof.Ongeri to have gotten the money instantly to pay the 250,000 teachers instantly.what I mean is that the Gok has a budgetting process that takes that long up to somewhere 31st June and starts somewhere July(correct my dates pls) that allows for the incorporation of any Budgetary changes but when the UNION wakes up and surprises tax-payers with instant Pay increase,what do they expect Ongeri to do in his own capacity as an individual bearing in mind that the GoK process can’t be that Instant? Third, what are some of the reasons that the teachers are asking for a salary increase? “Its because they want to be at same level with other Civil servants in salary” This is a flimsy excuse that the teachers Union ,being made up of Teachers who are believed to have gone to school, beats some of the Human resource reasons for salary increase request! when asking for salary increase,one is supporsed to either quote evidence of the fact that he/she has added value to the organization or the workload has increased more than it was at the time of recruitment etc but in the view of this,the teachers have refused to sign the performance contract but still want their delivery efforts recognised and renumerated! Liz,think about it and advise me accordingly! If they can’t be in the teaching proffesion,they can be relieved of their duties and given a chance by dismissal to go where they can deliver or belong.
